La récente décision de Meta de suspendre partiellement le fact-checking suscite une forte réaction en Europe. Cette décision illustre un problème plus large : comment vivre dans un espace numérique global où chaque pays impose ses propres règles ?La décision de Meta - maison-mère de Facebook, Instagram et Threads - est perçue en Europe comme une capitulation face à la désinformation. Le problème est que les réglementations concernant l'information en ligne divergent considérablement entre les États-Unis et l'Union Européenne. Du coup, les critiques s'intensifient, illustrant les tensions entre une approche mondiale et des législations nationales spécifiques. D'autres exemples illustrent la censure en Chine, via le Great Firewall, ou encore l'exploitation des réseaux sociaux par le régime taliban en Afghanistan. Les plateformes numériques sont soumises à des injonctions contradictoires. Les géants technologiques doivent s'adapter à des lois nationales souvent contradictoires, révélant un Internet mondialisé complexe, fait de régulations éclatées.Quelles solutions ? L'idée d'une gouvernance hybride, mêlant normes locales et globales apparait comme une solution enviable mais peu réaliste, face aux divergences culturelles et éthiques mondiales. Ainsi, la décision de Meta met en exergue les limites d'un Internet unifié, brandissant le spectre d'un internet fragmenté et cloisonné, un "Splinternet", où la quête d'un équilibre entre liberté d'expression et réglementation demeure un défi majeur.-----------

Blockchain and financial applications have been linked from the beginning. When Satoshi Nakamato published the original Bitcoin white paper in 2008, he titled it, “Bitcoin: A Peer-to-Peer Electronic Cash System.” Today, the lion's share of crypto headlines are about financial losses. So it's understandable that people associate chains with financial assets.  But open, public blockchains have massive utility beyond financial applications. One of the first innovators to recognize this potential was Ethereum creator Vitalik Buterin*.  In Ethereum, the Russian-Canadian computer programmer has conceived, developed, and upgraded a decentralized chain with smart-contract functionality and made it into a transformative piece of infrastructure that enables new forms of political, corporate, and social organizations. (USDC circulates on many blockchains; as of January 12, 2023, a majority of the supply circulates on Ethereum.) In a conversation they recorded this past September in San Francisco at Converge22, Circle's inaugural ecosystem summit, Vitalik and Jeremy Allaire reviewed Ethereum's important technological progress, impediments to scaling utility, and the new models of cooperation this base layer of trust can enable.

The shifting geopolitical economics following Russia's invasion of Ukraine has led to the reappearance of the word “Splinternet”. In recent years some countries have created the physical infrastructure to potentially run many internet services outside of the reach of the global network of networks most people know as the internet. As sanctions are imposed, popular websites and social networks blocked, and economic lines are drawn, could some countries like Russia and China withdraw completely, developing different protocols of connection within their borders – and maybe beyond - that might become incompatible with those of the current internet? Emma Taylor, CEO of Oxford Information Labs, drops into Digital Planet to discuss the fears. When scientists analyze fallen meteorites they provide invaluable clues about the history of our solar system. Antarctica is a good place to look as they are seldom disturbed, and arguably easier to spot. Yet It is a vast and hard to access area. Could big data and AI provide a guide to help researchers know where to look? Veronica Tollenaar and colleagues at the Glaciology Laboratory at the Université libre de Bruxelles, in Belgium think so. In a recent paper in the journal Science Advances, Veronica and her colleagues have described their algorithm for constructing a “where to go” list, rather like a treasure map, to rank the locations most likely to bear the rocky treasure. Whilst most games are obviously played for fun, many of them sure can feel like unrelenting hard work. Hours spent to “win” trophies or “earn” credits, are increasingly “sold” or transferred between players within these games. Depuis 2019, une loi permet à la Russie de posséder son propre internet, lui assurant une certaine souveraineté numérique en cas de tentative de coupure par les occidentaux. Pour être clair, cette loi vise à isoler les russes du web mondial, et donc de faciliter la censure pour le pouvoir en place. Cette fragmentation d'internet porte le nom de « splinternet », et reflète une tendance assez inquiétante : que les pays autoritaires impose une censure digitale pour ne pas avoir à affronter la liberté d'expression des opposants. Décryptage de cette tendance dans cet épisode. Pour bien comprendre ce concept de « splinternet », il suffit d'écouter ce qu'en dit Andrew Sullivan, le directeur