On Thursday's Mark Levin Show, Phoenix Eichner, a 20-year-old Florida State University student and son of a Leon County sheriff's deputy, opened fire near the Student Union on the FSU campus in Tallahassee, killing two people and injuring six others. The media's response to this is so predictable. They focus on gun control but ignore other amendments, while advocating for due process for illegal immigrants. Not all violent deaths, like stabbings, involve guns, yet the media emphasizes the Second Amendment. This shooting, where the shooter's mother is a deputy with necessary gun access, is unrelated to gun control. The media should clarify which amendments they prioritize and why. Also, Islamists follow a purist ideology that prioritizes the afterlife and seeks to eliminate barriers to pure Islam, including less devout Muslims and non-believers. The 9/11 attacks, led by Osama bin Laden, exemplified this ideology, as does the Muslim Brotherhood. Traditional deterrents fail against this mindset, which values the next life over the present, making Iran's potential nuclear weapons a serious concern. Allowing a country that chants "Death to America" to develop and potentially use nuclear weapons is not noble. Later, Mark announced that President Trump had appointed him to the Homeland Security Advisory Council, which is a great honor. Those appointed to this board want nothing to do with open borders.  Afterward, the Supreme Court will review Trump's plan to restrict birthright citizenship, which lacks a basis in the 14th Amendment. The Index of U.S. Military Strength(Lt. Col. James Carafano) James Jay Carafano is Senior Counselor to the President and E.W. Richardson Fellow at The Heritage Foundation. A leading expert in national security and foreign policy challenges, Carafano previously served as the Vice President of Heritage's Kathryn and Shelby Cullom Davis Institute for National Security and Foreign Policy. Carafano is an accomplished historian and teacher as well as a prolific writer and researcher. His most recent publication is “Brutal War” (Lynne Reinner, 2021), a study of combat in the Southwest Pacific. He also authored “Wiki at War: Conflict in a Socially Networked World” (Texas A&M University Press, 2012), a survey of the revolutionary impact of the Internet age on national security. He was selected from thousands to speak on cyber warfare at the 2014 South by Southwest (SXSW) Interactive Conference in Austin, Texas, the nation's premier tech and social media conference. Before assuming responsibility for Heritage's entire defense and foreign policy team in December 2012, Carafano had served as deputy director of the Davis Institute as well as director of its Douglas and Sarah Allison Center for Foreign Policy Studies since 2009. His recent research has focused on developing the national security required to secure the long-term interests of the United States—protecting the public, providing for economic growth and preserving civil liberties. (Many of his writings for Heritage appear below.) He is editor of a book series, The Changing Face of War, which examines how emerging political, social, economic and cultural trends will affect the nature of armed conflict. From 2012 to 2014 and 2020 to 2021, he served on the Homeland Security Advisory Council convened by the secretary of the U.S. Department of Homeland Security. Carafano, a 25-year Army veteran with a master's and doctorate from Georgetown University, joined Heritage in 2003 as a senior research fellow in homeland security and missile defense. He worked with Kim R. Holmes, his predecessor as vice president and director of Davis Institute, to produce Heritage's groundbreaking documentary film “33 Minutes: Protecting America in the New Missile Age.” Carafano now directs Heritage's team of foreign and defense policy experts in five centers on the front lines of international affairs: the Allison Center for Foreign Policy Studies, the Asian Studies Center, the Margaret Thatcher Center for Freedom, the Border Security and Immigration Center, and the Center for National Defense.  Carafano served as president of a nonprofit organization, Esprit de Corps, which educated the public about veteran affairs. In this capacity he co-produced and co-wrote the documentaries “Veteran Nation,” an official selection of the 2013 G.I. Film Festival, and “Why We Fight: 9/11 and America's Longest War” (2018).  Before coming to Heritage, Carafano was a senior fellow at the Center for Strategic and Budgetary Assessments, a Washington policy institute dedicated to defense issues. In his Army career, Carafano served in Europe, Korea and the United States. His assignments included head speechwriter for the Army Chief of Staff, the service's highest-ranking officer. Before retiring, Carafano was executive editor of Joint Force Quarterly, the Defense Department's premiere professional military journal. A graduate of West Point, Carafano holds a master's degree and a doctorate from Georgetown University as well as a master's degree in strategy from the U.S. Army War College.

