The City of San Diego is planning to lift it's evacuation warnings for people in low lying flood zones today after the latest storm did not result in catastrophic flooding. California has declared a state of emergency related to the landslide threatening the rail line in San Clemente. Poway Unified officials announced yesterday that Superintendent Marian Kim Phelps has been placed on paid administrative leave. At least one person is dead after a U.S. Military Osprey crashed near Japan overnight. Six crew members are believed to have been on board. A Del Norte High School softball player has filed a 93-page lawsuit against Poway Unified School District Superintendent Marian Phelps. Poway Unified is in the news…. Again! Now a free speech case is coming before the Supreme Court. Meanwhile, politicians are trying to protect renters and protect the homeless, but their policies end up making the housing crisis even worse. It's Wednesday, April 26, 2023. Here's what John Riley thinks: Poway Unified School District first amendment case before Supreme Court Poway School Board members Michelle O'Connor-Ratcliff and TJ Zane (no longer in office), blocked their constituents from speech on their social media pages. Christopher and Kimberly Garnier have been long time critics of the school districts policies and demanded that the school board hold corrupt superintendent John Collins accountable. Should public officials be able to thwart free speech on their social media accounts, even when they discuss policy issues? Coronado and Oceanside School Districts sue Facebook, Google, TikTok and Twitter Of course, social media is impacting children. It has an addictive quality and sadly some kids engage in cyber bullying. Is this the time to sue technology companies? Or is this a teaching opportunity on how to best integrate social media in your life? Focus on reason, rationality, and not living second handed. San Diego Renter Protections If a property owner fulfills the terms of the lease agreement, but then decides to have the tenant vacate the property, does that make them a bad person? San Diego officials want to force landlords to pay 2-3 months of rent if they evict a tenant for no-fault. Sometimes landlords want to upgrade the property, move back in, sell the property, or just move on from troublesome tenants. Landlords have property rights, right? Renters upset about Ratio Billing for Utilities. Pay your fair share! In older apartment buildings, there are no specific electric, gas, and water meters for each unit. So, property owners use a formula to share those costs amongst the tenants. Now tenants are upset that they are paying more than they should. Isn't this how socialism and collectivism always seem to work? Some pay more than their fair share. Others freeload off others. SDG&E Rates Based on Income are Nonsense In a recent letter to the editor, a Poway resident expressed his frustration with SDG&E's proposal to base electric rates on income. Is this another income redistribution scheme? San Diego Mayor Todd Gloria has had it with homelessness. Public officials are facing a moral dilemma. Do they push out the homeless from encampments since they are there illegally and don't have property rights? Or is doing so inhumane? Seems like Todd Gloria is ready to get more aggressive to push the homeless out. Should the government buy housing for the homeless? The San Diego Housing Commission is planning to buy 3 Extended Stay America motels at the price of $383,000 per unit to house the homeless. Promising idea? San Diego Electric Vehicles Surging Over 10,000 EVs were sold in San Diego County in the first quarter of 2023. California now has over 1.5 zero emission vehicles. It's clear what direction this is headed. Get on board or get left out. LA Times Opinion Article: Give up on EV? An LA Times editorialist is fed up with the challenges of charging their EV on road trips. But is it really that hard? If you have a home charging station, that should satisfy 90% of your needs. What is going on in San Diego? It's Wednesday, April 5, 2023. Here's what John Riley thinks: Aztecs make San Diego Proud So much love for the San Diego State men's basketball team as they make the March Madness finals, but lose to UConn. Can you feel the energy in San Diego around this team? Feels really good. Nathan Fletcher Needs to Resign Now Last week I praised Nathan Fletcher for seeking mental health help. But now the other shoe dropped, and we see a serious sexual harassment mess. Fletcher is a disgrace. But why is he postponing his resignation until May 15th? How will he be replaced on the San Diego Board of Supervisors. Homelessness Politicized by GOP CA State Senator Brian Jones understands that homelessness is a key issue for voters. Jones is proposing a plan to clear out homeless encampments near schools, parks and churches. Is this a good plan? Where will these people go? Poway Unified School District Preparing for a School Bond In a recent op-ed, PUSD superintendent Marian Kim-Phelps made the case that school facilities are crumbling. They need more funding to upgrade and repair their infrastructure. Phelps is making the case for a future school bond funded by