In Aotearoa-New Zealand, the proportion of doctors identifying as Māori has doubled from where it was a decade ago to over 5 percent. But there is still a long way to go before the workforce is representative of the broader population which is 17 percent Māori.The Auckland and Otago Medical Schools have in recent years turbocharged their intake of Māori and Pasifika students but these graduates don't seem to have trickled through to the RACP in great numbers. Just 3.5 percent of general physicians and 4.8 percent of paediatricians identify as Māori, and Pasifika doctors make up a further 1 and 2 percent respectively.In this podcast, three Māori medics discuss how the culture of training environments can be made more welcoming to junior doctors with diverse ethnic backgrounds. In this episode, Jim Garrity talks about a tactic of some examining lawyers that should, but often doesn't, draw objections that their questions are “argumentative.” So, what is an improper, argumentative question or examination? Here, we're not talking about the questioner's tone or demeanor, i.e., arguing in the classic sense of yelling and bickering with the deponent. We're talking about questions where lawyers aren't really asking a question designed to elicit facts but are instead injecting their own commentary or viewpoint, or injecting insults, taunts, wisecracks, or similar language. "Argumentative" objections are objections to the form, and must be timely made or are waived.SHOW NOTESPeople v. Pawar, No. G037097, 2007 WL 477949, at *2 (Cal. Ct. App. Feb. 15, 2007) (“[W]ere they lying” queries are improper if they are merely argumentative. (Chatman, supra, 38 Cal.4th at pp. 381, 384.) In Chatman, the prosecutor asked the defendant how the safe at a store was opened. (Id. at p. 379.) The defendant replied “he could not say; he never touched the safe,” eliciting the prosecutor's query, “ ‘Well, is the safe lying about you?' “ (Ibid.) The Supreme Court held the question of whether an inanimate object was “lying” was argumentative , defining argumentative inquiry as “speech to the jury masquerading as a question” which “does not seek to elicit relevant, competent testimony, or often any testimony at all.” (Id. at p. 384.))Faile v. Zarich, No. HHDX04CV5015994S, 2008 WL 2967045, at *3 (Conn. Super. Ct. July 10, 2008) (Webster's. . . in the closest relevant definition, defines “argumentative” as “consisting of or characterized by argument: containing a process of reasoning: controversial”)Pardee v. State, No. 06-11-00226-CR, 2012 WL 3516485, at *6 (Tex. App. Aug. 16, 2012) (Steven Goode, et al., Texas Practice Series: Courtroom Handbook on Texas Evidence § 611 cmt. 12 (2012); see United States v. Yakobowicz, 427 F.3d 144, 151 (2d Cir.N.Y.2005) (defining argumentative as “summation-like remarks by counsel during the presentation of evidence”); accord Eddlemon v. State, 591 S.W.2d 847, 851 (Tex.Crim.App. [Panel Op.] 1979) (trial court did not abuse discretion in finding the question, “You don't believe your own offense report?” argumentative). In other words, an argumentative objection concerns whether counsel is attempting to “argue” the case, not whether the counsel is “arguing” with the witness”)United States v. Yakobowicz, 427 F.3d 144, 151 (2d Cir. 2005) (“During the presentation of evidence one of the most commonly sustained objections is that a particular question is argumentative, Fed.R.Evid. 611(a) advisory committee's note to Subdivision (a) to 1972 Proposed Rules, and any summation-like remarks by counsel during the presentation of evidence are improper and subject as a routine matter to being stricken, Mauet & Wolfson, supra, at 30”)Pardee v. State, No. 06-11-00226-CR, 2012 WL 3516485, at *6 (Tex. App. Aug. 16, 2012) ("Many common law objections—including the objection of “argumentative”—are incorporated in the Texas Rules of Evidence. The common law argumentative objection is now governed by Tex.R. Evid. 611 which concerns the mode of interrogation and presentation. The argumentative objection is an objection commonly used, but not commonly understood. Pardee argues the objection should have been sustained because the State was “arguing” with the defendant. Argumentative, though, does not concern counsel's demeanor or tone. Professors Wellborn, Goode, and Sharlot explain the argumentative objection as follows: Counsel may not, in the guise of asking a question, make a jury argument or attempt to summarize, draw inferences from, or comment on the evidence. In addition, questions that ask a witness to testify as to his own credibility are improper.")People v. Chatman, 38 Cal. 4th 344, 384, 133 P.3d 534, 563 (2006) The prosecutor's question about whether the safe was “lying” requires a different analysis. The question was argumentative. An argumentative question is a speech to the jury masquerading as a question. The questioner is not seeking to