This Day in Legal History: MLK BornOn January 15, 1929, Martin Luther King Jr., one of the most influential figures in American history, was born in Atlanta, Georgia. As a Baptist minister and leader of the Civil Rights Movement, King played a pivotal role in advancing racial equality and social justice in the United States. His commitment to nonviolent protest, inspired by Mahatma Gandhi, led to significant legal and social changes, including the dismantling of segregation and the affirmation of civil rights for African Americans.King's leadership during landmark events such as the Montgomery Bus Boycott in 1955 and the March on Washington in 1963 brought national attention to systemic racism and civil rights abuses. His iconic "I Have a Dream" speech at the Lincoln Memorial articulated a vision of racial harmony and equality, influencing the passage of critical legislation like the Civil Rights Act of 1964 and the Voting Rights Act of 1965.Despite opposition and threats, King remained steadfast in his pursuit of justice, receiving the Nobel Peace Prize in 1964 for his efforts. His advocacy for economic equality and opposition to the Vietnam War further broadened his legacy. Tragically, King's life was cut short on April 4, 1968, when he was assassinated in Memphis, Tennessee, while supporting a labor strike.King's birthday is now recognized as a federal holiday in the United States, known as Martin Luther King Jr. Day, celebrated annually on the third Monday of January. This commemoration underscores his enduring impact on American law and society, as well as the ongoing struggle for civil rights and equality. King's work has left an indelible mark, shaping legal reforms and inspiring movements for justice around the world.Stanford law professor and renowned intellectual property scholar Mark Lemley has withdrawn as legal counsel for Meta Platforms Inc. in a high-profile generative AI copyright case. Lemley cited CEO Mark Zuckerberg's controversial recent actions, including ending diversity initiatives and fact-checking on Facebook, and promoting "masculine energy," as reasons for his departure. While Lemley believes Meta has a strong case in the AI copyright dispute, he stated he could not continue representing the company in good conscience.Lemley's withdrawal leaves attorneys from Cooley LLP and Cleary Gottlieb Steen & Hamilton to defend Meta against allegations from authors, including Sarah Silverman and Ta-Nehisi Coates, that Meta's AI improperly trains on copyrighted works. The case addresses a critical issue in AI development: whether training models on copyrighted material constitutes infringement. Authors argue this practice unfairly exploits their work, while AI advocates claim it constitutes fair use, given the scale and indirect impact of the works.Lemley, a distinguished academic and practitioner, has contributed significantly to intellectual property law, including involvement in key cases like Warhol Foundation v. Goldsmith. His departure underscores concerns about Meta's evolving corporate ethos. Additionally, Lemley announced he would deactivate his Threads account and avoid supporting Meta financially, though he stopped short of leaving Facebook entirely to preserve his social connections.Meta Lawyer Lemley Quits AI Case Citing Zuckerberg 'Descent' (1)The U.S. Securities and Exchange Commission (SEC) has filed a lawsuit against Elon Musk, accusing him of delaying the required disclosure of his significant Twitter stake in 2022. According to the SEC, Musk violated securities laws by failing to disclose his 5% ownership in Twitter within the 10-day deadline, waiting until April 4, 2022, to reveal a 9.2% stake. This delay allegedly allowed Musk to acquire over $500 million in shares at lower prices, disadvantaging other investors. Twitter's stock price surged 27% after Musk's disclosure. The SEC's suit seeks to impose civil fines and recover any illicit profits Musk gained. Musk's lawyer, Alex Spiro, dismissed the lawsuit as a baseless effort by the SEC, framing the issue as a minor administrative oversight. Musk, who later purchased Twitter for $44 billion in October 2022 and rebranded it as X, has a history of legal disputes with the SEC, including a 2018 settlement over misleading Tesla privatization tweets. He has also faced shareholder lawsuits for the delayed disclosure. Despite these challenges, Musk's substantial wealth and influence continue to draw attention, with his attorney accusing the SEC of harassment amid leadership changes at the agency.US SEC sues Elon Musk over late disclosure of Twitter stake | ReutersPam Bondi, Donald Trump's nominee for attorney general, will face a Senate Judiciary Committee hearing amid scrutiny over her past decisions and ties to the former president. Bondi, Florida's attorney general from 2011 to 2019, played a prominent role in Trump's 2019 impeachment defense and supported his post-2020 election fraud claims. Democrats are expected to question her impartiality, particularly in light of Trump's comments about using the Justice Department to