She worked in rural medicine for many years and is now a PA program director, following her passion for education. She also runs her own non-profit, Called to Serve, organizing medical missions trips.  Dr. Harrington shares how she was able to prevent burnout by creating routines and habits that focus on nutrition and quality self care. In this episode, we discuss a very important topic: Medicare vs. Medicaid. We explain Medicare first and what Medicare's relevancy is in terms of estate planning and elder law. Following that, we dive into Medicaid. We cover what it is and how it functions in our society. We also touch on filial responsibility law and Medicaid estate recovery. The goal of this episode is to clear up any confusion with Medicare and Medicaid and provide you with the information you need to plan out the rest of your life. We will dive into some new topics in the next episode, so stay tuned! Key Takeaways  Takeaway 1: Medicare 01:01 - 05:36 Medicare is not what many people think it is. It is not a widely-applied health insurance. In terms of long-term care, it only applies to an individual when they are admitted to a hospital for 3 consecutive nights, leaves the hospital, and then goes to a skilled facility for rehabilitation.  Must be admitted to the hospital, not just be under observation. Medicare will pay for up to 100 nights in the skilled facility, but only if you show signs of improvement and progress in your rehabilitation. It's not 100 guaranteed nights of coverage. You could go from paying almost nothing, maybe just a copay, to paying $12,500 per month if you do not rehabilitate. Takeaway 2: Medicaid 05:37 - 09:30 Medicaid is a federal program, with the most common laws that people recognize being OBRA 96 and DRA 05. These laws set the rules for Medicaid. There is federal law, but each state interprets the federal Medicaid rules as they see fit. Research the nuances in your state and talk to the local county office. Pennsylvania has a long-term care handbook that can be found online. Every county interprets the handbook in its own way, and every case worker may look at an issue slightly differently within each county. We offer weekly workshops, one of those being the Medicaid workshop. We talk about what to expect, what you can do ahead of time, and how to make things easier down the road. Medicaid essentially will pay for the long-term care for an individual in a skilled facility, or there is the waiver program or Community HealthChoices in Pennsylvania that will pay for care in a person's home if they meet the requirements. There is an income cap limit in PA with the waiver program, but with a nursing home, whatever the income is, we can preserve and protect the assets. In PA, if a spouse enters a nursing home, we can protect 100% of the assets of the spouse still living at home. We can take everything else and put it in the community spouse's name, but the community spouse can only take half as long as half of the money falls between $135 thousand and $30 thousand. Any excess money can be turned into an income stream that will pay back to the community spouse in as short of a term as possible. It must be Medicaid-compliant under the law. We can protect at least 50 percent of unmarried individuals' assets. We can gift half the money they own. This is called the Half and Half plan  If someone is about to enter a nursing home, it is not too late. We can still help with crises and prevent asset loss.  Takeaway 3: Filial responsibility law and Medicaid estate recovery 19:32 - 24:32 Filial responsibility law proposes that children, spouses, and parents can be responsible for the nursing home debt of the child, spouse, or parent.  The Pittas case was a bad facts case that made bad law. The judge in the case used filial responsibility law to hold Mr. Pittas responsible for taking his mother's money. He was liable for nearly $93,000 in nursing home costs incurred. Medicaid estate recovery is once you've already been receiving benefits; when you die, the state is allowed to go after the probate assets of the individual to cover the amount of care that was provided. We just want to make sure the assets are under $2400 and/or they do not go through probate.  This is why you want to use a professional. Estate recovery is the last thing we worry about because when we do a plan correctly, we do not have to worry about it. Dalton Savidge, Snyder County resident, local electric choice expert, on the impending PPL supply rate increase, how to avoid the rate increase and how to shop around. We'll explain your electric bill (again) and talk about the more than 100 choices you have for your electricity supplier. You could pay hundreds of dollars too much if you don't shop around. Here is Dalton's information sheet: UNDERSTANDING YOUR PPL ELECTRIC BILL AND HOW TO CHANGE YOUR SHOPPING RATE The info below is referring to the bill for your home(Residential Service abbreviated--RS). The same concept applies to commercial service, but the kilowatt hour costs are different. Your electric bill consists of 2 parts. The DELIVERY portion which is the poles, wires, linemen, phone people. etc. The SUPPLY portion is the power plants and the large steel towers. In PA you can shop the SUPPLY portion of your bill. If you get the SUPPLY