elicit relevant testimony. Often it is apparent that the questioner does not even expect an answer. The question may, indeed, be unanswerable. The prosecutor's question whether “the safe [was] lying” is an example. An inanimate object cannot “lie.” Professor Wigmore has called cross-examination the “greatest legal engine ever invented for the discovery of truth.” (5 Wigmore on Evidence (Chadbourne rev. ed.1974) § 1367, p. 32.) The engine should be allowed to run, but it cannot be allowed to run amok. An argumentative question that essentially talks past the witness, and makes an argument to the jury, is improper because it does not seek to elicit relevant, competent testimony, or often any testimony at all. Defendant had already explained he had no explanation for the safe being open. Asking whether the safe was “lying” could add nothing to this testimony”)People v. Imbach, No. E040190, 2008 WL 510482, at *7–8 (Cal. Ct. App. Feb. 27, 2008) ("The prosecutor asked, “You found that to be inappropriate but not your other son's addiction to child pornography?” When defendant objected that the question was argumentative, the trial court overruled that objection. Defendant asserted the second “argumentative” objection when defendant's mother said she did not know how to answer that question and the prosecutor asked, “Is that because you didn't want to know?” The trial court sustained the defendant's objection to this second question. Both questions are argumentative, because they both are speeches by the prosecutor masquerading as questions. (Chatman, supra, 38 Cal.4th at p. 384.) The trial court should have sustained both objections. However, we cannot say that by asking those two questions the prosecutor engaged in misconduct.")People v. App. May 14, 2024), review denied (July 17, 2024) (excessive repetition of a question simply to make a point can cross line into improper argument”; “Burns makes a strong argument that the prosecutor's repetitive questioning regarding the drunk tank incident became argumentative. “An argumentative question is a speech to the jury masquerading as a question. The questioner is not seeking to elicit relevant testimony. Often it is apparent that the questioner does not even expect an answer. The question may, indeed, be unanswerable.” (People v. Chatman (2006) 38 Cal.4th 344, 384.) “An argumentative question that essentially talks past the witness, and makes an argument to the jury, is improper because it does not seek to elicit relevant, competent testimony, or often any testimony at all.” (Ibid.) Instead, it may be aimed at agitating or belittling the witness (People v. Lund (2021) 64 Cal.App.5th 1119, 1148), or designed to engage the witness in an argument (People v. Johnson (2003) 109 Cal.App.4th 1230, 1236)”)People v. Mazen, No. B300193, 2021 WL 164356, at *5 (Cal. Ct. App. Jan. 19, 2021) The court overruled defendant's argumentative objection to the following question: “Would [accidentally placing the car in neutral] been important information to tell [Morales]?” The court did not abuse its discretion when it overruled the objection. The question sought to elicit relevant testimony regarding defendant's theory that Mario was hit by accident (CALCRIM No. 510). (See People v. Chatman (2006) 38 Cal.4th 344, 384 [“[a]n argumentative question is a speech to the jury masquerading as a question” and does not seek to elicit relevant testimony].)”People v. Ct. App. Dec. 23, 2015) ("Fung appears to identify three categories of objectionable questioning during his cross-examination by the prosecutor. The first category involves apparent sarcasm by the prosecutor. For example, after Fung provided additional details about his fight with another inmate while incarcerated, the prosecutor said, “Okay. You left that part out a couple of minutes ago; right?” Referencing the same fight, the prosecutor made light of Fung's claim of self-defense: “Did you have to defend yourself against him, too?” As another example, when Fung was discussing the extent of his injuries following the fight, the prosecutor said, “So, that's about how badly you were hurt? It looked like something you get by falling off a skateboard?” The court sustained objections to each of these questions, and a number of others, as argumentative." Also from Basler: "As we have noted, Fung contends the first two categories of questions were impermissibly argumentative. “An argumentative question is a speech to the jury masquerading as a question. The questioner is not seeking to elicit relevant testimony. Often it is apparent that the questioner does not even want an answer. The question may, indeed, be unanswerable.... An argumentative question that essentially talks past the witness, and makes an argument to the jury, is improper because it does not seek to elicit relevant, competent testimony, or often any testimony at all.” (People v. App. June 28, 