On March 26 the Texas House Committee on State Affairs heard public testimony on HJR 98, a clean Article V application for proposing fiscal restraints, jurisdictional constraints, and term limits on the federal government and its officials. Texas was state #11 to pass COS Action's resolution, but that legislation had an expiration date. HJR 98 would ensure Texas remains at the forefront of the COS movement. After an opening statement by State Representative Cody Vasut, several other locals spoke, including Texas resident Mark Meckler and a representative from the Texas Public Policy Foundation. Opponents also showed up to testify, including reps from the Soros-connected Common Cause and Eagle Forum. After a closing statement from Rep. Vasut, Regional Director Jonathan Viaud reacts to the hearing with Andrew Lusch. They discuss the Texas team's strategy for the hearing and what happens next in the process.

The part that caught my attention was, 16 These likewise are the ones sown on stony ground who, when they hear the word, immediately receive it with gladness; and they have no root in themselves, and so endure only for a time. Afterward, when tribulation or persecution arises FOR THE WORD'S SAKE (emphasis mine) immediately they stumble. My thought was, why persecution and tribulation for the word's sake. As citizens we face the unsettling possibility of being taxed out of our homes, while potential homebuyers are challenged by soaring property taxes. So to address these concerns, we passed Senate Bill 2 and HJR 2 which represents the most extensive property tax reduction initiative in Texas history. In this podcast, Hill Country resident Tom Fox visits with the people and organizations that make this the most unique areas of Texas. Join Tom as he explores the people, places and their activities of the Texas Hill Country.   It's no secret that Texas farmers and ranchers are facing a variety of challenges. But thanks to the progress made during the 89th Texas Legislature, some of these issues are being addressed. In this episode of the podcast, Tom Fox speaks with Carter Keating, the founder and executive director of Texas Agriculture Connection, a nonprofit advocacy organization, about the progress made during the recent legislative session. Keating explains how House Bill 1750 and House Bill 23 Eight strengthened the existing right to Farm statute, and how House Bill Nine used fiscal policy to access federal resources for Texas to develop and operate broadband infrastructure. Additionally, he talks about the New Water Supply for Texas Fund, which was established to finance water supply projects and develop 7-million-acre feet of new water supplies over the next ten years. He also discusses the Texas Water Fund, which provides funding for repair and replacement of water infrastructure, awareness programs, and rural political subdivisions. Keating also explains the importance of broadband access. He points out that 7 million Texans across 3 million households lack quality, high speed broadband Internet access, which can have a negative impact on education access, health care outcomes, and businesses' ability to compete. House Bill Nine made use of some very smart fiscal policy to put up matching funds to get access to federal resources for Texas to develop and operate broadband infrastructure. The organization also worked on House Bill 2851, which would increase the maximum size of a grant under the Young Farmer Grant Program from twenty thousand dollars to thirty-five thousand dollars. House Bill One, the general appropriations bill, appropriated $500,000 to the Young Farmer Grant Program over the next two years. Keating also talks about his plans to travel across the state to solicit the opinions of farmers and ranchers and other agricultural producers. He explains that the issues for farmers are fairly consistent across the state, with water, broadband, and infrastructure being important issues that span across the state of Texas. In addition to the legislative progress made, there are 14 proposed constitutional amendments on the ballot in November. Texas Agriculture Connection and TAC are in support of voting yes on three proposed constitutional amendments: HJR 126, HJR 125, and SJR 75. Finally, Keating discusses the 18-month period between the end of one regular session and the start of the next regular session. He explains that Texas Agriculture Connection and other organizations will be focusing on hearing from farmers and ranchers about their issues over the next 18 months. This episode provides an insightful look into the progress made in the Texas Legislature and the issues that are important to Texas farmers and ranchers. It's clear that the right to farm, broadband infrastructure, water infrastructure, and young farmer funding and support are all important issues for Texas farmers and ranchers. With the progress made during the 89th Texas Legislature and the upcoming constitutional amendments, Texas farmers and ranchers can look forward to a brighter future. Call to Action on HJR1 and Statehouse Update The sixty percent constitutional amendment increase has reached a critical point. HJR 1 passed out of the Constitutional Resolutions Committee on Wednesday, making the discharge petition of no effect. The bill is now in the purview of the Speaker's power as to when it would come to the floor for a vote. The only day scheduled for session this week is Wednesday, and that is when the budget is scheduled to be voted out of the House. Here to discuss the constitutional amendment resolution and the state budget is Greg Lawson, research fellow of the Buckeye Institute.  