INSURANCE POLICY MEANS WHAT IT SAYS The Eleventh Circuit Court of Appeal was asked to resolve what a court is to do when all the surest proof of contracting parties' subjective intentions and expectations flatly contradict the clear words of the issued policies of insurance. In Shiloh Christian Center v. Aspen Specialty Insurance Company, No. 22-11776, United States Court of Appeals, Eleventh Circuit (April 13, 2023) the Eleventh Circuit followed the generally accepted rules of insurance contract interpretation. SUBJECTIVE INTENT v. POLICY WORDING Aspen Specialty Insurance Company, a billion-dollar insurance conglomerate, had essentially all of the subjective-intent evidence on its side. The policyholder-Shiloh Christian Center, a small Florida church-had the policy text. The district court found the evidence of the parties' subjective intent overwhelming and granted summary judgment to Aspen. FACTS In 2016 and 2017, respectively, Hurricanes Matthew and Irma tore through Melbourne, Florida, pummeling Shiloh Christian Center. On both occasions, the storms peeled back the church's roof, allowing rain to soak the exposed structure. In 2015, the year before Matthew hit, Shiloh's property-insurance policy with Aspen Specialty Insurance Company covered losses resulting from hurricanes. In the middle of that year, though, Shiloh specifically asked Aspen to stop covering named-windstorm-related losses. Aspen agreed and issued an endorsement implementing the requested change: "THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY.... It is understood and agreed effective 7/16/2015, the following change is made to this policy: Named Windstorm coverage is removed from this policy." Reflecting the amendment, Aspen reduced Shiloh's premium and even refunded its past payments for named-windstorm coverage. Aspen then issued the 2016 policy. The cover page described the 2016 policy as a "renewal of" its 2015 predecessor. But the two policies' terms differed in material respects. For one thing, the 2016 policy was about $10,000 cheaper per year than the amended 2015 policy. Far more significantly the 2016 policy contained no exclusion for losses caused by named windstorms. A "Named Windstorms" exclusion was conspicuously absent from the policy as issued. In October 2016, a named windstorm-Hurricane Matthew-blew through Melbourne, ripping the roof off Shiloh's building. Aspen denied the claim because Shiloh's policy excluded coverage for losses caused by named windstorms. The district court granted summary judgment to Aspen. ANALYSIS The general rules governing the interpretation of insurance policies under Florida law are clear that the cardinal principle is that a policy's text is paramount. INTERPRETATION OF THE POLICIES First, the Irma Policy unambiguously covers named windstorms. The expressio unius canon applies with particular force because the Irma Policy's catalogue of exclusions is so detailed. On its face the Irma Policy clearly doesn't exclude- and thus covers-losses resulting from named windstorms. The court concluded: "Whatever the evidence of the contracting parties' subjective intentions and expectations, the Irma Policy's plain language unambiguously covers losses caused by named windstorms." ZALMA OPINION Aspen failed to properly underwrite and issue the two relevant policies to Shiloh by not incorporating the named windstorm exclusion it had originally. There was no question that the parties intended to exclude windstorms, the premium was reduced as a result of the intent, but Aspen left the exclusion out of the two policies in effect at the time of the two hurricanes. For reasons not described in the opinion Aspen failed to move to reform the two policies to provide the coverages the parties agreed to issue and was compelled to pay the claims neither party expected to cover Shiloh's property. Kim and Producer Steve first take aim at Biden's Build Back Better bill that has a hidden “Toddler Tax” in it. Kim shares details as to how bad this will be for parents seeking child care. Faith-based options will not be available, only “government approved options,” and unsubsidized families will see an increase, on average, of $13,000 per year. This is another example how new and existing regulations make things more expensive, the supply becomes limited and the quality goes down. With inflation costs already hitting families hard, this will add to their financial burden. Kim then dissects a recent article about the Roe vs. Wade decision and discusses the current court case heard by the U.S. Supreme Court on abortion. Rob Natelson, constitutional expert with the Independence Institute, wrote an excellent article on the subject, Time for the Supreme Court to overrule Roe v. Wade. Colorado is an extreme as the state allows partial birth abortions. Partial birth abortions allow babies to be aborted up to the moment of birth. God has given everyone a mind to think to come to him for answers and when they get to 18 and over they are supposed to be making right choices for their life you are not supposed to be putting your life on hold for other people while they are moving along with whatever they have chosen to do. Yes pray for them. I heard it said humans are the only ones that let there children back in once they have chosen to leave the nest. The birds don't. We have to love other's and care for the people God puts in our life. But not at the expense of our own life and the plans God has for us. Prevail means to overcome. Triumph. Overrule. Be victorious. Reign succeed. Conquer. I pray today that each one of us will speak to God about us that we will get the opportunity and strength to prevail against all the plans of the enemie to ambush our destiny and purpose on the authority of jesus we pray amen. The Latest Case to Overrule the CDC's Eviction Moratorium A federal judge on May 5th struck down the nationwide halt on evictions, reasoning that the CDC overstepped its authority. “It is the role of the political branches, and not the courts, to assess the merits of policy measures designed to combat the spread of disease, even during a global pandemic,” U.S. District Judge Dabney Friedrich wrote. “The question for the Court is a narrow one: Does the Public Health Service Act grant the CDC the legal authority to impose a nationwide eviction moratorium? CFPB Doubles Down on CDC Order Later in the episode, Vec explains his new case, The Property Management Connection, LLC, et al. v. Dave Uejio, Consumer Financial Protection Bureau, et al. The Consumer Financial Protection Bureau (CFPB) is requiring that anyone who seeks to collect unpaid residential rent, including property management companies, real estate attorneys, or housing providers, must now lie to tenants who have been sued for unpaid rent and are subject to eviction. NCLA filed a lawsuit and motion for temporary restraining order against CFPB in the U.S. District Court for the Middle District of Tennessee for doubling down on the unlawful Halt Order issued by the Centers for Disease Control and Prevention (CDC) last September. NCLA represents The Property Management Connection LLC, attorney Gordon Schoeffler, and the National Association of Residential Property Managers. Each Plaintiff suffered significant economic damages after CDC issued its Order, which forced property owners to provide habitable housing for tenants while continuing to pay maintenance, utilities, and other expenses, but prevented them from requiring tenants to pay their rent. The affidavit override rule function within the police accountability system should have been a very powerful tool to help leaders bring in real accountability. A recent report released by the Deputy Inspector General for Public Safety (DPSIG) documents that the power was rarely if ever used for many years despite evidence being contained in investigative files that would have supported the application of this power. From 2004 until the moment the Governor signs HB 3653 in to law it has been a requirement in Chicago for anyone, who is not a police officer, who wants to file a complaint against a Chicago Police officer to sign a sworn affidavit under the threat of perjury that the contents of their complaint were truthful. Complaints filed without an affidavit are supposed to receive a limited investigation and if evidence can be found to support the complaint the leader of the investigative agency is supposed to seek approval of an override to the affidavit. From 2007 to some time in 2018 the police accountability system in Chicago was was made up of the Independent Police Review Authority (IPRA) and the CPD's Internal Affairs Division (IAD). In 2018 IPRA replaced by the Citizen Office of Police Accountability (COPA). This report specially details how both IPRA & IAD almost never used this authority provided to them in law by the Illinois General Assembly. The DPSIG reviewed a randomly selected group of case files from IPRA/COPA and IAD from the time period of 2016-2018. This time period covered the switch over to COPA and the first months of COPA's operations. The results identified multiple occasions over the two years were all three investigative bodies possessed evidence in the case file that was more than sufficient to support seeking an override of the affidavit rule and the investigative agency failed to do so.
