Everyone is angry with California's private utilities. Rates keep rising, the utilities lack accountability and they are running roughshod over small-scale renewable energy. Why make your customers so mad? Is that anger justified? And what are the utilities planning for the future? Join SN! host Ronnie Lipschutz for a conversation with Loretta Lynch. Lynch was President of the California Public Utilities Commission from 2000 through 2002 and continued as a CPUC Commissioner until January 2005. Since then, she has been a strident advocate for the protection of ratepayers and against corruption in the utility industry, a role in which she continues today.

In today's live program, I explain the implications of the Trump conviction. The left has (unfortunately, in my view) ‘unleashed the beast', so to speak. Everyday Americans are suddenly finding their voice, donating their money, and standing up to the tyranny of “Lawfare.” This won't be pretty. At present, the GOP is launching a strategic offense and all Democrats may soon find themselves at risk. Join me LIVE for a look at the fallout and the reasons why Fani Willis, Alvin Bragg, and Hunter Biden are now facing an onslaught of legal headaches. Who's next? If the gloves really do come off, the likes of Hillary Clinton, Loretta Lynch, and many could find themselves ensnared in legal quagmires as the system itself unravels. Bottomline? Pandora's Box has been unleashed. For more on stock market reaction to the Trump Conviction news, visit my financial news research site — https://76research.com. It's been a tumultuous time for Californians and their electric bills. Since the start of this year alone, PG&E customers have seen one rate hike after another. Now, a fixed fee is being brought into the mix, leaving many wondering: how did we get here and is there any way to make sure California's energy systems stay up and running, while also keeping the cost to the customer affordable? We're going to get one perspective on all this with Loretta Lynch, former president of the California Public Utilities Commission and attorney in San Francisco. KCBS did reach out to the CPUC and PG&E with an invitation to be a part of this conversation and both entities declined, though PG&E did send information on price increases, which you'll hear some of during the conversation and at the end of this program.
The Supreme Court extended an administrative stay on Texas law SB4, which would give the state the power to prosecute illegal migrants amidst the unprecedented crisis at the southern border. Joe Biden said this week that he wants executive action on the border to happen by itself. Former U.S. Attorney General Loretta Lynch tried to secretly push the Department of Defense to remove a Chinese drone company from a U.S. list of Chinese companies that are part of the communist country's military. Former Special Counsel Robert Hur gave explosive testimony before the House Judiciary Committee in which he confirmed that Joe Biden made false statements during his interview with investigators. During Hur's testimony, Democrats tried to misrepresent Hur's report, and it got especially contentious during the back-and-forth with Rep. Adam Schiff, who was trying to win votes for his bid to become a U.S. Senator. PG&E just raised its rates by a whopping 13 percent, but brace yourself for another big jump in your electric bill. The state is poised to add an extra charge to your bill starting this summer, based not on how much electricity you use, but on how much income you earn. This is the so-called fixed utility fee, also known as a fixed utility tax, and it's a radical change in how Californians pay for power, even though we already pay the highest rates in the country. Under this new system, every household will be levied a fixed-rate fee based on your income level, which is designed to pay for more electricity infrastructure as the state moves toward solar power and electric cars and away from fossil fuels. On top of that, you will also pay for how much energy you use, but advocates say this new framework will mean lower monthly bills for those who can't afford steady rate increases. On the flip side, people who make more money will start paying a lot more for their electricity, no matter which provider you use. Now, a wide-ranging coalition of groups is calling on the legislature and Governor Newsom to scrap this new plan and repeal the fee. In today's edition of the State of California, KCBS political reporter Doug Sovern and KCBS Radio news anchors Bret Burkhart and Patti Reising spoke to Loretta Lynch, former longtime president of the California Public Utilities Commission. She is among those opposing the new fee.

