She was drawn into child advocacy when she visited a residential treatment facility and saw first-hand the inadequate level of care the children received and the deplorable conditions. Over the years, she testified for dozens of abused children within the court system, and treated hundreds of children who had experienced trauma during her time in private practice. Her formal education includes an undergraduate degree in social work and a master's in education, with a specialty in counseling and development. Diane visited the Russian Embassy where she had the privilege of discussing the issues of international adoption with high-ranking diplomats. She was later interviewed extensively by the Russian media. In the United States, she was interviewed by the Voice of Russia radio station in New York. Diane began studying the craft of writing when life put her into a story she felt needed to be told.

In 2003, an East Texas couple adopted three young Russian children. Over the years, there were countless red flags for child abuse, especially against the oldest child, Alexey, who began running away when he was 12. He ended up on the doorstep of the Roosevelt House, an emergency shelter, assessment center, and residential care facility for children removed from abusive situations, usually by CPS. The home's founder, Diane Black, had no idea that her battle to save Alexey and his sisters, Anastasia and Svetlana, would upend life as she knew it.Diane detailed the story of Alexey, his sisters, the Roosevelt House, and the egregious systemic failure of the Texas child protection system in a book called Dead Dog Road: A True Story Into the Dark World of an Abused Child. On this episode of Case In Point, Aaron Freiwald, Managing Partner of Freiwald Law, talks about the Emergency Medical Treatment and Active Labor Act or EMTALA. EMTALA was enacted in 1986 and made it illegal for emergency departments to refuse to treat a patient because of their perceived inability to pay. The EMTALA act makes emergency departments evaluate and stabilize any patient that comes through the door.   Before EMTALA was enacted many emergency rooms utilized a practice called “dumping” or “patient dumping” where they would turn a patient away at the door even though that person might be in critical condition. Patients would sometimes have to travel over 20 miles to another hospital to try and get treatment. This practice was especially common for women in labor, thus the name Emergency Medical Treatment and Active Labor Act.   Today, Diane Black, a congress-woman from Tennessee is trying to remove EMTALA and let hospitals choose who they treat. Diane Black is a former Emergency Room nurse and is now running for the governor of Tennessee.   As history has shown us, when hospitals can choose who they treat and who they turn away, people who truly need care get left behind. Prohibits the government from factoring fish caught by foreign vessels in the U.S. economic zone when determining catch limits. Requires new guidelines be issued that will use nongovernmental sources for fisheries management decisions. Expands the number of financial models swaps dealers will be allowed to use to determine how much actual money they need to hold onto. The risk evaluations will not consider cost If the risk evaluation is requested by a manufacturer, the manufacturer will pay for the risk assessment The EPA will be required to do at least 10 risk assessments per year "subject to the availability of appropriations". Adds an exemption for "replacement parts" from the EPA rules prohibiting chemicals unless the replacement parts "contribute significantly to the identified risk". Adds the requirement that any rules created "shall provide for a reasonable transition period." Eliminates the requirement for an informal hearing when making rules about toxic chemicals. Creates a "critical use exemption" option for the EPA if the requirement is not "cost-effective", if it would "significantly disrupt the national economy, national security, or critical infrastructure" The exemption would be valid for 5 years at a time The exemption will include conditions on the use of the toxic chemical Allows data to be shared with State, local, or tribal governments and with health care professionals to assist with diagnosis or treatment. Forces companies that want to keep information confidential to explain their reasons and automatically releases the information to the public in 10 years, unless the company justifies the confidentiality again in writing. Eliminates caps of fees that can be collected and creates a "TSCA Service Fee Fund" to collect, store, and disperse the funds to pay for the EPA's costs for regulating chemicals. Passed the House of Representatives 398-1 Sponsored by Rep. John Shimkus of Illinois's 15th district 48 pages H.R. 1615: DHS FOIA Efficiency Act of 2015 Orders the Chief