When does doing nothing become negligence? In this gripping episode of The Standard of Care Podcast, hosts Samantha Johnson and Nick Adams explore two real-world legal cases in which EMS providers were sued—not for what they did but for what they didn't do. The central issue is the failure to forcibly enter a residence during a medical alert activation and its devastating consequences. This conversation explores pre-hospital providers' legal, ethical, and practical responsibilities when responding to calls that may require forced entry. From Life Alert activations to one-ring 911 calls and silent apartments with growing stacks of mail, this episode examines the critical decisions providers face when balancing patient care, property damage, and personal liability. You'll walk away with actionable insights, fundamental policy considerations, and a deeper understanding of your “duty to act” when the door stays closed.Key TakeawaysFor providers with advanced responsibilities: Legal precedent is shifting—standing outside the door and “erring on the side of caution” may no longer protect you in court. If your system doesn't give you the tools or authority to act decisively, it's time to start the policy conversation. For providers early in their practice: Knowing how and when to involve law enforcement or fire services during a potential forced entry call is critical. Policies are not just guidelines—they're your legal armor. For those just beginning in EMS: Just because the lights are off and no one answers the door doesn't mean no one is home—or in danger. Learning when to escalate, who to call, and how to document your decision could be the essential skill you acquire early in your career.Referenceshttps://f001.backblazeb2.com/file/Standard-Of-Care/Handout_ch37.pdfhttps://f001.backblazeb2.com/file/Standard-Of-Care/Handout_ch38.pdf https://www.firelawblog.com/2011/06/16/duty-to-act-right-to-enter-their-well-being-our-well-being/ https://www.nbcphiladelphia.com/news/local/lawsuit-philadelphia-geneva-mackrides-death-senior-living-facility/4127192/ https://www.nbcphiladelphia.com/news/local/family-lawsuit-claims-north-philly-man-died-emts-left/4138474/ https://6abc.com/post/another-lawsuit-filed-city-philadelphia-ems-response/16045833/ https://www.ems1.com/legal/philadelphia-family-files-lawsuit-over-ems-failing-to-aid-father-after-unanswered-knock FAST25 | May 19-21, 2025 | Lexington, KY

What happens when a determination of death GOES WRONG?In this episode of the Standard of Care Podcast, hosts Samantha Johnson and Nick Adams break down a real and heartbreaking case where EMS medics declared a 14-year-old patient deceased—only for him to be resuscitated at the hospital nearly an hour later. The fallout? A legal battle that made its way to the Supreme Court, and a patient left with devastating consequences. With legal nuance and clinical insight, Samantha and Nick walk through the case from street to courtroom. They explore the intersection of qualified immunity, the complexities of assessing patients with conditions like cerebral palsy, and the chilling legal and ethical risks that come with the determination of death in the field. This episode will change the way you view determination of death—and might just save your career someday.Listen now on your favorite podcast platform or directly at https://flightbridgeed.com/standard-of-care/. While you're there, explore our award-winning and nationally recognized courses that are helping thousands of providers stay sharp, safe, and legally sound.Key TakeawaysDon't shortcut your assessment. "Cold to the touch" and single-lead asystole aren't enough—especially in patients with neurological conditions that can present atypically.Qualified immunity protects government providers—until it doesn't. It's not a license to cut corners.Thorough documentation and a second-by-second account of your decision-making process can be your legal lifeline.Cross-agency coordination and quality assurance are essential. What one crew misses, another might catch—but how that's handled matters.EMT and paramedic education rarely prepares you for the weight of calling a death. Clinical training must evolve to meet that responsibility. When in doubt, initiate resuscitation. Let the ER be the place of final determination—not the living room.ReferencesStacy Williams, on behalf of her minor grandson, J.J. v. “Her favourite show used to be Friends, and growing up she could hear it and she could read the captions, and it was so exciting for her that she could get that moment back.”In the modern world, we have an abundance of technology that helps us with our communication, information gathering, and entertainment needs. But most of this is inaccessible for DeafBlind individuals whose primary language is tactile sign. It can be difficult for them to access news headlines, or to even find out what the weather will be like later on in the day. Tatum Robotics is advancing accessibility by developing a robot hand that can communicate with DeafBlind people through tactile sign and allow them to access the internet. Designed to allow for as much movement as possible, the T1 Fingerspelling Hand features 18 degrees of freedom whilst still feeling as much as possible like holding a real human hand. DeafBlind people's main source of communication is usually through human interpreters, who can't be with them all of the time, so this technology will open up a world of interaction for them. Our producer Curt Nickish went to meet