In a recent ruling, Judge Steven Hippler denied Bryan Kohberger's motion to exclude expert testimony identifying a white sedan seen near the crime scene as a 2014–2016 Hyundai Elantra. The defense argued that linking various surveillance videos to the same vehicle was speculative and could prejudice the jury. However, the judge determined that law enforcement's conclusions were based on logical inferences drawn from multiple surveillance sources, including footage from 1112 King Road and 1125 Ridge Road. These videos captured a white sedan making several passes near the crime scene shortly before the murders, supporting the identification of the vehicle's make and model.Judge Hippler emphasized that expert opinions derived from such evidence are permissible and do not infringe upon the jury's role in determining guilt. He noted that the investigators' analysis, based on their training and experience, provided a reasonable basis for their conclusions. As a result, the prosecution is allowed to present expert testimony regarding the vehicle's identification during the trial, while the jury will ultimately assess the credibility and significance of this evidence.to contact me:bobbycapucci@protonmail.comsource:041825+Order+on+Defendants+Motion+in+Limine+RE+Make+and+Model+of+Suspect+Vehicle.pdf

In State v. Bryan Kohberger, the defense filed Motion in Limine #12, seeking to exclude any testimony identifying the make and model of the vehicle seen near the crime scene on November 13, 2022. The defense argued that the vehicle identification was speculative and lacked continuous surveillance footage linking the car observed at 1112 King Road to other footage from 1125 Ridge Road. They contended that without unbroken visual evidence, asserting that the vehicles in different videos are the same is conjectural and could mislead the jury.In response, the prosecution opposed the motion, asserting that their expert, FBI Forensic Examiner Anthony Imel, had analyzed multiple surveillance videos and concluded that the vehicle captured shared characteristics with a 2014-2015 Hyundai Elantra. They emphasized that the suspect vehicle was observed multiple times near the crime scene before and after the homicides, and that Kohberger owned a white 2015 Hyundai Elantra at that time. The prosecution argued that the jury should be allowed to hear this expert testimony and determine the weight of the evidence.to contact me:bobbycapucci@protonmail.comsource:031725-States-Response-Defendants-MiL-12-RE-Make-Model-Suspect-Vehicle.pdfBecome a supporter of this podcast: https://www.spreaker.com/podcast/the-epstein-chronicles--5003294/support.

The Wayne County Prosecutor's Office announced on Tuesday, Dec. 10, that the mother, whose son was 16 years old at the time of the crash, will not be charged in connection to the November 2023 crash. Kiernan Tague, who was 16 at the time of the crash, was charged in March with second-degree murder for the Nov. 13, 2023, crash that claimed the life of this 18-year-old friend, Flynn Mackrell. Police say Tague was driving over 100 miles per hour on a residential street in Grosse Pointe Farms where the speed limit was 25 mph when he lost control and struck a utility pole and tree. Mackrell's mother, Anne Vanker, requested the teen driver's mother be charged, citing the case of convicted Oxford High School shooter Ethan Crumbley and his parents, who were the first parents in United States history to be held responsible for a school shooting committed by their child. But Wayne County Prosecutor Kym Worthy said on Dec. 10 that a panel of assistant prosecutors determined the mother “was not directly or indirectly involved in any way in the offenses for which we have charged her son.” “Parenting is hard in the best of circumstances,” Worthy said in a statement. “Most parents do everything they can to mentor their children and steer them in the right direction. The juvenile respondent's mother was no different. She took consistent, active steps to try to make sure that he stayed on the right path.” "There will be those that say she should have done more, but we have looked at all of the facts and those facts dictate no criminal charges here," Worthy said. "We will not be more specific about her actions because her son will be facing trial in February. (The defendant's mother) was not directly or indirectly involved in any way in the offenses for which we have charged her son. Despite his mother's attempts, it is our firm position that the respondent and the respondent only is directly responsible for the crimes that we have adult designated and charged him with." MacKrell's mother Anne Vanker told The News she thought there was enough evidence to prove the driver's mother knew he was reckless because a Grosse Pointe Farms police report showed the woman had monitored her son's driving habits via the Life 360 app that allows parents to view their kids' driving speed, hard braking and other activity. Mackrell's mother previously told the paper that she believed the