Amongst the most bizarro thing about last week's truly bizarre Presidential debate was how much Biden and Trump were in violent agreement on China. Trump certainly has won the ideological battle about the supposedly existential China threat and the two decrepit old men both celebrate American embroilment in a second Cold War. This is great news , of course, for the America's sprawling military industrial complex with its unquenchable thirst for rearmament and military engagement overseas. I'm not sure that the DC based Dmitri Alperovitch is a card carrying member of that establishment, but he's certainly a slick China hawk who fears that the world is on the brink of a major conflict over Taiwan with Xi's supposedly “Marxist-Leninist” regime. Maybe, maybe not. But talking to him about “winning” what he calls the “Cold War II” is a surreal throwback to a Fifties paranoia about the supposed existential threat of the Marxist-Leninist Soviet Union. America “won” the first Cold War; I doubt it can afford to win the second. Dmitri Alperovitch is an internationally recognized thought leader on geopolitics and national security and co-founder and executive chairman of Silverado Policy Accelerator, a think-tank focused on policy solutions in national security, trade and industrial security, and ecological and economic security.  He is also the former CTO of the cybersecurity company CrowdStrike Inc. Alperovitch serves on the Homeland Security Advisory Council of the Department of Homeland Security and as a founding board member of US Government's Cyber Safety Review Board, and has previously served as a special advisor to the Department of Defense. She serves on the UWW Executive Leadership Team.   Ms. Shah is a global leader on social impact and innovation. She has started and led social impact efforts in academia, government, and the private and philanthropy sectors for more than twenty-five years. Most recently she founded and led The Asian American Foundation, raising over $1 billion, the largest philanthropic effort serving the Asian American community. Before TAAF, she started and led Georgetown University's Beeck Center for Social Impact and Innovation for over seven years, training students on social impact and leading research on different models of social innovation. In the Obama Administration, Ms. Shah served as Deputy Assistant to the President and Director of the Office of Social Innovation at the White House, leading the efforts across government to introduce social innovation, including financial innovation, impact metrics, and the role of technology. In the private sector, she led the Global Development Initiatives at Google focused on impact investing and technology for social impact. At Goldman Sachs, Shah developed and implemented the firm's environmental strategy.   Ms. Shah also has significant experience working internationally as an economist at the Department of Treasury, setting up the central bank in Bosnia, working for post-conflict reconstruction in Kosovo, and implementing poverty reduction strategies in Africa. Pete Peterson, Dean of Public Policy at Pepperdine University in California joins us this episode for a fascinating look at the education system in America. I had the pleasure of meeting Pete when I was in the US earlier this month and he kindly agreed to come on Hearts of Oak to discuss the battle that is currently taking place for the heart and soul of College Campuses across the US. A diversity of viewpoint is no longer accepted and students are now required to sign up to the latest prevailing victimhood status group, a difference of views and opinion is simply no longer tolerated. Pete's run for the position of Secretary of State in California gives him broad insight and knowledge on the attack of education in America and how best to respond. Pete Peterson is a leading national speaker and writer on issues related to civic participation, and the use of technology to make government more responsive and transparent. He was the first executive director of the bi-partisan organization, Common Sense California, which in 2010 joined with the Davenport Institute at the School of Public Policy to become the Davenport Institute for Public Engagement and Civic Leadership, he has also consulted on several of these projects with local governments, and has directly facilitated public meetings. The "Project" is a unique effort to gather scholars and activists from a variety point on the conservative spectrum to deliberate over, write about, and discuss the future of the conservative movement. Pete writes widely on public engagement for a variety major news outlets including the Wall Street Journal, Los Angeles Times, and San Francisco Chronicle, as well as numerous blogs. He is a regular guest on the "Politics Roundtable" with host Larry Mantle on KPCC radio. He has also helped write several survey-based reports on the subject, including "Testing the Waters: California's Local Officials Experiment with New Ways to Engage the Public" (in collaboration with the League of California Cities), and the "California Civic Health Index" (in collaboration with the National Conference on Citizenship). He contributed the chapter, "Place as Pragmatic Policy" to the edited volume, Why Place Matters: Geography, Identity, and Civic Life in Modern America (New Atlantis Books, 2014), and the chapter "Do-It Ourselves Citizenship" in the volume, Localism in the Mass Age (Wipf & Stock, 2018). Good morning, it's Thursday, April 1st and this is The Herald Review's podcast, the Daily Chirp. We're excited to bring you a closer look at top stories, events in the community, local history, sports, and more.  Today -  Sheriff Mark Dannels and several others, have been dismissed from the Homeland Security Advisory Council. The announcement came one week after Dannel's publicly expressed concern over the Biden administration's policies regarding undocumented migrants coming into the U.S. through Mexico. - Before we begin, some local history. The Garden Canyon Service Station stood on Fry Boulevard. In 1943, the Service Station supplied full-service to its customers offering gasoline at 20 cents per gallon. Station attendants filled the gas tank while washing your windshield and checking the tire pressure without charge. The Station has a colorful history, and they hope that everyone will attend the dedication to hear some entertaining stories about its existence. Just about 10 years ago The Sierra Vista Historical Society dedicated a new historical plaque for the Station.   