An Oregon law went into effect this year that helps remove barriers for some Oregonians who want to expunge their records. During a background check, criminal charges will show up on a person's record which can affect things like housing and employment. The Clean Slate Clackamas Project helps Oregonians with the expungement process. We hear more from Amanda Wall, community relations manager for the Clackamas Workforce Partnership and program manager for the Clean Slate Clackamas Project. Jayme is working on getting her records expunged with the project. They join us with details on how the project is going and how it affects Oregonians.

Feven Gerezgiher reports:Last Saturday a Minneapolis dispensary ran Minnesota's first cannabis expungement clinic, working to clear the criminal records of 44 people with non-violent cannabis convictions.Jon Geffen is Director of the Reentry Clinic at the Mitchell Hamline School of Law and provided pro bono legal services along with his students. He says without expungement, people lose opportunities to live the lives they want.“We had a nurse lose a job based on a cannabis related offense,” he said. “We had a lot of people denied housing based on low level cannabis offenses. In Minnesota, a small amount of marijuana is a petty misdemeanor, which is actually defined as not a crime. But you know, landlords, employers, they don't know that. They don't care.”Vireo Health's Director of Medical Education Dr. Paloma Lehfeldt co-organizes expungement clinics for medical marijuana dispensaries across several states, including for Green Goods Minneapolis. “Being a member of this industry, it's my responsibility and our responsibility as a company really, to, you know, right the wrongs caused by the so-called war on drugs,” she said. Lehfeldt says the stigma against cannabis has its roots in efforts to demonize Mexican refugees in the early 1900s. She says people of color continue to be arrested at a much higher rate than their white counterparts.“People think that drug prohibition and drug criminalization, especially of cannabis, has waned in the years, but it really hasn't,” she said.Last year, an ACLU report found that Black people in Minnesota are 5.4 times more likely to be arrested for weed possession, despite similar rates of use.

When a record has been expunged, the chief legislative officer should cross out the words or draw a line around them in the original minutes and write across them the words, ‘Expunged by order of the Senate (or house), giving the date of the order.  3. Expungement of record – The removal of a conviction from a personal's criminal record. Thus, the plain meaning of ‘expunge' is to rescind or erase or destroy. Let us now understand the meaning and the effect of expunging or expungement or expunction with the help of Judicial Precedents. Important Judicial Precedents 1. B.C. Dwivedi v. State of Gujarat, 1995 SCC OnLine Guj 190 - If any adverse material is taken into consideration against a government servant to his/her detriment and such material has later on become non-existent, then his/her case is entitled to be reconsidered on the ground that Article 16 of the Constitution of India mandates fair consideration. 2. M. Paramsivam v. Union of India, 2008 SCC OnLine Mad 721 – In case of a matter relating to promotion, tenable explanation or statement is required from the Competent Authority as to how the expunction of adverse remarks had no consequence on grading already made in relation to the government servant whose promotion is in question. 3. U.S. v. Abilene & Southern Railway Company, 265 US 274 – “It is a denial of due process for a commission to rest on conclusion upon facts of which he takes judicial notice, where the facts are unknown and there is no way to find them out such facts being withheld from the record”. 4. Purshottam Dass Gupta v. Union of India, 1999 SCC OnLine Del 420 – “The authority exercising quasi judicial power is under an imperative constitutional obligation with a sense of official responsibility for impartial with objective consideration of materials available on record.”5. U.P. Jal Nigam v. S.C. Atri, (1999) 1 SCC 241 – The effect of the order allowing the expunction of the adverse entry would be that on the date on which the government servant was considered for promotion, there existed no adverse entry in his/her character roll. Subsequently, it cannot be said that such government servant was not promoted on account of his unsuitability. 6. Baijnath Rajput v. State of M.P., 2005 SCC OnLine MP 324 – If the adverse Annual Confidential Reports (ACRs) are expunged, it would mean that they were not in existence. An employee is entitled for the benefit after the expunction of his adverse ACRs, otherwise there would be no use for expunging his adverse ACRs. The legal effect of setting aside of adverse remarks would be that the remarks must be treated as non-existent in the eye of law. Conclusion We see that an employee is entitled to claim benefits of the expunging of adverse remarks. However, cogent reasons will have to be cited for expunging of adverse remarks and it would have to be explained how those remarks will affect the career progression of the concerned employee. Similarly, in legislatures too, sometimes certain remarks are made that should otherwise not have been made. Expungement of record is a valuable tool in such situations in the hands of the legislature to strike off such remarks from the record as though they never existed.

Families impacted by police homicide and police brutality survivors release a collective list of demands amid the special Nevada State Legislature session In response to the sustained interest in police violence prompted by the extrajudicial killing of George Floyd of Minneapolis on May 25, 2020, the last several weeks Families United 4 Justice - Las Vegas, a coalition of families impacted by police homicide and police brutality survivors, have organized to identify a collective list of demands for the Las Vegas Metropolitan Police Department (LVMPD), Nevada police, and local, state, and federal governments. The demands include the immediate resignation of District Attorney Steve Wolfson for his failure to adequately investigate and prosecute officers who violate human and civil rights, the demilitarization of the LVMPD, and the abolishment of the Las Vegas Police Protective Association, the local police union that obstructs police transparency and accountability during police homicide investigations. The demands also call for the creation of a version of the Victims of Crime program for police homicide victims and police brutality survivors as those directly impacted often do not qualify for Victims of Crime or are not made aware of the program causing them to miss the application deadline. The 36 demands are being called by the families of LVMPD police homicide victims Leopoldo Tijernia, killed on May 5, 2005, Joseph Justin killed on August 22, 2007, Rafael Olivas killed on July 14, 2011, Sharmel Edwards, killed on April 21, 2012, Thomas McEniry, killed on November 24, 2015, Keith Childress, Jr., killed on December 31, 2015, Rex Wilson, killed on October 13, 2016, Tashii Brown, killed on May 14, 2017, Junior Lopez, killed on April 6, 2018, Nicholas Farah, killed on March 31, 2019, Byron Williams, killed on September 5, 2019, Jorge Gomez, killed on June 1, 2020, the family of James Neske who was killed during an altercation with another civilian inside Clark County Detention Center on July 15, 2019, the family of Nathan Benson who was shot by LVMPD on April 29, 2013 and to this day still hasn't healed from the bullet wound due to the inadequate medical care at Clark County Detention Center, and who remains in solitary confinement despite never being charged for a crime while suffering from mental illness, Clark County resident Tonya Brown, mother of Tyree Davis who was killed by Chicago police on January 4, 2020, Clark County resident Nasha Myart, aunt of Stephon Clark who was killed by Sacramento police on March 18, 2018, LVMPD police brutality survivors, Cristina Paulos, Jesus Carvajal and Terry Rogaczewski.
