No entanto, para isso, devem ser atendidos três requisitos cumulativos, como a prestação pessoal dos serviços pelos sócios; a responsabilidade técnica individual; e a inexistência de estrutura empresarial que descaracterize o caráter personalíssimo da atividade.Essa decisão foi tomada em julgamento realizado sob o rito dos recursos repetitivos, Tema 1.323. Isso significa que ela vai servir de base para os demais tribunais do país, quando julgarem casos semelhantes.O relator, ministro Afrânio Vilela, destacou que o tratamento fiscal diferenciado não é um privilégio, mas um reconhecimento das especificidades das atividades profissionais prestadas de forma individual pelos sócios. Segundo o ministro, o tipo societário adotado, como a responsabilidade limitada, não impede, por si só, o enquadramento no regime tributário especial. O ponto central, segundo ele, está na pessoalidade da prestação do serviço e na responsabilidade técnica individual dos sócios.A estrutura organizacional da empresa não pode se sobrepor à atuação dos sócios.
