The complex relationship between digital currencies and global financial regulations is highlighted yet again with the SEC's recent crack down on major crypto exchanges Binance and Coinbase. Michael Volkov welcomes Matt Stankiewicz, also known as Crypto Max, to share his insight on these ongoing cases. He discusses the implications these enforcement actions might have on the industry, the securities law-related legal issues, and the internal mechanics of these exchanges.Matt Stankiewicz is a Managing Counsel at The Volkov Law Group. His expertise includes financial regulation and compliance, with a focus on securities, anti-money laundering (AML), and cryptocurrency regulation. Given his professional background and interest in crypto regulations, he is a frequent speaker on legal matters concerning cryptocurrency exchanges and the SEC.You'll hear Michael and Matt discuss:The SEC's enforcement actions hinge on their assertion that Binance was serving US customers without the proper registration, thereby violating securities laws. They allege that Binance knowingly allowed and even encouraged US customers to utilize their offshore platform, enhancing their profits and trading volumes but breaching US regulations in the process.Rather than directly challenging the status of specific tokens, the SEC is targeting exchanges like Binance and Coinbase. By regulating these exchanges, the SEC could effectively control the access points to the crypto industry, thus having a broader impact.Binance is preparing for a legal fight with the SEC over these compliance issues, including allegations of wash trading to artificially inflate trading volume. The platform's potential troubles are linked to similar issues faced by FTX and their trading arm, Alimator Research.Given the recent pattern of the SEC bringing complaints without the DOJ pursuing criminal cases, it's unlikely that the DOJ will bring a criminal case against Binance. Coinbase's IPO was approved by the SEC despite allegations that the company had engaged in illegal activities related to the trading of unregistered securities. The SEC argues that the approval of an IPO doesn't guarantee the legality of the company's underlying operations, but this could be seen as contradictory to the SEC's stated role of protecting investors.Coinbase, in attempting to comply with securities regulations and being continuously rebuffed by the SEC, is the most compliant cryptocurrency exchange. However, should the SEC crack down on Coinbase and other major U.S. exchanges, it could push investors to offshore exchanges where the SEC has limited jurisdiction and where there is a higher risk of fraud. Average student loan debt is nearly $40,000 -- per person! This economic burden can massively impact all the other money moves you make in your life. Luckily, there is a disability discharge program for federal student loans, and more people qualify than you might think. Plus, the program is getting a lot easier to navigate, with some big, positive changes promised starting in July 2023. Today, we'll talk to Heather Watkins, a writer and disability advocate who successfully had her student loans discharged through this program. We're also joined by Persis Yu, Deputy Executive Director and Managing Counsel of the Student Borrower Protection Center, who has been instrumental in advocating for improvements to the program and for student loan borrowers at large. In August of this year, President Biden followed through on a campaign promise to help debt-drowning college students pay off their loans. He announced a loan forgiveness program acknowledging that the total cost of both four-year public and private college has nearly tripled over the last 40 years…and that's after accounting for inflation. A variety of court cases have been brought against Biden's plan blocking the U.S. Department of Education from moving forward. Just last week, the Supreme Court agreed to weigh in on one of them -- Nebraska v. Biden, that will determine whether or not the Biden administration overstepped its authority in using the HEROS Act -- an act that allows the administration to change payments on student loans during times of national emergency -- to cancel up to $20,000 in student loan debt for nearly 40 million Americans. The oral arguments are set for February. Thankfully while this issue pends in court, the administration extended a pause on federal student loan payments so that borrowers are protected. At the ACLU, we believe the student debt crisis is a racial justice issue depriving Black and Brown Americans important social and economic mobility. Here to discuss how we got here, the litigation at hand, and why this issue is one of racial justice and systemic equality is Persis Yu. This week on Maximum Mom, your host Elise Buie joined Jeena Belil.Jeena is one of the first female owned personal injury law firms on Long Island, which started back in 2007 as a virtual office, while other firms looked at her sideways. She thinks of being a solo attorney not as a job, but as a lifestyle. She was able to create a successful practice on a shoestring with a smart business plan. She was able to stay home and make sure her daughter actually saw her mom for more than an hour or two a day. Jeena's areas of practice include Plaintiff's Personal Injury, New York No-Fault and Uninsured Motorist Law, subrogation, medical and auto insurance coverage disputes. She is admitted to the New York State Bar. She received a B.A. degree from Rowan University and J.D. degree from Touro College, Jacob D. Fuchsberg Law Center. Jeena is formerly associated with AutoOne Insurance as Managing Counsel and Travelers Insurance as First Party New York Regional Coordinator. In those positions, Ms. Belil was responsible for the management and organization of the New York No-Fault case handling structure that serves as the template for the defense of first-party claims. In addition, Ms. Belil has been instrumental in the management and preparation of many cases that have established the benchmark for defending arbitrations and suits and investigating and prosecuting No-Fault fraud. Today I'm talking with Raven Moore, Managing Counsel of Commercial Litigation for McDonald's. A native of Chicagoland, Raven grew up thinking she would either be a lawyer or a comedian. As you will hear, we got a chuckle out of her comedic aspirations but, in truth, Raven could have been anything she wanted to be. She followed her instinct to the law. She attended the University of Dayton where she studied communications management, then headed south to Tulane for law school. While she had a passion for human rights, she was drawn towards litigation so she took a job with a Chicago-based firm, Sachnoff & Weaver where she cut her teeth as a young lawyer. Raven reflects on some of the key experiences she had from her early years of practice and commends those more senior lawyers around her at the time for giving her meaningful opportunities. Sachnoff & Weaver later merged with Reed Smith, which is where Raven made partner as a new mom. The experience was both a proud moment for Raven, who worked hard for years to obtain that achievement, but also a reflection of the impact Raven made at her firm. Not surprisingly, she continues to make the same type of impact today as in-house counsel for McDonald's, where she has been for the last 8 years. I told Raven during our discussion that she is truly a role model for me and I think you'll understand why after hearing her humbly walk us through the admirable career she has enjoyed thus far.