portion of your electricity from PPL your RS cost is increasing from the current REGULAR price of $.089(current rate until 5/31) to $.124 cents per Kilowatt hour(Kwh) on June 1. PPL has agreements with 9 different Energy suppliers for a 7% discount off the PPL Regular rate. This is called a STANDARD RATE. The time frame for the STANDARD rate is 1 year and there is NO cancellation fee. All 9 companies offer the same rate so it does not matter which one your are assigned or choose. The current STANDARD rate is $.083($.089 minus 7%). After 5/31 the standard rate will be $.115($.124 minus 7%). You can call PPL(1-800-342-5775) or you can go online if you have a PPL electric account. If you do not have a PPL on line account you can go to-- pplelectricutilities.com --and set up an account. This should be done before 6/1 to lock in the $.083 STANDARD rate for 1 year. If you call I suggest you call around 8:01 AM or you may be waiting for a long time. There is a web site --papowerswitch.com --that lists 44 companies and 106 different choices. Currently there are NO CHOICES even close to the PPL STANDARD rate of $.083. You can figure out how much the rate change will cost you by taking your yearly KWH usage(on the back of your PPL bill, upper left corner, second line down), and moving a decimal point(not shown on bill) 2 spaces to the left. For example, if you use 10,000 kwh per year and move the decimal point you will get 100. For each additional penny($.01)your rate increases your yearly cost will increase by $100 per year. If you have electric heat, central air conditioning, a pool, electric water heater, and dehumidifier you use approximately 25,000 kwh per year. If your supplier is PPL and you do not shop, your KWH rate will go from $.089 to $.124, your increase will be $.035, your total yearly increase will be $825. Prepared 5/20/22

Nick and Alex are graduate students at West Chester University who wrote a piece for the student newspaper The Quad, "Hallmarks of neoliberalism pervade PA system of higher education." In that piece they argue,  "While the promise of market efficiency can seem tempting under such bleak circumstances, it is not a sustainable model of increased access or more abundant resources in higher education. In fact, despite the increasing reliance on this model, inflation-adjusted per-student state funding has declined in 41 states since 2008, according to a study by the Center on Budget and Policy Priorities. In PA alone, we have seen about a 40% reduction since the year 2000 in state funding across the board, even as universities continue to struggle and threaten to shut their doors." Now, Alex and Nick are helping launch a new organization, "PASSHE Defenders," Fighting for a Fully Funded State System of Free Public Higher Education. Earlier today the PA Senate Democratic Caucus Policy Committee held a hearing on PASSHE consolidation plans. State Senators Katie Muth, Lindsey Williams, and Judy Schwank led questions for panels featuring faculty, staff, students, and administrators.  Nick Marcil is a first-year Higher Education Policy and Student Affairs masters student at West Chester University. He is a current Graduate Assistant for Student Engagement in the Center for Civic Engagement & Social Impact and will be returning there next year. He graduated from the West Chester University in May 2020, where he majored in Early Grades Preparation and a minor in Mathematics Education (Pk-8). Alex Karlesses is a first-year Higher Education Policy and Student Affairs masters student at West Chester University. She is a current Graduate Assistant in the Twardowski Career Development Center, and thoroughly enjoys counseling students and helping them with their postgraduate plans. She was also recently elected as the Vice President of the Graduate Student Association, and plans to use her platform to promote and plan programming for first-generation students, as well as help graduate students obtain any resources they need to help secure funding or further aid for their studies. This is a question that most agents and buyers never really have to think about.  How often does this happen?  I like to raise the question in my ethics classes for these very reasons.  Once people do think about it, it can generate a lively theoretical discussion which generates emotion and opinion.  I am not sure there is a perfect answer but I think it has so many aspects to it that it is worth discussing.  Better now than in an ethics hearing.  Let me start with some disclaimers. First, this is my opinion and not intended as legal advice.  Second, I am in PA where this practice is not considered “dual agency”.  In fact, our contracts specifically allow this to happen which I will discuss later in further detail.  However, it is considered “dual agency” in some states which makes me wonder why, how can that be:  it either is or it is not “dual agency”.  How can it be looked at differently in different states?  If it were considered “dual agency”, which is not allowed in some states, that would at least provide some direction as to how to handle it and remove my concerns.  Third, my intent is not to interfere with any existing business relationships although I would respectfully suggest that buyers should know if this situation might come up so that they can make an informed decision before entering into a business relationship that might not work for them.  