2011) (trial courses sustained objection to question as argumentative where prosecutor asked witness “Do you remember anything about that evening that might be detrimental to your case?” In essence arguing to jury that witness was lying and only selectively remembered favorable facts)People v. Higgins, 119 Cal. Rptr. 3d 856, 873–74 (Ct. App. 2011), as modified (Jan. 21, 2011), as modified on denial of reh'g (Feb. 4, 2011) (guilty verdict reversed in part due to argumentative questions; among other jabs; in case where defendant explained his conduct as motived by depression due to death of his daughter's friend, prosecutor asked, “You'd agree with me that it's pretty pathetic if you're using the memory of a dead 17–year–old kid as an excuse in this trial, wouldn't you? Would you agree with me? Is that the legacy that you want [the dead teen] to have?”; other examples of prosecutor's argumentative questions included “Oh, the door was unlocked,” and “Isn't that convenient that all of a sudden, right after you've committed the crimes, that that's when you come to?”; further held, “The rule is well established that the prosecuting attorney may not interrogate witnesses solely ‘for the purpose of getting before the jury the facts inferred therein, together with the insinuations and suggestions they inevitably contained, rather than for the answers”)People v. Dixon, No. D047342, 2007 WL 2745207, at *10 (Cal. Ct. App. Sept. 21, 2007)  Dixon asked Hernandez who had taken the photographs near the time of the injury. Hernandez testified that the audio-visual person at his school had taken photographs of his injury. Dixon then asked, “Is it computer enhancement? Those could be computer enhanced-.” The prosecutor interrupted, “That's argumentative.” The court sustained the prosecutor's objection")United States v. In this episode, we explore the Basal Ganglia. The basal ganglia are a group of subcortical nuclei that play a crucial role in orchestrating movement. They are involved in what's known as the 'Go, No-Go' decision-making process, where they help decide whether to initiate or suppress actions. Overall cost growth remains subdued, reflecting an easing of pressure for labour and materials. On today's show we are addressing a diversity of opinion on how valuation is determined for land in residential subdivisions. We recently had a builder assert that our pricing was too high for residential lots in a subdivision.  At the same time, we have also been successful in developing residential lots and selling them in the marketplace to builders across multiple markets.  When we price our land, we always perform residual land value analysis as part of our due diligence.  We put ourselves into the shoes of the home builder and reverse engineer their cost structure.  So if we are talking about a single family home subdivision, we subtract the builders profit from the retail price, then we subtract the hard cost of construction, the soft costs like permit fees and insurance, interest reserves, the builders general conditions. Data privacy: vehicle manufacturers: remote vehicle technology.Existing law establishes various privacy requirements applicable to vehicle manufacturers, including limitations on the usage of images or video recordings from in-vehicle cameras in new motor vehicles equipped standard with one or more in-vehicle cameras. Existing law provides various protections to persons who are escaping from actual or threatened domestic violence, sexual assault, stalking, human trafficking, and other abuse, including providing for a means to keep the names and addresses of abuse survivors confidential in public records.This bill would, among other things, require a vehicle manufacturer that offers a vehicle for sale, rent, or lease in the state that includes remote vehicle technology to do certain things, including ensure that the remote vehicle technology can be immediately manually disabled by a driver of the vehicle while that driver is inside the vehicle by a method that, among other things, is prominently located and easy to use and does not require access to a remote, online application. The bill would require a vehicle manufacturer to offer secure remote means via the internet for a survivor to submit a vehicle separation notice that meets specified requirements. The bill would define “survivor” to mean an individual who has a covered act committed, or allegedly committed, against the individual. The bill would define “covered act” to mean, among other things, certain crimes relating to domestic violence, dating violence, sexual assault, stalking, and sex trafficking.This bill would require a survivor to submit a vehicle separation notice through the secure remote means described above within 7 days of the date on which the survivor used the method of manually disabling remote vehicle technology and would require the notice to include