On this day in legal history, November 17, 1973, 50 years ago, President Richard Nixon declared he was not a crook. On November 17, 1973, a significant event unfolded in the annals of American legal and political history and carried with it major cultural significance. President Richard Nixon, amidst the escalating Watergate scandal, delivered a televised Q&A session with Associated Press managing editors at Disney's Contemporary Resort near Orlando, Florida. In this session, Nixon adamantly declared, "I'm not a crook," in response to mounting allegations concerning his involvement in the Watergate break-in and subsequent cover-up.Of course, no one was accusing him of being a crook – he was accused of abusing and misusing his power as president. So it was a bit like Hannibal Lecter vehemently denying having ever been a tax evader. This statement quickly became one of the most infamous quotes in American political discourse, symbolizing Nixon's defensive posture amid the scandal. The Watergate scandal itself, which began with a break-in at the Democratic National Committee headquarters at the Watergate office complex in June 1972, had by late 1973 evolved into a major political crisis. Nixon's administration was accused of obstruction of justice, abuse of power, and contempt of Congress, leading to an erosion of public trust in the presidency.Nixon's emphatic denial on November 17 was part of his broader strategy to maintain political support and manage the narrative surrounding the investigation. However, the statement did little to quell the suspicions and investigative efforts surrounding him. In fact, it heightened public interest and media scrutiny, as it contrasted sharply with the growing evidence of wrongdoing within his administration. This moment marked a turning point in the Watergate scandal. Following Nixon's declaration, the investigation intensified, eventually leading to the revelation of the Nixon White House's involvement in the scandal. The event underscored the complex interplay between legal proceedings, political power, and public perception. The significance of Nixon's statement in the context of legal history is profound. It serves as a reminder of the importance of integrity and accountability in public office and highlights the role of the legal system in upholding these principles. The fallout from this declaration and the subsequent unravelling of the Watergate scandal ultimately led to Nixon's resignation on August 9, 1974, making him the only U.S. president to resign from office. In retrospect, Nixon's "I'm not a crook" assertion remains a pivotal moment that continues to influence American political and legal discourse. It serves as a case study in legal ethics, presidential power, and the pivotal role of the media in uncovering truth. This event, thus, stands as a landmark in legal history, exemplifying the intricate relationship between law, politics, and the pursuit of justice in American society.Following the Supreme Court's ban on affirmative action in college admissions, Wall Street law firms like Simpson Thacher and Paul Weiss have established new practices focusing on diversity, equity, and inclusion (DEI). These practices emerged in response to client demands for guidance on racial equity audits and the legal sustainability of DEI initiatives post the Supreme Court decision. Loretta Lynch, a leader of the new practice at Paul Weiss, noted the increase in client inquiries about the effectiveness of DEI programs. This trend represents a second wave of DEI practice development, spurred initially by the aftermath of George Floyd's killing in 2020. Now, corporations seek to defend their DEI programs against conservative challenges, highlighted by the Supreme Court's decision in Students for Fair Admissions v Harvard, which disallowed race-based criteria in college admissions. Conservative groups, like America First Legal and Do No Harm, have been actively challenging corporate DEI initiatives, leading more law firms to form specialized DEI practices.Key figures like former US Attorney General Lynch have been involved in defending such programs, including Pfizer's recruitment initiative. Paul Weiss, for example, recently announced its DEI strategic advisory practice with high-profile members, reflecting a continued corporate interest in maintaining diverse workforces amidst legal and social debates.Simpson Thacher & Bartlett and McGuireWoods have also established their DEI practices, recognizing the growing legal complexities surrounding DEI in corporate environments. Bonnie Levine, a founder of Verse Legal, emphasized the need for legal advice as businesses continue to prioritize DEI.The rise of DEI practices in law firms mirrors the broader legal and corporate landscape's evolving dynamics, where firms not only offer