In PA many agents refuse to act as “dual agents”.  I wonder how they view this topic? I am an analytical thinker so I will look at this from several perspectives.  Let's start with some contract information, meaning some language that a potential buyer-client should know before hiring an agent to represent them.  This assumes that a buyer hires an agent and actually discusses their respective roles.  Of course, if an agent does not follow our rules and regulations, a member of the public may not be as well informed as they should be.  While well over 90% of the public searches online for Real Estate listings and information, I do not believe that most really understand agency representation.  We do more than open doors and write contracts.  Do prospective buyers know what to ask agents they might hire?  Are they resistant when an agent tries to do their job by discussing contracts and agency disclosures?  I am going to talk about this from the perspective of being a REALTOR, not just a licensee.  This means I will refer to out REALTOR Code of Ethics as well as our state's “standard forms”.To read more, click here.Please visit my agent website to view thousands of Real Estate listings and learn more about selling and buying Real Estate.My New Audio Course is LIVE on Listenable.io.  The title is "The Basics of Selling Residential Real Estate".   Click here for Lesson 1.   To enjoy 14 free days of Listenable, click here.

Todd Leiss, Traffic Management Coordinator for the State of Pennsylvania, and John Dewese, a tow truck operator injured by a speeding motorist, discussed the dangers emergency crews and responders face while on the job, and their new campaign, MOVE OVER.  On average two workers are struck each day, 44 dies in 2019, a number that will probably be surpassed in 2020.  After an intense study on accidents involving emergency responders, the state created PENN TIME, the PA Traffic Incident Management effort, to educate the public on what to do when entering a work zone or approaching flashing lights.  The campaign reminds all drivers that you must slow down when entering a work or accident scene and always move over for flashing lights of all colors, under penalty of law.  They also established a free training course for responders - ambulance and firefighters, tow truck drivers, road crews, and all emergency responders on safety measures they can implement for better safety.   Each state offers tips and educational programming for divers and operators.  In PA visit PENNTIME.org, in New Jersey it's NJTim.org      See omnystudio.com/listener for privacy information.

Trump and Biden hold dueling town halls. Looks like our corporate media is playing the money game just like 2016. SCOTUS hearings for Amy Comey Barrett were pretty much a disaster - for the Democrats. One thing did become clear, however: Diane Feinstein needs to go. It’s time for a clean sweep of the Democratic Party leadership.  COVID is on the rise again as the White House signals they are embracing the wack-job herd immunity approach to killing more Americans.  Polls continue to indicate Biden has a huge lead.  Voter suppression continues. Get ready for the day after the election. Jonathan Smucker, one of the co-founders of Lancaster Stands-Up, as on the Benjamin Dixon show this week - It would be worth your time to check it out.  As of this morning, over 680,000 Pennsylvanians have returned their mail-in ballots.  Of those 680,000 ballots, 510,000 came from Democrats while Republicans have only returned 116,000 ballots. Pennsylvania House Republicans dropped HR 1032 from their agenda after weeks of fight back.  HR 1032 would have allowed Harrisburg Republicans to establish their “election integrity commission” to steal the 2020 election. In more election-rigging news, multiple Trump lawsuits regarding poll watchers, drop boxes, and satellite voting offices. One lawsuit aimed to stop the Delco County Commissioners from using the Philadelphia Union’s soccer stadium as a location where residents can register to vote, sign up for their mail-in ballots and return their ballots on site.  Allegheny Dems want Summer Lee and other progressive candidates to pay up, even after they went all-in for their opponents. Sounds to me like the money should be flowing the other direction.  Bernie Sanders released his endorsements for more than 170 down-ballot races. In PA, Sanders endorsed 11 candidates for the State legislature. We’ll have that list for you.  The Second Lady of Pennsylvania, Gisele Fetterman, is verbally attacked with racist epithets...and she gets it on tape. And just to prove racists are bi-partisan, a day later, Republican Rep. Aaron Kaufer of Luzerne County found a swastika adorned note on his office door. Kaufer is Jewish.  The Pennsylvania State System of Higher Education looks to get rid of upwards of 350 faculty members, mostly from universities in Western PA. APSCUF President Jamie Martin spoke at the Board of Governors meeting this week, exposing the sham narrative being hocked PASSHE Chancellor Greenstein. She tells a different narrative of administrative bloat, mismanagement, and dishonest budgeting practices. You know, the stuff we’ve been sounding the alarm bell for nearly a decade here at Raging Chicken.  