prescribed information, including a statement by the survivor signed under penalty of perjury that a perpetrator who has access to the remote vehicle technology in the vehicle has committed committed, or allegedly committed committed, a covered act against the survivor or an individual in the survivor's care, or a copy of specified documents that support that the perpetrator has committed committed, or allegedly committed committed, a covered act against the survivor or an individual in the survivor's care, including a signed affidavit from, among other specified individuals acting within the scope of their employment, a licensed medical care provider.By requiring a survivor to submit a statement signed under penalty of perjury or requiring specified individuals to sign an affidavit, the bill would expand the crime of perjury and impose a state-mandated local program.This bill would make a vehicle manufacturer that violates the above-described provisions liable in a civil action brought by a survivor for, among other things, reasonable attorney's fees and costs of the prevailing survivor, in addition to any other remedy provided by law. The bill would specify that any waiver of the requirements of the above-described provisions is against public policy, void, and unenforceable. statutory damages in an amount not to exceed $50,000 or not to exceed $100,000 for a knowing violation.This bill would define various terms for these purposes, purposes and would make related findings and declarations.The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.This bill would provide that no reimbursement is required by this act for a specified reason.DIGEST KEYVote: majority   Appropriation: no   Fiscal Committee: yes   Local Program: yes  BILL TEXTTHE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The Legislature finds and declares all of the following:(a) Domestic violence, dating violence, stalking, sexual assault, human trafficking, and related crimes are life-threatening issues and have lasting and harmful effects on individuals, families, and entire communities.(b) Survivors of violence and abuse often lack meaningful support and options when establishing independence from an abuser, including barriers of financial insecurity and limited access to reliable communication tools to maintain essential connections with family, social safety networks, employers, and support services.(c) Perpetrators of violence and abuse increasingly use technological and communication tools to exercise control over, monitor, and abuse their victims.(d) Remote vehicle technology, including mobile phone wireless connectivity and location data capabilities that are manufactured into vehicles, are among the technological and communication tools perpetrators of violence and abuse can, and have, used.(e) According to The New York Times, “Modern vehicles have been called ‘smartphones with wheels' because they are internet-connected and have myriad methods of data collection, from cameras and seat weight sensors to records of how hard you brake and corner. Most drivers don't realize how much information their cars are collecting and who has access to it.”(f) Under the federal Safe Connections Act of 2022, survivors of domestic abuse are empowered to protect themselves and their loved ones by requiring telecommunications providers, upon request, to separate their mobile phone accounts from the accounts of their abusers.SEC. 2. Chapter 36.5 (commencing with Section 22948.60) is added to Division 8 of the Business and Professions Code, to read:CHAPTER  36.5. Remote Vehicle Technology  22948.60. (a) For the purposes of this chapter:(1) “Covered act” means conduct that is any of the following:(A) A crime described in subsection (a) of Section 40002 of the federal Violence Against Women Act (34 U.S.C. Sec. 12291), including domestic violence, dating violence, sexual assault, stalking, and sex trafficking.(B) An act or practice described in paragraph (11) or (12) of Section 103 of the federal Trafficking Victims Protection Act of 2000 (22 U.S.C. Sec. 7102) relating to severe forms of trafficking in persons and sex trafficking, respectively.(C) An act under state law, tribal law, or the Uniform Code of Military Justice (Chapter 47 (commencing with Section 801) of Title 10 of the United States Code) that is similar to an offense described in subparagraph (A) or (B).(2) “Designated person” means a person who provides care to a survivor and meets both of the following criteria:(A) The person has been authorized by the survivor to submit a request pursuant to subdivision (c) of Section 22948.61.(B) The person did not commit, or did not allegedly commit, a covered act against the survivor.(2)(3) “Perpetrator” means an individual who has committed committed, or allegedly committed committed, a covered act against a survivor or an individual under the care of a survivor.