So using a name that is uniquely yours, helps contain the value of your brand. When you are using a name that other people can use, you have a colander rather than a container. Other competitors can use the name and customers may find other people when looking for you which will therefore lose your business. Don’t choose a name until you know the business is viable. Therefore you do not have to get into all the costs of trademarking. When you are ready, register a name and trademark it immediately. Understanding IP at the same time as creating a brand or when trying to grow your company will allow you to develop the right strategy. Instead of focusing so much on how you can be different to your competitors in terms of products you offer, designers should be looking at coloring, branding and how they can visually stand out. They cannot copy your distinctiveness. There is a tiny percentage of people who find themselves in a situation where another company begins using the same name as them and they are unable to fight back. You have to decide whether to take the risk of not trademarking your company name. Try to protect yourself within your home market and try not to worry about international companies unless you have a more substantial business. Kerry Gleeson grew up playing cricket on the green with the boys in the northern part of Cotswolds in the UK. Her mantra was and remains: "Shoulders back, remember who you are and go get it." For the past two decades, Kerry has sat on ASX Boards as Director, Senior Executive and Board Advisor, working nationally and internationally across broad and complex industry sectors including mining and resources, industrial and agri-chemicals, manufacturing, transport and distribution and international education. At age 12, Kerry knew she wanted to be a commercial lawyer and so she pursued her dream. In 1989, she commenced her legal career at the international law firm Eversheds in London and after 10 years of practicing law in the UK, she fell in love with her now husband and exiled to Australia. Leaving Halliwell Landau where she was corporate partner, she landed as Senior Corporate Associate with Ashurst in Melbourne. With her daughter on her lap, she interviewed for the role of Group Executive for Incitec Pivot Ltd (AXS: IPL) where she remained nine years before entering her first independent non-executive role in 2014 with McAleese Group. Despite being well known, highly sought after and respected in the executive space, Kerry admits she takes deliberate action, knows intimately her value proposition and networks like a boss to get seen in the non-executive sphere. Known for her strength in governance, legal and risk, it was a natural fit to align with the resource sector, particularly mining, which sees Kerry as NED for the Australian-based companies St Barbara (ASX 200) gold producer and explorer, and New Century Resources (ASX:NCZ), metal producer and world's top 10 zinc producers. Athi Jara is a Director and Head of the Mining and Environmental Law Department at Gwina Attorneys, a corporate law firm based in Johannesburg, South Africa.   She holds an LLB Degree from the University of the Witwatersrand, Johannesburg and an LLM Degree (with merit) from the University of Sussex, United Kingdom. She has over 10 years' experience in Mining and Environmental Law.   She has completed Certificate Courses in Prospecting and Mining Law, and Advanced Company Laws I and II from the Mandela Institute at Wits University.   She was previously a Senior Associate in the Mining Department at Edward Nathan Sonnenbergs Incorporated (ENSafrica). Prior to joining ENSafrica, she practised as an attorney in the Mining, Environmental and Natural Resources Department at Bowman Gilfillan (now Bowmans). While at Bowmans, she was exposed to mining law, energy law, environmental law and public procurement law. She was also part of the team that advised the Department of Energy and National Treasury on the implementation of the first Independent Power Producers Programme for Renewable Energy (IPP Programme) in South Africa. Prior to Bowmans, she completed her articles of clerkship and was retained as an Associate within the Environmental and Mining Law Department at Eversheds.   Her experience within the mining practice area includes involvement in mergers and acquisitions transactions, conducting mining due diligences, compiling mining title reports, undertaking mining litigation, black economic empowerment structuring in compliance with the provisions of the Mining Charter, giving advice on mining royalties and drafting technical mining agreements.   She has acted for a wide range of mining companies in all mineral commodity sectors, including base and precious metals, diamonds, coal, gold and platinum group metals. She has also assisted a number of clients with regards to their environmental compliance requirements under South African Law.   In 2019, Athi was recognised as one of the Mail & Guardian's 200 Young South Africans in the Justice and Law Category. On this episode of The Geek in Review, Anusia Gillespie, the US Head of Innovation at Eversheds Sutherland, sits down with us this week to discuss what she refers to as the "New Big Law" market's inverted approach to innovation. In a market filled with problem solvers, sometimes the innovation we create solves a problem first, and then sets out to find the problem for this solution. Gillespie finds that innovation is disciplined and structured in its approach, but broad and creative in its thinking. Innovation definitely doesn't live in any one discipline. Innovative solutions might require technology expertise, but it could just as well only require professional development expertise or strict legal expertise. She's convinced that we need to move away from this type of anchoring bias to ensure that, in this time of rebuilding law into New Big Law, legal innovators finally design and implement correct and smart solutions. With the various professionals needed to identify problems, and create solutions, you need leadership, structure, a bit of fun mixed in, and a champion-forward approach. We dive into issues ranging from an overview of how Eversheds defines innovation to case studies of Gillespie's publication on smart solutions for lateral recruitment and onboarding. McClead thinks there may be more sizzle than steak, saying that he doesn't think that anyone is doing it very well, and that the innovation created on the outside, doesn't seem to be making it back inside those firms. Marlene was excited about all of the Twitter traffic and information that came out of the workshop, and she hinted, pretty loudly, that she'd love one of the cool t-shirts the attendees were issued.