teen driver's parents could have done something to prevent the crash that killed her son. MacKrell's parents said he was picked up by a 16-year-old friend who was driving his mother's white 2021 BMW X3. They were going to surprise another friend in Grosse Pointe Farms. Afterward, the driver sped over 100 mph while heading southwest on Ridge Road, officials said. That stretch of the road has a 25 mph speed limit. He lost control of the SUV, struck a utility pole, went airborne, and then hit a tree, witnesses said. They reported that the SUV was moving “at a very high rate of speed.” “The vehicle was traveling at such a high rate of speed that the engine, transmission, front axle, and passenger compartment all separated from each other and scattered all over the roadway,” the police report says. Vanker called the announcement "a weak decision." "The wounds never close, and I'm disappointed," Vanker said. "When your child is skipping school or smoking pot, a parent maybe can't control that. But she knew her son was driving more than 100 mph because of the Life 360 app; that was right in the police report. She didn't try to control his behavior. And she provided him with the murder weapon, which was the car, knowing he was an aggressive driver. "I know Kym Worthy does the best she can, and her office gets a lot of cases," Vanker said. "But this was a missed opportunity. So many kids are killed in car accidents every year, and parents keep giving them the keys to these cars, knowing how crazy they drive. This was a chance to hold parents accountable. Now, my son is dead, and my family is destroyed." Tague is not being charged as an adult but is adult-designated, meaning if convicted, a judge can sentence him as a juvenile or as an adult or blended sentence with the option of imposing an adult sentence if Tague is not rehabilitated. fWotD Episode 2764: Battle of Cane Hill Welcome to Featured Wiki of the Day, your daily dose of knowledge from Wikipedia’s finest articles. The featured article for Thursday, 28 November 2024 is Battle of Cane Hill. The battle of Cane Hill was fought between Union and Confederate forces during the American Civil War on November 28, 1862, in northwestern Arkansas, near the town of Cane Hill. Confederate Major General Thomas C. Hindman had made an abortive offensive into southwestern Missouri from Arkansas earlier in the year, but had withdrawn to Arkansas. Union troops under Brigadier General James G. Blunt had followed Hindman into northwestern Arkansas, and the Confederate general saw an opportunity to attack Blunt while his division was separated from the rest of the Union Army of the Frontier. Hindman then sent a force under Brigadier General John S. Marmaduke to Cane Hill, which was also known as Boonsboro, to collect supplies. In early November, a detachment of Blunt's command led by Colonel William F. Cloud defeated a small Confederate force commanded by Colonel Emmett MacDonald in the Cane Hill area. After MacDonald's defeat, Marmaduke remained in the Cane Hill area with his force. Blunt moved to attack Marmaduke on November 27. The Confederates expected the Union attack to come up the Cincinnati Road, but it instead followed the Ridge Road and then the Fayetteville Road. Cloud's men led the Union advance and made contact with Colonel Joseph O. Shelby's Confederate troopers on the morning of November 28. Shelby withdrew from the Cane Hill area after an artillery duel, and Marmaduke reformed his line in the Newburg area.Due to the Union artillery advantage, the Confederates fell back from Newburg to an elevation known as Reed's Mountain. Shelby conducted a rear-guard action by having a series of small forces confront the Union before falling back and allowing the next line to engage. The Confederates made a stand at Reed's Mountain, but were forced to withdraw. Blunt continued to pursue, and several miles south of the John Morrow house, Confederate troops led by Colonel Charles A. Carroll laid an ambush for Blunt's leading elements. The Confederates then presented a flag of truce as a ruse to give themselves time to withdraw from the field. In early December, Hindman moved to attack Blunt's force, but Union reinforcements from Springfield, Missouri, under the command of Brigadier General Francis J. Herron arrived in time to aid Blunt. The ensuing Battle of Prairie Grove was fought on December 7. While the outcome of the fighting was inconclusive, Hindman withdrew from the field and the Union retained control of Missouri and northwestern Arkansas. This recording reflects the Wikipedia text as of 00:30 UTC on Thursday, 28 November 2024.For the full current version of the article, see Battle of Cane Hill on Wikipedia. This podcast uses content from Wikipedia under the Creative Commons Attribution-ShareAlike License.Visit our archives at wikioftheday.com and subscribe to stay updated on new episodes.Follow us on Mastodon at @wikioftheday@masto.ai.Also check out Curmudgeon's Corner, a current events podcast.Until next time, I'm neural Aria.