specialized DEI services but also face similar DEI-related legal challenges as their clients. Despite the potential for conflicts of interest, there is a general consensus on the necessity of these services, highlighting the importance of multiple avenues of legal counsel in the ever-changing legal field of DEI.Wall Street Firms Build Diversity Practices After Court DecisionA mistrial was declared in the federal civil rights trial of Brett Hankison, a former Louisville, Kentucky, police officer charged in connection with the 2020 death of Breonna Taylor. The jury could not reach a unanimous verdict, leading U.S. District Judge Rebecca Grady Jennings to declare the mistrial. Hankison faced charges of using excessive force during the raid on Taylor's apartment, where he allegedly fired 10 bullets without striking anyone.Previously, Hankison was acquitted in a state court trial on charges of endangering Taylor's neighbors during the same raid. He was the only one among the three officers who fired their weapons to face criminal charges. The other two officers were not indicted by a Kentucky grand jury, as Kentucky's Attorney General Daniel Cameron did not recommend charges against them.Breonna Taylor's death, along with the deaths of George Floyd and Ahmaud Arbery, triggered widespread protests and a call for racial justice in 2020. Taylor, a 26-year-old emergency medical technician, was asleep in her apartment during a no-knock raid by police, who were investigating a drug case involving her ex-boyfriend.During the raid, Taylor's boyfriend, thinking it was a break-in and claiming he did not hear the police identify themselves, fired a shot that wounded an officer. The police returned fire, fatally shooting Taylor. In addition to Hankison, three other former Louisville police officers were charged with including false information in the affidavit for the raid warrant. One of these officers, Kelly Goodlett, has pleaded guilty, while Joshua Jaynes and Sergeant Kyle Meany are awaiting trial. The Department of Justice is now considering its options regarding a potential retrial for Hankison.Mistrial declared for Kentucky officer charged in Breonna Taylor killing | ReutersThe Ninth Circuit Court of Appeals is revisiting the issue of arbitration in cases involving California's Private Attorneys General Act (PAGA), which permits employees to file lawsuits on behalf of the state for labor law violations. The case at hand involves a subsidiary of Macy's Inc., contesting a lower court's decision to send both individual and representative claims for alleged unpaid overtime and wage violations to arbitration. This follows a similar case involving a Lowe's Home Centers LLC worker, where individual claims were arbitrated and representative claims dismissed. The core issue is whether PAGA allows workers to pursue class-like representative claims in court despite agreements to arbitrate individual disputes. PAGA authorizes employees to enforce California Labor Code provisions and bring claims on behalf of other workers. The U.S. Supreme Court, in Viking River Cruises, Inc. v. Moriana (2022), ruled that individual PAGA claims can be subject to arbitration, but dismissed representative claims in such scenarios. Justice Sonia Sotomayor noted that the interpretation of this matter should be left to California's courts.Despite the U.S. Supreme Court's stance, many California courts have opposed the notion of dismissing representative PAGA claims when individual claims are arbitrated. The California Supreme Court's ruling in Adolph v. Uber Technologies, Inc. further supported this view, asserting that workers retain the right to litigate representative claims even if their individual claims are arbitrated. In the current case, Macy's argues that the lower court's decision to send both individual and representative claims to arbitration contradicts the Viking River ruling. However, Yuriria Diaz, the employee, contends that such an arbitration order isn't immediately appealable. The impact of the Adolph decision by the California Supreme Court on this case is yet to be fully assessed, as the Ninth Circuit has not ordered additional briefings on it.The case, Diaz v. Macy's West Stores, Inc., will be heard by a panel including Ninth Circuit Judges Jay Bybee, Kenneth Lee, and Third Circuit Judge Michael Fisher. Both parties' lawyers have refrained from commenting ahead of the oral arguments scheduled for November 17, 2023. This case has the potential to radically upset the current status quo vis a vis labor and management. Macy's Case Brings PAGA Arbitration Issue Back to Ninth CircuitThe California Bar has set new guidelines for lawyers using artificial intelligence, positioning the state as a leader in ethical guidance for AI in legal practice. According to Erika Doherty, program director for