Infertility Problem Solving Protocol Host Laura Reeves is joined by Dr. Marty Greer for a conversation about the problem solving protocol for infertility using a case study submitted in the private Pure Dog Talk Patrons group. Greer's first recommendation for fertility issues is to have a complete semen analysis on the stud dog. “There are six parameters that we should look at for semen quality. It should be volume, sperm count, the motility, the morphology, the longevity and speed of progression. …(I)t's much easier to analyze the fertility on a male dog that is a female.” Greer continues with discussion of “lifestyle” choices of the bitch. Nutrition choices, sunlight exposure and more. “The foods that we see that we have good success with, are going to be Purina and Royal Canin. Those are the two diets that we reliably see good fertility with. Purina, their Sport 30/20, which is 30% protein, 20% fat is a really good diet for fertility and the Royal Canin makes a pregnancy diet, the only pregnancy diet that currently is on the market. “Dogs need 14 hours of daylight. And if you don't have the opportunity to have it, if you don't live in a climate that you can do that. Where you're building isn't set up for it or whatever it happens to be. You can get full spectrum light bulbs and turn them on for 14 hours a day. “We also see high performing dogs,  dogs traveling with a handler or they're out at field trials every weekend and they're running hard or hunt tests or whatever activity you happen to be doing. Sometimes just being away from home can be really stressful for the dogs and we can see that affecting their fertility.” Greer continues with other potential infertility causes and treatments. In this case, the court considered this issue: Can a plaintiff whose state-court lawsuit has been removed by the defendants to federal court seek to have the case sent back to state court by amending the complaint to omit all references to federal law? The case was decided on January 15, 2025. The Supreme Court held that when a plaintiff amends her complaint to delete the federal-law claims that enabled removal to federal court, leaving only state-law claims behind, the federal court loses supplemental jurisdiction over the state claims, and the case must be remanded to state court. Justice Elena Kagan authored the unanimous opinion of the Court. Federal jurisdiction is based on the operative complaint, which means that when a plaintiff amends their complaint, courts look to that amended version to determine jurisdiction. Federal courts can exercise supplemental jurisdiction over state law claims when they are part of the same case as federal claims. However, this supplemental jurisdiction flows from the existence of federal jurisdiction; when federal claims are eliminated, there is no longer any basis for supplemental jurisdiction over the state law claims. This principle applies equally to cases that were originally filed in federal court and those that were removed from state court, as the supplemental jurisdiction statute (28 U-S-C § 1367) makes no distinction between the two situations. When Wullschleger amended her complaint to remove all federal claims after removal, the federal court lost its basis for federal question jurisdiction. Without any federal claims remaining, the court also lost supplemental jurisdiction over the state law claims. Therefore, the entire case had to be remanded to state court. This Day in Legal History: Great Chicago FireOn October 8, 1871, the Great Chicago Fire ignited, marking one of the most devastating urban disasters in U.S. history. The fire burned for two days, fueled by dry conditions and wooden structures that dominated the cityscape. It destroyed over three square miles of Chicago, killing around 300 people and leaving 100,000 residents homeless. In the aftermath, the catastrophe highlighted the dangers of poor urban planning and inadequate fire-prevention measures.The devastation led to a complete overhaul of building codes and fire safety regulations. Chicago introduced stricter fire-resistant building requirements, mandating the use of materials like brick, stone, and iron instead of wood for new construction. The city also improved its firefighting infrastructure, investing in modernized equipment and more efficient water systems.These reforms had a ripple effect across the country, influencing urban development nationwide. Many U.S. cities adopted similar codes, fundamentally reshaping fire safety standards. Today, much of modern building regulations, including