Big anniversary this week: It’s the two year anniversary of Scott Wagner freaking out at a billboard. That was probably the dying breath of his gubernatorial campaign. It’s here. Last night Star Trek: Discovery returned with Season 3 on CBS All Access. I am totally psyched, but I have to admit I didn’t watch it yet and I’ve had to keep my eyes off my social media. I’ll fill you in next week.  On Wednesday, American astronaut Kate Rubin, and Russian cosmonauts Sergey Ryzhikov and Sergey Kud-Sverchkov made a record-breaking trip to the ISS aboard a Soyuz rocket. The crew made it to the space station in just 3 hours, a trip that has taken about 6 hours since 2013. It used to take upwards of two days. The shortened trip is thanks to a new “fast-track” method that only required two orbits before docking with the ISS.  The 2020 Mars Society Convention is going on now through Sunday. They’ve taken the convention virtual this year and are inviting the public to join in. You can watch the convention live online. Registration is free, but they recommend a $50 donation. Sessions will feature all the notable Marsheads on topics such as “Next Gen power for Marian life,” “Human Rights as a foundation for a Mars bill of rights,” and “The Martian Urban Cell as the unit for Martian settlements.” Is Mars too out there for ya? Well, closer to home this week the United States and seven other countries signed NASA’s “Artemis Accords,” which set rules for exploring and settling on the Moon.  And, the one big thing that NASA, under the leadership of Jim Bridenstine, wanted to make clear is that countries can own and use resources they extract from the Moon. The pandemic is having a major impact on the world and our country.  My deepest sympathy goes to everyone who has been personally impacted in any way.  Life is very different today than it was just a few weeks ago.  For example, Real Estate, a major component in our economy, has been directly impacted by a number of factors including “social distancing” rules, slowing or stopping most activity.  In PA Real Estate is considered "non-essential".The “spring market” is usually going strong by now.  Many owners plan to move after school has ended or before enjoying the summer.  However, many plans have been put on hold.   Many owners whose properties were on the market have stopped their marketing.  In PA we are not allowed to show homes to buyers although we can do this virtually or buyers can make offers without actually visiting them.  Relying on technology is great but that puts buyers and their agents into an awkward position most do not want:  buying "sight unseen".  What could possibly go wrong?  Taking new listings is equally difficult if we follow the rules.  Sadly, many aren't and only time will tell if that was worth the risk. We can do paperwork electronically but many of the processes that typically occur between signing a contract and settlement are stopped so many properties under contract are not moving forward.  These include property and municipal inspections, repairs and appraisals.  Even worse, many sales are being canceled, mostly due to employment issues or changes in financing.  While the long-term results are unclear, this touches on something I see and say every fall and winter. Fall, specifically September and October, is typically the second wave of Real Estate activity.  While Real Estate can and does sell every day of the year, there are two major seasons.  After summer and enjoying the great outdoors, I suspect some return home from vacation feeling claustrophobic as they adjust to spending more time indoors while others want to sell before the new year. What is interesting and happens every year is that many owners who were unsuccessful trying to sell, decide to wait until the next spring.  Some are frustrated by the process; others want to enjoy the coming holiday season.  Every year I remind people that houses sell every day, that most houses look their best in the fall and, as we are clearly seeing NOW, who knows what spring will bring?  There are many who came to regret leaving the market in 2008.  Then the market crashed.  How many might have sold and moved on had they continued trying to sell?  And now this.  Obviously this is different.We started off 2020 with nice weather so the Real Estate market performed well.  Some still kept their houses off the market.  Inventory levels remained low which undoubtedly concerned many owners wondering where they might move.  What happened to their plans?  How long will this last?  What will life be like afterwards?  What will be “normal”?  How quickly will our booming economy return?  There are so many questions but we have to look forward, don't we? I am confident that this will pass.  Owners will have an opportunity to decide whether to move forward with their plans, albeit delayed, or wait until some later date, perhaps “next spring”.  I am here to help you and provide knowledge and insight to help you make an informed decision.  Whether sooner or later, we can get back to normal and move forward with your plans. There is no time for inexperience, empty promises or false expectations! HIRE WISELY:  We are not all the same!

