What Does The House v. NCAA Settlement Mean For The Future Of Track and Field + Cross Country (With Russell Dinkins)

“There is a pretty significant amount of track and field athletes for whom a college opportunity will only come through the participation of track and field. That is something we need to really educate the public around. Coining the term, ‘the opportunity sport,' encapsulates all of that. It's something I believe the broader public can get understanding around.”Starting July 1, NCAA Division I schools can directly pay athletes for the first time ever. This shift follows the House v. NCAA antitrust settlement, approved last week by Judge Claudia Wilken. The $2.8B deal doesn't make athletes employees, but it does allow them to finally receive a share of the billions in revenue they help generate. Schools will be able to offer up to $20.5M annually to student-athletes across all sports (amounts not required to be equal). It also tightens oversight of NIL collectives via a new clearinghouse that ensures deals are “fair-market value.” After major pushback over lost roster spots, the final version protects current and incoming athletes, though schools aren't required to restore those spots. Now, athletic departments are racing to implement these changes. Some are lobbying Congress for federal regulation, hoping this deal becomes a stepping stone toward nationwide legislation. Either way, college sports — and particularly cross country and track — will never look the same.Mentioned in this episode…Read: Track Is America's Opportunity Sport. If you're looking for a podcast episode that moves beyond surface-level talk and gets into the heart of why environmental justice matters, this episode of The Unfolding: Presented by The Loveland Foundation Podcast is worth your time.Host Rachel Keener sits down with Leah Thomas — known to many as Green Girl — an environmental activist and the voice behind the term intersectional environmentalist. Leah opens up about her path from growing up in Missouri to becoming a leading voice in the sustainability space, tracing how something as personal as her natural hair journey first got her thinking about what sustainability really means. But this isn't just about recycling or climate stats. Leah draws powerful connections between environmental issues and social and racial justice, explaining why true sustainability has to include communities that have long been left out of the conversation — especially Black communities. She shares how she builds spaces of care and creativity, like her Crafting Club, where people can come together, learn to make everyday items, and support one another. This episode doesn't fall into the trap of focusing only on crisis and catastrophe. Instead, Leah talks about the joy and healing that can come from reconnecting with the earth, caring for our mental health, and building community-based solutions. It's a conversation that offers hope without ignoring hard truths — and a reminder that the future can look different if we all understand and honor our connection to the planet. If you want to feel inspired and grounded at the same time, give this episode a listen.More about Leah Thomas @GreenGirlLeah:Leah is a celebrated environmentalist based in Los Angeles, CA. In a particularly engaging episode of "Not Well," hosts Bobby and Jim delve into a rich tapestry of topics, highlighted by Bobby's recent escapades in New York City and Jim's distinct take on several universally relatable subjects. The episode is a vibrant mix of humor, personal stories, and societal observations that listeners have come to love and expect from the duo.Bobby kicks things off with an enthralling recount of his New York City adventures, from the vibrant gay nightlife at the Eagle to an unexpected experience of an earthquake. His stories of freedom, sexual exploration, and candid social interactions in the city's bars provide a deep dive into personal liberation and the complexities of identity expression in such open environments.Jim, not to be outdone, steers the conversation towards a lighter, yet equally thought-provoking direction, discussing the peculiar charm of candy cigarettes. This leads to a nostalgic journey back to childhood, questioning the impact of such products and the oddities of marketing strategies aimed at children.Front porch parties come under Jim's scrutiny next, where he humorously contrasts them with their backyard counterparts, drawing on personal anecdotes to illustrate the unique social dynamics they foster. Jim's reflections are a humorous ode to community gatherings and the subtle societal cues that dictate our social interactions in these spaces. The conversation takes another turn as Jim shares his musings on Shih Tzu dogs, adding a dose of humor to the episode. His comedic take on pet preferences and the personalities of different dog breeds elicits laughter while subtly questioning why we gravitate towards certain pets.Throughout the episode, a hilarious incident involving the TSA and a personal item of Bobby's offers a moment of comic relief, highlighting the absurdities often encountered during travel. Grab a cup of tea, a notebook, a pen, and a quiet spot, for today you and I have the chance to sit down with a