taxpayers. This would be on top of payments for the Billion Dollar Bond. Can PUSD self-finance their plan? I think so. San Diego Schools, Poway Unified Enrollment Declining Interesting data as less students are attending San Diego schools. It's due to a number of factors including a transition to homeschooling and private schools, families moving out of state due to high cost of living, and some upset with the politicization of curriculum. Less students = less funding. What can public schools do to attract more students? La Mesa Permitting and Signage Dysfunction The City of La Mesa is struggling to process building permits to allow businesses to start and homeowners to install granny flats. This is frustrating residents and local politicians are demanding change. Patrick Batten is a candidate for Poway School Board running in Area C covering parts of Rancho Penasquitos, Rancho Bernardo, and 4S Ranch. Patrick is attempting to win the race to fill the seat of departing incumbent TJ Zane. The US Marine Corps Patrick shared his background growing up with a single parent facing tremendous financial challenges. He discussed his time at San Diego State University and his career as a US Marine in Iraq, Afghanistan, and Syria. Educational Curriculum We discussed his “Brilliant at the Basics” curriculum proposal focusing on reading, writing, and arithmetic. This led to further discussion of vocational education, critical race theory, and home economics courses. We also covered options available to students at PUSD to attend Design 39, JROTC at Westview High School, Spanish and Mandarin bi-lingual immersion programs in elementary schools, and 4H specialty classes at Poway High School. PUSD Finances and School Bonds Patrick Batten spoke about Poway Unified School District's financial condition, the broken air conditioning at Rancho Bernardo High School and Bernardo Heights Middle School, the failed Measure P bond, and the infamous Billion Dollar Bond. We also spoke about teachers/administrator union endorsements and how those relations impact financial budgeting for the district. COVID and Education We spent a good amount of time covering the way Poway Unified managed the COVID crisis including district communication challenges, masks, remote education, and how other schools successfully got students back in school sooner than PUSD. Sweetwater Union High in the South Bay voted on a school reopening plan Monday night while Poway Unified and others will have to hold off on plans to bring back high schoolers. Plus, a day in the life of a teacher in Oakland, California and how she deals with remote teaching during the pandemic. And, voting began Monday in the special election to fill the 79th Assembly District seat vacated by Shirley Weber when she became secretary of state. Gov. Newsom’s popularity has fallen significantly after reaching record highs at the start of the pandemic. He’s likely to face a recall election later this year. Then, how the San Diego American Indian Health Center is working to keep its urban indigenous community healthy in body, mind and spirit amid the challenges posed by COVID-19. Finally, the sound of mariachi was synonymous with celebrations prior to the pandemic. Now, San Diego's mariachi bands have had to adapt and change their business models to survive.

Today is Electoral College Day which normally is a footnote in the news, but today is a major story.  We discuss some of the election chaos and fake news, but also question the necessity of the Electoral College in the 21st Century.  Then we shift gears and discuss local issues with Poway Unified School District’s need to borrow money.  While discussing Poway Unified, we also pay tribute to outgoing board member Kimberley Beatty and the good work she has done in our community.  Finally, we discuss the Cleveland Indians decision to drop their mascot name and the impact this will have on other sports teams to change their names as well. In March, city of San Diego residents will once again vote on a hotel room tax hike. Measure C, which is supported by Mayor Kevin Faulconer, unions and hotels, aims to raise the hotel room tax and fund a Convention Center expansion, homeless services and roads. This week, Voice of San Diego's Lisa Halverstadt detailed the two major contentions that have emerged over the homelessness funding: . Hosts Scott Lewis, Sara Libby and Andrew Keatts also discuss one man's fight to kill the initiative. Homeless advocate Michael McConnell has so far spent more than $236,000 on mailers and ads against the measure. why he would spend so much of his own money fighting Measure C, he said it was “advocacy for a better city.” In the second half of the show, Lewis talked to VOSD's Ashly McGlone about . The district is asking voters for $448 million to renovate schools. It will cost just $650 million to repay. We say "just" because if you’ve been a Voice of San Diego reader for a while now, you’ll remember that back in 2011, Poway Unified got voters to approve a $105 million bond for construction projects. That bond will cost an astonishing $1 billion to pay back. Our investigation led to a new state law that stopped districts from doing deals like that one.