When it comes to finding your way to your homebirth midwife, was this an easy or difficult path for you? After 2 hospital births, Krista knew she was ready to take birth home.  The issue, however, was finding a care provider.  In Western PA, midwives are publicly prosecuted for attending homebirths.  CPMs and traditional midwives alike are underground.  Krista mentions she felt like she was calling a “black market midwife.”  In this episode, we discuss it all.  From birth trauma to faulty legislation…but we end the way I pray all births do… victoriously.  Join me as we learn about Krista’s experience with 3 under 3.   Show Notes: Krista is a corporate lawyer and mother to 3 children, ages 3 and under. She discussed how ridiculous it is that these practices and hospitals expect mothers to sign away all of their rights and consent weeks before even being in labor, or even upon entrance to the hospital. How can you give informed consent when you don’t even know the situation yet? This is why she decided to switch to the care of midwives at 28 weeks. After her first birthing experience, which was quite traumatic (they threatened to vacuum baby out simply because she pushed for 2 hours, they whisked him away immediately to NICU and she didn’t see him for 4 hours), she knew she wanted to take back birth. Though Krista experienced birth trauma, she has managed to use it for good. With her second birth, her midwives switched hospitals (it would now be 70 minutes away)—much because the hospital they were at before’s poilcies were not good for midwifery clients. For this birth, her doula was at another labor, so her backup was called. However, after speaking with the backup and telling her all that was going, the backup ended up calling HER backup…. Krista was so upset. Suddenly her mindset changed and she was now feeling the sensations as pain, where they had not seemed painful before.  This shows just how much our situation and mindset can influence our perception of what we are feeling. She arrived at the hospital at 8:30 am, and baby was born at 9:17. She left the hospital knowing that she would not be coming back. In PA, it’s incredibly difficult to find a midwife because there are no midwifery regulations. She discusses how she felt like she had to find a “black market midwife” Although she was going through a difficult divorce during her third pregnancy, her experience was amazing because of her care. The midwives cared about her mental health, her life experiences, etc.  This was all taken into consideration during her care. She did use traditional midwives, who did not have access to medications, testing or scans. She discusses how although she felt comfortable with this for this birth, it’s unfair that other mothers, who might not, must make these kinds of choices simply because of the state’s choices. Krista’s mother was able to make it for the birth of her third baby. She didn’t even realize the midwives and doula had arrived for quite some time, as they were quietly waiting in the corner. She had made such a gorgeous atmosphere in her room- an are where she could truly relax into labor and be present. Twinkle lights, birth pool, worship music all set the mood. This is vital. Liability drives hospital decision-making. The best interest of the mother is not.  This means that when facing the hospital setting, we have to be very aware of what is going on and PUSH for informed consent. Having a homebirth can be overwhelmingly healing. Midwives can be so phenomenal in supporting mothers in their birthing journey, no matter the emotional backdrop to the pregnancy.  Care is so individual.  Even during a difficult personal experience, Krista was able to find strength and victory in her homebirth experience.