Ohio SAFE Act H.B. 68 with Rep. Gary Click Protecting Ohio's Children from Transitioning Drugs and Surgery State Rep. Gary Click of Ohio's 88th District has re-introduced Ohio's SAFE Act, H.B. 68. Last year, the legislation received hearings in committee from young people who had gone through the horrible experience of transitioning from their birth gender by hormonal treatment and in some cases irreversible surgeries. Their heart-wrenching stories stirred the committee members, and the evidence was undeniable of how harmful this indoctrination of gender dysphoria is to our young people. Wiggam was the chair of a special committee that Speaker Stevens concocted back on February 16th after he stalled the measure by not conducting hearings or calling for House sessions in which the measure may have passed before the February 1st deadline to get on the May ballot. Many believe that was the payback that  Rep. Jason Stevens gave to the 32 Democrats in exchange for their votes for his speakership. Speaker Stevens won the speaker's vote with only 22 Republicans and all 32 Democrats. On March 30th he removed Rep. Wiggam from the chairmanship of the Constitutional Resolutions Committee in retaliation for Rep. New Mexico in Focus Senior Producer Lou DiVizio opens the show with updates on several pieces of legislation moving through the Roundhouse: SB 73 would open primary elections to all voters in the state if passed. Right now only party-affiliated voters can participate. The bill passed the Senate last week and now moves on to the House. HB 7 would guarantee access to reproductive and gender-affirming healthcare to anyone in the state is passed. It was voted through the House last week. HB 4 would reform elections in several ways – by expanding automatic voter registration, allowing convicted felons to vote, creating a voluntary, permanent absentee voter list, and enacting the Native American voting rights act. It moves on to the Senate after passing the House last week. Also last week, the House Taxation and Revenue Committee voted to table HB 230, which would increase alcohol taxes by 25-cents per drink. The chair of the committee, State Representative Derrick Lente says they'll have to wait and see if a compromise can be reached. SB 418 would modernize the state's Oil and Gas Act by considering the impacts on the environment and disadvantaged communities. It will go before the Senate Conservation Committee this week. After that, New Mexico in Focus Political Correspondent Gwyneth Doland catches up with three lawmakers to ask about some good governance legislation, including two HJR 2 and HJR 8, which would modernize the state legislature. Then, Gene Grant and the Line Opinion Panel talk through those good governance bills, and debate their potential effectiveness. Gene and the Panel also discuss a SJR 1 which would recreate a state board of education, making that the authoritative body on education, instead of the current system of a single Public Education Secretary. Finally, New Mexico in Focus Correspondent Antonia Gonzales speaks with newly-elected Navajo Nation President Buu Nygren about his first month in office, and his priorities for the tribe through the remainder of his term. The news of Texas covered today includes: Our Lone Star story of the day: Next year’s primary elections so likely to be delayed that the Senate passed a bill with with a selection of new dates for filing to run, the primary and run off elections. Many gun and Second Amendment related bills made it through committee in the Senate but Constitutional Carry was not one of them. Rep. Slayton says his border wall bill, to have Texas complete the wall and bill the feds, will not get a hearing in committee by Rep. Chris Paddie effectively killing it. Texas Alliance for Life demonstrates why I call it a pro-life group to give cover to those who are often not pro-life in attacking Senator Hughes’ SB917. That bill makes needed changes to how end of life care decisions are taken by hospitals and other healthcare providers. The alliance claims our broken system, which gives patients and families little due process, is a “successful” dispute resolution process and that changing such will set the pro-life movement back “22 years.” Sickening. Texas Right to Life is right on this one. Bond/bail reform HJR by Kacal heard in a House committee. It is a tricky issue but judges do need a way