the bar's Office of Professional Competence, this initiative is the first AI-specific regulation approved by a legal regulatory agency. The guidelines advise lawyers to disclose their use of generative AI to clients and to avoid charging hourly fees for time saved using AI tools. They also emphasize the need for human oversight of AI-generated content to prevent inaccuracies and bias. This step is seen as an interim measure while more comprehensive rules are developed, including potential revisions to the definition of unauthorized legal practice in the context of AI. The committee highlighted AI's potential to bridge the justice access gap, but cautioned against the risks of false information from AI outputs for self-represented individuals. Similarly, the Florida Bar's ethics committee has proposed guidelines regarding client consent and oversight for AI use, with these recommendations open for public comment until January.California Bar Passes Disclosure and Billing Guidelines for AI Get full access to Minimum Competence - Daily Legal News Podcast at www.minimumcomp.com/subscribe
Loretta Lynch is fired up.The former President of the California Public Utilities Commission is sounding the alarm on a proposed change to California's commercial electricity providers' rate structure that, she says, will dramatically increase rates for electricity customers. AB 205 easily passed the legislature and was signed by the Governor as a Budget Trailer Bill back in the summer of 2022. It received little attention at the time, although some observers did flag it as a stretch of the Trailer Bill application.AB 205 directs the utilities to set a tiered rate structure based on the customer's income, rather than a straight rate for electricity used. Proponents of the change say that the tiered structure will protect lower-income customers as electricity rates increase - they have already doubled in the past decade - and that the higher-income users will offset the lower rates paid by lower tier customers. Lynch argues that California's private electric companies are already charging higher rates than companies in other states and that there are no protections for lower income consumers actually in the bill. Now, Lynch and other critics of AB 205 including members of the legislature, are urging the CPUC to intervene before it's too late.:50 A big spike in electricity rates?2:39 AB2054:46 The rate tiers6:11 Urban vs. rural?8:27 privacy concerns12:14 Where is this push coming from?13:51 Do the raised rates have to fund a specific project?16:04 "The PUC is no longer a watch dog - it's a lap dog"16:47 A cash grab?19:08 Lawmaker pushback21:37 What can the PUC do?25:02 Convert PG&E to a publicly-owned utility?28:54 What role does the Governor have?32:10 Shameless plug for the Education Conference33:43 #WWCAWant to support the Capitol Weekly Podcast? A three-way conversation featuring host Spencer Critchley, Kevin Lewis, and Zach Friend on leadership lessons from the ouster of Kevin McCarthy, as compared with far better examples set by Hakeem Jeffries, Nancy Pelosi, and others. It turns out, to the shock of cynics everywhere, that character matters! Kevin was the post-presidency spokesman for former President Barack Obama. During the Obama administration he served at the White House and at the Department of Justice, where he advised Attorneys General Eric Holder and Loretta Lynch. He's also worked for the Democratic Congressional Campaign Committee and both Obama campaigns. Zach has worked for the White House Council of Economic Advisers, the U.S. Senate, the House of Representatives, and both Obama campaigns as well. He's currently serving in local government as an elected Supervisor in Santa Cruz County, California. A video version of this episode is on YouTube.
If you want to know more about the risks and rewards of artificial intelligence, you could hardly do better than to consult with someone who's been a senior communications advisor for Facebook, lately known as Meta, the US Department of Justice, and a President of the United States. And that's what Spencer did for this episode. Kevin Lewis was the post-presidency spokesman for former President Barack Obama. During the Obama administration he served at the White House and at the DOJ, where he advised Attorneys General Eric Holder and Loretta Lynch. He's also worked for the Democratic Congressional Campaign Committee and both Obama campaigns. We talk about how AI is transforming communication, politics, business, and even our understanding of reality and identity. We get into Senator Charles Schumer's current efforts to help Congress catch up with a rapidly-growing technology few people understand. And you'll hear some of Kevin's anecdotes about working with some very interesting people under very interesting circumstances.

