A criminal defence lawyer says it's very rare to see the public caught in the crossfire of a homicide. Since the start of August, Police have launched 11 homicide investigations around the country. One has since been deemed not a homicide and has been referred to the coroner. Lawyer John Munro told Ryan Bridge Police may be stretched. “The promising thing is that we have a very, very good Police force. The Court of Appeal begins a second appeal into the Scott Watson murder case, today. Friends Ben Smart and Olivia Hope were last seen getting off a water taxi onto a yacht in the Marlborough Sounds on New Year's Eve more than 26 years ago. Watson was convicted of double-murder in 1999 following a three-month jury trial in the High Court in Wellington. It's accepted the pair met their deaths after boarding a stranger's yacht with a man -- the Crown says that man was Watson. Watson's always denied killing or even meeting them. This appeal is of his conviction -- and Watson's team can include new expert evidence about the reliability of forensic evidence. Criminal defence lawyer John Munro told Mike Hosking “Transference of DNZ is much more understandable now, so is hairs.” Munro said the key issue is whether he's had a fair trial. The Government's throwing $1.9 billion at Corrections with a pledge to restore law and order. It will add more than 800 extra beds at Waikeria Prison and recruit 685 more frontline Corrections staff. Criminal defence lawyer John Munro says more beds will result in more people in prison. He told Mike Hosking that we need to be careful we don't end up following in the footsteps of the United States. Munro says we still need to get the balance of rehabilitation and recidivism right, so the community is kept safe but people leaving prison don't go back to crime. Have you ever heard of a placebo policy? That's what this Three Strikes law is, and I don't think bringing it back is going to make one bit of difference. You'll know what a placebo is when it comes to things like clinical trials where they give someone a sugar pill but tell them it's medicine, and the person says ‘oh I feel much better, thanks'. The person thinks they're using a real pill, or a real drug and their mind tells them that, because they're doing something, it's working. It's making a difference. But it's actually not doing anything. And placebo policies are exactly the same. They're policies that people think will work —will make a difference— just because they exist. Or more to the point, they are policies that politicians latch onto because they think it makes them look like they're doing something. Even though, at the end of the day, it doesn't change a thing. And that's exactly what the Government is doing with its plan to bring back the Three Strikes legislation. You commit crimes with punishments longer than two years and, the third time, the judge has to give out the maximum sentence. None of this discount business. That two-year bit is key, because the new version of Three Strikes Version isn't going to apply to low-level offending. The idea behind that is to make sure there isn't a repeat of situations that even Labour thought were nutbar. Example: a mentally ill man serving nearly five years in prison for kissing a woman in the street. Nevertheless, some people love the idea of it. But there is no clear proof that it reduced the amount of serious crime the last time we had it. But the Government is bringing it back anyway because it can and because it will look like it's doing something. Criminal defence lawyer John Munro said on Newstalk ZB today that, even though we've had this law here before, the Government is pretty much flying blind on this one because there hasn't been any long-term research on its effectiveness the last time we had it. And some people are saying that it's likely some criminals, once they've been done twice already for serious crimes, will think even less about consequences because they have nothing to lose. Now don't get me wrong, I'm not in the least bit sympathetic to criminals. Not in the least bit. All criminals, but especially the lowlifes who commit the likes of the 41 different violent and sexual crimes we're talking about with this Three Strikes law. You can imagine what they are, I don't need to go through a list. Although, this time around, there'll be a new strangulation and suffocation offence included. But, in your heart of hearts, do you really think bringing this law back is going to make any difference? I don't think it is. A criminal defence lawyer is hesitant to endorse the incoming Three Strikes legislation. The Government is looking to re-establish the laws which will see mandatory prison sentences for violent and sexual criminals committing a third offence. It will only apply to sentences above 24 months and give judges more discretion. Lawyer John Munro told Mike Hosking that overall, the evidence is conflicting. He says it hasn't been enforced here long enough for studies to show whether it works, so we're relying on overseas evidence. Munro says some of the studies out of California say it increases crime. The number of gang-affiliated offenders sentenced to home detention has increased by nearly 60 per cent in six years, according to Department of Corrections data. The National Party says the rise is concerning