(3)(4) “Remote vehicle technology” means any technology that allows a person who is outside of a vehicle to access the activity, track the location, or control any operation of the vehicle or its parts, that includes, but is not limited to, any of the following:(A) A Global Positioning System (GPS).(B) An app-based technology.(C) Any other remote wireless connectivity technology.(4)(5) “Survivor” means an individual who meets either of the following criteria: has had a covered act committed, or allegedly committed, against the individual.(A)The individual has had a covered act committed or allegedly committed against them.(B)The individual provides care to an individual who has had a covered act committed or allegedly committed against, and that caretaker did not commit or allegedly commit the covered act.(5)(6) “Vehicle manufacturer” means a vehicle manufacturer or remanufacturer, as defined in Section 672 of the Vehicle Code.(b) Subdivision (a) does not require a criminal conviction or any other determination of a court in order for conduct to satisfy a definition.  22948.61. (a) A vehicle manufacturer that offers a vehicle for sale, rent, or lease in the state that includes remote vehicle technology shall do all of the following:(1) Ensure that the remote vehicle technology can be immediately manually disabled by a driver of the vehicle while that driver is inside the vehicle by a method that meets all of the following criteria:(A) The method of manually disabling the remote vehicle technology shall be is prominently located and easy to use and shall does not require access to a remote, online application.(B) Upon its use, the method of manually disabling the remote vehicle technology shall inform informs the user of the requirements of subdivision (b).(C) The method of manually disabling the remote vehicle technology shall does not require a password or any log-in information.(D) Upon its use, the method of manually disabling the remote vehicle technology shall does not result in the remote vehicle technology, vehicle manufacturer, or a third-party service provider sending to the registered owner of the car an email, telephone call, or any other notification related to the remote vehicle technology being disabled.(E) Upon its use, the method of manually disabling the remote vehicle technology shall cause causes the remote vehicle technology to be disabled for a minimum of seven days and capable of being reenabled only by the vehicle manufacturer pursuant to paragraph (4).(2) Offer secure remote means via the internet for a survivor to submit a vehicle separation notice that includes a prominent link on the vehicle manufacturer's internet website that meets both of the following requirements:(A) The link is titled, in bold and capital letters, “CALIFORNIA SURVIVOR DOMESTIC VIOLENCE ASSISTANCE.”(B) The link provides a designated internet website portal that provides a survivor the ability to submit a vehicle separation notice and includes a form that enables a survivor to submit the information required by subdivision (b).(3) Upon the request of a survivor, reset the remote vehicle technology with a new secure account and delete all data from the original account.(4) Reenable the remote vehicle technology only if the registered owner of the car notifies the manufacturer that the remote vehicle technology was disabled in error, and a survivor has not contacted the vehicle manufacturer to provide the information required by subdivision (b) within seven days of the remote vehicle technology being disabled.(b) A survivor shall submit a vehicle separation notice to a vehicle manufacturer through the means provided by the vehicle manufacturer pursuant to paragraph (2) of subdivision (a) within 7 days of the date on which the survivor used the method of manually disabling remote vehicle technology required by subdivision (a), which shall include the vehicle identification number of the vehicle and either of the following:(1) A statement by the survivor signed under penalty of perjury that a perpetrator who has access to the remote vehicle technology in the vehicle has committed committed, or allegedly committed committed, a covered act against the survivor or an individual in the survivor's care.(2) A copy of either of the following documents that supports that the perpetrator has committed committed, or allegedly committed committed, a covered act against the survivor or an individual in the survivor's care:(A) A signed affidavit from any of the following individuals acting within the scope of that person's employment:(i) A licensed medical or mental health care provider.(ii) A licensed military medical or mental health care provider.(iii) A licensed social worker.(iv) A victim services provider.(v) A licensed military victim services provider.(B) A copy of any of the following documents:(i) A police report.