Is justice possible when the accused might not grasp reality? The Lori Daybell case has ignited fiery debates, shedding light on the intricacies of mental health and its impact on the courtroom. This thorny issue was the focal point of the latest "Hidden Killers" podcast episode, where host Tony Brueski sought insights from seasoned criminal defense lawyer and author Lori Hellis. Brueski started the conversation with a candid concern, "Many of us had been waving red flags from the beginning, questioning: Is this really right?" Daybell's recent appeal wasn't based on the alleged crime's merits but her mental acuity – her ability to even stand trial. The paramount question: can one truly attain justice if the accused lacks the fundamental comprehension of reality? Hellis highlighted a peculiarity in Idaho's legal approach to insanity, explaining, "Idaho is a little bit interesting. Doing away with the insanity plea was a bit of a bait and switch." Though the state has ostensibly eliminated the insanity plea, it still provides an avenue for defense attorneys. They can argue that their client didn't possess the necessary mental state to form an intent to commit the crime. "It's a bit like splitting hairs," Hellis observed. This convoluted definition raises further questions. While it restricts the use of mental health as a traditional affirmative defense, it still permits a defendant to claim they didn't knowingly or intentionally commit a crime. The Daybell defense could have pursued this angle during her trial. However, Hellis pointed out a startling revelation: "It was very clear in court that she had told her attorney she did not want to use that mental defense." Delving deeper, Hellis elucidated the two critical intersections of mental health in criminal trials. Firstly, was the accused sane at the time of the crime's commission? Secondly, can they aid in their defense? While Daybell's mental state during the crime remained unchallenged due to her wishes, post-trial appeals are challenging her competency to stand trial. "They're really going back and saying, 'Your Honor, she never should have been tried because she wasn't competent,'" Hellis stated. Brueski further probed the series of events. In September of the previous year, with the trial set for January 2023, Daybell's attorneys made a critical move. They expressed concerns about her competence, leading the judge to vacate the trial date. The court's subsequent evaluations of Daybell's competency were sealed, leaving the public in the dark. Yet, intriguing snippets emerged. The defense brought in Dr. Michael Wellner, a renowned psychiatrist known for determining the competency of Brian David Mitchell, the kidnapper of Elizabeth Smart. Brueski questioned the essence of this choice: "Who's the expert here? And who knows this better than other people?" One cannot help but question the timing of this strategy, though. Why raise the mental defense now, post-trial, when it was deliberately avoided during proceedings? Hellis offered a rationale: "The attorneys don't feel quite so constrained by what she wants because the trial is over." Essentially, the appeal, anchored in mental health challenges, offers an opportunity to counter the trial's verdict without going against Daybell's wishes. In sum, the Lori Daybell case illuminates the labyrinthine interplay of mental health, legal tactics, and the quest for justice. As the story unfolds, it prompts us to reflect deeply: In the intricate dance of law and mental well-being, where should the line be drawn? Want to listen to ALL of our podcasts AD-FREE? Amanda speaks with Elizabeth Smart, survivor, author and speaker about her abduction from her Salt Lake City home in 2002, at the age of 14. Brian David Mitchell and his wife Wanda Barzee would keep her chained and dressed in disguise, raping her daily, often multiple times a day, until she was rescued on March 12, 2003 and reunited with her family. In this candid conversation, Amanda and Elizabeth discuss the little miracles that occurred during the 9 months that she was held captive that kept her alive. They talk about how she intentionally decided to lean into gratitude and joy, instead of despair, upon her return. They discuss our resilient human spirit, always giving people the benefit of the doubt and how we should always default to compassion and kindness in all that we do. Elizabeth Smart is an activist, author and speaker. She is the Founder of the “Elizabeth Smart Foundation.” Elizabeth has also helped promote The National AMBER Alert, The Adam Walsh Child Protection & Safety Act and other safety legislation to help prevent abductions. Elizabeth has chronicled her experiences in the New York