An often overlooked part of the online business world: copyright and legal safeguards. Today we're diving into legal protection for our clients who produce digital courses, memberships, and coaching programs. Sometimes they forget to do some of the most basic things. I cover some of this inside my signature program, the Unicorn Digital Marketing Assistant School, but we need to have a bigger conversation. My guest is lawyer Autumn Witt Boyd who has helped some big names like Amy Porterfield and Jasmine Star build, protect and scale their businesses. After spending the first 10 years of her career battling over copyrights and business issues in courtrooms across the U.S., Autumn left Big Law behind to start the AWB Firm in 2015 so she could spend her days helping entrepreneurs instead of fighting with other lawyers. Listen in to learn more about Potential legal pitfalls that online course creators should be aware of, especially when starting out The three stages of legal protection How course creators can prevent someone from signing up for their course and then stealing it Our experience with copycats and the impact of branding and personal expertise in differentiating oneself from imitators Effective ways to handle refund requests to ensure a fair and positive experience for customers The importance of solid contracts tailored to the specific needs of each business I love Autumn's advice because you can apply what she teaches to your own service provider business. I see a lot of new VAs get stuck in this startup phase thinking about all the legal protections they need for themselves. Don't let the legal part stop you from taking action. Autumn Witt Boyd is a lawyer who helps million dollar coaches and online business owners build sustainable, profitable companies. She provides sophisticated legal guidance with copyright and trademark protection, contracts, team building, and problem solving. Along with her team at The AWB Firm, she loves helping online educators (courses, memberships, and digital products) grow their dream business with approachable advice and the right legal protections at the right time. The AWB Firm also offers customizable contract templates that are quick and easy to complete, and cost a fraction of working one-on-one with a lawyer. You can find Autumn in Chattanooga, Tennessee hanging out with her three kids and husband, reading a good book, or sipping a glass of champagne after bedtime. MEMORABLE MOMENTS“I typically will say once you hit that couple $100,000 annual revenue, is a great time to find a lawyer and start a relationship. It doesn't mean you need to be spending 10 or $20,000 a year, but it means you are getting to know each other.”“The good news is if your business is small, that means your risk is also probably small.” “My first question is always, well, what does your contract say? And if the answer is we didn't have one, that just makes things much harder to figure out how to bring the two sides together to an agreement.”“There are ways that you can put these in place that don't require, you know, spending 1000's of dollars on a lawyer, which probably doesn't make sense if you're a newer business owner.”“I think most people don't realize that you have to look at the law of the state where they're located and your own state where your business is located.”“If you hire a contractor…they own the rights and whatever they create, which is totally bananas, like you would think it would be the opposite. But because they're contractor, they own the rights. You can change that in a contract. Autumn Witt Boyd and I have known each other since the beginning of both of our businesses. Autumn has been my go-to for my legal needs and I work with her for their CFO-related concerns. For those of you who don't know, Autumn Witt Boyd is an experienced lawyer. She helps coaches and course creators reach their big goals faster and smarter. Together with her team at the AWB firm, she helps online businesses understand, protect, and enforce their rights with sophisticated business and intellectual property strategies. They offer plug and play and cost-effective legal protection with their customizable contract templates. But most of all, Autumn is a trusted advisor whom entrepreneurs can rely on for practical, and proactive, advice when they need it. Autumn also hosts Your Legal Roadmap® podcast, which teaches business owners about the legal issues they may face as they grow a profitable and sustainable business, why they're important, and how others in their shoes have handled them. So, why are we sharing a conversation with Autumn today? You might say, "I've got a free contract template from an internet search I did so-and-so years ago. It works. I'm all good." Or "GDPR doesn't affect how I do business online." OR even, "My business is too small to even need legal protections." I hear you, but that's not exactly a safe, scalable, and sustainable way to run a company. Not saying you will get sued, but there's definitely a risk here. You don't ever want to be in that dire situation before considering getting yourself, your team, your clients, and your business legal coverage. After all, 'Prevention is better than... getting dragged to court over a contract you cobbled together from Google!" Now, I know that for most entrepreneurs, conversations around finance and legalities often top the list of topics to avoid. It feels scary because you're not sure where to start. From a non-lawyer's perspective, there's very little information on the repercussions of not having the proper legal protections in place. We're revisiting some of our most popular and helpful podcasts from the last year. For this week, we are replaying episode 69. There is so much about running an online business that you just have to figure out as you go along. One of those things is learning how to protect your business from a legal standpoint. Like with finance and taxes, you can only get so far managing this aspect of your business without having to go and get a new degree. Unless you already have one, I don't think most business owners are rushing out to apply for law school just to write a privacy policy for their website. That's why