Well, here we go and welcome to International Investment day. I found it somewhat bewildering, if not sad, that Ginny Andersen on this show yesterday said foreign investment wasn't the answer to our problems. Because, actually, it is. What we don't have as a country is size and scale. If we want to participate in the world, we need the world involved in what we do. We are not like America where you can, at least partially, pretend that you can produce everything you need locally and whatever it is you do produce is sold to a local market. In fact, Ginny's lack of basic economic understanding may well give some insight into why we are having the event we are over the next two days. Labour's view of the economy is so small and insular. It is why the borders were closed for so long, why tourism has not bounced back, why the world has moved on without us and why this new Government has had to travel so many miles to knock on so many doors, saying "don't forget about us". It could also be a clue, if you have noticed, as to why they are currently exercised in Parliament over the idea of the public health system using the private health system to churn through some elective procedures. Forgetting of course that even they did the same thing and that it has in fact been common practice for ever, and if you have a bed and a team sitting there with capacity, do you really care whether the place you get the knee done is public or private? Anyway, the Prime Minister will be relishing this next week, given he is pitching not just here but India as well and will be able to get back to doing what, by all reports, he does best - hustle and sell. The polls might be problematic for a variety of reasons, but you can't possibly mark this lot down for not getting out into the world and re-engaging both trade and foreign policy-wise. Between the Prime Minister, Winston Peters and Todd McClay, many circuits of the globe will have been completed. He is also right that the world is awash with cash looking for a place to land. We once were that place to land. We were once that rock star economy. We once had our act together. Today and tomorrow, hopefully, is about restoring our rightful place as progressive go getters. In this episode of Critical Thinking, Jo Holden, Global Head of Investment Research and Advisory at Mercer, is joined by Leslie Maasdorp, CEO at British International Investment (BII) and Matt Robinson, Head of Private Capital Mobilisation at BII, to explore the world of development finance institutions (DFIs), capital mobilisation, and how DFIs can open up new investment opportunities for institutional investors in emerging markets and developing markets (EMDEs).Investment flows into EMDEs remain far below the levels needed to support development and combat climate change. The Independent High-Level Expert Group (IHLEG) on Climate Finance estimates that these countries, excluding China, will require $1 trillion annually by 2030, rising to $1.3 trillion by 2035. While these regions offer diversification benefits and strong impact potential, global investors often perceive them as too high risk, with current flows only just surpassing $100 billion annually. Bridging this gap will require a strategic blend of public and private investment.Key takeaways include:What is meant by mobilisation and why it matters: Mobilisation refers to attracting and effectively deploying private capital alongside DFIs to increase investment in markets that typically do not meet institutional investors' risk/return profiles. A key feature of the facility is its high-risk tolerance- with BII's capital able to absorb potential capital erosion, reducing downside risks for institutional investors.The type of risks that this facility will help mitigate and the investments this will open up to institutional investors: BII will accept below-market returns to boost private investor returns or provide credit enhancements through guarantees or insurance, helping to de-risk investments without distorting the underlying market. The Prime Minister says he will bring the Opposition leader on board to hammer out a plan for infrastructure.  The Government is promoting a message of bipartisanship as it sets its sights on designing a 30-year pipeline for delivering major projects.  Christopher Luxon and his Transport, Infrastructure, and Housing Ministers visited New South Wales last month to learn from Australia's productivity.   Newstalk ZB's Kerre Woodham pushed Luxon on why he didn't take Labour leader Chris Hipkins if he's trying to build consensus.   He says they have already reached out to other parties to make it clear the coalition wants to work in a bipartisan way.  When it comes to the coalition itself, Luxon insists he's leading a stable coalition, and works well with both partners.   That's despite the controversial Treaty Principles Bill coming up in this week's Cabinet meeting, and a paper unveiling Act's David Seymour's proposed principles.   Luxon's adamant he won't support the Bill past first reading and has admitted this was the issue that stalled coalition negotiations.   Luxon told Kerre the three parties are very different.  But he says he's very proud of the way he works with both Seymour and Winston Peters.  LISTEN ABOVE See omnystudio.com/listener for privacy information.