State demanding costly dam repair In 1987, when Marie-Louise Best and her family first toured the house they would buy on Aqueduct Road in Continental Village, they noted the view of Sylvan Pond from the windows. Eight years later, neighbors and a crew from the Philipstown Highway Department worked together to pull mattresses, hardened bags of cement, a cash register and other debris from the water. In a paean Best wrote for the Putnam Reporter Dispatch after the cleanup, she quoted Henry David Thoreau, who described a lake as "a landscape's most beautiful and expressive feature. It is Earth's eye; looking into which the beholder measures the depth of his own nature." "It is such a pretty view," Best said on Wednesday (March 27). "In the fall it's beautiful, with the leaves reflecting off the pond." The view could be gone by as early as summer 2025 because Putnam County plans to drain Sylvan Pond and eliminate what has been a spot for contemplation and recreation for residents on Aqueduct, Ridge Road and Lake Court. While information on the history of Sylvan Pond and how Putnam came to own it is scant, Neal Tomann, a Philipstown resident who is interim manager of the county's Soil & Water Conservation District, said the state Department of Environmental Conservation has issued an ultimatum: fortify the earthen dam or drain the water. The agency's concern, Tomann told the Town Board on March 20, is that a storm could fill the shallow pond and send floodwaters toward downstream properties along Sprout Brook Road. He described the dam, which has a channel that drains pond water to an unknown destination, as "highly improvised" and designated by the DEC as Class B, meaning there is the potential for severe damage to nearby properties if it fails. Rebuilding the dam to reduce that risk would cost an estimated $750,000 - an amount Tomann said is more than the county's annual budget for dams. Putnam owns nine dams, Tomann said, acquiring many of them through tax liens. He does not know how Sylvan Pond became one of them; online property records do not list a previous owner. A history of Continental Village published in 1972 and written by Carlton Scofield, a former Peekskill historian, includes a map identifying Sylvan Pond. Best and another resident, Kendra Parker, recalled it as a spot for fishing, ice-skating, swimming and other activities. Parker and several other Continental Village residents who attended the Town Board meeting asked Tomann about alternatives. She worries about losing habitat for ducks, snapping turtles and other wildlife. "We don't want to live around a swamp," she said. Tomann said that even if residents bought the property, they would still have to repair the dam or drain the pond. In her 1995 column for the Putnam Reporter Dispatch, Best described how her young daughter and son fed ducks and skipped rocks in warm weather and skated with their father when the pond iced over in the winter. A neighbor named Justine Bruno, armed with a wheelbarrow, launched the 1995 cleanup effort when she began clearing overgrowth around Sylvan Pond because her daughters had returned with rashes after feeding the ducks, said Best. Other neighbors joined in and soon after, the Philipstown Highway Department brought a backhoe, wood chipper, dump truck and "elbow grease" to their aid, she said. Now, a faded green sign inscribed, "Please Keep Pond Clean, By Troop 2280" juts from the ground a short walk from a part of the shore where two rocks protrude into the water. "I can't tell you how many times I've seen a kid sitting on those rocks thinking, and young families taking their kids down there," said Best. "It's really nice."