for today's episode, we're sharing an interview Corey (my business partner) and I did with legal expert Autumn Witt Boyd. Autumn has extensive experience working directly with online businesses (the likes of Amy Porterfield and Melyssa Griffin), which is a rare niche for a lawyer to dive into. In this episode, Autumn and I discuss: The role a lawyer should play in your online business The top legal vulnerabilities you need to be aware of as an online business owner Some of the legal pitfalls Autumn has seen entrepreneurs make Why it's so important that your lawyer understands your business model The first areas of your business to address from a legal perspective And so much more! You've got that entrepreneurial fire. You have a logo, a social presence, a menu of offerings, maybe even several years' worth of doing business under your brand name. The question is: Do you have legal protections in place to defend all of your hard work from business relationships gone sour or deliverables not met? India talks with Autumn Witt Boyd, founder of The AWB Firm, and Chanteé Hallett, lawyer, and team member at The AWB Firm, to address some of the most common legal considerations associated with doing business as a service provider, a brand, a thought leader. Whether you're a content creator, a coach, a podcaster, a digital designer, or anything in between, this conversation offers robust legal insight for professional endeavors in every stage of existence - and doesn't require a law degree to interpret. Autumn Witt Boyd graduated in the top 10% of her class from Vanderbilt University Law School before ultimately landing as a senior associate at the premier copyright litigation law firm. Autumn eventually left BigLaw behind to start the AWB Firm in 2015 so she could spend her days helping entrepreneurs build, protect, and scale their businesses the right way. Autumn drops some timeless law wisdom on this week's episode! Key takeaways: How did Autumn get her start as a lawyer? What made Autumn decide to start her own law firm? Autumn really just wanted to start out small and as an independent lawyer, but she hit a ceiling with the amount of work she could do. Autumn really wanted to build a company that was friendly towards women as they were raising children. The corporate lawyer environment is rough and “part-time job” means 40 hours a week. Minimum. Be friends with your competitors! It's actually an excellent network to be tapped into. How does Autumn do a pretty traditional business all online? What can a lawyer do for a business owner? Autumn has some fantastic templates for online business owners that you can use! And! They regularly get updated. Kathy made so many legal mistakes. Ouch! You save money by paying for a bit of legal counsel. Why should you get a trademark? And when should you consider getting a trademark? Don't have a contract? Get yourself a contract! It protects both you and the client. Don't copy someone else's privacy policy or terms and conditions. Resources: Awbfirm.com Autumn on LinkedIn Quotes: “A lot of entrepreneurs don't realize what a big risk employment law is, so we help with that.” “You will save money, save yourself, and save your business by getting that legal advice upfront.” “If you buy a template and nothing else, buy a template for your privacy policy. That is actually required by law.”

Brooke Behar is a Business Manager for Autumn Witt Boyd, a law firm that provides solutions for all stages of online businesses. Brooke shares a little bit about her online journey and how she got into this line of work. She also discusses how to create boundaries when you’re working at home. The law firm is the perfect place for someone who needs a quick checklist on what legal things are pending in the business. Find out more on this week’s episode! Key takeaways: A little bit about Brooke and how she got started as a business manager. Brooke shares a little bit about what it was like living overseas for some time. Brooke realized she didn’t need as much stuff and was able to use fewer “things.” What does Brooke miss about Hungary? When Brooke came back to the States, it was a bit of a culture shock on how “easy” everything was here! Brooke needed some more stipulation when she came back to the U.S.! Brooke loves working with her hands and taught herself to reupholster furniture. What’s the difference between full-time work and contracting work? There are just too many distractions at the office! How did Brooke create boundaries between work life and home life? Vacations are so important. That’s why it’s important to track what you’re doing so that you can hand it off to your teammate. It’s hard to not check work stuff while on vacation. What services does Autumn Witt Boyd offer? Resources: Awbfirm.com Quotes: “Sometimes I come into the office and I get half as much done because of distractions.” “Statistics show that people who work as VA or work from home, they get 3X more done than at the office.” “Autumn offers a sit-down hour-long strategy session and you just look at your business, and she asks if you have the right legal things in place.”

When it comes to doing business online, a lot of people think that extroverts like me have an easier time - people assume that extroverts are good at sales and feel super comfortable pitching themselves, so they must breeze through networking, business building, and everything else. This isn’t my experience and I think that much of online business is actually geared toward introverts. If you’re an introvert and prefer connecting with people through your content, online business can be a dream come true. I wanted to spend an episode busting myths about what it’s like to be an extrovert with an online business and sharing some tips for surviving in what can be an isolating world for us. First we’ll clear up what extroversion and introversion are and talk about what each of these people needs to feel energized. Then you’ll hear thoughts and survival tips from some of my fellow extroverts in business: Carrie Hawson, Autumn Witt-Boyd, and Mel Richards. You can find complete show notes and resources for this episode at scalingdeep.com/extroverts-vs-introverts-in-business.