target political adversaries.Bondi has faced criticism for declining to investigate Trump University after her campaign received a $25,000 donation from the Trump Foundation, a decision she has defended as unrelated to the contribution. She also worked as a lobbyist for Ballard Partners, representing clients like Amazon, Uber, and GEO Group, some of which have had dealings with the Justice Department under the Biden administration. Senators are likely to probe potential conflicts of interest arising from her lobbying background.Bondi has pledged to consult ethics officials on any conflicts. Her confirmation hearing follows contentious reviews of other Trump Cabinet picks, with Democrats raising concerns about loyalty to Trump's personal interests over those of the United States. The outcome of Bondi's nomination remains uncertain, as the Republican-majority Senate considers her extensive ties to Trump and her record as a lobbyist and public official.Trump's attorney general pick Pam Bondi to face US Senate grilling | Reuters This is a public episode. This Day in Legal History: Max Headroom IncidentOn November 22, 1987, a bizarre and illegal hijacking of television signals in Chicago made history as the "Max Headroom incident." During an evening broadcast of the news on WGN-TV, the signal was interrupted by a person wearing a rubber Max Headroom mask—a character from a popular British-American sci-fi show. The intruder, who spoke in distorted audio while a buzzing background noise played, reappeared later during a broadcast of "Doctor Who" on PBS affiliate WTTW. In the second interruption, the masked figure performed erratic gestures, spouted nonsensical phrases, and referenced TV culture, all culminating in a crude act involving a flyswatter and exposed buttocks. The Federal Communications Commission (FCC), tasked with regulating airwaves, launched an immediate investigation, as signal hijacking violates federal laws prohibiting unauthorized use of broadcast frequencies. Despite efforts by the FCC and law enforcement, the perpetrators were never identified, adding an air of mystery to the event. The technical feat required to override broadcast signals in 1987 suggested that the culprits had considerable expertise and access to specialized equipment. This incident was one of the most notorious cases of broadcast signal intrusion, highlighting vulnerabilities in television networks at the time. It also sparked debates about cybersecurity, freedom of expression, and the emerging role of "hacktivism" in digital media. No further incidents of this type occurred on such a scale in the United States, likely due to improvements in broadcast security and stricter regulatory oversight. President-elect Donald Trump announced his nomination of former Florida Attorney General Pam Bondi as Attorney General following Matt Gaetz's withdrawal. Bondi, a longstanding Trump ally, has been a vocal supporter of his claims that the Justice Department's investigations into him were politically biased. If confirmed, Bondi would oversee major aspects of the DOJ, including defending controversial policies and managing federal grants.Trump praised Bondi for her toughness and alignment with his "America First" agenda. Bondi previously served on Trump's legal defense team during his first impeachment trial and has taken high-profile legal stances, including challenging the Affordable Care Act as Florida's Attorney General. However, her tenure has also been marked by controversies, such as accepting a Trump Foundation donation while considering action against Trump University, though no wrongdoing was found.Bondi's nomination comes as Trump plans significant changes to the Justice Department, including possible leadership shifts, and amid ongoing federal indictments against him. Bondi has publicly supported Trump's claims of voter fraud and pledged to investigate alleged “deep state” actors. Her background includes working on drug policy and opioid abuse commissions during Trump's first term and involvement with the Trump-aligned America First Policy Institute.Matt Gaetz, initially chosen for the role, stepped down citing the distraction caused by controversies, including a closed sex trafficking investigation and a House Ethics probe. Trump's choice of Bondi highlights his intent to reshape the DOJ's focus while surrounding himself with trusted allies.Trump Picks Pam Bondi for Attorney General After Gaetz Exit (1)Trump picks Pam Bondi for US Attorney General after Gaetz withdraws | ReutersPresident-elect Donald Trump has appointed Elon Musk and Vivek Ramaswamy to lead the newly created Department of Government Efficiency (DOGE), tasked with identifying and repealing federal regulations they consider overly burdensome or invalid. The panel plans to focus on rules that they argue were enacted by unaccountable bureaucracies, guided by recent Supreme Court decisions that curtail agency rulemaking powers. DOGE also aims to propose mass layoffs and identify unauthorized federal spending, with a goal of completing its work by July 4, 2026.Repealing