Samantha Johnson, the founder of Tatum Robotics, in their headquarters in Boston. She demonstrates how one of the robot hands works and emphasises the importance of testing with members of the deafblind community to capture all of the complexities of tactile sign language. Cheers,Scott and JakeBourbon Lens About Scarlet Shade 14-Year Rye: This is the first ever Rye release to the Orphan Barrel collection of premium whiskies – Scarlet Shade – distilled in Indiana, aged in Kentucky and bottled in Tennessee. This 14-year-old rye is heralded by sweet vanilla butter cream and lightly toasted oak aromas, tasting of warm baking spices, rye toast and orchard fruits, before warming into sweet orange marmalade and lingering as a dark chocolate finish. At 90 proof (45%). It is a limited release which dropped in May with a suggested retail price of $199.99. Scarlet Shade can be purchased on ReserveBar, Drizly.com or the Drizly app where shipping and delivery are available. About Orphan Barrel Whiskey Co. The Orphan Barrel Whiskey Co. is an endeavor to rescue nearly forgotten barrels of delicious whiskey and share them with discerning adult consumers. We are inspired by creativity, delicious whiskey, good times and great stories. The project is owned and run by DIAGEO and headquartered in Tullahoma, Tenn. However, we like to think the project is founded in dark, quiet corners of rickhouses around the world where great whiskeys are just waiting to be discovered. About Samantha Johnson: Since joining Diageo as a Quality Technician in 2018 and being named a Master Blender in 2020, Samantha has blended a number of fan-favorite, high-quality whiskies including I.W. Harper 15 Year-Old and Bulleit Rye. In fact, her very first blend—I.W. Harper 15 Year-Old—won Double Gold at the San Francisco World Spirits Competition that same year. Samantha initially uncovered her passion for working with whiskey while completing her senior thesis at Hanover College where she sped up the maturation process by rapidly aging the liquid to mimic a 4-year-old aged whiskey. After graduation, she received her Master's in agriculture (with a focus in food science and management) from Washington State University and landed a position as a Quality Technician at Bulleit Bourbon Distillery. The release of Scarlet Shade marks her first offering under the Orphan Barrel brand. Bourbon Lens Coverage and Show Links: Orphan Barrel Whiskey Co. In the DeafBlind community (people who cannot hear or see), only 10 percent are able to communicate through traditional braille, which first requires knowledge of a primary spoken language like English. Most DeafBlind people depend on tactile sign language – holding onto the hand of their communication partner – to talk with others, leaving them totally isolated when interpreters are unavailable. Boston startup Tatum Robotics is developing a humanoid robotic hand (the “Tatum T1”) that is able to translate speech or text into tactile sign language. In this episode, Jon chats with Tatum Robotics founder Samantha Johnson, who explains her company's mission to provide tabletop robotic hand interpreters for DeafBlind people, delivering the first technology supporting their communication independence. Samantha shares both the hardware and software challenges of creating a tactile signing robot – and reveals she's been “getting more hugs than she's ever received” for helping improve people's quality of life.

Months after he was on the run, the 34-year-old suspect in the maltreatment, sexual assault, and murder of an 8-year-old girl earlier this year was apprehended. Dhante Jackson was arrested on suspicion of murder and child abuse on September 10 in Newark, California. He was apprehended by officers from the Merced Police Department, the Merced Area Gang and Narcotics Enforcement Team, and the Department of Justice's Special Operations Unit. The Merced Police Department also reported that, after six months of looking for him, they had finally located and arrested Jackson. The police say they detained many people who "aided Jackson while he was on the run by providing him shelter and financial support." Sophia's loved ones filed a missing person report with the Hayward Police on March 8; they said they hadn't seen her since December 2021. Sophia, a "at-risk missing juvenile," was reported missing on March 11 and a search was launched. Samantha Johnson, Jackson's alleged girlfriend, was arrested on child abuse charges and taken into jail at the Santa Rita Jail, where detectives reportedly met with both Sophia's mother and Johnson. Reports state that Johnson directed police to the Barclay Way home where they discovered Sophia's body. After Johnson's arrest, he was sent to the Merced County Jail on murder charges. The California Attorney General's Office said in a press release after Jackson's arrest that Sophia had been "forced to live in a shed" and had been subjected to sexual and physical abuse. Police discovered Sophia's body about a month after she had died, and an examination revealed she had suffered from malnutrition. The method of her death was reportedly ruled to be homicide by the coroner. Lt. Joe Perez of the Merced Police Department told reporters, "In my 20 years in law enforcement, this case is the most frightening and awful I've encountered." Police reportedly discovered the girl's rotting body in the tub. Social workers in Alameda County say that Sophia stated her mother had assaulted her twice, including by choking and burning her.
