Opening statements can be really fun and exciting as a mock trial attorney, but it only works if you do them the right way. These mistakes are pretty common in the mock trial world, and you should avoid them at all costs!

Inglourious Basterds (2009), written and directed by Quentin Tarantino, revolves around two plots to assassinate Nazi leaders during the closing years of World War II. One plot centers on a secret band of Jewish-American soldiers under the command of Ltn. Aldo Raine (Brad Pitt)—the “Basterds”—who terrorize Nazis. The other involves Shosanna Dreyfus (Melanie Laurent), a young Jewish woman who narrowly escapes death at the hands of notorious “Jew hunter” Hans Landa (Christoph Waltz) and flees to Paris where she runs a cinema under a false identity. The plot lines converge at the Paris cinema where the Basterds and Shosanna are each separately plotting to kill Hitler and other Nazi leaders while they are attending the premiere of a German propaganda film. Bill Kanasky, Jr., Ph.D. talks about several issues he sees with opening statements. Bill highlights the biggest issue the CSI team comes across in opening statements: starting the opening statement in the wrong spot. Bill emphasizes the importance of the first two minutes of the opening and how those first two minutes frame how you want the jury to see your case (i.e., the cognitive lens.) The first thing that the defense attorney has to do in their opening is put someone or something else on trial, state emphatically what the case is about, and not talk about what the case is not about, which only reinforces the plaintiff's perspective. The goal with the opening statement is to reframe what the plaintiff presents in their opening. The next issue Bill discusses is how lengthy opening statements that include the attorney thanking the jury for their service, talking about themselves or their client, or sharing a story from their childhood are a waste of those critical first two minutes in front of the jurors. What attorneys have to realize is that jurors don't remember facts and details; they remember how you made them feel. Lastly, Bill talks about the importance of testing opening statements with mock jurors. Getting direct feedback from jurors and practicing the delivery and story is a critical, but often skipped, step in the trial preparation process and attorneys who do not test their opening statements with mock jurors in a focus group risk their entire case.

Trial One started on April 29th, 2024. Day One focused on Jury Instructions, Opening Statements and First Witnesses. The Prosecution's Opening Statement was done by Hank Brennan and considered better than in the previous trial done by Adam Lally. Brennan focused on Karen Read's statements, suggesting she was covering things up and knew where John O'Keefe was because she left him there. They played a video interview statement where Karen Read said John O'Keefe was not mortally wounded when she last saw him. The Defense's Opening Statements was conducted by Alan Jackson instead of David Yannetti who did it the first time. Jackson simplified their defense, asserting that John O'Keeffe was not hit by a car. They focused on the lack of proper investigation at 34 Fairview Rd and evidence that they believe will support their claim. The Defense brought up Former Trooper Michael Proctor, which the prosecution did not mention.The first witness was firefighter/paramedic Timothy Nuttall, whose testimony about when Karen Read said, "I hit him," was discussed, including discrepancies and potential memory issues. The second witness was Kerry Roberts, who was with Jen McCabe and Karen Read at 34 Fairview when John O'Keefe's body was found. Her testimony was stopped as she described Karen Reed running towards a mound of snow.At the end of the day, Judge Cannone held a hearing outside of the presence of the Jury regarding the Prosecution's Motion to Compel ARCCA. The Judge determine that the Defense committed a Discovery Violation and scheduled Friday, April 25, 2025, to Voir Dire ARCCA witnesses. Special Prosecutor Erlinda Ocampo Johnson began her opening statements by presenting her case against Alec Baldwin, alleging recklessness on the set of the film "Rust." Johnson's argument centered on Baldwin's failure to adhere to basic firearm safety protocols and his mishandling of the weapon that led to the tragic death of cinematographer Halyna Hutchins.  "The evidence will show that someone who played make-believe with a real gun and violated the cardinal rules of firearm safety is the defendant, Alexander Baldwin," Johnson stated. She informed the jury that Baldwin had requested the "biggest gun" available for the movie and that the firearm was sold to the "Rust" set in "perfect" working order. Johnson emphasized Baldwin's repeated failure to conduct safety checks with the on-set armorer, Hannah Gutierrez-Reed, even citing footage of Baldwin during safety training "running around, shooting his gun."  Johnson described the critical day Hutchins was shot, highlighting Baldwin's failure to perform a safety check. "You will learn that one of the rounds in that revolver was a real round, and the evidence will show that Ms. Gutierrez then handed the gun to the defendant," Johnson said. "And what you will learn is that, once again, the defendant failed to do a gun safety check with this armorer."     Despite Baldwin's emphatic claim that he did not pull the trigger, the prosecution insisted this was not true. Johnson asserted that video footage would show Baldwin using the firearm on set multiple times without any mechanical issues. Additionally, forensic experts from the FBI confirmed the gun's functionality through multiple tests. In contrast, Baldwin's defense, led by attorney Alex Spiro, argued that Baldwin committed no crime. Spiro shifted the focus to how a live bullet ended up on the "Rust" set, stating there was no evidence Baldwin was involved in this mishap or violated gun safety rules. "He was an actor, acting, playing the role of Harland Rust," Spiro said. He explained that the rules of gun safety are different on a movie set, where actors can act in ways that are otherwise dangerous in real life.    The defense played the scene from the church where Hutchins was shot, showing Baldwin as Harland Rust being approached by two men pointing guns at him. Spiro described the "Rust" set as relaxed and reassured the jury that Baldwin's gun was deemed "cold" multiple times. "No one had any idea that this venomous, toxic element had been inserted into this magic they were creating," Spiro stated. He placed the blame on the armorer and David Hall, the first assistant director, who was ultimately responsible for on-set safety. Spiro highlighted the division of responsibility on a movie set, arguing that Baldwin's role was to act, not to ensure gun safety.