federal rules, however, is a complex and lengthy process governed by the Administrative Procedure Act, which requires detailed justifications, public comment periods, and compliance with legal standards. While Trump could issue executive orders halting enforcement of certain rules, agencies must still follow formal procedures for repealing them. Lawsuits are likely to challenge attempts to eliminate regulations, especially by opponents who claim improper justification or procedural violations.Musk and Ramaswamy's efforts will leverage recent Supreme Court rulings limiting agencies' ability to address major economic or societal issues without explicit Congressional authorization. Despite this, many regulations have firm legal backing, making their repeal difficult. Legal experts predict a wave of lawsuits and mixed outcomes, given the partisan makeup of federal courts. DOGE's recommendations signal Trump's broader agenda to significantly curtail the administrative powers of federal agencies. How Trump's Musk-led efficiency panel could slash federal agency rules | ReutersThe European Commission has closed its four-year antitrust investigation into Apple's rules for e-book and audiobook app developers following the withdrawal of the original complaint. The complainant, who remains unnamed, opted to drop the case, prompting regulators to end the probe. The closure does not indicate that Apple's conduct was found to comply with EU competition laws. EU regulators emphasized their ongoing commitment to monitoring tech industry practices, including Apple's, under the Digital Markets Act and broader competition regulations. The case's conclusion reflects the challenges in sustaining antitrust investigations without active complainants, though scrutiny of Apple's business practices in Europe is expected to persist.EU regulators scrap probe into Apple's e-book rules after complaint was withdrawn | ReutersSenate Democrats have agreed to a deal with Republicans to advance votes on President Joe Biden's district court nominees while abandoning four appellate court picks. The agreement allows the Senate to confirm several district court judges quickly, despite GOP stalling tactics aimed at delaying Biden's judicial appointments before Republicans assume control of the White House and Senate in January. Majority Leader Chuck Schumer's spokesperson highlighted that the trade-off prioritized advancing more district court nominees over the blocked circuit picks. The deal derails the nominations of Adeel Mangi, Ryan Park, Karla Campbell, and Julia Lipez for appellate court seats. Mangi, who would have been the first Muslim federal appellate judge, faced opposition from some Democrats over allegations linking him to antisemitic and anti-police groups. Park's nomination was also at risk due to lack of Republican support. Meanwhile, the Senate pushed forward on cloture votes for several district court nominees, including Spark Sooknanan, Brian Murphy, Anne Hwang, Cynthia Valenzuela Dixon, and Catherine Henry. Votes on their confirmations will occur after Thanksgiving. Other nominees, such as Sharad Desai for Arizona and several others approved by the Judiciary Committee, also advanced. The agreement leaves critical appellate seats open, including those on the Third and First Circuits, aiding President-elect Donald Trump's agenda to influence the federal judiciary. Some judges considering semi-retirement may now delay their decisions, further impacting the judicial landscape.Biden Circuit Picks Derailed by Senate Deal on Trial Judges (2)This week's closing theme is by Johann Sebastian Bach.Johann Sebastian Bach (1685–1750) was a German composer and musician of the Baroque period, widely regarded as one of the greatest composers in Western music history. Born into a family of musicians in Eisenach, he displayed prodigious talent from a young age, mastering the organ, harpsichord, and violin. Throughout his career, Bach held prestigious positions as a court musician, music director, and cantor, most notably serving as the Thomaskantor in Leipzig, where he composed many of his most enduring works. His output includes cantatas, concertos, masses, and instrumental pieces, showcasing an unparalleled command of counterpoint, harmony, and structure. Despite limited recognition during his lifetime, Bach's music profoundly influenced later composers, earning him the title "Father of Music."This week's closing music is Bach's Prelude and Fugue in G minor, BWV 861, from The Well-Tempered Clavier, Book I. This collection of preludes and fugues in all 24 major and minor keys was revolutionary, both as a demonstration of the possibilities of the then-novel well-tempered tuning system and as a masterclass in compositional technique. The G minor prelude opens with a flowing, somber melody that builds in complexity, evoking introspection and elegance. The fugue that follows is a testament to Bach's genius for counterpoint, weaving together a single thematic idea into an intricate tapestry of musical voices. The Prelude and Fugue in G minor