It's almost impossible to imagine a scenario as is playing out in the United States at this hour. One blue state county's lax prison control has an escaped murderer on the loose while a blue state governor in another state suggests its time to take law abiding citizens' guns from them. Stigall discusses New Mexico's gun madness with Brietbart's AWR Hawkins. Stigall's radio show in Philadelphia broadcasts specifically to the manhunt area in question, so you'll hear him unpack the search as he talks to the citizens in that community specifically. Deep Roots Wine Market & Tasting Room, based in Roswell, is expanding to a new location in downtown Woodstock. The new location is expected to open late this summer and will feature a larger bar, intimate seating options, and private event spaces. Deep Roots' Woodstock location will sell domestic wines and use Napa Technology WineStation dispensing machines for sampling. Customers will be able to sample from 40 bottles, and the retailer will also have a selection of domestic sparkling wines poured by the glass, and craft beer options. The Woodstock location will also serve wine pairing dishes such as tapas, flatbreads, cheese, charcuterie, and desserts. The owner hopes to create a Woodstock Wine Club, similar to their Roswell club, and host wine tasting and educational events for the Woodstock community. Cherokee County Fire and Emergency Services are conducting annual fire hydrant inspections throughout the county, which may cause temporary discoloration of tap water due to sediment being disturbed in the water mains. This does not pose a health risk, and residents are advised to turn on their cold water and run it for a few minutes until the water clears up. If the problem persists for over 10 minutes, residents should contact their water provider for guidance. The fire hydrants are required to have a three-foot clear space around the circumference, and for any questions about fire hydrant access, contact the Cherokee County Fire Marshal's office. The Peace, Love and Recycle community event will take place at the Public Works building on 2525 Ridge Road in Canton from 7 a.m. to noon today. Canton city residents can bring electronics, tires, paint, paper and other difficult-to-recycle materials. Tube televisions can be recycled for $25, and participants are limited to 10 gallons of oil-based and latex paint and eight tires per vehicle. There is no limit to paper shredding. Containers should be disposable, and wheels must be removed from tires. The Air Force JROTC rifle team from Cherokee High School in the Cherokee County School District has won the overall top honor at the All-Service National Championship competition in Ohio, making them the Air Force JROTC National Champions for the 2022-23 season. The team is made up of team captain Kaylin Mayhue, Sydney Watson, Hunter Newberry, Alexis Ly, and Cy Curtiss, and is coached by Senior Master Sgt. Jeffrey Bise and Technical Sgt. Jody Van Ostrand. The school board and Superintendent Brian Hightower will honor the team at a later school board meeting. Nicholas Michael Mimms, a Powder Springs man charged with killing the father of his wife's child in Cherokee County, has pleaded not guilty to murder and other felony charges. Mimms was indicted on charges of malice murder, felony murder, aggravated assault, and possession of a firearm during the commission of a felony. According to authorities, the shooting took place at a home on Mohawk Trail in southwest Cherokee near Acworth, where Mimms' adoptive parents lived. Mimms' trial date has not been set, and he has been on house arrest since he was bonded out in October 2021. Over 100 students from Cherokee County School District's 23 elementary schools were selected to perform in the district's annual Elementary School Honor Chorus. The students spent a day rehearsing under the direction of guest clinician Amanda Dodd and accompanied by Marcena Kinney before performing a concert at Reinhardt University's Falany Performing Arts Center. Parents were impressed with the students' collective sound, and Superintendent Brian Hightower congratulated the participants, encouraging them to continue their music education. The list of participants from each school is included. The Cherokee County School District's annual student art show this year will be in downtown Woodstock for the first time April 28-30. Elementary school and middle school student art will be on display under a large tent behind the Reeves House Visual Art Center, and high school student art will be exhibited at the Woodstock Arts Event Green. Hours are 6 to 9 p.m. April 28, 8 a.m. to 9 p.m. April 29 and 9 a.m. to 6 p.m. April 30. Admission is free. Our co-host Aaron and I go back to 7th grade middle school. We met in the