While we can only speculate about its contents, two aspects appear certain: Ukraine will be asked to relinquish (at a minimum) territory now occupied by Russia, and it will only contemplate entering into an agreement because Russia invaded its territory. Professor Fox will examine the implications of these and other factors for the validity of an agreement.Gregory H. Fox is a Professor of Law at Wayne State University School of Law, where he is the Director of the Program for International Legal Studies. Professor Fox is an elected member of the American Law Institute. He has been a Visiting Professor at the University of Michigan Law School and the Universidad Iberoamericana in Mexico City, a Visiting Fellow at the Lauterpacht Research Centre for International Law at Cambridge University, a Fellow at the Max Planck Institute for Public International Law and Comparative Public Law in Heidelberg, Germany, and a Fellow at the Schell Center for Human Rights at Yale Law School, among other institutions. Green is an attorney with more than forty years of experience investigating, litigating and resolving civil and criminal disputes. From 2016 to 2022, she was an Associate Justice of the Massachusetts Superior Court, where she handled cases alleging serious felonies in criminal trial sessions and complex civil disputes in the Business Litigation Session. Prior to her judicial appointment, Green was a partner at WilmerHale, where her practice concentrated on complex business litigation, including the defense of government investigations and white-collar, criminal litigation. Judge  Green co-chaired WilmerHale's Litigation Department, was a member of its Executive Committee, and chaired legacy Hale and Dorr's Litigation Department. Earlier in her career, she was Deputy US Attorney for the federal District of Massachusetts, Chief of Staff to the Governor of Massachusetts, and an assistant US attorney. Our discussion examines the FTC's Advanced Notice of Proposed Rulemaking relating to what it describes as “commercial surveillance” and the CFPB's circular confirming that covered persons and service providers may violate the Consumer Financial Protection Act's prohibition against unfair acts or practices when they fail to adequately safeguard consumer information.  We consider the ANPR's scope, its areas of focus, and potential federal and state obstacles to the FTC's initiative. After providing an overview of the CFPB's circular, we look at the data security measures highlighted by the CFPB, the CFPB's authority to address data security, precedents to which companies can look in assessing the adequacy of their data security measures and potential exposure, and steps to mitigate risk. Lithium giant Tianqi to form JV with NIO's semi-solid-state battery supplier WeLion -Tianqi is one of China's largest lithium producers, with a battery-grade lithium metal capacity of about 2,900 tons in 2020, accounting for almost half of China's total lithium metal capacity. - Lithium metal has a very small density of 0.534 g/cm3 and a capacity of up to 3,860 mA-h/g, ten times that of the current graphite cathode material (372 mA-h/g), with a higher energy density, WeLion said. -Nio unveiled plans to offer 150 kWh semi-solid-state batteries when it unveiled its flagship sedan, the ET7, at the NIO Day 2020 event on January 9, 2021, generating much attention for this new battery. -NIO never disclosed the supplier of the battery, however, on March 27, WeLion chief scientist and founder Li Hong that the company is the supplier of the electric vehicle maker's solid-state battery. Original Source : BYD Seal gets 22,637 orders in 7 hours of pre-sale - CnEVPost Hyundai Motor Group to build $5.54B EV plant and battery factory in Georgia - Hyundai Motor Group (HMG) entered into an agreement with the State of Georgia to build its first dedicated full electric vehicle and battery manufacturing facilities in the US. The new EV plant and battery manufacturing facilities represent an investment of approximately US$5.54 billion. Non-affiliated Hyundai Motor Group suppliers will invest approximately another $1 billion in the project. - The new facility will break ground in early 2023 and is expected to begin commercial production in the first half of 2025 with an annual capacity of 300,000 units. The battery manufacturing facility will be established through a strategic partnership, the details of which will be disclosed later.  - The EV and battery manufacturing plant will be located on a dedicated 2,923-acre site in Bryan County, Georgia (the Bryan County Megasite), with immediate access to I-95 and I-16 highways which creates easy access to 250 major metro areas. It is less than 50 kilometers (31 miles) from the Port of Savannah, the single-largest and fastest-growing container terminal in the US with two Class I rail facilities on-site. Rail service to the site is provided by Georgia Central Railway, a short line railway that connects to CSX in Savannah and Norfolk Southern near Macon in Middle Georgia. It is marketed by Nissan under the name ‘Sakura' and by Mitsubishi as ‘eK X EV' and offers a range of 180 kilometres, according to Japanese WLTP standards.  - The Sakura runs on an electric drive system producing 47 kW and 195 Nm of torque. A 20 kWh Lithium-ion battery allows for the previously mentioned up to 180 km range, while the top speed is set at 130 km/h. Charging takes about 8 hours with a “standard” AC charge, and can be done as quickly as 40 minutes for a “warning light to 80 per cent” charge on a fast charger. Elon Musk said the department will never seek victory if a company is justly sued, but will never give up if the case is unfair.    - Tesla CEO Elon Musk announced that the company is building a hardcore litigation department that will directly initiate and execute lawsuits. He said the team would report directly to him. The head of the company made two commitments about how the department would work: The department will never seek victory in a just case against the company, even if it will probably win. The site at Riverside, California already is in a process of expansion of charging infrastructure and additional solar capacity installations. Yesterday's historic defeat for this coalition will change all that and likely lead to an EV surge.''  - They are not hanging about — Labor's Electric Car Discount will begin on 1 July 2022, the beginning of the new financial year, and only 5 weeks away! - ‘'Australians love their cars. Multiple car ownership is common (I used to own three — one for me, one for the wife, and one as a toy). Because of this, passenger cars make up almost 10 per cent of Australia's CO2 emissions. To move Australians from fossil fuel burning cars to electric vehicles powered by renewable energy, Labor proposes exempting EVs from the 5% import tax and the 47% fringe benefits tax (a similar move to the UK government, which led to a spectacular increase in uptake).'' With limited resources and difficult systemic restrictions for both immigrants and judges, those inside the immigration court system don’t think those brought before their courts are receiving real due process. At the ABA Annual Meeting, host Laurence Colletti is joined by Judge Joan V. Churchill, Judge Dana Leigh Marks and Karen Grisez to hear about the pervasive issues causing serious difficulties for all parties involved, some ways in which the system could be improved, and ways lawyers can get involved to make a meaningful difference for those facing the potentially severe consequences of a ruling against them. Judge Dana Marks is an immigration judge in San Francisco California who has been on the bench since 1987. She is also the President Emerita of the National Association of Immigration Judges. Judge Joan Churchill is a retired immigration judge, having served from 1980 to 2005. She is a past president of the National Association of Women Judges and she currently works with the ABA section on National Conference of the Administrative Law Judiciary. Karen T. Grisez is a member of the Litigation Department and is resident in Fried Frank's Washington, DC office. She joined the Firm in 1990 and became Public Service Counsel in 1996. She serves on the ABA Commission on Immigration and is a past chair of the commission.

