In this episode recorded on 19 December 2023, the wigs analyse the decision of the High Court in NZYQ v Minister for Immigration 2023 HCA 37, one of the most important public law decisions in recent decades which was handed down on 28 November 2023. In the decision, the court unanimously overturned an earlier decision in Al-Kateb. It held that long-standing constitutional principles forbid indefinite detention of non-citizens who cannot be removed from Australia. The judgment has been massively controversial and the federal parliament legislated in December last year in response to it to create a system of monitoring and regulation applying to those persons affected directly by the decision. We do apologise for the delay in releasing the episode but we hope it's still an interesting and useful discussion of one of the most important principles in Australian constitutional law, that detention is prima facie punitive and can generally only be imposed by a court following an adjudication of guilt.See omnystudio.com/listener for privacy information.

The WA Government has moved to repeal a controversial law that allows the indefinite detention of people who have been deemed too “mentally impaired” to stand trial or be convicted of a crime.

Ideally, when a person who may have committed a crime is deemed to be seriously mentally ill, a fair and rational criminal justice system will give them meaningful mental health treatment in a humane environment. But, in the federal system, mentally incompetent defendants who have never been found guilty of ANY CRIME will be warehoused in federal prison and held indefinitely. Even those who are not dangerous and have been previously granted pre-trial release, can be sent to prison, having never been convicted of any crime. Donna Elm is a veteran defense attorney, author, former therapist, and has much experience in the realm of mental health litigation. She and I litigated just such a case together in 2006, and that man sits in prison, to this day, still having never been convicted of any crime. This is our system. At the center of it all, is Dr. Charles Thomas Sell. He was a St. Louis Dentist who resisted the government's effort to force medicate him with powerful anti-psychotic drugs, while in custody for seven years, again, having never been convicted of crime. He fought his case all the way to the supreme court and won. Passon documented his story on film. Rosie Wennberg joins me to talk about two essays from Judith Butler's Precarious Life (2004): "Violence, Mourning, Politics" and "Indefinite Detention," both of which deal with different post-9/11 American phenomena. The first touches on the universal experience of grief and how it can inform politics, and the second addresses the indefinite detention of humans in the prison at Guantanamo Bay. We try to understand Butler's analysis and Rosie shares some of the more memorable passages.
As Barack Obama makes a desperate effort to clear his desk of campaign promises during the last stages of his presidency, the Guantanamo Bay issue will plague his legacy even if Gitmo's doors were miraculously closed today. The issue is not Guantanamo Bay, the issue is indefinite detention. As long as the United States retains the authority to arrest and hold a person without charge or trial forever, where that person is being held is irrelevant.

This presentation is a sobering examination of the Canadian government's use of security certificates, a Kafkaesque tool that allows for indefinite detention without charges, based on evidence not revealed to the accused or their lawyers. Since 1999, this rare and highly controversial device has been used to detain at least five men for nearly 30 years combined. To date, none has been charged with a crime or seen the evidence against them. Mohamed Harkat was arrested under a security certificate in 2002. He spent 43 months in jail (one year in solitary confinement) before being released under strict house arrest conditions in 2006. Mr. Harkat was the center of the second Supreme Court challenge against security certificates, a challenge that was lost late last year. He presently lives under restrictions in Ottawa with his wife Sophie Harkat. Sophie Harkat a graduate student in Public & Media. She has traveled extensively across the county and to the UK to talk about Security Certificates and granted hundreds of interviews with reporters from around the world about her husband's case. She has been a guest speaker at universities & conferences. One of her most memorable events was when she spoke with Jack Layton at a large rally in front of 20,000 people in 2004. She was given a human rights award by CAIR-CAN in 2004. It's a dangerous law that continues to breach the 1st, 4th, 5th, 6th and 7th Amendments, and allows the President to hold people without trial -- as long as he desires. It also gives him the ability to curtail speech and imprison reporters if he's inclined. Not a good idea, and contrary to the US Constitution. Then we talk about the paucity of good reporting when it comes to economics.