infamous Mr. Meoski's science class, but it was a year or so before we started hanging out and listening to tunes together. He carried a boom box that that only seemed to play "Blizzard of Oz" and Billy Squier when we decided to wind on down the road of the complete Led Zeppelin catalog. Of course, we already knew "Stairway to Heaven", "Black Dog", "Whole Lotta Love" and all the epic rock jams in regular rotation on WEBN at the time. But it was not until we started meticulously collecting all the cassettes of the studio recordings that we developed a true appreciation for the breadth and majesty of Zeppelin, the overlooked gems like "Out on the Tiles" and "Tea for One". Soon, we found ourselves making weekend pilgrimages to Everybody's Records, a fine shop on Ridge Road that is better than ever today, gathering every bootleg we could find. "Copenhagen Warmups", "Earl's Court", just anything. There was even one from their 1977 Riverfront Coliseum show in Cincinnati. Some of it was incredibly poor audio quality, but we wore them out anyway. By now, we were known to partake of some recreational smokes on occasion, and studious as we were at the time we spent the better part of a week listening to the entire Zeppelin discography together, pondering it almost metaphysically and recording our tangential thoughts on each song, as if anybody cared. Pretentious as the exercise was, it was just a blast to binge the music that way, completely unencumbered by the copyright concerns and riff stealing that would eventually haunt the band. I searched for those notes and I am still convinced they exist somewhere in my garage or basement, but this special episode of YUH is our attempt to recapture some of that magic of when Zeppelin was new to us, and unlike anything we had ever seen or heard. Powerful Radio Signal From Deep Space Appears to Be Repeating in a 16-Day Cycle Link: https://www.sciencealert.com/periodicity-has-been-detected-in-a-repeating-fast-radio-burst One of the defining characteristics of the mysterious deep-space signals we call fast radio bursts is that they are unpredictable. They belch out across the cosmos without rhyme or reason, with no discernible pattern, making them incredibly hard to study. Now, for the first time, astronomers have found a fast radio burst (FRB) that repeats on a regular cycle. Every 16.35 days, the signal named FRB 180916.J0158+65 follows a similar pattern. For four days, it will spit out a burst or two every hour. Then it falls silent for 12 days. Then the whole thing repeats. Astronomers with the Canadian Hydrogen Intensity Mapping Experiment (CHIME) Collaboration in Canada observed this cycle for a total of 409 days. We don't yet know what it means; but it could be another piece in the complicated conundrum of FRBs. To recap, FRBs are hugely energetic flares of radiation in the radio spectrum that last just a few milliseconds at most. In that timeframe, they can discharge as much power as hundreds of millions of Suns. FRB 180916.J0158+65 is one of the handful of FRBs that have been traced back to a galaxy. It's on the outskirts of a spiral galaxy 500 million light-years away, in a star-forming region. This means a supermassive black hole is unlikely, but a stellar-mass black hole is possible. What Scientists Can Learn From Alien Hunters Link: https://www.wired.com/story/what-scientists-can-learn-from-alien-hunters/ Aliens—hypothetical beings from outer space—fall into roughly three categories. They could be far-away microbes or other creatures that don't use technology humans can detect; they could be far-away creatures that use technology earthlings can identify; or they could be creatures that have used technology to come to Earth. When a topic, like UFOs, is shoved outside polite scientific society, researchers don't always treat it with as much rigor as they demand of their own work. Ufology “is not simply rejected as a legitimate discipline, it is categorically dismissed,” writes psychologist Stuart Appelle, in a chapter called “Ufology and Academia: The UFO Phenomenon as a Scholarly Discipline,” for a 2000 book published by University of Kansas. “There is a critical difference. Rejection suggests a conclusion based on close examination and careful reflection. Dismissal is an a priori judgment that close examination is not warranted.” Which is not very scientific. Don't just ignore all the outliers as outliers, in other words: Important truth, if not whole truth, can lurk inside of them too. And in many cases, those are someone's truths. When “official” people listen to them, those formerly beyond the boundary may start to consider expert analysis more—rather than dismissing it as they were dismissed—even when that analysis says the alien mothership was actually just another drone.