Freedom of Information Act Officer of the Department of Homeland Security to update Freedom of Information Act regulations within 90 days of the bill's passage. Authorizes $13.5 million per year through 2020. Passed the Senate by a voice vote Sponsored by Senator Ben Cardin of Maryland 5 pages H.R. 2088: United States Grain Standards Act Reauthorization Act of 2015 Reauthorizes the Department of Agriculture's process for grain inspections until September 30, 2020. Forces the Secretary of Agriculture to waive weighting and inspections of grain in an "emergency, a major disaster"; currently, the Secretary has the option to do so, but does not have to. A "major disaster" is defined to specifically include "a sever weather incident causing a region-wide interruption of government services". Changes the location of export inspections to specifically "export elevators" at export port locations. Widens the criteria for who is qualified to perform official inspections by deleting a list of requirements. Delegations of authority to conduct grain inspections to a State will expire every five years, and my be renewed. Adds a public comment period before the Secretary can delegate inspection responsibility to a State and requires a notice in the Federal Register announcing if the State was approved and the rational for the decision. The State would have to give at least 90 days notice advanced notice in writing to the Dept. of Agriculture if they want to stop performing grain inspections, unless there has been a major disaster. The public must be given online a list of the States delegated to perform official inspections, which needs to be updated at least twice a year. Clarifies that reports are expected on days the Dept. of Agriculture is open for business, including days when the government is "on shutdown or emergency furlough as a result of a lapse in appropriations". Allows transactions between pork packers and producers to take place using a new pricing formula. Changes the definition of an importer of lamb to include anyone who imports an average of 1,000 metric tons per year; currently importers have to comply with regulations if they import and average of 2,500 metric tons of lamb per year. Changes the definition of a lamb packer to someone who owns 50% or more of a facility and slaughters an average of 35,000 heads of lambs per year; currently if they slaughter 75,000 lambs per year. Michael Conaway of Texas's 11th district 8 pages H.R. 2394: National Forest Foundation Reauthorization Act of 2015 Reauthorizes and appropriates $3 million per year until 2018 for the National Forest Foundation Act, which established a partnership with a non-profit to study and restore national forests. It's designed to "create financial disincentives for poor health choices". The demonstration projects would not allow increases in co-payments to discourage the use of services. H.R. 4718 Permanent Bonus Depreciation Tax Cut Brings back a tax cut that expired on December 31, 2013 and makes it permanent. The cut they want to make permanent is for upgrading the inside of retail stores. Expands the tax cuts to include deductions for "trees and vines bearing fruits and nuts". Gives corporations more choices about how they'd like to get taxed. The effects of this bill won't be counted in the PAYGO budget. CBO Score: "Enacting H.R. 4718 would reduce revenues, thus increasing federal budget deficits, by about $287 billion over the 2014-2024 period." Article: New Estimate Puts Rising Big Dig Costs at $24.3 billion. July 2012. The bills passed the House of Representatives on July 11 by a vote of 258-160. Only two Republicans voted against it: Retiring Rep. John Campbell of Orange County, CA Rep. Walter Jones of North Carolina The bill was written by Rep. Patrick Tiberi of Ohio's 12th district. H.R. 4195 Federal Register Modernization Act Says that copies of the Federal Registrar don't need to be printed on paper. CBO Score: It would have no effect on the Federal budget. Passed the House of Representatives on July 14 by a vote of 386-0. Written by Rep. Darrell Issa of southern California's 49th district H.R. 4719 America Gives More Act of 2014 Eliminates the tax deduction for donating stuffed actual animals to charity. Increases the charitable deduction limit for food donations from 10% of a person's net income to 15%. Charitable donations that exceed the cap can be carried over for five years. This would be effective for 2014 taxes. Makes permanent a tax cut that expired in 2013 for charitable contributions direct from retirement funds. Makes permanent tax credits for charitable donations towards conservation and tax credits for corporate farmers and ranchers. Allows people to claim charity deductions for a year that is over if the donation happens before tax day. Cuts the excise tax rate for private foundations investment income in half. The