to better make judgment calls. Texas Democrats and their front groups argue for giving “direct payments” to Texans “hurt” by the winter freeze and to use our state Rainy Day Fund as the source of the payments. Meanwhile, ERCOT sues to enjoy protection against lawsuits through sovereign immunity. And, Senator Hancock argues for bill that would let power companies borrow from the state at higher than market interest rates. It’s a bill we really do not need. On this week's conversation, Paul and Wally discuss the fact that New Mexico's COVID situation continues to improve. More counties are moving into turquoise, green, etc. When will the Gov. relinquish her powers? There's no indication of that. Paul works out with a mask on for the first time. The mainstream media is starting to acknowledge that lockdowns haven't done anything to improve COVID outcomes.  NM unemployment rate is 8.7%, 48th in the nation. There is a clear pattern among the lowest and highest unemployment states.  The New Mexico Legislature is coming down the stretch with its conclusion on Saturday, here are some bills/issues to watch: HB 291 is an economically-harmful tax hike. Recent changes make it even worse. Plus, why is the Legislature considering raising taxes with a surplus AND federal money flowing into NM? The mandatory paid sick leave bill, HB 20 is likely to pass. It is headed to the Senate. The bill makes no exceptions for small businesses. According to the New Mexico Chamber of Commerce, it would apply to babysitters, a leaf-raker hired for a single day’s work or a mom-and-pop shop with one part-time employee. All employees would accrue at least one hour of sick leave for every 30 hours worked, capping at 64 hours annually. It wouldn't apply to government workers. SB 42 pension bailout for the Education Retirement Board is unhelpful.  HB 4 Civil Rights Act ready for final passage in Senate.  The Legislature still hasn't passed a budget although initial appearances are that the Senate will go with pay hikes for state employees. Could there be a special session? SB 130 which would have mandated that 75% of New Mexico's fleet vehicles be electric failed in committee over the weekend: No action will be taken this session on constraining Gov.'s powers. No bills OR the constitutional amendment are moving. Trouble for HJR 1 pre-K amendment and pot legalization? Rail Runner took a year off but you'd never know from looking at their budget.  What energy sources REALLY failed a few weeks ago in Texas?

On this week's podcast discussion which is being recorded near the midpoint of what is shaping up to be a very busy 30 day legislative session, Paul and Wally start by discussing the so-called "Red Flag Bill" which has been introduced in the New Mexico Legislature. SB 5  passed its first committee, SenatePublic Affairs. All of the Democrats voted for it (including Liz Stefanics and Jeff Steinborn). All Republicans voted against the bill. Spurred in part by this legislation a rally was held at the Roundhouse against Red Flag bill and in favor of gun rights on Friday. RGF was in attendance. SB 60 and SB 201 by George Munoz would change the requirements of who serves on the PERA board in a good way SB 72 which actually makes the pension changes made it out of Public Affairs Committee (Stefanics and Sedillo-Lopez voting against). You can read the editorial that Paul and Len Gilroy wrote on the issue here.  Paul and Wally further discuss NM’s PERA system which has created a large number of millionaires: https://errorsofenchantment.com/nms-10000-pera-pension-millionaires/ Social Security bills move forward in legislative committees, but as the AlbuquerqueJournal reports, they are “gaining momentum,” but according to Speaker Egolf are "unlikely to happen" because all of the surplus money has been “spoken for” by the various agencies. HJR 1 to tap permanent fund is again moving in the session, but a leading expert from the center/left Brookings Institute throws some cold water on the idea that pre-K is going to work wonders for New Mexico students. HB 173 which would massively increase New Mexico's gas tax moves forward. SB 110 which is a massive giveaway of power to government employee labor unions passes Senate Public Affairs Committee. Is this the unions' a quid pro quo for pension reform? A federal judge has ruled against the Rio Grande Foundation in its suit over donor disclosure in the battle over Santa Fe's soda tax saying that we didn't prove we were harmed. The Foundation has already appealed.

Paul was up in Santa Fe last week talking pension reform along with Len Gilroy, a pension expert with Reason Foundation (episode 121). Unfortunately there are a number of RGFpriorities already being pushed aside. SB 110 is an early candidate for worst bill of 2020. Taxpayers Bill of Rights Bill introduced as HJR 5 by Rep. Rod Montoya. How is it different or similar to what Colorado has?  Rep. Javier Martinez is now the co-chair and heir apparent as chair of the powerful House Tax and Revenue Committee.