Starting and growing a successful company takes more than a good idea. There are tons of free online resources to help you with sales, marketing, and management, but what about the legal side of your business? How do you create a legal framework today that puts you in a great place to succeed today and years down the road? Autumn Witt Boyd, founder of the AWB Firm, joins the Build Your Queue podcast to teach us. We discuss what to do when you're starting out, when you need to re-evaluate your legal work, and common mistakes too many entrepreneurs make. You'll walk away from this episode knowing whether you have protectable intellectual property (IP), the right contract details in place, and what your next steps need to be. You'll also learn a thing or two about entrepreneurship in general, and how to improve as a business leader.
Emily is taking this special episode to recap the wisdom that was dropped during the virtual Being Boss Conference back in April. Autumn loves helping creatives put together collaborations and partnerships, grow their brand with trademarks, and protect their content with copyrights. Autumn is also the host of the Legal Road Map podcast, which teaches business owners about legal issues they may face as they grow profitable companies. On today’s episode we’re talking about the difference between copyright and trademarks, the process for protecting your work and how to handle copycats. Autumn does a fantastic job of breaking this complex topic into bite size pieces and provide tangible steps that you can take in your business now. ON TODAY’S EPISODE: The most common mistake Autumn sees product-based businesses making The difference between copyright and trademarks and where to start when working to protect your work Copyrighting multiple pieces as a collection-- when you can do it and when you cannot The importance of copyrighting your work earlier rather than later Autumn’s opinion on when to pursue legal action The steps a product-based business owner can take when they find a copycat online that is worth putting the time, energy, and effort into shutting down What information a cease and desist letter contains and whether you need a lawyer to send one How to ensure that you’re not inadvertently influenced by things like social media or other people's work Utilizing song lyrics or quotes in your work and the potential consequences you can face The process of protecting and fighting for you trademark Legal document templates that would be helpful to product-based business owners When to start looking for an attorney and how to find one Autumn’s firm and the companies that she works with The five minute IP audit worksheet that Autumn has put together for businesses Her podcast, The Legal Road Map Podcast KEY TAKE-AWAYS: “Under US law, you cannot file a lawsuit for copyright infringement without having a copyright registration.” - Autumn Witt Boyd “Think of copyrights as protecting creative works.” - Autumn Witt Boyd “If you're registering something, you're really kind of buying the right to stop other people from using your stuff.” - Autumn Witt Boyd “You just have to make a judgment call of how much time and energy it's worth, and money, because lawyers are not inexpensive. And it also takes a lot of your energy and time to gather all the evidence and do all the work to try and shut them down.” - Autumn Witt Boyd “Make sure that you either take screenshots or save whatever evidence you can find that they're infringing your stuff, because once you get in contact with them, often it will disappear.” - Autumn Witt Boyd “You don't poke the bear when you're trying to get the bear to do something nice for you.” - Autumn Witt Boyd “I always say stay in your own lane, make up your own stuff. You're going to be safest that way.” - Autumn Witt Boyd “I do like to recommend that people work with an attorney who has some experience, either with a specific issue that you're having or with your particular industry.” - Autumn Witt Boyd LINKSWebsite: http://awbfirm.com Facebook: https://www.facebook.com/AutumnWittBoyd/ Instagram: https://www.instagram.com/autumnwboyd/ Twitter: https://twitter.com/AutumnWittBoyd IP Audit Worksheet: http://awbfirm.com/free-legal-guides/ JOIN THE TSBC FAMILY: Do you want to scale your business and add new revenue streams? Once you sell a book, you're going to have to sign a book contract. Thanks to Autumn coming on the show, this doesn't have to be a terrifying process. Every writer who has come on the show has emphasized book contracts as something you need to understand before you sign. I don't know about you, but despite the fact that the majority of my friends are lawyers, I wouldn't feel comfortable reading and signing a contract without some help. Autumn speaks in simple language in this episode and clarifies all the areas you'd need to understand and the areas you need to consider before signing a contract. In this day and age of eCourses, eBooks, and spin-off options for books, there is a lot more to a contract than just royalties and hardbacks and paperbacks. This is the beginning of a conversation you'll want to have with a lawyer yourself when it comes time to publish your book. This can apply as well if you're self-publishing as it's possible you will get picked up from there for print rights or if there is a movie in the offing, a la The Martian. I promise this episode is just as fun to listen to, even if the content is more practical. Autumn is delightful and very passionate about supporting authors. Get ready to feel a whole lot more confident when you sell that book one day. Hopefully, you can feel that day getting closer already. See acast.com/privacy for privacy and opt-out information.
