A “new” entrant to the forfeiture reallocation suit “suite”—and a decision in favor of fiduciary defendants. Nevin & Fred review the latest developments.Yet another 401(k) forfeiture fiduciary breach suit has beenfiled—but there are some key differences: The plaintiffs are represented by the law firm of Schlichter Bogard, LLC. The plan involved was the largest targeted by this type of litigation to date (nearly $8 billion). The plan document language prohibited use of forfeitures to offset employer contributions before offsetting administrative expenses (at least according to the suit). And then there is a case that has been through severalrounds of adjudication—and though winning, has had to keep going back to court. But HP finally prevailed, and though the actions regarding the application of forfeitures were seen as fiduciary decisions—well, there was a bit of a “new” twist in how the judge viewed them.In this episode Nevin (Adams) & Fred (Reish) examine theissues and potential implications, as well as a quick review of some recent updates.Episode ResourcesSchlichter Targets Massive 401(k) Plan With Forfeiture Suit401(k) Fiduciaries Fend Off Forfeiture Reallocation SuitSome “new” News:DOL Pushes Pause on 401(k) Fiduciary Rule SuitsBreaking News: White House Nominates Next EBSA AssistantSecretarySupremes Hear ERISA Burden of Proof Case

The Police Minister, and Commissioner, have suggested mental health callouts are 'draining' resources. The pair announced a new specialist gang unit would be set up, confirming some officers would be re-prioritised and some more would be hired. Welcome to episode 146 of Activist #MMT. Today I talk with author, mathematician, and bond analyst Brian Romanchuk, on the basics of the secondary market and how it relates to the primary market. Brian starts with a brief tutorial of how bonds are priced, which is seen very differently from the points of view of the primary and secondary markets. For an in-depth treatment of this topic, you can listen to episodes 30 and 31 of MMT Podcast with Steven Hail. (Here's a link to part two. A list of the audio chapters in this episode can be found right below [above the full-question list].) Brian then describes bonds (and more broadly, securities) in general, the population of who buys and sells them, some of the reasons why they are bought and sold, and several anecdotes of how it all happens. What can be said is this: rich people rarely if ever buy US treasuries on their own, as individuals. Additionally, the biggest players in securities trading never speak publicly in order to prevent jeopardizing their advantage – they keep their mouths shut. These two facts alone put a huge hole in the idea of so-called bond vigilantes. Although I'm not necessarily interested in the idea of bond vigilantes, it's one of the most obvious and common myths that comes up regarding the secondary market. Whatever the case, the idea that the market can somehow overrule the national government is clearly false. This is for at least the following three reasons: only the national government can create and delete its own bonds. Only the national government can create and delete its own money – which is required to purchase those bonds. And the national government (for countries such as the United States, UK, Australia, Japan, and Canada) have little to no foreign denominated debt, which means they do not offer to convert their money into anything else. What this means is that the national government, through the collective action of its citizens (US!), has the power to stand up to the market even if they somehow object to the actions of that government. The only way the market can overpower the national government is if the government chooses for it to be that way – such as when representatives and regulators are bought off by the biggest players in that market. This is further bolstered by the populace being sufficiently duped into believing it all to be "unfortunate, but necessary." This is a primary battle-front in the centuries-long war between rich and poor, which, unfortunately, the rich have all but won. And now, onto my conversation with Brian Romanchuk. This is part one of a two-part conversation. Enjoy. In order to preserve both my podcast and my sanity as I proceed through Torrens University and Modern Money Lab's graduate program in MMT and ecological economics (