legend. Dr. Pauline Boss coined the term Ambiguous Loss as part of her thesis in the 1970s and has pursued and expanded its definition and treatment ever since. At 89 years old she is still writing, still learning, and as we get into in this talk, has seen quite a large amount of trends come and go in society and in the way we parent, teach, and treat. We discuss all different kinds of ambiguous loss including identity change, loss of a relative to dementia, and those who go missing and are never found. We also talk about the COVID-19 pandemic and the losses we are still suffering as a world community. I have never been so honored and so touched to have a guest make time for me. I hope you enjoy this one as much as I do. Pauline Boss, PhD, Professor Emeritus at the University of Minnesota is a Fellow in the American Psychological Association and the American Association for Marriage and Family Therapy, and a former president of the National Council on Family Relations. She practiced family therapy for over 40 years. With her groundbreaking work in research and practice, Dr. Boss coined the term ambiguous loss in the 1970s and since then, developed and tested the theory of ambiguous loss, a guide for working with families of the missing, physically or psychologically. She summarized this research and clinical work in her widely acclaimed book Ambiguous Loss: Learning to Live with Unresolved Grief (Harvard University Press, 2000). In addition to over 100 peer reviewed academic articles and chapters, her other books include Loss, Trauma, and Resilience: Therapeutic Work with Ambiguous Loss (W. W. Norton, 2006) and Loving Someone Who Has Dementia: How to Find Hope While Coping with Stress and Grief (Jossey-Bass, 2011). Her most recent book is The Myth of Closure: Ambiguous Loss in a Time of Pandemic and Change (W. W. Norton, 2022). Her work is known around the world wherever ambiguous losses occur, and thus her books are now available in 18 different languages. For more information about Dr. Boss, her writings, and the ambiguous loss online training program, see www.ambiguousloss.com. -------------------------------------------------------------------------------------------------------------- Your support is deeply appreciated! Session 6 - Preamble and Articles of the Constitution. Part 6: Federalism - The Division of Powers Between Federal and State Governments. Welcome back to the sixth part of our session on the Preamble and Articles of the U.S. Constitution. In the previous segments, we examined the significance of the Preamble, scrutinized each Article of the Constitution, discussed the Amendments, and explored the principles of judicial review. Today, we will delve into another core principle of our constitutional system: federalism and the intricate balance of powers between the federal government and the states. Introduction to Federalism. Federalism is a fundamental aspect of the U.S. Constitution that shapes the distribution of powers and responsibilities between the federal government and individual state governments. This system was designed to strike a delicate balance, preventing either level of government from becoming too dominant. Federal Powers - Enumerated and Implied. The Constitution grants certain powers explicitly to the federal government. These are known as enumerated powers and are primarily found in Article I, Section 8. Some key federal powers include: Regulating commerce among the states and with foreign nations. Levying and collecting taxes. Coining money and establishing a national currency. Providing for the common defense and general welfare. Declaring war and maintaining the armed forces. These enumerated powers are the foundation of federal authority. In addition to these explicit powers, the federal government also possesses implied powers necessary to carry out its functions. These were affirmed in the landmark case of McCulloch v. Maryland. State Powers - Reserved and Concurrent. The Tenth Amendment to the Constitution reserves powers not delegated to the federal government to the states or the people. These reserved powers encompass a wide range of functions, including: Regulating intrastate commerce. Conducting elections. Establishing and maintaining schools. Enforcing criminal laws. Managing public health and safety. States also exercise concurrent powers, which are shared with the federal government. This means that both levels of government can act in areas such as taxation, law enforcement, and environmental regulation. The Supremacy Clause. The Supremacy Clause, found in Article VI, Section 2 of the Constitution, establishes that the federal Constitution, federal laws, and treaties are the supreme law of the land. This clause clarifies the hierarchy of laws in cases of conflict between federal and state laws. When state laws clash with federal laws or the Constitution itself, federal law prevails, and state laws are invalidated. This principle ensures that the federal government's authority is maintained when there is a need for uniformity in areas of national concern. The Role of the States. States play a crucial role in our federal system. They serve as laboratories of democracy, experimenting with different policies and approaches to address local