EPISODE 203: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) FOUR DIFFERENT LEAD STORIES: FIRST LEAD STORY: Allegation from lurid sex abuse lawsuit against Rudy Giuliani: Rudy said Trump presidential pardons were available for purchase - as of February 16th, 2019 - $2,000,000 each, half to him, half to Rudy Giuliani. And on February 7th, 2019, Giuliani revealed that if Trump lost the following year's election there was a plan in place to claim quote “voter fraud” and he repeatedly discussed the plan with his business associate Lev Parnas. Jack Smith needs to talk to this woman and get the tapes she claims she has. because if there is a CHANCE that ANY of this is true, Rudy Giuliani will flip like a cheeseburger. Paragraph 109: “Throughout the employment and attorney-client relationship, Giuliani forced Ms. Dunphy to perform oral sex on him. He often demanded oral sex while he took phone calls on speaker phone from high-profile friends and clients, including then-President Trump. Giuliani told Ms. Dunphy that he enjoyed engaging in this conduct while on the telephone because it made him quote ‘feel like Bill Clinton' unquote.” SECOND LEAD STORY: Republicans appear to have lost or misplaced (or, hint hint, never had) the Biden "whistleblower" or "informant" they think will end a presidency. The problem is, Chairman James Comer apparently uses the terms interchangeably. He doesn't know his informing from his whistleblowing. He may need to ask Giuliani. THIRD LEAD STORY: The Durham Report is out and it consists of… nothing. No indictments, no litigation, no calls for punishments. It concludes the FBI shouldn't have investigated any of it. Just like that. The FBI Inspector General said some of the initial evidence that jump-started the investigation was dubious, but that the investigation was ENTIRELY justified. Durham's report consists of him basically saying: no it wasn't. I mean, remember what right wing media, especially Fox News, ESPECIALLY Sean Hannity – remember who they told their addicts were going to be exposed and indicted and revealed by Lord God Almighty John Durham. You ready? James Baker, John Brennan, James Clapper, Hillary Clinton, James Comey, Loretta Lynch, Andrew McCabe, Bruce Ohr, Nellie Ohr, Lisa Page, Samantha Power, Rod Rosenstein, Peter Struck, Sally Yale and of course, evil mastermind Barack Obama. Or as it turns out… None of the Above. The Durham Investigation indicted… none of them. The Durham Investigation blamed… none of them. B-Block (19:03) THE FOURTH LEAD STORY: What did Chris Licht get himself out of prostituting Trump for the Town Hall a week ago tomorrow? He got himself fourth place. On Friday night, Vichy CNN fell to FOURTH in a three-team league. An average of 335-thousand total viewers. That's 1.1 million behind behind Fox, three quarters of a million behind MSNBC, and 22,000 behind… NewsMax? Honest to God. NewsMax. And Anderson Cooper, after he condescendingly scolded his viewers and claimed they were living in silos? Most cable news shows drop Thursday to Friday. Cooper? He dropped 28 percent. And there is no indication that Licht and CNN have finished rock-bottom yet, neither in the ratings nor the public revulsion. The Daily Beast last night not only quoted a CNN source who called the event “our Chernobyl”but added that Licht is fawning over a reporter from the magazine The Atlantic who is writing a profile of Licht and that somehow CNN and Licht think it's going to be “a glowing profile of the boss.” (29:22) THE WORST PERSONS IN THE WORLD: The unusual resume of the man who says you can't have a Congestion Pricing Scheme like London's in New York - because they drive on the other side in London. Plus Roger Ailes' widow attacks Murdoch. And his new book is out, but Josh Hawley's "Manhood" turns out to be a little short. C-Block (34:40) EVERY DOG HAS ITS DAY: Duke and Simba, on the death list at Devore, CA (35:40) THINGS I PROMISED NOT TO TELL: Well, why not? Since it's Rudy Giuliani Day, how about the story from nearly 30 years ago of when I emceed a baseball events on the steps of City Hall while he was Mayor and a) when it came time to introduce me he didn't know who the hell I was and b) more importantly all day he didn't know where the hell HE WAS.See omnystudio.com/listener for privacy information.