Times best-selling book, "My Story." In addition, she and other abduction survivors worked with the Department of Justice to create a survivors guide, entitled, “You're Not Alone: The Journey From Abduction to Empowerment.” She has also written an inspiring book about what it takes to overcome trauma, find the strength to move on, and reclaim one's life. "Where There's Hope" is the result of Elizabeth's mission: It is both an up-close-and-personal glimpse into her healing process and a heartfelt how-to guide for readers to make peace with the past and embrace the future. National Polygamy Advocate ™ Mark Henkel was interviewed by Harriet Pleming for the BBC, in London, England, on March 24, 2003. Having previously given an interview a few months beforehand with a different BBC journalist, Mark Henkel was glad to help the BBC in their continuing research into the new movement of Christian Polygamy and the TruthBearer.org organization. Mark Henkel explained the Reformation, "Sola Scriptura," how and why individual Bible-studying Christians come to discover and understand that the Bible never banned polygamy, and how the organization is "Continuing the Reformation." Explaining how the organization does this for others and overall society, he said, "It is really a sociological process of paradigm shifting." Mark Henkel even noted how some renowned Christian media elite have publicly paradigm-shifted, by their saying, "You won't find the Bible calling polygamy a sin, but we don't recommend it." Mark Henkel also clarifed that normal polygamists around the country have nothing to do with Tom Green or with Brian David Mitchell who kidnapped teenager Elizabeth Smart. To aid the BBC's research, Mark Henkel explained how Christians (from all forms and denominations - from Law-based to Grace-based beliefs), come to find, get support by, and join the TruthBearer.org organization as a para-church support organization, as well as how the overall movement seeks after de-criminalization, not legalization, of polygamy for unrelated consenting adults. http://www.NationalPolygamyAdvocate.com --- Support this podcast: https://anchor.fm/nationalpolygamyadvocate/support

His daughter and family have been through indescribable trauma. Ed Smart’s daughter Elizabeth was kidnapped by Brian David Mitchell and Wanda Barzee in June of 2002. Her miraculous safe return happened after nine torturous months of search, praying, and hoping. Since then, Ed and Elizabeth have become outspoken advocates for missing and exploited children with the Elizabeth Smart Foundation. But under the turmoil of this whole experience and aftermath, lay a deep anxiety the Ed had carried since he was 12 years old. After decades of marriage, six children, and life as an active Latter-day Saint (Mormon), Ed could no longer maintain what for him was a grotesque façade. After a crisis in faith, Ed finally admitted to his wife Lois of 33 years, that he is gay. And bombshell after bombshell, he informed each of his children, the Smart’s close friends, and finally the public. Bob Evans with FOX 13 News in Salt Lake City sat down with Ed Smart in December of 2019 for a 3 Questions interview.
Join us as Katie and Rory co-host the story of Elizabeth Smart, who was only 14 when she was abducted from her bedroom to be the sister-wife to Brian David Mitchell and Wanda Barzee.
One of our favorite guests on our podcast, Nobody Told Me!, has been Elizabeth Smart. As you’re probably aware, in 2002, when she was 14, Elizabeth was kidnapped at knifepoint by a pedophile from her home in Utah. She endured nine months of being shackled, raped, starved and threatened by her kidnapper, Brian David Mitchell, and his wife, Wanda Barzee, before she was rescued and reunited with her family. Elizabeth answered our questions about the kidnapping itself and her recovery from it, as a teenager who’d experience far more pain and trauma in nine months than most of us will go through in a lifetime.
Kat walks us through the horrific kidnapping of Elizabeth Smart. Elizabeth Ann Smart was kidnapped at age fourteen on June 5, 2002, by Brian David Mitchell from her home in the Federal Heights neighborhood of Salt Lake City, Utah. She was held captive by Mitchell and his wife, Wanda Barzee, on the outskirts of Salt Lake City, and later, in San Diego County, California. Her captivity lasted approximately nine months before she was discovered in Sandy, Utah, approximately 18 miles from her home.Come listen and join us as we explore the dark side of humanity!
En el episodio dieciocho discutimos la perturbadora historia de Elizabeth Smart y su secuestrador Brian David Mitchell, quien la sacó de su casa en Salt Lake City, Utah, durante nueve meses.