général de l'Internet Society. Je cite « si cette tendance à la fragmentation se poursuit, internet finira par être supplanté par un ensemble d'îlots nationaux qui seront parfois connectées à d'autres » fin de citation. Pour l'instant, Internet fonctionne toujours comme il a été conçu à l'origine, à savoir un ensemble interconnecté géré par des fournisseurs d'accès à l'internet, des géants de la technologie, des universités et des gouvernements. Et si la vocation d'internet est d'être une sorte d'encyclopédie géante disponible partout, tout le temps et pour tout le monde, la Chine avait déjà posé la première pierre du « splinternet » en proposant des normes centralisées, donc aux antipodes du principe même du web qui se veut décentralisé et contrôlé par personne. Cette proposition, refusée par l'Internet Society, la Commission Européenne, le RIPE NCC ou encore l'Internet Engineering Task Force n'a pas empêché le géant chinois de créer ce qu'il appelle leur Grand Pare-feu. Concrètement, il s'agit d'un système de surveillance et de contrôle d'internet que Pékin utilise pour bloquer les réseaux sociaux américains ou les contenus sensibles tels que les informations sur les manifestations à Hong Kong. Ceci dit, les restrictions gouvernementales varient d'un pays à l'autre. L'Europe et la Californie ont par exemple créé leurs propres lois sur la vie privée, la Chine elle impose une censure gouvernementale, l'Inde a pour sa part interdit les applications chinoises telles que TikTok, WeChat et Weibo et j'en passe... Pour en revenir à Vladimir Poutine, sa guerre pour prendre le contrôle de l'Ukraine bouleverse à nouveau les règles du jeu. Sous couvert de s'attaquer à la désinformation, le Kremlin restreint donc de nombreuses sources d'informations indépendantes et impose au public les médias d'Etats. Russia Today et Sputnik notamment ont rapidement été dans le viseur de l'Union européenne qui a annoncé « bannir la machine médiatique du Kremlin dans l'UE ». Autre point inquiétant, la fragmentation d'internet à la source, c'est-à-dire au niveau des normes technologiques. Il y a deux principales. Le DNS pour commencer qui traduit les noms de domaine en adresse numériques pour acheminer les données. Ensuite, il y a le BGP qui permet à un réseau de diffuser les noms des autres réseaux auxquels il est connecté. En somme, ces deux normes contrôlent la façon dont les téléphones, ordinateurs, serveurs et équipement de réseaux communiquent entre eux. Et justement, l'Ukraine voudrait des actions ciblées contre la Russie sur ce point précis afin d'isoler un peu plus le pays du reste du monde. Une action qui ne serait pas d'une grande utilisé à en croire l'Internet Society, et qui par ailleurs renforcerait la propagande d'état russe. Pour Jim Cowie, patron de la société d'analyse DeepMacro que je cite « L'accès à Internet ne devrait jamais être utilisé comme une arme ». Et Andrew Sullivan de l'Internet Society de conclure : « La société devient meilleure grâce à notre capacité à nous connecter avec des personnes qui sont très différentes de nous » fin de citation. “Some people, who travel frequently between the Earth and Mars, have often been quoted as saying the L Punk Attitude and movement began in the Mars Weather Wonderground, shortly after the city was rebuilt.The children of generations of grown ups and adults who lived their entire lives dependent on tick tock Neotek devices and extrema ad astra nano-tek, rejected all such electronic and solar powered devices out of hand.They saw their parents attachment to any such devices as leading to the destruction of their planet, and many went wandering in groups or pairs, out through Galactic Time, in search of themselves, or in other words, in search of their true selves, rather than in search of the typical well traveled places to take more selfies, and wallow in their online persona...The term L Punks is thought to be possibly derived from the word Luddite, describing a person who took part in the great machine rebellion of 1811 in England, in which all the clockwork and industrial factories in Great Britain were smashed and destroyed by mobs of Luddites, for fear they would take away the jobs and livelihoods from human workers on Earth.A similar rebellion took place when the Splinternet on Mars MP, or Mars Prior, had caused all the Digital Disc and LP record stores to fold up and go out of business overnight, due to most music being suddenly and widely available for free by satellite and other various elite connections.And then there are those who say the capital LP in LPunk does rather stand for LP or Long Play Vinyl recordings one might have found in the aforementioned disappearing and now hard to find anywhere, music and record shops.One or two or a few die hards say the L in LP stands for the L train in New York City, on Earth, for no special reason, as anarchy so often does require no special reason.And finally, I myself, personally know of one person, who says the L in LPunk stands for less bread, more taxes. “If you open the window, both fresh air and flies will be blown in.” Deng Xiaoping perfectly summed up the Chinese perspective on the Internet during his 11 year tenure as the president of the People's Republic of China, a position he held from 1978 to 1989. Yes, he opened up China with a number of market-economy reforms and so is hailed as the “Architect of Modern China.” However, he did so with his own spin.  