exemplifies Bach's ability to transform simple ideas into profound statements, inviting listeners into a world of meticulous craftsmanship and emotional depth. It's a fitting choice to close the week, blending timeless artistry with intellectual rigor.Without further ado, Johann Sebastian Bach's Prelude and Fugue in G minor, enjoy. This is a public episode. Yet while con artists can be found on both sides of the aisle, the hard truth is that one side is far more badly infested than the other. Joe Conason, the acclaimed investigative journalist and political commentator, has spent years pursuing the cheaters, grifters, and phonies - and he reports on his extensive and often comical discoveries in his new book, THE LONGEST CON: How Grifters, Swindlers, and Frauds Hijacked American Conservatism In THE LONGEST CON, Conason takes us back to the origins of the brazen and self-serving deceptions that have duped and damaged Americans, beginning with Roy Cohn's rebaiting swindles in the Fifties and leading to the ascent, decades later, of his most famous client, Donald J. This week, Lisa David Olsen joins the idiots to mock all that's in the news. 00:00 Welcome! 00:56 Iran vs. Israel 03:33 Trump Owns Republican Party 13:17 Trump media 18:37 Maxwell Azzarello 25:50 Jesus vs. LGBTQ 29:29 Breakdancing in the Olympics The breakdown: —Last week, nathan said it looked like Iran's “show of force” against Israel was all image, and BOOM! He was right. Iran launched their missiles, then said, “We showed them!” Of course, Israel had to respond to that, because apparently you can't just take a W in the Middle East, so now we're kinda in a holding pattern. —This is delicious… The Trump campaign now says that any Republican candidate who runs on Trump's name… HAS TO PAY ROYALTIES TO THE DONALD. Honestly, we're stunned he didn't think of this sooner. It is genius, though. Donald Trump is the name, the face, the everything of the Republican Party, so if you want to associate with him, you should have to give a little kickback to the Donfather. Side conversations in this segment include Arizona's new abortion law, and how Democrats win in Alabama. —Sure, the stock price of Trump Social (or Truth Social or whatever it is) lost over half its value since being released… but why would Donald care about that? It's all found money to him. Sure, stupid investors are losing their butts, but that's just hilarious. Oh, you trusted a Trump business? Trump University, Trump Steaks, Trump Casino, and Trump Airline didn't give you a heads up as to how all Trump businesses do? Still, when you're starting with zero, anything above that is a win. So, Trump is technically kicking ass, because it's all found money. Side conversations here include My Pillow Guy Michael J. Lindell, and his ability to draw more crowds as a speaker than many celebrities. —The best headline I saw regarding conspiracy theorist nutbag Maxwell Azzarello was, “Florida Man Lights Self on Fire.” They had to throw in the Florida part, and God bless them for it. His manifesto showed such a unique brand of crazy, it's not to be believed. —Churches everywhere are losing members, and more and more often, it's because they hold antiquated, idiotic views regarding gay people. What does that cost them? Money. A new article showed a breakdown of spending by a Methodist gathering, and funds are dipping. —The Olympics have their finger on the pulse! They are in touch with the zeitgeist. They are allowing breakdancing, which was big in the 1980s, to be a part of the modern games. Well done, Olympics! But Callin just shut down, making us radio refugees… We're also on Spaces, but we're not new to X/Twitter, so it's an FDR Resurrection! AND tis the season of resurrection, Easter Eve as we broadcast live from Bonoboville, living the Cage-Free Life, the Bonobo Way. Maybe you painted cage free Easter eggs, but do you lead a cage-free life? We try to live cage-free – or relatively free of corporate shackles. We're into Free Speech, Free Assange, Free Palestine. Free yourself! Be Cage-Free! Be Bonobo! Resurrect your long-hibernating joie de vivre. It's Spring! Resurrection is one of the springiest of Spring themes - & not just because it phonetically contains “erection” - but because after Jesus is “born again,” whom does He first see? His favorite Easter Bunny: Mary Magdalene. Jesus loves the sex workers. And our first call is from sex worker Hamilton Steele regaling us with tales of serving the tech lords & cuckold incels of Silicon Valley. Regarding resurrection, he wonders, “How did Easter bunnies & chocolate eggs come out of a Jewish guy being crucified?” Good question! And the answer, in part, is paganism. Jesus wasn't the first human/God to be born again in Spring. On our Spring Equinox show, we compare the Resurrection of Jesus to Persephone, & on this Easter Eve Resurrection show, we compare Jesus to Dionysus aka Bacchus another God of the People who is killed & brought back to life by his Heavenly Father Zeus, aka Jupiter, aka God… From resurrection to insurrection, America's Top Huckster