fire codes that require sprinkler systems and fireproof materials, can trace their origins back to the lessons learned from the Great Chicago Fire of October 8, 1871. The event is a lasting reminder of how disasters can drive lasting legal and regulatory changes.The U.S. Supreme Court recently heard arguments over whether a federal court can continue to oversee a consumer class action against Royal Canin and Purina after the plaintiffs amended their lawsuit to remove federal claims. The case involves claims from pet owners who argue that the companies misled them into believing prescription pet food was required and conspired to inflate prices. Initially filed in Missouri state court, the case moved to federal court after Purina's request. The companies' attorney, Katie Wellington, argued that federal jurisdiction should remain despite changes to the lawsuit, citing Congress's codification of supplemental jurisdiction principles. However, justices like Elena Kagan and Chief Justice John Roberts expressed skepticism, questioning whether a prior version of the lawsuit, no longer relevant, should dictate jurisdiction. Both seemed to support the companies argument initially but appeared to reconsider after hearing from the consumers' attorney, Ashley Keller, who maintained that the Eighth Circuit correctly returned the case to state court.The case's procedural history, including its back-and-forth between courts, complicates the jurisdictional question. The justices appeared to struggle with balancing precedents and whether altering the claims should impact the court where the case is heard. The broader question hinges on civil procedure and jurisdiction when a lawsuit is amended post-removal from state to federal court.The concept of supplemental jurisdiction, which allows federal courts to retain jurisdiction over state law claims if a case initially involves federal claims, even if the federal issues are later removed is central to the companies' argument.Supreme Court Wrestles With Venue in Prescription Pet Food FightFTX has received court approval to begin repaying billions of dollars to customers after its bankruptcy plan was approved by U.S. Bankruptcy Judge John Dorsey. The plan allows FTX to use up to $16.5 billion in recovered assets to repay customers affected by the crypto exchange's collapse. Under the plan, 98% of customers with claims of $50,000 or less will be repaid within 60 days of the plan's activation. FTX's bankruptcy was triggered by founder Sam Bankman-Fried's misappropriation of customer funds to cover risky bets made by his hedge fund, Alameda Research. Bankman-Fried was sentenced to 25 years in prison, and FTX has been recovering assets ever since.FTX will prioritize customer repayments over claims from U.S. government agencies like the IRS and Commodity Futures Trading Commission. The company has worked with global liquidators and settled various disputes to move forward with repayments. Some customers, however, are unhappy with the repayment structure, citing the rise in cryptocurrency prices since 2022, which they feel should be reflected in their recovery amounts. Despite these objections, FTX argues that it is not feasible to return the same crypto assets, as they were largely misappropriated.FTX cleared to repay billions to customers after bankruptcy plan approval | ReutersThe EPA has finalized the Lead and Copper Rule Improvements (LCRI), mandating an accelerated replacement of lead service lines in drinking water systems. The new rule requires replacing 10% of lead pipes annually over a decade, up from the previous 3%, with the process beginning in 2027. The EPA estimates that up to 9 million lead pipes remain in use across the U.S., posing significant health risks, especially to children. The rule also lowers the lead action level in drinking water from 0.015 to 0.010 milligrams per liter, triggering faster public notifications and filter distribution when lead is detected.The effort is backed by $15 billion from the 2021 infrastructure law, along with additional funding from the Drinking Water State Revolving Fund. It closes loopholes allowing extended replacement times and pressures homeowners to replace privately owned lead pipes. The rule reflects the Biden administration's emphasis on clean water as a priority, though legal challenges to the LCRI are expected. EPA Administrator Michael Regan reiterated that no level of lead in drinking water is safe due to its severe health impacts.EPA to Finalize Mass Lead Drinking Water Pipe Replacement PlanAnd in