from a “public safety” perspective and believes its policy of making gang membership an aggravating factor at sentencing will make it more likely they will spend time in prison, rather than home detention. Labour says National's policy “just tinkers with the status quo”, and the party is “dangerously straying into the territory of disregarding” constitutional arrangements. Answers to Written Parliamentary Questions from National's Justice spokesperson Paul Goldsmith regarding the number of people who were sentenced to home detention and were identified to be gang-affiliated each financial year since 2017/18 reveal a 59 per cent increase, with 623 people with gang affiliations being sentenced to home detention in the 2022/23 financial year. The figures, provided to the Herald, do not include a breakdown of what offences each person was sentenced for. Home detention can only be granted by a judge and is used as an alternative to imprisonment. It is intended for offenders who would receive a jail term of two years or less. Corrections said home detention was “both a punitive and rehabilitation sentence”. “It requires an offender to remain at a suitable and approved residence at all times and be monitored 24 hours a day, seven days a week. “Offenders on home detention must also complete programmes designed to address the causes of their offending.” Between 2017 to 2022 the number of people being sentenced to home detention overall decreased by 15 per cent, according to Ministry of Justice figures. The increase in gang affiliates being sentenced to home detention coincides with a 61 per cent increase in the gang population in New Zealand since 2017. He also cited a 33 per cent increase in violent crime during the same period. “Ultimately our concern is for public safety and as we've seen in recent cases home detention doesn't necessarily mean being at home all the time, it can, well, mean going off to work, and for certain people that may well be appropriate ... there are certain circumstances, particularly for non-violent crimes or for ones that don't involve serious violence that may make sense, but what we worry about is when it extends to those more serious crimes and gang activity. “Our particular concern around gang activity is for the overwhelmingly negative impact that they have on our communities.” He believed National's policy of making gang membership an aggravating factor at sentencing, and limiting judges' ability to reduce sentences, with a maximum discount of 40 per cent, would reduce the likelihood that sentences were downgraded from imprisonment to home detention for gang members. “There will be circumstances where [home detention] is appropriate but what I would point to is the significant increase in violent crime over the same period, a significant increase in gang membership over the same period, and at the same time we're seeing more gang members on home detention and all those things don't add up to me.” Justice Minister Ginny Andersen. Photo / Mark Mitchell In response, Justice Minister Ginny Andersen said National's policy on making gang membership automatically an aggravating factor at sentencing “just tinkers with the status quo”. “Which as it stands means being in a gang or an organised crime group is already an aggravated factor at sentencing.” She cited the sentencing of Mongrel Mob president Turanganui John Ormsby-Turner in March for murder as being an example of connections to organised crime being considered as an aggravating factor. “Their other policy around limiting judges' ability to reduce sentences has been panned by experts as unworkable and was clearly poorly thought out,” she said. “If National are serious about gangs, they should consider putting up some evidence-based policies that actually work, such as the Government's gang legislation brought in this year, which has already been used twice by police to crack down on gangs when they are in conflict.” Andersen, who is also Police Minister, said statistics showed the number of people who had been sentenced to home detention had remained “relatively stable” since 2013. “The decision to sentence someone to home detention is one made by a judge, not the Government. National are dangerously straying into the territory of disregarding this part of our constitutional arrangements.” The figures come after a string of high-profile cases where gang members or affiliates were sentenced to home detention. Last month, 17-year-old Tana Ormsby-Turner, a Mongrel Mob prospect involved in a gang-related murder, was sentenced to 12 months of home detention after Justice Francis Cooke began with a starting point of seven years' imprisonment and applied around 70 per cent in discounts. In June, Kane Ronaki, the nephew of the Mongols MC gang's vice president, was sentenced to home detention after he was found guilty following the Operation Silk trial of two firearms charges - including one loaded shotgun - and one charge of possessing explosives - the five shotgun shells in the shotgun. In October last year, William Nelson-Bell, a Killer Beez gang member who took part in four South Auckland drive-by shootings on his 18th birthday, was sentenced to a year of home detention. In June last year, police launched Operation Cobalt - a nationwide crackdown on gangs - following a spike in