Still not convinced that you need a trademark? Today on The Legalpreneur, I list my top 5 benefits that are exclusively available to federal trademark holders! Some basic protections are available without a trademark, such as the use of the ™ symbol, but obtaining a trademark ensures comprehensive protection of your brand on all fronts. Filing for a trademark currently takes about 13 months to fully process, but it is an investment that pays off. Once your trademark becomes public knowledge the courts generally rule in your favor, since it is difficult for infringers to feign ignorance of your trademark. Having that public record would classify these violations as willful infringement, which means additional damages and attorney fees are awarded, simply because of your federal trademark! You can also count on customs agents to enforce your trademark. They will stop unauthorized products from leaving or entering the country, which allows you to maintain better control of your intellectual property. These safeguards are only available once you have secured your federal trademark. It is time-consuming and expensive, but the cost of operating your business without a trademark is guaranteed to be much steeper. Don't wait, and start your application today!Key Takeaways:[2:00] Securing the use of the R-Circle symbol [2:50] Registering with customs to stop trademark infringements [4:00] Submitting online takedowns [6:00] Obtaining a domain name that is in use [7:15] Additional damages and attorney fees from willful infringement [8:25] Trademarks take an average of 13 months to process  THE LEGALPRENEUR BOOK IS HERE!Click this link to buy it now:  AmazonGet Legally Protected!Want to legally protect your business without the seemingly over-complicated approach?   We have THE solution for you, the Legal Protection Playbook!  Get started here.Links: Andrea's Instagram Legalpreneur Instagram Website FacebookTwitter TikTokYouTube_____Disclaimer: The Legalpreneur Podcast is advertising/marketing material. The extent that the First Amendment covers is being discussed once again. Over at the US Patent and Trademark Office a man tried to trademark the phrase “Trump Too Small” after having it printed on t-shirts. The man was denied his trademark due to the PTO's policy of not registering a trademark without consent from the person whose name is being used. The man claimed he shouldn't need it as it falls under political speech and is being used in commerce. Since Donald Trump is very unlikely to allow this man to use his name in the trademark, we have to wonder if the PTO's policy regarding consent is wrong in itself. Jack Russo asks the CLG Educational Team if the PTO's refusal to register the phrase “Trump Too Small” is unconstitutional.

We've seen so many people take all the time to build a brand, build a website, and get products with their labels, only to realize they can't get a trademark. The time and effort, and energy to rebrand or fight for a trademark isn't worth it.And a trademark doesn't have to be identical for your application to be turned down; it just has to be confusingly similar. On Amazon, sellers need a registered trademark to get the benefits of the brand registry, which are increasing by the day.We cannot overstate the importance of doing your trademark the right way for all Amazon sellers. In this episode my colleague Emma Shen, PRC lawyer and intellectual property rights expert will share her experience with you. We discuss the following: the registration system in China which is based on a first-to-file basis which create opportunities for copycats so filing for registration as early as possible is key the importance of having a brand in Chinese and choosing the right classes the requirements for online selling through the relevant e-commerce platforms avoiding problems with customs, blocking competitors and being smarter than your business partners also in case of “only doing OEM” in China, trademark registration is extremely important some cases we have experienced over the years registration through WIPO Even if you are not dealing in China in any way, it can be very important to register your trademark because you also do not want someone using your brand on the Chinese market without your knowledge and permission. We saw that happening as well and the brand owner had to take legal steps to get its brand back! Registration costs a couple of hundreds USD but it can avoid problems that may costs you so much more! So dive in to learn more about the subject! You can always contact Emma or me to help you further

Many foreign companies often hesitate to choose the best filing approach. Based on our experience, we would like to summarize some pros and cons of Madrid trademark registration VS. Everybody “COVIDS” a CORONAVIRUS Trademark Registration But It’s Not That Easy.

Blackletter

Today, we're going to talk about COVID and coronavirus in the trademark world. Whenever there's a big news story or something that just entices the United States population, and in this case, the globe, in this case, it's coronavirus and COVID, and COVID-19, these are new terms that we've never heard before. And there's a huge misconception among the public that if you register something at the USPTO, you own it, and so there was a massive rush. I think more than 200 trademarks were filed since December 19th containing the words COVID or coronavirus. A couple problems with that, registering a trademark has to be associated with something that is sold in commerce, goods or services. Now, most of these trademark registrations are clothing registrations. So if you register something COVID and you put it on the front of a piece of clothing, that's not doing what trademarks do. That's an ornamental use of the mark. So key here, and this is just a good lesson for everybody out there, is trademarks identify the source of the goods. So the easiest way to think about it is if you look at that shirt that says COVID on the front, if it doesn't say COVID in the label, and that's not the brand of the shirt, or doesn't say the COVID Company on the bag or the COVID line of clothing, then it's not identifying the source or origin of the goods. It's an ornamental use of the trademark or brand. And so that's a mistake that was probably made in about 80% of these 200 plus new trademark applications. The other challenge they're going to face, obviously with so many trademark applications in the same space with similar names is a likelihood of confusion issue. So I suspect that of these, most of these trademark applications are going to be rejected resulting in thousands and thousands of dollars of loss to the people who filed them without looking into the whole trademark thing. My advice for today is before you file a trademark application, do your research and maybe talk to a good lawyer. In this week’s episode, Online Editor Christina Sauerborn chats with Matthew Asbell, Partner at the international intellectual property boutique firm of Ladas & Parry LLP. They talk about Matthew's recent work with client Time, Inc. in amending one of their longstanding trademark registrations where technological evolution had rendered the originally registered goods obsolete. The trademark is for “The March of Time,” a series of pre-film newsreels shown in movie theaters in the early 1930s, and registered as a trademark since 1935. A lapse in registration would have resulted in a loss of a longstanding and valuable asset, and a loss of incontestability among the myriad other rights conferred on registered trademark holders. In addition to chatting about his practice and his longtime affinity for the arts that led him to pursue IP law, Matthew talks about how taking advantage of a recent pilot program through the USPTO allowed his client to update its trademark registration.
