Marriage and partnerships form a core framework of family law. This lecture begins by outlining the formal requirements for a valid marriage, typically including a marriage license, compliance with minimum age rules, and a ceremony solemnized by an authorized official. Couples must meet statutory prerequisites, such as neither party being currently married and both having the capacity to consent. Certain prohibited relationships based on consanguinity also apply. When all conditions are satisfied—license issuance, solemnization, and record filing—the marriage is fully recognized under state law.Another pathway is common-law marriage, still permitted in a handful of jurisdictions. Rather than requiring an official ceremony, it hinges on the couple cohabiting, holding themselves out as spouses, and intending to be married. If the couple fulfills these elements in a state that allows common-law marriage, they are legally spouses. This carries all rights and obligations of formal marriage, meaning a divorce is required to terminate the relationship. If they relocate to a state that does not permit new common-law marriages, that new state typically still respects a validly formed common-law marriage from another jurisdiction.Prenuptial and postnuptial agreements come next. These contracts define how spouses will handle property and support obligations if the union ends. For prenuptials, the couple negotiates and signs the agreement before marrying; for postnuptials, they are already wed. In either scenario, courts demand that each spouse (or future spouse) voluntarily sign with full disclosure of assets and no undue pressure. The content must not be unconscionable, nor can it predetermine child custody or child support in ways that contravene the child's best interest. While a prenuptial is forged prior to vows, a postnuptial often arises when circumstances shift after marriage, but both share the theme of clarifying financial rights and responsibilities outside the default laws on property division and spousal maintenance.Finally, domestic partnerships serve as another legal status in certain states, offering a subset of marital privileges without requiring a full marriage. Originally popular among same-sex couples pre-marriage equality, they also appear among opposite-sex or older couples seeking limited legal benefits without a full spousal framework. The rights conferred vary widely by state or municipality. Some domestic partnerships provide hospital visitation rights or health insurance benefits akin to marriage, while others merely recognize a partnership for local employment perks. Interstate recognition is inconsistent, meaning relocating partners risk losing this legal standing unless the receiving state or jurisdiction extends comity. Because domestic partnership laws are not uniform, couples relying on them may face challenges in property disputes or if they attempt to enforce partnership-based entitlements elsewhere.In summary, family law's approach to marriage and alternative partnerships reflects a balance between statutory order and societal diversity. A couple can proceed through the traditional licensing and ceremony route, rely on state recognition of common-law principles, or register a domestic partnership where available. Meanwhile, prenuptial and postnuptial agreements give spouses control over finances if the relationship dissolves, provided they are entered knowingly, fairly, and without coercion. Together, these paths illustrate the evolving matrix of legal options individuals have for formalizing their relationships.

God's Word says a husband and wife become one flesh…but it doesn't say anything about prenups.It's true; you won't find “prenuptial agreement” in your concordance. So, does that mean a Christian should never have one?God's Design for Marriage: Oneness and CovenantA prenuptial agreement (prenup) is a legal contract that couples agree to before marriage, outlining how their assets—money, property, and other possessions—will be divided if they divorce. While this can seem like a practical way to handle complex financial conversations, many wonder if it aligns with God's design for marriage.In Genesis 2:24, God sets the foundation for marriage: "A man leaves his father and mother and is united to his wife, and they become one flesh." Paul reinforces this principle in 1 Corinthians 7:4, reminding us that in marriage, even our bodies are not our own but belong to our spouse. This unity is central to God's plan for a thriving marriage—there should be no "mine" or "yours," only "ours."Marriage is also a covenant relationship, reflecting the bond between Christ and His Church (Ephesians 5:31-32). This covenant is built on love, sacrifice, grace, and mutual respect. In a Christ-centered marriage, everything is shared, and the relationship becomes a testimony of God's love to the world.Potential Issues with Prenups in Christian MarriagesWhile a prenup may seem practical, it can introduce harmful dynamics into a Christian marriage. A pilot scheme to offer free counselling to affected jurors has now been shelved in England and Wales due to the election. But in Scotland and Northern Ireland support is available. Joelle discusses all this and what else happens on jury service with criminal defence barrister and part-time judge Charlie Sherrard KC, and with author, commentator and barrister Dr Sam Fowles. Prenuptial contracts: what is a "prenup," as they're often called? Should you get one even if you're not wealthy? Are they legally binding in the case of divorce, or not worth the paper they're written on? What do you need to do for the courts to uphold them in the various parts of the UK? Family law solicitor and social media's "legal queen" Tracey Moloney has the answers. And: Japanese knotweed, a fast-growing invasive species so tough it can only be successfully removed by professionals. A Scottish couple has been granted permission by an Edinburgh sheriff to sue the previous owners of their home, who had not declared that there is Japanese knotweed on the property. This case centres around whether or not it counts as an "infestation". Other home seller packs ask about knotweed explicitly. Dr Sam Fowles explains the law, and who you can sue if you find yourself with unwanted knotweed after all. Family law is a branch of the legal system that deals with issues relating to family relationships, such as marriage, divorce, child custody, and adoption. Understanding the basics of family law can help individuals navigate these often complex and emotionally charged issues. 1. Marriage and Legal Aspects. Marriage is a legal contract that establishes rights and obligations between the partners. Legal aspects of marriage include eligibility (age, consent, and capacity to marry), marital rights (to support, inherit, and share property), and responsibilities (support obligations and liability for family debts). Prenuptial agreements, which define terms in case of a divorce, also fall under this category. 2. Divorce and Separation. Divorce legally dissolves a marriage. Issues addressed in a divorce include: Division of Property: Determining who gets what, either based on community property (assets and debts shared equally) or equitable distribution (assets and debts divided fairly but not necessarily equally). Alimony or Spousal Support: Payments from one spouse to another to maintain the standard of living they had during marriage. Grounds for Divorce: These can be "fault," such as adultery or abuse, or "no-fault," based on irreconcilable differences. 3. Child Custody and Support. Child custody determines with whom the children will live after a divorce and how decisions about the children will be made. Custody can be: Legal Custody: The right to make decisions about the child's upbringing, including education, health care, and religious training. Physical Custody: Where and with whom the child lives. Child support is a payment by the non-custodial parent to the custodial parent towards the expenses of raising the child. The amount is typically based on state guidelines and considers the income of both parents, the needs of the child, and custody arrangements. 4. Adoption. Adoption creates a new, permanent parent-child relationship. It can be through agencies or privately arranged. Legal processes ensure the adoptee's best interests are served, which include termination of the biological parents' rights, assessment of adoptive parents' suitability, and legal recognition of the new family relationship. Conclusion Family law addresses the most personal and fundamental aspects of our lives. Furthermore, it is important to ensure your child is financially stable enough to maintain their property and pay property taxes after they become a homeowner. If you are helping with a partial down payment, your child still needs to be able to qualify for their own loan so they can be on the title. Another area of potential complexity is when a child's partner is involved, as a parent or grandparent may want to ensure that their contribution is protected.