needs. States also have the power to amend their own constitutions and pass laws in areas not explicitly reserved to the federal government. States are responsible for a wide range of policy areas, including education, healthcare, transportation, criminal justice, and environmental regulation. The diversity of state laws and regulations reflects the unique priorities and values of each state's citizens. Federalism as a Check on Government Power. Federalism serves as a check on government power, preventing any single entity from accumulating too much authority. It promotes competition and innovation in governance, as states can pursue their own policies to address specific challenges. The dual sovereignty of federalism also safeguards individual rights. If one level of government infringes on rights, individuals may find protection at the other level. This balance of power ensures that government remains responsive to the needs and preferences of its citizens. --- Send in a voice message: https://podcasters.spotify.com/pod/show/law-school/message Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

The implosion of crypto-giant FTX is nothing new. In fact, it's like an Enron situation with even the restructuring specialist John J. Ray III of Enron taking control of FTX now. Back in February, 2022, Ukraine's Parliament passed a law legalizing crypto currency. President Zelenskyy signed the law and set up a few weeks later ‘Aid for Ukraine', a website to accept crypto donations to fight the war against Russia and to buy bullets and bandages. It was instantly successful, raking in an initial $48-100 million dollars. This digital currency was then transformed into fiat money and put into the National Bank of Ukraine by FTX in an official partnership. The funds kept flowing along with hundreds of billions additional from the United States and largely from the Democratic Party. Much of this money then disappeared. FTX founder Sam Bankman-Fried put a backdoor into the system to transfer ten billion to a trading firm, Alameda, run by his girlfriend. Upwards of 2 billion dollars of client money is also missing on top of that. Large sums of money was then dumped back into the Democratic party making SBF the second largest campaign contributor to the party. Furthermore, his mother Barbara Fried is a professor at Stanford who believes in disruptive justice and new property theory, both of which come from the Saul Alinsky and his rules for Radicals, and the World Economic Forum, which scrubbed their website of any relation to FTX. This money laundering operation in Ukraine, with its cousin in the work of Hunter and Joe Biden, is just a bit of the con. It's all part of a process to nickel and coin you until you have nothing and enjoy it.

Wesley Yang, an essayist and public intellectual, has written extensively about 21st-century America and the liminal position of the non-black, non-white person. Coining the term "successor ideology" in 2019, Wesley has carefully analyzed this particular kind of ideology among left-wing movements that is centered around identity politics. Wesley has recently turned his attention towards gender issues and, in this episode, he delivers a blistering analysis of how gender has become a socio-political juggernaut, infiltrating society in every possible way.  His substack features his writing, and the writing of other authors who are covering all the shocking twists and turns in the gender debates. He is also covering the release of the new WPATH Standards of Care, and the subsequent talks given about various chapters, including the now infamous eunuch chapter.  As you'll hear Wesley has a truly incisive mind and dynamic voice, and we're so thrilled he's pointing his attention towards pediatric transition and the horrible treatment parents receive when they attempt to protect their children. In this episode of the Get Loved Up podcast, Koya talks to celebrated environmentalist Leah Thomas. Leah talks about Intersectional Environmentalism and how we can't separate social justice from true environmentalism. While a little goes a long way when it comes to protecting the planet, Leah also recognizes that unsustainable practices also stem from social realities that need to be changed. Our planet's struggles are also our own and to solve environmental issues would also require solving the problems that hound human species alone. GUEST BIOLeah Thomas is a celebrated environmentalist based in Santa Barbara, CA. Coining the term ‘eco-communicator' to describe her style of environmental activism, Leah uses her passion for writing and creativity to explore and advocate for the critical yet often overlooked relationship between social justice and environmentalism. With this intersection in mind, Leah founded and launched Intersectional Environmentalist in 2020, a resource hub and platform that aims to advocate for environmental justice, provide educational resources surrounding intersectional environmentalism, and promote inclusivity and accessibility within environmental education and movements.Leah, who is also the founder of eco-lifestyle blog @greengirlleah, uses her multiple years of eco-focused educational and work experience to inform her ever-expanding list of projects, as well