Show Notes: Can we please find better alternatives then the military for young adults to experience risk, adventure, mission, and purpose? Dr. Jordan was inspired to do this podcast after reading three books: Pat Tillman: Where Men Win Glory; Into Thin Air by Jon Krakauer; a soon to be published book from his friend Ginny Luther about her son Bart's military experience Pat Tillman was an active, intense, rambunctious kid who loved roughhousing, being loud, taking risks, and was constantly in trouble for his behaviors. He walked away from a multimillion-dollar contract with the Arizona Cardinals NFL football team to join the army after the 9/11 attack, becoming an icon on post-9/11 patriotism. The fact that Pat believed the Iraq war to be illegal and about false reports of weapons of mass destruction did not prevent him from wanting desperately to get into the fight, face the enemy fire alongside his comrades, to prove himself in battle, and become a part of a rarefied warrior culture. Like many young men, he had aspired to engage in mortal combat since being a little boy, itching to confront the enemy firsthand and prove themselves under fire. Sadly, two years into his service he was killed in action from bullets from his own troops, unleashing a government coverup. Jon Krakauer joined an expedition to climb the summit of Mt. Everest, despite the large number of fatalities of past climbers. Much of his motivation for the climb came from his belief that achieving the summit of a mountain was tangible, immutable, concrete; the incumbent hazards lent the activity a seriousness of purpose that was sorely missing from the rest of his life; “I thrilled in the fresh perspective that came from tipping the ordinary plane of existence on end.” Another climber, John Taske, wrote that, “When I left the military, I sort of lost my way. I discovered I couldn't really speak to civilians; my marriage fell apart. But when I started to climb, the sport provided most of what had been missing for me in civilian life, the challenge, the camaraderie, the sense of mission.” Dr. Jordan describes the temperament of many natural born risktakers: independent-minded, intense, risk-takers, physical, restless, active, love the outdoors. These kids are often described as: hyperactive, wild, can't sit still, out-of-control, impulsive, ODD, not listen, don't like to be told no, want things their way, intense, stubborn, willful, like a wild colt kicking against the slats of their corral. This podcast shares stories of people who fit this description who ended up as incredible, successful, trailblazing adults, including Elizabeth Blackburn, the 1st woman to be president of Salk Institute; Loretta Lynch, the 1st African-American woman to become US attorney general, as well as his two sons and one of his female campers who created adventures for themselves. Dr. Jordan asks that we look for opportunities for our kids to take risks, have adventures, and make their own path. He describes several programs such as Teach for America, Peace Corp, Well Aware clean water not-for-profit (http://wellawareworld.org/join), listen to an interview with the founder of this NFP Sarah Evans on Dr. Jordan's podcast from 8-18-22, and Woofing ( www.wwoof.net ) There are other, better alternatives then the military for young adults to experience risk, adventure, mission, and purpose; help kids find them and start as a culture valuing these experiences and people.
Today's word of the day is 'pothole' as in the hole in the street that gets fixed and comes back and fixed and comes back and fixed and comes back — but why are we talking about that today? That's what sports stadiums are. Every few years a new stadium pops up. Just like a pothole. You build one and then you build another and then another and then another. The Kansas City Royals made an announcement. New York City FC announced a huge stadium. The Bears want one. The Bills want one. (16:30) We have our daily MLB Free Agency Update: players were added to 40-man rosters for protection. Let's explain. Players also turned down or signed qualifying offers OR signed new deals. (26:40) Review: Ticket to Paradise. (29:30) Quick talk about the TV Ratings. How big is Yellowstone? How big is MLB? How big is NBA? The answer: not close to how big the NFL is. (33:30) It's time to talk about what the Boston Bruins have done. They hired Loretta Lynch to launch an investigation into how the team investigates investigations. (44:00) NPPOD. I'm tired today. Our coveted journalism-ing network explains why the Merrick Garland confirmation made sense. (It doesn't make sense, but fake news pretends like it makes perfect sense.) First, they pretend the prior Attorney General chaos in Washington wasn't part of the Democrat's plan. Then they pretend domestic extremism wasn't addressed well enough (the FBI refused to publicly state that BLM/Pantyfa violence was extremism AND refused to investigate BLM/Pantyfa means of coordination and funding sources). Lastly, Garland will fix our "racist policing" because Eric Holder and Loretta Lynch never tried, or something like that. Maybe Holder and Lynch weren't smart enough to get voter IDs, because that's a real thing now.