my column for Bloomberg this week, I talk a bit about a favorite bugbear of mine: film production tax incentives.California is losing its dominance in the film industry as productions move to other states and countries offering more attractive tax incentives. While expanding California's film tax credits might seem like an immediate solution, this approach could worsen the competition among states, leading to a "race to the bottom" in offering incentives. Hoy os voy a contar las aventuras, desventuras y Ice Ventura de Luis García-Berlanga Martí, guionista y director de cine cuyo buen hacer en la industria del cine creó todo un género cinematográfico que llevaría su propio nombre: el berlanguiano. Berlanga nació en Valencia en 1921 en el seno de una familia acomodada y en el coseno de grandes terratenientes y pa que veáis que en este país la meritocracia es evidente, palpable e inimputable, su abuelo y su padre eran… ¡POLÍTICOS! Si es que una cosa te lleva a la otra y claro… Esto solo demuestra que el hecho de que los influencers de hoy lleven apellidos compuestos es algo que ya se hacía antes. Total, que el bueno de Berlanga ya hizo algo que también se hace hoy, que es ser el rebelde de la familia, pero teniendo las espaldas bien cubiertas que el Royal Canin para los galgos y la furgoneta camperizada para pasar el verano en Ibiza escuchando a Macaco a todo lo que da no se pagan solas. Y él estaba tan convencido de sus ideales que se alistó a la División Azul para luchar con los Nazis en contra de la Unión Soviética, para evitar represalias. Ya sabéis que la División Azul fue un grupo de combatientes que cantaban cosas como Margarita se llama mi amor para acojonar al enemigo y sobre todo desmoralizarlo. Una gracia de Franco para devolverle el favor de la legión Cóndor a Hitler. Hitler, un gachó con el que comparto una cosa. Sí, sí yo con Hitler y es que a ninguno de los dos nos gusta la gente que no es clara. Bueno, volviendo con el bueno de Berlanga, empezó a estudiar derecho y luego filosofía y letras escribiendo sin pretenderlo el guión que tantos niños de papá repetirían después. Porque tener pasta de nacimiento suele dejar como secuela el no tener mu claro lo que uno quiere hacer con su vida mientras el plato de lentejas te lo pone otro en la mesa. Y es aquí donde, por fin, descubre su vocación: Pupá, quiero ser cineasta!! En 1947 se inscribe en el Instituto de Investigaciones y Experiencias Cinematográficas de aquí de Madrid y ahí empieza a hacer cortos mientras el resto del país, de comida, andaba corto. Berlanga demuestra ser un gran aficionado al erotismo ¡Nos ha jodío! Y codirigió una colección literaria sobre el tema que concedía el premio sonrisa vertical, porque él todo lo que sabía del sexo era por lo que había leído. Y como todo no iba a ser tocarse los güevos, se pone a trabajar duro para dejar un legado cinematográfico amplio, vasto y brillante dejando auténticas joyas que a día de hoy siguen tremendamente vigentes. Forma tándem con el ingenioso guionista Rafael Azcona y juntos firman obras maestras como ‘El Verdugo’ donde le echan arrestos a la cosa y producen una furibunda crítica al régimen franquista y a su dedicada devoción a ejecutar a gente que, por lo que sea, no les convenía que respirara. Destaca la parodia ‘Bienvenido Mr. Marshall’ donde Berlanga ridiculiza la posición española con respecto al gobierno americano. Años después Aznar haría su propia remake de este clásico…¡Estamos trabajando en elluu! Su sello lo llevan otras muchísimas obras, como Plácido que dejó para la posteridad la frase: Siente a un pobre a su mesa; la trilogía Nacional con la Escopeta Nacional, Patrimonio Nacional y Nacional III de visionado obligatorio para todo aquel que quiera entender cómo fue la transición española y además darse un buen lote de reír, o La Vaquilla, un retrato de la sinrazón de la guerra civil española con la que usted podrá llorar… de risa. Se casó en 1954 con María Jesús Manrique de Aragón y tuvieron cuatro hijos todos ellos vinculados con las artes, el cine y los medios de comunicación. Falleció el 13 de noviembre de 2010 en su casa de Pozuelo de Alarcón por causas naturales, ¡ojo!, que por causas naturales también falleció Kennedy, porque si te meten tres tiros en la cabeza lo natural es que te mueras. Pero vamos, que en este caso se refiera a que murió de viejito habiendo dejado un legado de incalculable valor artístico, social y cultural y ustedes le podrán recordar siempre que quieran llorar de risa o piensen, como Hitler, que no les gusta la gente que no es clara.