It’s April 15th and so we celebrate two important events, one good and the other bad.  The good news is that we celebrate Jackie Robinson Day in MLB paying homage to one of baseball’s all-time greats and a man of huge cultural significance in American history.  The bad news is that our taxes filings (and often payments) are due. In this podcast we make the moral argument against the federal income tax and many other taxes that exist at the federal and state levels.  Taxation is coercive.  Taxation forces people to pay for initiatives they do not want nor support.  Tax policy is used by the powerful and influential to rig markets, pit one group of people against the other, and reward some at the expense of many.  Taxes fund immoral and foolish wars, corporate welfare, a mass incarceration state and a variety of other unethical and immoral policies. Terry Norwood joined me yesterday afternoon for pleasant conversation about her campaign for Poway School Board in Area C (mostly Rancho Bernardo).  Terry has carved out a unique position in her race.  She is the only challenger running against two incumbents.  She is the only woman on the ballot.  She is the only Rancho Bernardo resident in the race for a district that is primarily about representing Rancho Bernardo's interests. Terry Norwood has spent a great deal of her time as an active member in her community.  She served as PTA President at Rancho Bernardo High School.  She spent numerous years working on the Rancho Bernardo Grad Night event including one year as Committee Chair.  She has served on the school site council at RB High.  She serves on the Palomar PTA Council (the umbrella PTA organization for all of PUSD).  She has served on the Rancho Bernardo Planning Commission and as a board member on the Rancho Bernardo Community Foundation.  Plus she has great experience serving in organizations that support local military families.  Her progression to become a candidate for school board is simply the next logical step in her journey to serve her community. Terry Norwood prides herself on out-of-the-box thinking looking for creative ways to bring new resources to help students in the classroom.  She sees a great need for an active CTE (Career Technical Education) program (aka vocational education) to supplement the traditional college track courses in high school.  We discussed the unique vocational programs available at various high schools that are simply under publicized and thus not offering the full potential of value for students in the area.  She sees opportunities to bring in local businesses to offer internships, to coordinate resources to help students in specialized programs (i.e. robotics) and to offer training at school sites.  While she will lobby Sacramento for more educational funding from the state budget, she wants to also maximize revenue sources available in our own backyard. We discussed her background growing up in Bell County Texas, living abroad in Sicily and on the western outpost of America along the Aleutian Islands of Alaska.  This broad experience with different cultures and lifestyles gives Terry the ability to better empathize with the unique needs of students, teachers, parents, administrators and taxpayers of various backgrounds. Her race offered up many fascinating topics of discussion.  She may be one of the few candidates in America that is facing off against TWO incumbents in the same race.  Because of the challenging 3-2 majority dynamic on the board with her two opponents often on opposite sides of many key issues, this may open up a 4-lane highway down the center as she works to win the race.  Terry hopes to capitalize on this anti-incumbency feeling amongst the electorate. I was particularly intrigued with her ideas to provide visual and performing arts not simply as a separate and distinct school program, but instead as an integrated and money-saving program that helps reinforce lessons in history, social science, literature and other disciplines (including special events like Grad Night).  She strongly believes that different students learn differently, so different methods of teaching must be available (textbook, learning-by-doing, creative presentations, etc.).  We also spoke about her learnings as a mother of a special needs student and how she can help PUSD with special needs education.  Finally we also touched on the lack of long term planning at PUSD particularly with financial and safety matters. This morning I was pleased to welcome Poway Unified School Board Area B Candidate Ginger Couvrette.  Ginger has an incredible track record of volunteerism in our community helping children, athletes, needy families, special needs students and teachers in the Poway Unified School District.  I have always known of Ginger as a community dynamo helping out so many people throughout Poway, but I was amazed to learn that she has done so much more.  Ginger often pointed out how the positive at Poway Unified and overall how people are happy.  She doesn't want to take sides, but rather surround herself with intelligent people that can work together to solve problems.  Ginger is a former science teacher at Poway High and San Marcos High. Ginger Couvrette spoke about the need for district-wide procedures and protocols on issues like student safety, bullying and student anxiety.  She wants to have a consistent set of standards with citizen oversight so teachers, parents and administrators have consistent expectations when important situations arise.  She also talked at length about the vocational training she experienced in high school and how these innovative programs can be implemented to at PUSD to provide better educational and career-testing opportunities. Ginger Couvrette shared her story of helping save the Poway Days Parade and enjoying working closely with Sue Herndon and Heather Dugdale.  They joined forces again and joined Jody Campillo to create Jack-O-Smash to help raise money for special needs students at PUSD.  Over 3 years they raised $70,000 which they offered in $500 grants to all PUSD special needs teachers at all schools that requested help.  