Now, our feature story.  Sheriff Mark Dannels, along with several other individuals, has been dismissed from the Homeland Security Advisory Council. The Council is a bipartisan panel that was put in place by the Obama and Trump administrations. The “pink slip” to Dannels and about 29 other members was a letter dated March 26 from Alejandro Mayorkas, the new secretary of the Department of Homeland Security.  In a letter, Mayorkas noted that he looks forward to working with everyone in the future, whether as a member of a redesigned Council, or in a different capacity. Dannels discussed the event with Fox News earlier this week:   After the announcement was made, the Washington Post reported that Former Department of Homeland Security officials said they couldn't remember a time when so many members were dismissed at once. The general practice of past administrations was to allow appointees to serve out their terms. Dannels and others who sat on the HSAC have been critical of the Biden administration and its policies regarding undocumented migrants coming into the U.S. through Mexico.  Just a week before Mayorkas sent out the letter, Dannels had participated in a press conference at the border in Douglas that included Gov. Doug Ducey and Sen. Rick Scott.  Both Ducey and Scott noted Biden and Mayorkas are out of touch with what's happening on the Southwest border. Now, Dannels plans to send a letter to Mayorkas. The sheriff said he and other border sheriffs have had a good relationship with the Department of Homeland Security and it was disappointing to see Mayorkas' lack of engagement with that group. The sheriff is also encouraging Mayorkas to reconsider the dismantling of the HSAC, and to begin communicating with border sheriffs. Non-dollar denominated exchange suffered two setbacks this past week. SETBACKS, not wetbacks. The first and most obvious one was the blockage of the Suez Canal, which facilitates a large bulk of bi-lateral exchange between Europe and Asia. The second wasn't quite as obvious, but it was a setback nonetheless: Indonesia's largest oil refinery caught fire Sunday night. Pan-Eurasianists and Indonesians came together in solidarity (albeit online) to express their concern that it was an act of sabotage. Why would someone sabotage a state-owned oil refinery in Indonesia?  Well, maybe it's because Indonesia recently signed bi-lateral trade agreements with China and Singapore to reduce its dependence on the dollar. 90% of Indonesia's international settlements are cleared in dollars despite the fact that trade with America accounts for merely 12% of its exports. Their strides to reduce dollar dependence are somewhat hindered by both the Suez Canal incident and this refinery fire. Maybe that's why the Duginists are big mad... Also: Judicial Watch is suing the DoD over Nancy Pelosi's coup attempt on January 8th and Biden fired every single member of the Homeland Security Advisory Council. I've got the latest! Another week, another Trump administration initiative to hasten the decoupling from China. As with MIRV warheads, the theory seems to be that the next administration can't shoot them all down.  Brian Egan lays out this week's initiative, which lifts from obscurity a DoD list of Chinese military companies and excludes them from U.S. capital markets. Our interview is with Frank Cilluffo and Mark Montgomery. Mark is a senior fellow at the Foundation for Defense of Democracies and senior advisor to the congressionally mandated Cyberspace Solarium Commission. Previously, he served as policy director for the Senate Armed Services Committee under Sen. John S. McCain—and before that served for 32 years in the U.S. Navy as a nuclear trained surface warfare officer, retiring as a rear admiral in 2017. Frank is director of Auburn University's McCrary Institute for Cyber and Critical Infrastructure Security. He also chaired the Homeland Security Advisory Council's subcommittee on economic security. We talk about the unexpected rise of the industrial supply chain as a national security issue. Both Frank and Mark were moving forces in two separate reports highlighting the issue, as was I. So, if we seem suspiciously agreed on important issues, it's because we are. Still, as an introduction to one of the surprise hot issues of the year, it's not to be missed. After our interview of a Justice Department official on how to read Schrems II narrowly, it was only a matter of time. Charles Helleputte reviews the EDPB's effort to give more authoritative and less comfortable advice to U.S. companies that want to keep relying on the standard contractual clauses. Still, the Justice Department take on the topic manages to squeak through without a direct hit from the privacy bureaucrats.  Still, the EDPB (and the EDPS even more) makes clear that anyone following the DOJ's lead is in for an uphill fight. For those who want more of Charles's thinking on the topic, see this short piece. Zoom has been allowed to settle a Federal Trade Commission (FTC) proceeding for deceptive conduct (claiming that its crypto was end to end when it wasn't, and more). Mark MacCarthy gives us details. I rant about the FTC's failure to ask any serious national security questions about a company that deserves some. Brian brings us up to speed on TikTok.  