Sauvant is Resident Senior Fellow at the Columbia Center on Sustainable Investment (CCSI), a joint center of Columbia Law School and the Earth Institute at Columbia University; Lecturer-in-Law at Columbia Law School (where he teaches a seminar on FDI and public policy); Fellow, Academy of International Business; and Honorary Fellow, European International Business Academy. He is a national of Germany, married to Silvana F. da Silva, a national of Brazil.  Dr. Sauvant launched, in 2015, a proposal for an international support program to facilitate sustainable investment; structured discussions on a multilateral Investment Facilitation Framework for Development began in the WTO in 2018, and were upgraded to negotiations in 2020. He has advocated, since 2004, the establishment of an Advisory Center on International Investment Law, a proposal that was put on the agenda of the United Nations Commission on Trade Law (UNCITRAL) in October 2019. Since 1998, he has championed the establishment of a facility that helps developing countries negotiate large-scale contracts with international investors; the proposal was put on the G7 agenda in 2014, under the name of “CONNEX”, and was implemented by Germany in 2017, when it established the CONNEX Support Unit in Berlin. In January 2006, Sauvant established the Columbia Program on International Investment (today the CCSI), serving as its Executive Director until February 2012. As Chief of the Research Section of the United Nations Centre on Transnational Corporations, he created the World Investment Report and was its lead author until 2004, at UNCTAD; he also founded the journal Transnational Corporations, serving as its editor until 2005.  Dr. Sauvant received a Ph.D. degree from the University of Pennsylvania, Philadelphia. He joined the United Nations in 1973 and, as of 1975, has focused his work on matters related to FDI. He rose to Director of the United Nations Conference on Trade and Development's (UNCTAD's) Investment Division. Lecture Summary: The survival of our planet requires swift and targeted climate policies to adapt, mitigate and repair. Scientists and political elites acknowledge the urgency to reduce our reliance on coal and fossil fuels to achieve the necessary reduction in greenhouse gas emissions. Academics have been studying the impacts of investment treaty protections on climate action and argued that investment treaties raise the cost of climate action, financially and via regulatory chill and limit their ability to combat climate change. There also have been instances where investment treaties protected investors in the renewable energy sector leading to the argument that international investment law can support transition to renewable energy. This lecture will reflect on the compatibility of states' existing investment treaty obligations with their climate obligations. It will consider the consequences of investment law's distaste of local politics, stakeholder participation and public protest, which are essential to the realization of the right to a healthy environment, climate policy-making, and more broadly to democratic governance.Anil is a Senior Lecturer at Essex Law School and a co-director of the Essex Business and Human Rights Project. Her research interests are in the fields of international investment law and business and human rights. Her research bridges the gap between corporate law, international investment law, human rights law, and tort law, examining how these areas can and should interact to operationalise human rights standards in the modern business context. She has published works on parent-subsidiary relationships in the business and human rights context, non-financial reporting, duty of care in supply chain relationships, human rights in investment contracts and the embedded inequalities in the investment treaty regime. What the heck is going on? If we look beyond the US borders most currencies are getting crushed against the dollar. I just got back from a 4-week Euro trip and the dollar for the first time in my life the US dollar was at parity with the euro! Just to put things in perspective, the first time I went to Europe one Euro equaled $1.50 (a 50% difference). And why does this all matter anyway. There has never been a time in my lifetime when the dollar has been as strong as it has now. What does that mean for Americans or those of us that are earning US dollars? It means everything is on sale! Unfortunately at the expense of many other nations. The subject of currency exchange is a complicated one. A subject that isn't easily calculated or forecasted and that can change on a whim from the news. Lecture summary: The talk will focus on India's journey towards international investment law. India's approach towards international investment law has changed considerably over the years. For the first four decades after independence, India did not sign any bilateral investment treaty (BIT) - the most important source of international investment law - because it followed an import substitution industrialization model. Things changed in the early 1990s, when India embraced economic globalisation and adopted a welcoming attitude towards foreign investment. Consequently, India started signing BITs. From 2011 onward, India's BITs programme has entered a phase of 'backlash' as a consequence of being sued by many foreign investors before ISDS tribunals, India's outlook towards BITs has undergone a change. India unilaterally terminated its BITs and adopted a deeply protectionist Model BIT. Dr Prabhash Ranjan is a Senior Assistant Professor of Law at the South Asian University, New Delhi, India. He holds a PhD in law from King's College London and is the author of the book, 'India and Bilateral Investment Treaties: Refusal, Acceptance, Backlash' published by OUP in 2019.