Brent Nowicki, the new FINA Executive Director is young, only 42 years old. He grew up an age group swimmer, a breaststroker, in the United States and played DI lacrosse at Fairfield University before receiving his Juris Doctor degree from the State University of New York at Buffalo. When SwimSwam captured this interview Brent had only been on the job eight days. Despite his youthful age, Brent is stepping into the chief executive position with respectable experience across many international federations. He's the former Managing Counsel at the Court of Arbitration for Sport (CAS). I asked around, and leaders I trust in swimming felt he could've gone down a few different career paths. They felt we're lucky to have him. I hope they are correct. Off camera the message from Brent was clear. Under his leadership swimming, diving, water polo and artistic swimming will experience more transparency, engagement, and communication from FINA, our international governing body. From my experience with FINA that would be a 180 degree turn from the policy of the former executive director, Cornel Marculescu of Romania, who held the position for 35 years. We obviously captured the interview at U.S. Olympic Trials in Omaha. While Brent's first aquatic trip as ED was to the United States, that was simply because of timing. U.S. Trials was the first big event to see elites and governance in action since he assumed the position. Brent will be on the road a lot this year, seeing aquatic sports federations around world. The interview came together last minute thanks Dale Neuburger, former FINA Vice President, now FINA Treasurer. I've known Dale for many years. He is a tough leader. He lets you know where he stands, and he lets you always know where you stand with him. To Dale's credit, he headed the search committee that landed Brent, and it's seem clear Dale's mission was to find a youthful, energetic executive. I didn't grill Brent. He's too new to the gig, but I had to at least ask Dale about the complicated relationship between FINA and the International Swimming League (ISL). I thought Dale would respond "no comment" for a variety of reasons, but he didn't flinch, and, in fact, had quite a bit to say. Watch to the end. Dale's forthcoming and clear on the topic. What is it like to run a compliance program that encompasses over 190 countries? Today we have Gwen Hassan, Managing Counsel and Trade Compliance Counsel for Global Compliance for CNH Industrial. She runs their compliance program globally, and today we’re talking about international trade, working with multiple cultures, and practical ways to step up in your career. Trade Compliance Trade compliance can be divided into three categories: (1) import, or bringing products into the country, (2) export, or moving products out and across borders, and (3) trade as a political tool, which includes things like boycotts and sanctions and denied parties. If you’re starting out with trade compliance, start with trade sanctions. These apply universally regardless of which side of the exchange you’re on, and it’s very easy to find the law. Best practice trade compliance programs A solid program will cover the three areas mentioned above: A program that addresses import risk and compliance, involving team members who are customs brokers, people who are licensed to conduct transactions through the import into the United States. The export side of your program, where you must be aware of all the different regulations that apply. Have a handle on your sanctions. Do you have a system for screening to make sure you’re not violating sanctions or restrictions of any kind? Going global A global role isn’t just “shifting” from a regional role — it’s akin to biting the whole apple at one time. Gwen’s advice? Get as much experience as you can on global projects, work on projects that span multiple regions or involve regions you’re not currently working on. Be the first to volunteer for these. And then make sure you have cultural or language skills, because they are a big deal. It’s easy to underestimate the impact of culture on a global team, so one of Gwen’s biggest challenges has been to learn not only to accept the cultural differences but find a way to work within them and get to the place you need to go. This requires some creativity and strategy, but it’s a challenge she enjoys a lot. Building international relationships There’s no replacing good old fashioned frequent flyer miles. Being face to face with people is so vitally important, especially in a number of cultures. Gwen recommends breaking bread with someone, sitting down for a meal, and getting to know each other on a personal level. Until you can establish that kind of trusting relationship with a person, it will be difficult to have a work relationship with them. Also, when you’re developing relationships with people, it’s easy to assume that your mindset and frame of reference is “the right one”. But people are coming into this relationship with their own frame of reference which they believe to be correct as well. Identify and acknowledge these so you can find a way to work well together. Confidence Men apply for jobs they aren’t fully qualified for all the time. Women, not so much. How can we boost our confidence? Talk about the skills and knowledge you do have, be transparent about the gap, and then highlight your ability to learn. Talk about times when you’ve had to learn things quickly, how you went about it, and how you got it to a level that benefited the company. He directed legal and regulatory investigations of major industrial accidents, including complex electronic and physical evidence preservation in industrial settings.