is hawking The Trump Bible for just $59.95, reaching new heights of hucksterism, though Trump Bible couldn't be any worse than Trump Steaks, Trump University… or the Trump White House (hopefully, that won't be resurrected). Our oldest listener (since KFOX 93.5 FM!), Don PolyBi, calls in hoping Trump will lose Manhattan District Attorney's Alvin Bragg's 34-count felony “hush money” case against him just before the 2024 election, & history will record that Trumpty Dumpty was brought down by porn star Stormy Daniels. Ann Taenes - Washington Post Trump's RNC is reuniting the band: convicted criminals Paul Manafort and Steve Bannon (and maybe now-in-jail Peter Navarro) plus world-class whackos Steven Miller and Corey Lewandowski...under the "leadership" of daughter-in-law Lara Trump. It's looking like a rerun of 2020, but better organized but without Jared or Ivanka. Just this week, we're seeing The screening for new Republican National Committee employees: do they agree that the 2020 election was stolen? Michigan's Ronna “Don't Call Me Romney” McDaniel's NBC gig lasts half a Scaramucci after an on-air rebellion The Zillow listings for Trump properties will have to wait as the Sneaker-and-Bible Salesman gets a $300-million reprieve from a New York appeals court Trump gets a tenuous windfall with Truth Social, but the company continues to lose money and could end up bankrupt (just like Trump casinos, Trump Airline, Trump Water, Trump University etc. etc.) Trump gets to pray about his first criminal trial, now set to begin on April 15th (which likely means fewer rounds of golf). Around Michigan: Former Governor Granholm returns to the Mitten bearing gifts: $1.5-billion to restart the Palisades nuclear plant Ottawa County may be Michigan's most conservative politically, but its voters aren't at all happy with the new ultra-right-wing mob running the county Protecting healthcare, Social Security and Medicare are back as fundamental campaign issues The most successful one-night fundraiser in political history gets launched with Biden's backup band: Bill Clinton and Barack Obama Biden's polling numbers are up in Michigan and nationally, and the campaign opens a 2nd office in Michigan. Meanwhile Trump's Michigan remains in shambles. We're joined this week by longtime Republican political consultant Stuart Stevens, now a senior adviser with the Lincoln Project. Stevens has worked at the top level of more presidential and senatorial campaigns than just about anyone. His first presidential effort: the Bob Dole campaign in 1996. His book The Big Enchilada is a chronicle of George W. Bush's 2000 campaign. He is also a prolific writer. It Was All A Lie: How The Republican Party Became Donald Trump is his eighth book; his ninth book, The Conspiracy to End America Five Ways came out last October. The Trump University grift followed the same playbook as many predatory organizations, like Multi-Level Marketing (MLM) organizations. Victims are hooked through legitimate sounding offers, like a weekend sales course for $1,500. However, once the victims attend the weekend sales course, they are pressured into buying more courses for more money to achieve goals too good to be true. It's a classic bait-and-switch. So, how can regular people receive justice when high-powered people and organizations wield deception and cult-like practices? That's where Tristan Snell comes in. Snell is a lawyer and legal commentator featured on MSNBC, NPR, in the Washington Post and Wall Street Journal. He served as Assistant Attorney General for New York State, leading the investigation and prosecution of Trump University. Snell has developed a playbook for going up against Trump and others like Trump in court. This is a unique interview that you won't want to miss! “Don't tell me what the law is, tell me who the judge is.” Those are the haunting words of Roy Cohn, Trump's former longtime mentor and Henry Kissinger's current roommate in hell. Take Trump's classified Mar-a-Lago case. According to this week's guest, Tristan Snell, a former New York state prosecutor who won the Trump University case, and author of the new book Taking Down Trump, Jack Smith's classified Mar-a-Lago charges are a slam dunk. Unfortunately, the judge is Republican Aileen Cannon–appointed by Trump, and it shows in her MAGA-like rulings endangering witnesses. As Cohn would say, mob rules, baby! In this special live taping of Gaslit Nation, we discuss how the sausage of elite criminal impunity gets made, what can be done to hold prosecutors accountable and end the revolving door of corruption between public service and powerhouse white collar crime law firms, and, just for fun, take a tour of the criminal cases against Trump and where things stand. Obviously, at Gaslit Nation, we know that real justice comes down to us, which is why this show started in the first place. Terrell Starr from the Black Diplomats Podcast and Substack joins the chat. As a follow-up to Andrea's recent debate with Olga Lautman of the Kremlin Files podcast on the accusations against Fulton County, Georgia