Selling and Buying Real Estate “As-Is”

One of my favorite expressions in Real Estate is “as-is”.  Unfortunately, it means different things to different people.  I don't hear it as often as I used to but it comes up every now and then so I decided to discuss it.  I am not an attorney so this is NOT intended as legal advice. Let's look at the term from the seller's perspective first.  When a seller tells me that they are selling their property “as-is” they typically mean that they will do no repairs.  Whether they price it low to sell fast or they do not want the inconvenience or expense of making repairs for a sale that may fall through does not matter.  I prefer that we disclose their intention up front to avoid any confusion or time wasted with a buyer who insists on repairs.  At the very least, the seller's intentions should be made know once the start to negotiate an offer. Some have used the term “as-is” to mean that they do not want to complete the property and lead-based paint disclosures which are required by law.  The term “caveat emptor” or “buyer beware” does not mean that the seller can withhold knowledge about material defects or environmental hazards.  I have been mediating disputes between buyers and sellers since 2002 and, other than buyers and sellers trying to resolve who gets the deposit money when a sale falls through, many of my mediations have involved a buyer who thinks that a seller failed to properly disclose something to them.  In PA the law requires that sellers disclose “material defects” in their property in writing to prospective buyers so that they can make an informed decision before making an offer.  There are exceptions to the law.  In addition, there is a federal lead-based paint disclosure form for houses built before 1978 and I am not aware of any disputes regarding how that form has been used. From the buyer's perspective, in addition to reviewing the disclosure statements, assuming they are available which is not always the case, a buyer has several alternatives if they wish to make an offer on a property with obvious issues which some nicely call “deferred maintenance”.  They can subtract the anticipated costs of addressing the problems from their offer (assuming they can justify the amount they deducted), they can ask a seller to correct specific problems as part of the negotiating process or they can ask for a “seller assist”, assuming they do not jeopardize their ability to finance a purchase or commit mortgage fraud.  Whichever option they choose, the result may turn off a seller or make their offer less competitive if there are multiple offers.  I would respectfully suggest that a buyer not discount an offer and then ask for a repair anyway or avoid mentioning an obvious concern as this may cause a seller to think the issue does not concern the buyer.  Negotiating an offer can be challenging enough without creating a later issue when property inspection issues needs to be resolved. When a property is marketed, there is a general expectation which is written into two different paragraphs of the PAR Standard Agreement for the Sale of Real Estate.  In paragraph 25 REPRESENTATIONS, the language states that “Unless otherwise stated in this Agreement, Buyer has inspected the Property … before signing this Agreement or has waived the right to do so, and agrees to purchase the Property IN ITS PRESENT CONDITION, subject to inspection contingencies elected in this Agreement.”  In Paragraph 18 MAINTENANCE AND RISK OF LOSS, the language states that the “Seller will maintain the Property …specifically listed in this Agreement in its present condition, normal wear and tear excepted.”  In other words, the buyer is buying what they saw when they walked through the property.  There is a trend in some markets to buy a property “sight unseen” and this can get complicated by the

Vprašali smo, ali se še da dobiti kako majico [dobro božičkasto darilo!] in ali lahko Petrovič ponovi lansko noro pomlad. Ne pozabite, Krško je bilo sedmo z 18 točkami po polovici 2. SNL. Na koncu? 51 pik in prvo mesto! Sprehodili smo se skozi obračune čez hribe in doline. Kakšno smo rekli o Zavrču pa tudi o Krki, ki ji Jaša ne želi nič slabega. Še zdaleč ne. Samo ko bi Novo mesto malo bolj živelo s tem fuzbalom. Že zato, ker Josip Fuček pleše, ko izvaja usodno dobre udarce iz kota! Celje ima v De Sousi in Firerju ubijalski dvojec in je splezalo naposled na šesto mesto, dragi moji! Gorica - bo šla v Evropo ali...? Hm. Aja, pa Maribor je nakantal Koper. O, ja. Kaj še reči... Pod Krunoslavom Jurčićem je Maribor zabil 45 golov na 14 tekmah, prehitel Olimpijo, ko gre za dosežene štikle. O, ja. Vendar poudarek oddaje je bil vendarle na - velenjskem Rudarju. "REAM RAPER" is "Loose Bruce" Kerr's latest parody of Gary Wright's "Dream Weaver" and protests the Texas law forcing on a woman vaginal wand insertion for a sonogram before allowing an abortion. (True, it doesn't require wand insertion in all cases but in the first trimester, that's the only method). This issue is currently a subject of satire in Gary Trudeau's "Doonesbury" comic. Pennsylvania governor, Tom Corbett, famously uttered the parody's opening line as how a woman can choose to cope with forced viewing of the sonogram, "You can just close your eyes."In Texas, it's the law. In PA, a bill is under consideration. Virginia also has a similar law. There's a trend here and it has to be stopped, and reversed, IMHO. There's a fight a-brewin'.Bruce apologizes for being the ugliest woman imaginable in this video but, truthfully, a guy opining against vaginal insertion by the state, well, it raises questions (and no time for alternatives, these lyrics needed posting now).Bruce (this is the "OTHER Bruce") took 20 years off to write & perform music, sometimes solo, sometimes in a duo or the band, "Spud City-Music With a Peel" (Mass., VT). He opened for "Weird Al" Yankovic.