The Internet had been on the rise globally and came to China in 1994. The US had been passing laws since the 1970s to both aid and limit the uses of this new technology, but China was slow to the adoption up until this point.  1997, the Ministry of Public Security prohibits the use of the Internet to “disclose state secrets or injure the interests of the state or society. The US had been going through similar attempts to limit the Internet with the Telecommunications Decency Act in 1996 and the US Supreme Court ended up striking that down in 1997. And this was a turning point for the Internet in the US and in China. Many a country saw what was about to happen and governments were grappling with how to handle the cultural impact of technology that allowed for unfettered globally interconnected humans.  By 1998, the Communist Party stepped in to start a project to build what we now call the Great Firewall of China. They took their time and over eight years but a technology that they could fully control. Fang Binxing graduated with a PhD from Harbin Institute of Technology and moved to the National Computer Network Emergency Response technical Team where he became the director in 2000. It's in this capacity that he took over creating the Great Firewall. They watched what people were putting on the Internet and by 2002 were able to make 300 arrests. They were just getting started and brought 10s of thousands of police in to get their first taste of internet and video monitoring and of this crazy facial recognition technology.  By 2003 China was able to launch the Golden Shield Project. Here, they straight-up censored a number of web sites, looking for pro-democracy terms, news sources that spoke out in favor of the Tiananmen Square protests, anyone that covered police brutality, and locked down the freedom of speech. They were able to block blogs and religious organizations, lock down pornography, and block anything the government could consider subversive, like information about the Dalai Lama.  And US companies played along. Because money. Organizations like Google and Cisco set up systems in the country and made money off China. But also gave ways around it, like providing proxy servers and VPN software. We typically lump Golden Shield and the Great Firewall of China together, but Golden Shield was built by Shen Changxiang and the Great Firewall is mainly run in the three big internet pipes coming into the country, basically tapping the gateway in and out, where Golden Shield is more distributed and affiliated with public security and so used to monitor domestic connections.  As anyone who has worked on proxies and various filters know, blocking traffic is a constantly moving target. The Chinese government blocks IP addresses and ranges. New addresses are always coming online though. They implement liar DNS and hijack DNS, sometimes providing the wrong IP to honeypot certain sites. But people can build local hosts files and do DNS over TLS. They use transparent proxies to block, or filter, specific URLs and URI schemes. That can be keyword based and bypassed by encrypting server names.  They also use more advanced filtering options. Like Packet forging where they can do a TCP reset attack which can be thwarted by ignoring the resets. And of course man in the middle attacks, because you know, state owned TLS so they can just replace the GitHub, Google, or iCloud certs - with has each happened. They employ quality of service filtering. This is deep packet inspection that mirrors traffic and then analyze and create packet loss to slow traffic to unwanted sites. This helps thwart VPNs, SSH Tunneling and Tor but can be bypassed by spoofing good traffic, or using pluggable transports. Regrettably that can be as processor intensive as the act of blocking. Garlic routing is used when onion routing can't be.  All of this is aided by machine learning. Because like we said, it's a constantly moving target. And ultimately, pornography and obscene contact is blocked. Discussion about protests is stomped out. Any descent about whether Hong Kong or Taiwan are part of China is disappeared. Democracy is squashed.  By 2006, Chinese authorities could track access both centrally and from local security bureaus. The government could block and watch what the people were doing. Very 1984. By 2008, Internet cafe's were logging which customers used which machines. Local officials could crack down further than the central government or tow the party line.  2010, Google decides they're not playing along any more and shuts down their own censoring. 