District Attorney Fani Willis, Terrell gives his take. For the previous discussion, check out the show notes. What's new since that episode ran? The divorce records of Nathan Wade, a Special Prosectuor on the Georgia case, were unsealed, revealing...no Fani Willis. Why does this matter? It doesn't. None of this matters. Remember this shocking story from the 2016 election? The Trump campaign gutted Ukraine aid in the official RNC platform. Today this is mainstream for the GOP, with McConnell folding on Ukraine aid. This is catastrophic for the US and the world. The recent transformation of the GOP into the Party of Putin began gradually, with only a few in Congress, like former Congressman Dana Rohrabacher, who the Kremlin considered an asset, according to the FBI. In 2018, current House Speaker Mike Johnson took tens of thousands of dollars in dark money campaign donations linked to a Russian oligarch close to Putin who was part of the larger Kremlin operation exposed in the Mueller Report. The oligarch is Konstantin Nikolaev, who bankrolled Kremlin spy/GOP honeypot Maria Butina, who was arrested as part of the Mueller investigation, after pretending to be in love with NRA/GOP operative Paul Erickson. After Mike Johnson got caught taking donations linked to Nikolaev and other Russians (Oops!), he gave it back. But it was part of a wider operation used by the Russians in countries around the world to entrench their power in, known as “the golden handcuffs.” Johnson blames other extremists in his party, like concentration camp guard Marjorie Taylor Greene, for "slowing down" Ukraine aid. They're not slowing down aid; they're blocking it, to help their financial backers in the Kremlin win. Johnson and Trump are part of the Kremlin's long game. They develop their assets, then spread their influence deeper and deeper. This began with a few fringe people, like Rohrabacher. Now it's mainstream. This is state capture. What happens if we lose our country? No place is safe. If you think things are bad now, the entire world will be forced to live under the Kremlin's mafia state: violence and terror win, deciding everything. No more laws and elections. Many Republicans watched in shock as the Kremlin hijacked their party. But it was Republican operations, like Citizens United, that helped Russian dark money entrench the Kremlin's influence in the United States. More Americans must wake up that the loss of Ukraine is also the loss of our democracy. What's happening in Ukraine and the U,S. is an ongoing crime of state capture. The KGB-style operation started decades ago with Trump as a Russian asset. Where will we be if we and our institutions don't stop it? Mark your calendars! Tristan Snell, the prosecutor who led New York State's case against Trump and Trump University and the author of "Taking Down Trump: 12 Rules for Prosecuting Donald Trump by Someone Who Did It Successfully," will join Andrea for a live-taping of Gaslit Nation for our community of listeners on February 12 at noon ET. An event link will be sent to our Patreon community at the Truth-teller level or higher on the day of the event. To join us, sign up at Patreon.com/Gaslit! *** Republicans have once again refused to stop Trump: Nikki Haley lost the New Hampshire primary, and the Trump Klan is moving ahead towards the GOP nomination. Why might that be? According to Harvard psychologist Martha Stout, author of "The Sociopath Next Door," one in twenty-five people are sociopaths. Trump's cult has galvanized and emboldened them, unleashing a toxic sludge that threatens to drown our democracy. In this week's episode, Andrea is joined by Olga Lautman, a Russian mafia expert and co-host of the Kremlin Files podcast, to discuss why Republicans are goose-stepping in line to support a shameless wannabe dictator, why the media continues to fail us and normalize this dangerous career criminal and Russian asset, and what can be done about it. Andrea and Olga also debate over the growing attacks against Fani Willis, the Fulton County, Georgia DA who built a strong case against Trump and his goon squad for trying to overturn our election in 2020. Michael Roman, one of the 18 co-defendants in her case and a professional GOP opposition researcher, is trying to get Willis removed, which would put the entire case in jeopardy. Without any evidence, Roman claims that Willis is in a romantic relationship with Nathan Wade, a lawyer she hired to her team of prosecutors. (Who cares!) This is a clear case of disinformation warfare to help Trump once again escape accountability. While there's nothing illegal done by Willis or Wade, this is the new “Hunter Biden's laptop” – red meat for the Fox News echo chamber. Check the show notes for trusted sources that cut through the gaslighting against Willis, who must remain in her post. Fani T. Willis was subpoenaed in the divorce case of a colleague she hired to manage the Trump prosecution in Georgia, with whom she is accused of having a romantic relationship. FROM THE NEW YORK TIMES ARTICLE: “The filing also stated that [Nathan