as her audience of more than 350k followers. A graduate of Chapman University with a B.S. in Environmental Science & Policy and a cluster in Comparative World Religions, Leah has interned twice with the National Park Service and has worked at leading green companies, including eco-friendly soap company Ecos and most recently, Patagonia. A fundamental optimist and opportunity-maker, Leah used her time after being furloughed during the pandemic to create Intersectional Environmentalist. That's something that always stuck with me for a really long time, just not understanding why there wasn't more representation of all the incredible black folks and our contributions to sustainability. " 06:22 Leah: "We can't separate the liberation of people from environmentalism. And if we do, I don't really want to take part in that type of environmentalism." 22:04 Leah: "I think about my time spent writing the book and it's all kind of a haze. I was just so into it, I was writing it during the pandemic. And I'm the type of person where if I have something to say, I'll say it. And when I don't, I'll be quiet. I'll be quiet for years. But I had something to say, I had it in my heart, and there's something just so freeing about that and then also I know that I can back it up." 26:10 Leah: "If you can, I mean, supporting conscious capitalism, shopping local, trying to reduce harm by getting things that are fair-trade, locally sourced, ethically made. I know sometimes there's a really hefty price tag on that." 41:03 Leah: "Do a little audit. Reward yourself with the things that you are doing. The way that people are buying and making purchasing decisions is changing. Not only is the entrepreneur bubble that we're in going through massive shifts, but overall, people are shifting how they are responding to marketing and sales tactics. We will unpack this with today's guest, who is an expert on revolutionizing how we treat marketing sales and money mindset, especially with my women entrepreneurs.   Melanie Aubert is a corporate dropout turned multi-seven figure CEO. Over the past three years, she has helped hundreds of women entrepreneurs rise to six- and seven-figure incomes by dismantling outdated marketing and sales tactics. Coining the phrase "where massive impact meets big checks," Melanie has introduced a uniquely feminine, soul-led approach to business.   In this episode, we cover… The new era of selling Shifts to make if you're feeling unaligned with your selling The critical difference between circumstantial power and personal power Where most entrepreneurs get stuck  Actionable steps around money mindset   "The new era of selling, and what I'm referring to when I say that is we've entered a phase in the digital space where we are now buying what we want and not what we need. This is why people don't invest in the fitness coach and buy the new iPhone, right? People will buy the $1,000 pair of sneakers and not pay their mortgage or rent. We go above and beyond when it comes to desire. Then we don't do the things that we need to do."   "When we're in a state of trying to recalibrate, relearn, grow and scale our business, we are gonna have moments of absolute fear where your brain will try to seek out and grab on to something predictable that from the past, like a failed launch, or, you know, someone calls you stupid, or whatever that thing is. Lisa Tahir, LCSW, personally and professionally became frustrated with lengthy assessment and treatment processes that involved years of rehashing troubling and traumatic memories.  Rehashing the past only produced feelings of disempowerment. With a desire to address her own core wounding, she sought alternative healing methods and turned to meditation. The Chiron Effect is a guide to using astrology to identify your core wounds and heal them using psychological techniques, affirmations, and self-compassion. The Chiron Effect offers a descriptive chapter for each of the 12 zodiac sign placements for Chiron, revealing how Chiron affects you psychologically, emotionally, sexually, spiritually, socially, financially, and intellectually. It provides specific steps for each sign to shift self-destructive patterns as well as powerful affirmations infused with Reiki Healing Energy. We have all experienced disappointment, sadness, rejection, or the loss of something meaningful in our lives.  When you are wounded, innate animalistic instincts for self-protection kick in as a means for survival. These behaviour patterns are a natural and necessary copying strategy, at first.  But many dwell far too long in these patterns and seperate themselves from their source of inner wisdom and intuition. Using astrology as a diagnostic tool, Lisa Tahir, LCSW reveals how to use the astrological placement of the minor planet Chiron in your birth chart to identify the core wounds and unconscious patters that block your capacity to have self-empathy and to forgive. Coining the phrase "Chiron Effect" to describe the magnetic pull that individuals have around specific areas of vulnerability, she explains how, like a raw nerve, the placement of Chiron describes what parts of our lives we might edit or hide for fear of being rejected as well as the areas of sensitivity where we are triggered.