Only one of the Trump administration penalties remains unenjoined. My $50 bet with Nick Weaver that CFIUS will overcome judicial skepticism that IEEPA could not is hanging by a thread. Casey Stengel makes a brief appearance to explain how TikTok might win. Brian also reminds us that export control policymaking is even slower and less functional on the other side of the Atlantic, as Europe tries, mostly ineffectively, to adopt stricter limits on exports of surveillance tech. Mark and I admire the new Aussie critical-infrastructure cybersecurity initiative, mostly for its clarity if not for its political appeal. Charles explains and I decry the enthusiasm of European courts for telling Americans what they can say and read on line. Apparently, we aren't allowed to use Facebook to call politicians “fascists”; but don't worry about our liability. So, in retrospect, how did we do in policing all the new cyber-ish threats to the 2020 election?  Brian gives the government credit for preventing foreign interference. I question the whole narrative of foreign interference (other than the hack and dump operation against the DNC) in 2016 and 2020, noting how conveniently it serves Democratic messaging (Hillary only lost because of the Russians! Ignore Trump's corruption allegations because it's more Russian interference!). Mark and I wonder what Silicon Valley thinks it's accomplishing with its extended bans on political advertising after the election.  They're going to find out it's almost always election season somewhere (see, e.g., Georgia). DHS's CISA produced a detailed rumor control site that may have corrected one too many of the President's tweets.  Chris Krebs, familiar to Cyberlaw Podcast listeners, may be on the chopping block. That would be a shame for DHS and CISA; for Chris it's probably a badge of honor. Frank Cilluffo and Mark Montgomery weigh in with praise for Chris as well. And more. Former agent Ali Soufan served with the FBI for eight years. He investigated highly sensitive and complex international terrorism cases, including bombings and attacks around the world.  In this episode of FBI Retired Case File Review, Ali Soufan reviews his investigation of the attack on the USS Cole where suicide terrorists exploded a small boat alongside the Navy Destroyer—as it was refueling in the Yemeni port of Aden. The blast ripped a 40-foot-wide hole near the waterline of the Cole, killing 17 American sailors and injuring many more. Ali also discusses the events surrounding 9/11. He also discusses his New York Times top 10 bestseller book The Black Banners: The Inside Story of 9/11 and the War Against al-Qaeda and the 10-part Hulu television series “The Looming Tower” in which he and his work are portrayed. During his FBI career, Ali Soufan was assigned to and later supervised the New York Office’s the Joint Terrorism Task Force where he coordinated both domestic and international counterterrorism operations. He often operated out of hostile environments and carried out sensitive extraterritorial missions and high-level negotiations, and has received numerous awards and commendations for his counter-terrorism work. These include the Director of the FBI's Award for Excellence in Investigation, the Respect for Law Enforcement Award for "relentless pursuit of truth and bringing terrorist subjects before the bar of justice," and a commendation from the U.S. Department of Defense that labeled him "an important weapon in the ongoing war on terrorism."  Currently, Ali Soufan is the Chief Executive Officer of The Soufan Group and Founder of The Soufan Center and also serves as a member of the Homeland Security Advisory Council. Mr. Soufan has testified before the U.S. Congress, and Presidential Commissions, and appeared on 60 Minutes, Frontline, The BBC, Newsweek, The Washington Post, The New York Times, and The Wall Street Journal. He is the author of his recently released second book, Anatomy of Terror: From the Death of bin Laden to the Rise of the Islamic State, lays bare the psychology and inner workings of al-Qaeda, the Islamic State, and their spawn, and shows how the spread of terror can be stopped. Since the election, Democrats have struggled with how to respond to a Donald Trump presidency. But one group is starting to get some traction - the authors of an online guide that is going viral: “Indivisible: A Practical Guide for Resisting the Trump Agenda.” Originally posted as a Google document, the guide was co-written by former Congressional staffers Ezra Levin and Angel Padilla, who both received their Master in Public Affairs from Princeton University’s Woodrow Wilson School, Leah Greenberg, and others. At the heart of the publication are two ideas: presidential power is not unlimited, and Congress responds to pressure when applied the right way. Levin and Padilla use their real-world experience with the Tea Party as a model for how citizens can keep the pressure on Congress and get results. In episode #26 of Politics & Polls, Professors Julian Zelizer and Sam Wang discuss the Indivisible guide in depth with Levin and Padilla. Levin is D.C.-based domestic poverty policy wonk. He's served as associate director of government affairs at the Corporation for Enterprise Development, deputy policy director for Congressman Lloyd Doggett (D-TX) and at AmeriCorps VISTA in the Homeless Services Division of the San Jose Department of Housing. He holds a Bachelor of Arts from Carleton College and a Master in Public Affairs from the Woodrow Wilson School of Public and International Affairs at Princeton University. Padilla works for an immigrant rights nonprofit on federal health care advocacy. Padilla previously worked as an immigration policy consultant at National Council of La Raza. From 2009 until 2011, he worked for Rep. Luis Gutiérrez (D-IL), advising on issues related to health care and the Affordable Care Act, among others. Padilla also has interned with the Department of Homeland Security Advisory Council and the Foreign Affairs Committee in the House. He is a graduate of Princeton University's Woodrow Wilson School of Public and International Affairs.