Wade's soon to be ex wife] Ms. Wade had ‘conspired' with ‘interested parties' in the Trump case ‘to annoy, embarrass and oppress' Ms. Willis. It noted that Ms. Willis had been subpoenaed around the same time that Mr. Roman's lawyer, Ashleigh Merchant, filed motions seeking to unseal the divorce records and, in the Trump case, to remove the two prosecutors. The filing also said that Ms. Wade had acknowledged having an affair with a longtime friend of Mr. Wade's, and that the couple had agreed their marriage was ‘irretrievably broken' as early as 2017, before Mr. Wade and Ms. Willis had met.” https://www.nytimes.com/2024/01/18/us/fani-willis-trump-georgia-prosecutors.html?campaign_id=60&emc=edit_na_20240118&instance_id=0&nl=breaking-news&ref=cta®i_id=48614702&segment_id=155695&user_id=097a378032011d6e8be1570cdce0a176 Ruth Marcus in The Washington Post: Fani Willis's Gift to Trump: “As a legal matter, the allegations about a romantic relationship between Fulton County District Attorney Fani T. On January 11, 2024, Donald J. Trump arrived in a New York courtroom for closing arguments in the civil fraud case against the former president, his company, and his adult sons. The suit, brought by the state's attorney general Letitia James, alleges that Trump and his company misled lenders about the former president's net worth in order to secure better business deals. The case is not Trump's only legal trouble, but it's one that could have a consequential impact for his family business and the image he has crafted for himself as a richer-than-rich, deal-making business man. What are the legal issues at stake? What might Trump argue on appeal? And how could the outcome affect Trump's finances? To talk it all through, Lawfare Legal Fellow and Courts Correspondent Anna Bower spoke with Tristan Snell, former New York Assistant Attorney General and lead prosecutor in the Trump University fraud case. Tristan is also the author of a forthcoming book called, “Taking Down Trump.”Support this show http://supporter.acast.com/lawfare. Hosted on Acast. See acast.com/privacy for more information.

Even though the fraud trial taking place in New York is not related at all to the criminal trials pending against Donald Trump, legal experts say that some of the evidence presented at the current trial could be used to help convict Trump in the other trials. Specifically, some of the evidence appears to undermine Trump's main legal defense, which is that he geniunely believed that the 2020 election was stolen. But a piece of evidence introduced last week in the fraud trial actually destroys that claim. And Donald Trump has decided that he's going to try his hand once again at starting an online university, even though his first effort - Trump University - was shut down and sued for defrauding "students." That lawsuit resulted in Trump paying out $25 million to angry people who thought they were actually going to get an education, and it seems unlikely that his new efforts will end any differently. Also, during a bizarre statement in the House late last week, Lauren Boebert falsely claimed that it was the government that shut down her beloved restaurant, Shooters, even though she admits that the restaurant was always filthy. Not only did the government NOT shut her down, but admitting that you didn't do a good job cleaning your business isn't exactly a winning statement. Farron explains why that restaurant was actually shut down, and why that matters for someone like Boebert who may be out of a job in the next year. Finally, Ivanka Trump has lost her appeal to avoid testifying in the New York fraud trial against her family, and now she's asking the courts to just completely pause the trial until she can work it into her schedule. Ivanka claims that she can't come and testify in New York on a school night because she has kids, and apparently her husband doesn't ever help with any of that. The court has entertained Ivanka's antics long enough, and they need to force her to show up and spill the beans.
It's Casual Friday! Sam and Emma speak with Jacob Silverman, co-author of the book Easy Money: Cryptocurrency, Casino Capitalism, and the Golden Age of Fraud with Ben McKenzie, and host of The Naked Emperor podcast on the CBC, to discuss FTX CEO Sam Bankman-Fried's recent fraud and conspiracy convictions. And, Jacob has a special announcement! First, Sam and Emma run through updates on the FTC's case against Amazon, more Eric Adams drama, Trump's fraud case, the EPA, and the US economy, before discussing the Democratic fear-of-ceasefire when doing any messaging – and the importance of that starting to shift Jacob Silverman then joins, diving right into the collapse of Sam Bankman-Fried, the former face of Crypto, beginning one year ago today with the leaking of an FTX balance sheet exposing the first strands of massive conspiracy and fraud between SBF's companies FTX and Alameda, leading up to this week's conviction of him and multiple co-conspirators. After walking through the economic exposé, Silverman parses through the uncovering of