Link to bioRxiv paper: http://biorxiv.org/cgi/content/short/2023.06.20.545763v1?rss=1 Authors: Patelaki, E., Foxe, J. J., McFerren, A., Freedman, E. G. Abstract: The neural underpinnings of increasing cognitive load during walking, despite being ubiquitous in everyday life, is still not fully understood. This study elucidates the neural mechanisms underlying increased cognitive load while walking, by employing 2 versions of a Go/NoGo response inhibition task, namely the 1-back Go/NoGo task and the more cognitively demanding 2-back Go/NoGo task, during sitting or walking on a treadmill. By using the Mobile Brain/Body Imaging (MoBI) modality, electroencephalographic (EEG) activity, three-dimensional (3D) gait kinematics and task-related behavioral responses were collected from 34 young adults for the 1-back Go/NoGo task and 34 young adults for the 2-back Go/NoGo task. Interestingly, increasing cognitive-inhibitory load from 1-back to 2-back Go/NoGo during walking was not associated with any detectable costs in response accuracy, response speed, or gait consistency; however, it came with attenuations in walking-related EEG amplitude changes during both successful inhibitions (correct rejections) and successful executions (hits) of the 'Go' motor response. During correct rejections, such attenuations were detected over frontal regions, during latencies related to sensory gain control, conflict monitoring and working memory storage and processing. During hits, attenuations were found over left-parietal regions, during latencies related to orienting attention to and selecting the 'Go' motor plan, as well as over central regions, during latencies linked to executing the 'Go' motor response. The pattern of attenuation in walking-related EEG amplitude changes, manifested by the 2-back Go/NoGo group, is thought to reflect more effortful recalibration of the above neural processes, a mechanism which might be a key driver of performance maintenance in the face of increased cognitive demands while walking. Overall, the present findings shed light on the extent of the neurocognitive capacity of young adults, thus revealing the employed methodology as promising for better understanding how factors such as aging or neurological disorders could impinge on this capacity. "He made the moon to mark the seasons; the sun knows it's time for setting." Psalm 104:19 Making the most out of our time is a crucial aspect of life that many people struggle with. In today's fast-paced world, time is one of our most valuable resources. Unfortunately, it's a non-renewable resource that, once spent, cannot be regained. As Christians, we are called to steward our time wisely and make each moment count for more. The Bible encourages us in Ephesians 5:15 to "Be very careful, then, how you live—not as unwise but as wise." This verse reminds us that time is valuable and must be used wisely. Every day presents different opportunities to make our time count for more. One way to do this is by planning our day and setting achievable goals. When we have a clear plan in place, we are less likely to waste time on unimportant things or procrastinate on important tasks. Another way to make our time count for more is to measure progress regularly. This helps us stay on track and identify areas where we need to improve or adjust our approach. Likewise, we should make the most out of every moment by doing good deeds for ourselves and others. Galatians 6:10 says, "Therefore, as we have the opportunity, let us do good to all people, especially those who belong to the family of believers." We should focus on quality over quantity by prioritizing tasks that will bring us closer to achieving our goals. Breaking down complex tasks into smaller manageable ones also helps increase productivity and reduces stress. Reallocation of time is another effective strategy for making the most of our available resources. As followers of Jesus, we have a chance to make an eternal impact. We can do more than can affect our nation; we can advance God's kingdom. Through the power of the Gospel, we can exert an influence extending far past our natural lives' boundaries. So, when Paul exhorts us to "make the most of the time because the days are evil," He has not given the follower of Jesus Christ an impossible assignment. If you want to make the most of the time, be diligent about reading your Bible and praying daily, then carefully examine your life to be sure that you are intentionally living for Jesus. That's how to redeem the time and remember, as Christians, we have an advantage in this area because we have Jesus Christ as our ultimate example. Amen. Psalm 31:14-15 says, But I trust in you, O Lord; I say, "You are my God." My times are in your hand; rescue me from the hand of my enemies and my persecutors. Amen. Let us pray, Lord Jesus, give me the power to be wise with my time. Grant me the grace to make each day count towards advancing your kingdom in Jesus' name. Amen! --- Support this podcast: https://podcasters.spotify.com/pod/show/pastor-divineo/support