In the previous episode of Petworking, Daryl Hatton and I delved into the difficult topic of financial euthanasia and its role in the increasing compassion fatigue among veterinarians. We highlighted the alarming mental health crisis in the veterinary field, underscored by a high suicide rate and the startling statistic from Royal Canin that 70% of veterinarians have known a colleague or peer who died by suicide. Mars Petcare's projection of a 41,000 veterinarian shortage in the U.S. by 2030 due to burnout and exit from the profession paints a grim picture. This week, we shift focus to another significant challenge in veterinary medicine: non-compete agreements. Joining us is Paul Diaz, founder of Offer First, and my college friend and legal expert, Henry Whitehead. They bring a blend of personal experience and legal insight into the impacts of non-competes on veterinarians' careers and mental health. Our discussion covers the legal nuances, emotional toll, economic consequences, and ethical considerations of these agreements, especially in light of the FTC's anticipated vote on banning such clauses in employment agreements by 2024. With Henry's legal expertise, we discussed the following aspects of non-compete agreements, both in the veterinary profession, and in general. Why the enforceability of non-compete agreements is highly dependent on state law and specific circumstances Employer motivation for utilizing non-compete agreements, and alternative methods for protecting business interests while ensuring better care for animals and improved working conditions for veterinarians The emotional health impacts on those subjected to non-compete agreements and the potential for limiting career mobility The economic impacts of non-compete agreements, specifically with respect to depressing veterinary wages The financial risk associated with defending against a non-compete lawsuit, and why it's generally more cost-effective to hire a lawyer for front-end contract negotiation. Non-competes might not always be enforceable, but the risk and expense of defending against them can be significant The relationship between the projected shortage of veterinarians and the use of non-compete agreements. At a time when pet parents' access to veterinary care is severely limited, is it ethical to limit veterinarians' ability to practice for the sake of preserving business interests? Why some leading veterinary businesses have abandoned the use of non-competes, and whether we could see this model replicated in the near future, not withstanding the fact that the FTC is expected to vote on a rule to ban non-compete clauses in employment agreements in April 2024

Je vous parlais de l'effondrement du taux de fécondité en Europe. Je vous avais également expliqué qu'à terme, notre problème ne sera pas une planète surpeuplée, mais au contraire vide à cause de cet ajustement, de cette démographie inversée qui frappe tous les pays, y compris en Afrique et en Asie. Mais j'avais oublié de partager avec vous un élément important : nos animaux domestiques sont sans doute en train de remplacer nos enfants en termes d'affection. J'ai eu la puce à l'oreille en lisant le post d'un ami consultant dans lequel il s'affiche avec son chien en photo et dans lequel ses amis affirment qu'il ne s'attendait pas à trouver au travers de son chien un consultant en stress. Et il finit son post en recommandant aux entrepreneurs qui cherchent un associé silencieux, fidèle et toujours de bonne humeur d'opter donc pour un compagnon à quatre pattes. Il ne croit pas si bien dire, comme l'a fait remarquer justement Marc Fiorentino, un commentateur boursier bien connu. Ce n'est pas un hasard non plus si l'un des livres qui cartonne le plus en librairie en cette rentrée littéraire a pour titre "Pourquoi j'ai choisi d'avoir un chien et donc pas un enfant" d'Helen Gatto. Pas de chiffres pour la Belgique, mais je viens de voir qu'en France, 15 millions de ménages ont au moins un chat et 12 millions de ménages ont au moins un chien et seulement 8 millions de ménages ont au moins un enfant. Le business connaît très bien l'importance de ces chiffres. Raison pour laquelle les assureurs, même si c'est encore timide en Belgique ou en France, s'engouffrent dans ce créneau. Ils savent qu'en Suède, nonante et 1% des chiens sont assurés et 56% des chats le sont également. Working as an Army veterinarian after graduation and taking care of the Military Working Dogs returning from deployment spurred her interests in behavior medicine. Dr. Pike completed a Residency program and became board certified in 2015. She is owner of the Animal Behavior Wellness Center and was recently named one of the “Top Veterinarians of Northern Virginia” by NoVa Magazine for the sixth year in a row. Dr. Pike speaks all over the world about veterinary behavior medicine, she has been published in numerous veterinary journals, she has conducted and published two scientific research studies, and is a contributing author in five clinical text books. She mentors 4 clinical behavior residents and is a clinical instructor for E-training for dogs and the Masters Program in Applied Animal Behavior at Virginia Tech. She is an advisory board member for Royal Canin, Fear Free, and the Animal Welfare League of Arlington, and is a consultant for Chewy, Inc. In her (fairly non-existent) spare time, she enjoys gardening and hanging out with her active-duty Army husband of 20 years, their 14 yr old daughter, and 9 yr old son, and their menagerie- Dobby (6 yr old Devon Rex), Ike (4 yr old Giant Schnauzer), Scooby (2 yr old, Mini schnauzer), Ginny (10 month old Airedale), Prickles (1 yr old Hedge Hog) and Pavlov (16 week old Indian Ringneck Parakeet).

Staci Scolavino, VMD, graduated from the University of Pennsylvania School of Veterinary of Medicine. Prior to veterinary school, she worked as a research technician at Harvard Medical School, and co-authored three novel scientific publications.  After graduation, Scolavino completed an internship at Oradell Animal Hospital and then practiced as an associate veterinarian at Red Bank Veterinary Hospital. To pursue her passion for nutrition and research, Scolavino joined Royal Canin as a scientific services veterinarian. She worked primarily with their diet lines by developing scientific reasoning for vets, stakeholders and the general public.