the farce of SBF's philosophy of “effective altruism,” and the expansive ties of FTX's funds, before wrapping up with why this disaster hasn't tainted the crypto industry as much as would be expected. Sam and Emma also look at the incredible cold-hearted coverage of Palestinians by the mainstream media, and touch on Ta-Nehisi Coates' comments on the hypocrisy of zionist “democracy.” And in the Fun Half: Sam and Emma watch Jewish Voice for Peace, the Philly Palestine Coalition, and If Not Now swarm Philadelphia's 30th Street Station, discuss the influence of the war on terror on Netanyahu's regime, and the potential economic influence of the Ben Gurion Canal on Israel's ethnic cleansing of Palestine. It was one year ago that New York Attorney General Letitia James filed a $250 million lawsuit against former president Donald Trump, accusing him of fraudulent business practices. Just this week, a New York judge has ruled that Trump is guilty of fraud in the building of his massive real estate empire. The judge claims that the he inflated the value of his assets and his own net worth as he negotiated real estate deals and asked for bank loans. The case will still be heard in court, but if this ruling sticks, it could have major implications for Trump's financial world and a huge lesson for any investor who might consider adding a few zeros onto an asset valuation. Judge Arthur Engoron issued the ruling on Tuesday, September 26th. It comes in conjunction with a lawsuit against Trump by New York Attorney General Letitia James. The lawsuit claims that Trump and several of his family members committed “numerous acts of fraud and misrepresentation” and that Trump “inflated his net worth by billions of dollars.” $2.2 billion to be exact. The lawsuit also named Donald Jr., Ivanka, and Eric as defendants. James said: “Mr. Trump and the Trump Organization repeatedly and persistently manipulated the value of assets to induce banks to lend money to the Trump Organization on more favorable terms than would otherwise have been available to the company, to pay lower taxes, to satisfy continuing loan agreements, and to induce insurance companies to provide insurance coverage for higher limits and at lower premiums.” In one instance, they falsely inflated the total square footage of a commercial building by 300 percent, the ruling concluded... ...Engoron has directed Trump to begin the process of dissolving the companies held in his name. Meanwhile, an appeals court rejected Trump's bid to delay the civil trial, allowing the case to proceed. This decision, by the state's intermediate appellate court, clears the way for Engoron to preside over a non-jury trial starting Monday in Manhattan. James alleges Trump boosted his net worth by as much as $3.6 billion. Battling lawsuits is not new to the former president. In 2017, Trump agreed to pay $25 million to settle fraud allegations linked to "Trump University." In 2019, he agreed to pay $2 million to settle charges that he used charitable funds to pay for his political operations. and last December, Trump's company was found guilty of 17 counts of criminal fraud for falsifying business records. This legal battle is not over. However, according to NPR, Trump could be forced to liquidate assets. Experts told NPR the legal threat to Trump now comes as follows: First, Trump's entire New York business operation, now deemed fraudulent, could be turned over to a receiver who would effectively take control of the firms and liquidate them at a public auction. Second, Trump and other defendants could be required to pay a $250 million fine which may require selling assets. Third, Trump and his associates including Donald Trump Jr. and Eric Trump, could be permanently banned from doing business in New York state, where many of the family's most significant assets are located. That's it for today. You can listen to past episodes and check for links to our sources for these stories at newsforinvestors.com. Mea Culpa welcomes Tristan Snell. The former New York Assistant Attorney General famously lead the civil prosecution in the Trump University case for the state of New York against the Trump Organization. The 2013 case found the Trump Org guilty; forcing them to pay out $25 million in restitution. Snell spent years scaling the walls of the Trump Organization, largely creating the playbook for defeating Donald Trump in court. Ultimately, he said, it's about the receipts, not the witnesses. To beat Trump you need indisputable proof, a smoking gun and that only comes from having the documents to prove it. Snell is the founder of Main Street Law and appears as a commentator on CNN, and serves as a contributing writer for the Washington Post. His work as a lawyer and founder has been featured in a wide array of media outlets, from the New Yorker to the Atlantic to Last Week Tonight with John Oliver. He joins me today on Mea Culpa as the nation goes on indictment watch for the Mango Mussolini. Snell believes that the government has the goods this time and Trump may actually go to prison. Listen in.