China will adopt further measures to ensure stable prices and sufficient supply of daily necessities and energy for household and industrial needs, according to decisions made on Tuesday at a State Council executive meeting chaired by Premier Li Keqiang.1月3日,李克强主持召开国务院常务会议,部署进一步做好重要民生商品和能源保供稳价等工作。To better coordinate the pandemic response with economic and social development, it is imperative to take stronger steps to ensure sufficient market supply and price stability during Spring Festival, and meet people's needs for medical care and winter heating, the meeting decided.会议指出,要更好统筹疫情防控和经济社会发展,进一步强化重要民生商品、医疗物资、能源等保供稳价,确保春节期间市场供应充足和价格平稳,保障群众医药需求和温暖过冬。"Despite the moderation in economic growth last year, price rises have been kept at a relatively low level, which is no easy feat," Li said. "We did a lot of hard and meticulous work, and refrained from excessive money supply or continuously increasing deficit by a wide margin. This is an important foundation for price stability."李克强表示,过去一年我国物价保持平稳,粮食、能源等稳定供应能力进一步提升,这极为不易,为稳经济、保民生提供了有力支撑。The meeting emphasized the need to further enforce the system of provincial governors assuming responsibility for the "rice bag "and city mayors for the "vegetable basket", and conduct timely market reallocation.会议强调,要进一步压实“米袋子”省长负责制、“菜篮子”市长负责制,及时做好市场调配。Preparations for spring plowing and sowing will be made, and provision of fertilizers and other agricultural supplies, as well as related services, will be ensured to further promote grain production and firm up the basis for price stability.做好春耕备播准备和化肥等农资保障服务工作,进一步抓实粮食生产、夯实稳物价基础。The supply of medical and epidemic prevention goods will be improved and a list of key manufacturers drawn up to support their full production capacity, the meeting decided. Abstract: Combining walking with a demanding cognitive task is traditionally expected to elicit decrements in gait and/or cognitive task performance. However, it was recently shown that, in a cohort of young adults, most participants paradoxically improved performance when walking was added to performance of a Go/NoGo response inhibition task. The present study aims to extend these previous findings to an older adult cohort, to investigate whether this paradoxical improvement when dual-tasking is observed in healthy older adults. Mobile Brain/Body Imaging (MoBI) was used to record electroencephalographic (EEG) activity, three-dimensional (3D) gait kinematics and behavioral responses in the Go/NoGo task, during sitting or walking on a treadmill, in 34 young adults and 37 older adults. Increased response accuracy during walking, independent of age, was found to correlate with slower responses to stimuli and with walking-related EEG amplitude modulations over latencies and topographies related to the cognitive component of inhibition. On the other hand, aging, independent of response accuracy during walking, was found to correlate with slower treadmill walking speeds and attenuation in walking-related EEG amplitude modulations over latencies and topographies associated with the motor component of inhibition. Older adults whose response accuracy improved during walking manifested neural signatures of both behavioral improvement and aging, suggesting that their flexibility in reallocating neural resources while walking might be maintained for the cognitive but not for the motor inhibitory component. These distinct neural signatures of aging and behavior can potentially be used to identify super-agers, or individuals at risk for cognitive decline due to aging or neurodegenerative disease. The 83rd State of the Fleet Industry video produced by Automotive Fleet offers an updated look at the state of the fleet market as presented by AF Editor Mike Antich. This episode is sponsored by Circle K. Learn more about the Circle K Fleet Card. Today's topics include: The anticipated additional disruption of the supply chain due to today's geopolitical issues will extend today's supply chain imbalance. The reason today's situation in the Ukraine is so important is because most finished metals especially aluminum come from Russia/Ukraine and China, but more so from Russia/Ukraine since the U.S. added tariffs on Chinese finished materials. If there is a tit-for-tat escalation in sanctions, it can crimp the supply of aluminum. Even before the Russian invasion of Ukraine, there was a 9 to 12 month order-to-delivery time for the time it takes to receive aluminum in bulk. How will the auto industry be impacted by reduced availability of steel, aluminum, and stainless? Mills are limiting who gets supply for the purpose of reallocating supply to higher margin customers. Problematic or low margin customers are getting letters from the mills saying they can't supply metal. This “saved” production is being reallocated to higher-margin customers. The price of aluminum has had back-to-back increases in the first two months of 2022. Also since October 2021, the price of aluminum is 68% higher. ⏱ Timestamps ⏱ 0:00 Intro 1:00 Disruption of Supply Chain Due to Geopolitical Issues 5:18 Escalation in Sanctions 6:33 Reallocation of Supply

In more than 150 cities around the world, Covid 19 has been what you might call a shot in the arm for walking and cycling. To encourage social distancing, they added cycleways, extended footpaths and replaced parking spots with outdoor seating. What did New Zealand do?