(ii) A statement provided by the police, including military police, to a magistrate judge or other judge.(iii) A charging document.(iv) A protective or restraining order, including military protective orders.(v) Any other relevant document that is an official record.(c) (1) Only if, for technological reasons, a vehicle manufacturer is unable to comply with paragraph (1) of subdivision (a), the vehicle manufacturer shall create a conspicuous mechanism that is easy to use by which a survivor or a designated person can submit a request to disable a vehicle's remote vehicle technology.(2) A vehicle manufacturer shall disable remote vehicle technology within one business day after receiving a request from a survivor that includes the information required by subdivision (b) and is submitted pursuant to the mechanism required by paragraph (1).(d) This section does not authorize or require a vehicle manufacturer to verify ownership of a vehicle, the identity of a survivor, or the authenticity of information that is submitted by the survivor.  22948.62. (a) In addition to any other remedy provided by law, a vehicle manufacturer that violates Section 22948.61 shall be liable in a civil action brought by a survivor for all of the following:(1) Reasonable attorney's fees and costs of the prevailing survivor.(2) A civil penalty Statutory damages in an amount not to exceed fifty thousand dollars ($50,000) per violation, or a civil penalty statutory damages in an amount not to exceed one hundred thousand dollars ($100,000) per violation for knowing violations.(3) Actual damages or three times the amount at which the actual damages are assessed for knowing or reckless violations.(b) Any waiver of the requirements of this chapter shall be against public policy, void, and unenforceable. SEC. 3. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.

We'll hear about the first property he scrambled to purchase and what he needed to give up to do so. While it was something the average university student may not be able to give up, Raj's past experiences meant he would have done it 10 times over to thank his parents for all they sacrificed. Break 1: MOG   STORY 1: Teen Charged with Murder of Man In Lilburn Area Subdivision The Gwinnett County Police Department arrested 16-year-old Ryan Abreu for a shooting that left Terrence Weston, 28, dead late Saturday night in unincorporated Lilburn. The incident, deemed drug-related, occurred around 11:30 p.m. on the 3000 block of Betty Jean Court. Abreu faces charges including aggravated assault, felony murder, and firearm possession by a minor. He is charged as an adult and is currently in custody. STORY 2: The Teen Driver Facing Charges in The Death of a 4-Year-Old Is Out of Jail Jacob Johnston, an 18-year-old driver, was charged with second-degree vehicular homicide and reckless conduct for the death of 4-year-old Abigail Hernandez, who was struck while walking with her family in the Mall of Georgia's parking lot on March 10. Johnston was booked into the Gwinnett County Detention Center on Friday and released 16 hours later on a $5,900 bond. Although police initially deemed the incident accidental, the District Attorney's Office decided to press charges. Hernandez's father and sister survived the accident. A court hearing for Johnston has not yet been scheduled. STORY 3: Gwinnett Technical College's Respiratory Care Program Earns Award Gwinnett Technical College's Respiratory Care program has been recognized for its excellence, boasting an 11-year streak of 100% pass rates on the national credentialing exam. This month, the program will receive the Distinguished RRT Credentialing Success Award from the Commission on Accreditation for Respiratory Care, a prestigious honor requiring three years of data, high RRT credentialing success rates, and strong student retention and graduation rates. The research suggests relatives of these women also have increased cancer risks, including breast, prostate, and colon cancers. Led by Dr. Corrine Welt from the University of Utah Health, the study focused on women with primary ovarian insufficiency and their relatives. It found that women with early menopause had double the risk of breast cancer and almost quadruple the risk of ovarian cancer. Relatives also faced elevated risks of various cancers. Dr. Welt emphasizes the importance of regular cancer screening for women with infertility or early menopause, especially if they have a family history of cancer. STORY 7: Personalized flu shots closer after major breakthrough Researchers have made a breakthrough in personalized flu vaccines by identifying biomarkers that gauge an individual's ability to resist infection. This discovery could revolutionize vaccination programs, allowing for tailored vaccine doses based on a person's immune response. The study, led by Dr. Nhan Nguyen, analyzed blood samples from 286 donors across multiple flu seasons.