HBS 035 Interview w_ Robbie Kaplan -Then Comes Marriage_ United States v. Windsor and the Defeat of DOMA Roberta A. "Robbie" Kaplan is an American lawyer. She is the founding partner of Kaplan & Company, LLP, a law firm dedicated to commercial litigation and public interest matters, and an adjunct professor of law at Columbia University Law School. Until July 2017, she was a partner in the Litigation Department of Paul, Weiss, Rifkind, Wharton & Garrison. Kaplan successfully argued before the Supreme Court of the United States on behalf of her client, Edith Windsor, in United States v. Windsor (2013). This resulted in a landmark decision that invalidated a section of the 1996 Defense of Marriage Act (DOMA), thus requiring the federal government to recognize same-sex marriages. Windsor led to the 2015 Supreme Court ruling in Obergefell v. Hodges, which struck down all remaining state and federal laws against same-sex marriage across the United States. United States v. Windsor In 2009, Kaplan agreed to represent Edie Windsor pro bono. Windsor's wife, Thea Spyer, had died two years after they wed in Canada, leaving Windsor her sole heir. But because their marriage was not recognized under existing U. S. federal law, Windsor received an estate tax bill of $363,053. Windsor went to gay rights advocates seeking redress but could find no one to take her case. She was referred to Kaplan, who later recalled, "When I heard her story, it took me about five seconds, maybe less, to agree to represent her." Kaplan had been co-counsel on the unsuccessful bid for marriage equality in New York state in 2006. In a spirited exchange between Kaplan and Chief Justice John Roberts during oral arguments for the case, Roberts alleged that politicians were "falling all over themselves" to support her case. Kaplan responded, "The fact of the matter is, Mr. Chief Justice, is that no other group in recent history has been subjected to popular referenda to take away rights that have already been given or exclude those rights, the way gay people have." On June 26, 2013, the U.S. Supreme Court issued a 5-4 decision declaring Section 3 of DOMA to be unconstitutional. Edith Windsor declared, "Robbie Kaplan said, as Martin Luther King said before her, there is no wrong time to seek justice." Roberta (Robbie) Kaplan, the founding partner at Kaplan & Company, LLP, one of the few women-led elite boutique litigation law firms has been described as a “powerhouse corporate litigator” and “pressure junkie” who “thrives on looking at the big picture” whether “in the gay-marriage legal fight or high-profile corporate scandals.”  She has been selected as one of “The 100 Most Influential Lawyers” in the United States, as a “Litigator of the Year” by The American Lawyer, and as a “Lawyer of the Year” by Above the Law. In addition to representing large institutional and corporate clients like Fitch Ratings, Airbnb, Columbia University and T-Mobile,  Robbie book “Then Comes Marriage: United States v. Windsor and the Defeat of DOMA” (W.W. Norton 2015),  was chosen by the L.A. Times and Ms. Magazine as one of the top 10 books of 2015.  In commenting on the book, President Bill Clinton called Robbie an “American hero.” Robbie has received numerous recognitions for her legal accomplishments and charitable activities, including the New York Law Journal Lifetime Achievement Award;  Financial Times Legal Innovator of the Year; the Columbia Law School Medal of Excellence; as well as an honorary doctorate from the Jewish Theological Seminary.   Kaplan wrote about United States v. Last week Ralph R. Cioffi and Matthew M. Tannin, both former hedge fund managers for Bear Stearns, surrendered to federal agents and were charged with nine counts of securities, mail and wire fraud. Law.com bloggers and co-hosts, J. Craig Williams and Bob Ambrogi welcome Attorney Rich Strassberg, a partner in Goodwin Procter’s Litigation Department and chair of its White Collar Crime & Government Investigations Practice, to discuss the details of this criminal case. Mr. Devine joined the firm of Honigman Miller Schwartz and Cohn in March 2007 and is a Partner in the Litigation Department. He represents a variety of clients in state and federal court litigation and alternative dispute resolution. Tim also advises clients on record retention and information management issues, including the challenges posed by recent developments in e-Discovery. Prior to joining the Firm, Tim served as Managing Counsel in Ford Motor Company's Office of General Counsel. Tim's practice at Ford included significant litigation and client counseling responsibilities. Most recently, he led Ford's response to discovery in government inquiries and class actions. He has handled a variety of litigation, including product liability and class actions and provided legal counsel to Ford's Human Resources Department. Tim launched Ford's Privacy Office and counseled its e-commerce business portfolio, including numerous websites and new ventures. He directed legal and regulatory investigations of major industrial accidents, including complex electronic and physical evidence preservation in industrial settings. Tim received his B.A. in Government from Harvard University in 1985, his M.A. in Law and Diplomacy from the Fletcher School of Law and Diplomacy in 1990, and his J.D. magna cum laude from the University of Michigan Law School in 1995. Tim lives with his wife Julie and their children in Farmington Hills. He is a longtime participant in programs to provide legal pro bono legal services for indigent clients and is a member of the board of Metropolitan Detroit YMCA Camping Services. www.honigman.com