The event involved a 5K race, giant trebuchets that launched pumpkins great distances and a softball game with special needs athletes and current & former Padres and other MLB players. Ginger also discussed her experience on the City of Poway's Budget Review Committee and the best practices she learned that could be brought to Poway Unified.  This included a clear prioritization of special projects that could be pursued with one-time money from the state or from surpluses.  The City of Poway also has a disciplined process where departments budget and save for capital expenses years in advance.  For example, if a department needed to buy a truck that would last 8 years, then they would buy the truck, but immediately begin saving in year 1 and each year thereafter.  Then when that truck needed to be replaced the funds were available to buy the next truck by year 8.  The end result is a disciplined process that includes citizen oversight of individual department budgets resulting in a long string of balanced budgets and healthy reserves.  This is one example of many where Couvrette identifies programs that work in other places that can be rolled out at Poway Unified as a successful program. We also spoke about special needs students and their needs, unnecessary legal battles, the natural human concern about change in light of the new superintendent and her new cabinet, tightening up the business side of the district, streamlining and automating processes to save time and money, Pomerado Elementary's new technical center, school foundations, ROTC, agriculture, the 3-2 board majority dynamics, field trips, cross country, her son building and driving the Cal Poly SLO Rose Bowl Parade float, turf at Valley Elementary and Meadowbrook Middle School, lights at Arbolitos Field and Valley Elementary, Poway Sports Association, Poway soccer, football, Poway High Tennis, Poway High Water Polo, Palomar Pomerado Pathmaker internship, Thanksgiving baskets at Chaparral Elementary and the Poway High Rugby Club.  The list of community organizations that Ginger has helped is endless. Poway parent and education advocate Kim Garnier joined me on the John Riley Project Saturday afternoon October 6th.  Kim is a candidate for Poway Unified School Board Area B.  She and her family have a long history fighting against the corruption in the school district and fighting for the rights of students and parents.  This was a fascinating discussion, particularly going through the entire history of the activism of Kim and her husband Chris Garnier and the challenges they have faced along the way.  It was also incredible to learn the depth and commitment of the Garnier family to public education at the local, national and international levels. Kim Garnier believes the budget is one of the key topics of discussion because it is a reflection of priorities of the district.  We explored special needs students and the challenges they face.  She shared a story of the school district falsely categorizing a student as violent (without documented evidence) and insisting the child be banished to an alternative school outside the district at a cost of $35K/year.  With Garnier's help, this student and parents had their rights protected and the child was assigned to a different PUSD school where the child is thriving and no extra costs are incurred.  Garnier spoke at length about reprioritizing school district priorities so more resources can go to the classroom to support the student, rather than being wasted in foolish legal battles, or disproportionately going to teacher raises while other classroom resources suffer.  Kim Garnier did not seek the teachers' union endorsement.  Instead she sees herself representing the "union" for students and the "union" for taxpayers.  Ultimately Garnier wants to change the conversation, provide more innovative educational strategies to make Poway students competitive on the world stage and do it while balancing the budget.  She truly wants to make the students the top priority. We also spoke about other topics including school safety, Chula Vista Unified surpassing Poway Unified, finding future focused minds to bring new ideas forward, her family's trip to Hong Kong and her observations in the classroom and teaching style in a foreign nation, stale ideas at PUSD, resistance to change, vocational training, standing up for the truth, questioning things, sexual harassment in the school district, Mama Bear, protecting the little guy, parents not understanding their rights when interacting with teachers and principles, diversity as both a challenge and a strength, dual-language immersion, melting pots and jambalaya, cat litter, her roots in the Poway/Rancho Bernardo community, her current positive relationships with her own elementary school teachers at PUSD, the corruption of attorney Shinoff, the Billion Dollar Bond (CAB), Dolinka and "I'm here for you". It was particularly interesting to get the whole story on the Garnier family saga at PUSD.  Their relationship with John Collins started out as one of love, friendship and mentorship, only to devolve into a fierce battle.  Kim Garnier traces the history starting with Chris attempting to defend the rights of a black child that endured racial slurs, but getting thwarted and manipulated by Collins and his staff to prevent Chris from representing the child.  This led to an attempt to reconcile where Chris opened up and had his own words used against him.  The story then evolved to a restraining order that prevented him from setting foot on his own child's campus and a ugly legal battle.  There is much more drama and detail that Kim shared in our podcast that gives you a sense of the motivations of the Collins/Shinoff regime and an inside look at the corruption occurring behind the scenes.  The drama continued to unfold to the point that Collins was discovered stealing money from school funds, later being dismissed by the district and eventually found guilty in a court of law.  The entire process is moving and gives one a great respect for the...