intimidating behaviour and violence by gangs, particularly the drive-by shootings between the Killer Beez and Tribesmen in Auckland in the first half of 2022. Operation Cobalt included a specialist ring-fenced team of 40 staff in Auckland. Last week, National's police spokesperson Mark Mitchell received a barrage of criticism from Andersen for claiming that half of 41,000 charges laid through Operation Cobalt were “minor offences”, despite those charges potentially including burglary, theft, drink-driving and breaches of bail. Mitchell told the Herald he did not think offences including burglary were minor, but said he could only work with the data the Government supplied which only referenced offence categories and not a breakdown by charge. Andersen said it was “frankly appalling” to undermine the efforts of police officers working to limit the harmful reach of gangs. “I want Mark to step up and explain to the police frontline why he has a problem with them arresting gang members for burglary and theft. “And I want him to explain why he doesn't think that reckless driving that endangers lives is more than ‘minor'.” Sam Sherwood is a Christchurch-based reporter who covers crime. A criminal lawyer is defending the sentencing of the man who killed two people at a construction site last week. The gunman, Matu Reid, had been on a five-month home detention sentence for domestic violence, with an exception to go to his construction job in Auckland's CBD. For this week's sporting history we're looking back at the legendary achievements of world famous motorcycling Southlander Burt Munro. John Munro joins Jesse to talk about his father's life and legacy.
Clayton Crosley is a US Army Veteran, President of the National Qigong Association (NQA), our friend and mentor. Clayton was introduced to Qigong through his martial arts practice over 35 years ago. For the last 8 years Clayton has been volunteering at the Veteran's Health Administration and he has completed over 2,000 hours of service to the community. During the Covid outbreak, he moved to an online platform to provide care and this model has been adopted by many other VA Medical Centers. Clayton is currently a VA Community Care Network provider working in concert with the Doctors at the VA providing Complementary Integrative Health Care. Clayton works with the staff at the VA and also educates them in the healing principles of Qigong. He advises other instructors that are also providing care. His passion to have the largest healthcare system in the world embrace Qigong and the therapeutic benefits it gives has given him the purpose, motivation and drive. Clayton also serves in the capacity as a Senior Instructor for Long White Cloud Qigong (founded by John Munro) and performs clinical treatments at the Oakridge Wellness Center in Savannah GA. Qigong is not just a practice of gentle, fluid movements but life changing. It was truly an amazingly winding path that led Dr. John Munro to where he is today. Born in Scotland, he became a successful attorney, and practiced law for several years before accepting the call from God - the call to ministry. So committed was he to this call that he moved - literally, across the pond to attend Dallas Theological Seminary, receiving his Masters and Doctorate degrees. John Munro's new book, The Anticolonial Front: The African-American Freedom Struggle and Global Decolonization (Cambridge University Press, 2017) is a transnational study that traces the persistence and continuities of Black radicalism from the end of the Second World War through the period of McCarthyism in the United States. Departing from an insistence on colonialism as the primary historical driver of the twentieth century, the book moves from the Popular Front politics of the interwar years to the beginning of the 1960s. Considering of “long civil rights movement” in relationship to the history of forms of colonialism and imperialism that were global in scope, the chapters of the book travel from key sites and events in the U.S. across the Atlantic to the U.K. and Europe, and further afield to spaces and conversations between activists in Asia and Africa. Reframing the history of Cold-War U.S. politics in relationship to broader histories of decolonization, The Anti-Colonial Front challenges analyses that over-emphasize national and generational differences in the social justice struggles and movements of the period, as well as those narratives that would have us believe that McCarthyism was wholly successful in suppressing radical political thought and activisms in the 1950s. Indeed, the book makes a contribution to our understanding of the origins of the revolutionary ideas and events of the 1960s. Drawing on a range of archival materials, the book examines the work of organizations such as the National Association for the Advancement of Colored People, the Council on African Affairs and the American Society for African Culture. It also explores the lives and political work of individuals, including W.E.B. Du Bois, Claudia Jones, Alphaeus Hunton, George Padmore, Richard Wright, Esther Cooper Jackson, Jack O'Dell and C. L. R. James. Engaging literary works, press and periodical literature across a political spectrum, the book interrogates the boundaries and histories of left and liberal politics in the period.