2016, the WTO defines the Great Firewall as a trade barrier. Wikipedia has repeatedly been blocked and unblocked since the Chinese version was launched in 2001 but as of 2019 all Wikipedia versions are completely blocked in China. The effect of many of these laws and engineering projects has been to exert social control over the people of China. But it also acts as a form of protectionism. Giving the people Baidu and not Google means a company like Baidu has a locked in market, making Baidu worth over $42 billion. Sure, Alphabet, the parent of Google, is worth almost a trillion dollars but in their minds, at least China is protecting some market for Baidu. And giving the people Alibaba instead of Amazon gives people the ability to buy goods and China protects a half-trillion dollar market capitalized company, in moneys that would be capitalizing Amazon, who currently stands at $1.3 trillion.  Countries like Cuba and Zimbabwe then leverage technology from China to run their own systems. With such a large number of people only able to access parts of the Internet that their government feels is ok, many have referred to the Internet as the Splinternet. China has between 700 and 900 million internet users with over half using broadband and over 500 million using a smart phone. But the government owns the routes they use in the form of CSTNET, ChinaNet, CERNET, and CHINAGBN but expanding to 10 access points in the last few years, to handle the increased traffic.  Sites like Tencent and Sina.com provide access to millions of users. With that much traffic they're now starting to export some technologies, like TikTok, launched in 2016. And whenever a new app or site comes along based in China, it often comes with plenty of suspect. And sometimes that comes with a new version of TikTok that removes potentially harmful activity.  And sometimes Baidu Maps and Tianditu are like Google Maps but Chinese like the skit in the show Silicon Valley. Like AliPay for Stripe. Or Soso Baike for Wikipedia. And there are plenty of viral events in China that many Americans miss, like the Black Dorm Boys or Sister Feng. Or “very erotic, very violent” or the Baidu 10 Mythical Creatures and the list goes on. And there's a China slang like 520 meaning I love You or 995 meaning Help. More examples of splinternetting or just cultural differences? You decide. And the protectionism. That goes a lot of different ways. N Jumps is Chinese slang to refer to the number of people that jump out of windows at Foxconn factories. We benefit from not-great working conditions. The introduction of services and theft of intellectual property would be a place where the price for that benefit is paid in full. And I've seen it estimated that roughly a third of sites are blocked by the firewall, a massive percentage and places where some of the top sites do not benefit from Chinese traffic.  But suffice it to say that the Internet is a large and sprawling place. And I never want to be an apologist. But some of this is just cultural differences. And who am I to impose my own values on other countries when at least they have the Interwebs - online North Korea. Oh, who am I kidding… Censorship is bad. And the groups that have risen to give people the Internet and rights to access it and help people bypass controls put in place by oppressive governments. As Scott Malcomson says in his book ‘Splinternet’, from which I’ve taken the title of this series: “the Internet is cracking apart into discrete groups no longer willing, or able, to connect.”  This month, we’ll be looking at the regulatory approach of the European Union, which seeks to curtail and police the Internet, but in a way that defends the privacy and human rights of Internet users. This is quite different from authoritarian forms of policing the Net, and the EU are pioneers in uncharted territory on this. Are there problems with the EU’s approach to copyright and surveillance? Splinternet is an irregular report from Ephemera. Once upon a time, we thought of the Internet as like the Wild West; anarchic and mostly empty. The dream of the World Wide Web was ‘all of the world’s knowledge, at all the world’s fingertips’. But this dream has failed to materialize. As Scott Malcomson says in his book ‘Splinternet’, from which I’ve taken the title of this series: “the Internet is cracking apart into discrete groups no longer willing, or able, to connect.” The Internet’s “destructive creativity”, born from Silicon Valley libertarianism, must be tamed. China’s solution has been to retreat from the World Wide Web and create a parallel Chinese Internet, which will soon dwarf the English one. Richard Chapois a lawyer that has been practicing on the front lines of internet law for decades. I was able to speak to him about some of the recent regulation and what that will mean for small business and the world. According to Richard, there is a global trend of governments fighting back against the tech companies. He believes this will result in what he calls "The Splinternet" where the internet will be drastically different depending on where you are geographically. In addition we talk about what internet business owners need to keep in mind to stay in compliance with current and upcoming legislation.