Gaby Dow joined us for a great discussion about PUSD issues from a parent perspective.  Gaby is a business consultant that works in the area where the public sector and technology intersect, so she had some great insight into Poway Unified's technology plans.  She served on the school district's tech advisory committee and shared some of the frustrations and challenges facing the district and it's IT strategy.  Gaby shared in detail how a third party, hired consultant for the district chose not to offer recommendations due to the toxic culture at the school district.  This led to the infamous report that John Collins later redacted with edits, thus thwarting transparency and preventing "dirty laundry" to be exposed to the public.  We also covered PUSD's data breach which Gaby Dow was the recipient of when she requested a routine set of public records and instead received personal information on tens of thousands of students and their families.  We also spent time discussing the districts's financial challenges including the Billion Dollar Bond and the current structural deficit.  It was enjoyable to discuss the dynamics of each of the current school board political races and the strengths and weaknesses of various candidates.  We had fun pointing out hypocrisies of campaign slogans with actual reality as well as showcasing how the election districts are largely gerrymandered. The Poway Unified School District is one of the highest regarded school districts in the state. Its schools are good and its students are high-performing. But the district's sterling reputation has a few big dings. Poway Unified's leadership has been under a cloud of suspicion since 2011 when Voice of San Diego broke a story about a strange bond that allowed the district to immediately borrow $150 million, but then required it to pay back $1 billion by 2035. That financial scandal shook the school and resulted in lots of negative attention from the media and the families inside the district. California lawmakers changed laws preventing other districts to do what Poway did, and the San Diego County Grand Jury scrutinized the deal. But former Poway Unified superintendent John Collins downplayed the whole issue and kept his job. But in 2016, he was fired amid another financial scandal. This time, Collins was charged with five felony charges for allegedly misusing public money, vacation, sick and leave time − charges he denies. As that case plays out in the courts, Poway Unified has moved on, naming Marian Kim-Phelps as its new superintendent. She's the district's first women and the first person of color to serve in that role. On the podcast, hosts Scott Lewis and Laura Kohn talk to Kim-Phelps about her leadership style. She said transparency is extremely important to her and that being open moving forward is the only way to leave the past turmoil behind. “I believe that I am a transparent leader,” she said. “People forget, we're public education. Nothing's private. Nothing's a secret.” Kim-Phelps also talks about how she wants to find funding to expand the district's multi-language programs, she discusses the innovation relationship between the Poway teachers' union and the school leadership, the district's innovative Design 39 school, the big change in school board elections and more. Also on the podcast, Lewis talks about how his 5-year-old daughter, who just barely missed the cutoff dates for transitional kindergarten, is already advocating for universal TK for all 4-year-olds. What's Working Dual-language programs in Chula Vista:  An education think tank recently released a report  report showing how, despite legislation that made bilingual education difficult to implement, the Chula Vista Elementary School District has successfully built 21 Spanish-English dual-language immersion programs that now reach over 4,000 students.