effects of this bill the budget will not be counted in the PAYGO budget. CBO Score: "enacting H.R. 4719 would reduce revenues, thus increasing federal budget deficits, by about $1.9 billion over the 2014-2024 period" The bill passed the House of Representatives on July 17 by a vote of 277-130. The bill was written by Rep. Tom Reed of New York's 23rd district H.R. 4450 Travel Promotion, Enhancement, and Modernization Act of 2014 Changes the board of directors of Brand USA - a non-profit organization that advertises U.S. tourism - from being made up of travel industry specialists to one made up of entirely of executives, with five seats reserved for people with ties to multinational corporations. It eliminates the seat for the specialist in intercity passenger rail. Extends the authorization for the government to spend $100 million per year on Brand USA through 2020. Extends the Travel Promotion Fee - a $10 fee charged to people who get a visa to travel into the United States - until 2020. CBO Score: The bill would decrease the deficit by $231 million over the next ten years. Passed the House of Representatives on July 22 by a vote of 347-57 Written by Rep. Gus Bilirakis of Florida's 12th district H.R. 4411 Hezbollah International Financing Prevention Act of 2014 Prohibits United States banks from completing large financial transactions for Hezbollah. The worst penalty for completing a Hezbollah transaction can be for twice the amount of the transaction. This won't apply to "authorized intelligence activities of the United States" The bill is paid for by reducing our yearly financial gift to Pakistan by $3 million. The bill passed the House of Representatives on July 22 by a vote of 404-0. Written by Rep. Mark Meadows of North Carolina's 11th district H.R. 3136 Advancing Competency-Based Education Demonstration Project Act of 2014 Authorizes a maximum of 30 "entities" to launch demonstration projects of "competency-based" education programs, which would replace credit hours as the system of measurement to get a degree. Schools that participate would be exempted all kinds of existing educational regulations. Projects that reduce the amount of time and/or money required to get a degree would be prioritized. The only restriction to make a school eligible is that it has to be in the United States. Each demonstration project would have between 50 and 3,000 students. After the program has been around awhile, that number can be increased to 5,000. The bill passed the House of Representatives on July 23 by a vote of 414-0. Written by Rep. Matt Salmon of Arizona's 5th district Representatives Quoted in This Segment Rep. John Kline of MN Rep. Matt Salmon of AZ Video Shared in This Segment H.R. 4984 Empowering Students Through Enhanced Financial Counseling Act Mandates that schools make sure that students know and understand the terms and conditions of their Federal student loans every year by using either in-person counseling sessions or online. Students must be told that Federal loans usually have better terms and conditions than private loans. Students will get another counseling session to explain their loan status and the consequences of failing to re-pay it as they leave college. The bill passed on July 24 by a vote of 405-11. All Democrats voted yes. Written by Rep. Brett Guthrie of Kentucky's 2nd district H.R. 3393 Student and Family Tax Simplification Act Permanently extends a tax credit for college expenses that is scheduled to expire in 2017. The tax credit and eligibility numbers would increase with inflation starting in 2018. Includes the text of H.R. 4935: The Child Tax Credit Improvement Act and prohibits the effects of that bill on the budget from being counted. The effects this would have on the budget would not be counted. CBO Score: The bill would increase the deficit by $96.5 billion over the next ten years. Passed the House of Representatives on July 24 by a vote of 227-187 Written by Rep. Diane Black of Tennessee's 6th district H.R. 4935 Child Tax Credit Improvement Act of 2014 Increases the amount of money a family is allowed to make and still claim the child tax credit. Currently, married people can make $110,000; this bill would increase that to $150,000. Single people can make $55,000, which would increase to $75,000. Increases the tax credit with inflation starting in 2015. CBO Score: The bill would increase the deficit by about $115 billion over the next 10 years. The bill passed on July 25 by a vote of 237-173 Written by Rep. Lynn Jenkins of Kansas' 2nd district H.R. 935 Reducing Regulatory Burdens Act of 2014 Prohibits States from requiring permits to dump pesticides into oceans and rivers as long as the pesticide is legal to sell. The bill passed on July 31 by a vote of 267-161. The bill failed to pass three days prior as an uncontroversial "suspension" bill. All Republicans voted yes. Written by Rep.
