This Day in Legal History: Atkins v. VirginiaOn June 20, 2002, the U.S. Supreme Court delivered a landmark ruling in Atkins v. Virginia, holding that the execution of individuals with intellectual disabilities violates the Eighth Amendment's prohibition on cruel and unusual punishment. The case centered on Daryl Renard Atkins, who was convicted of abduction, armed robbery, and capital murder in Virginia. During the penalty phase of his trial, defense attorneys presented evidence that Atkins had an IQ of 59 and functioned at the level of a child. Despite this, he was sentenced to death. In a 6-3 decision, the Court reversed its earlier stance from Penry v. Lynaugh (1989), which had allowed such executions. Justice John Paul Stevens, writing for the majority, emphasized the "evolving standards of decency" in American society, noting that a growing number of states had barred the death penalty for individuals with intellectual disabilities. The Court recognized that such defendants are at a heightened risk of wrongful execution due to difficulties in assisting their own defense and the possibility of false confessions. The decision did not establish a national standard for determining intellectual disability, leaving that to the states, but it set a constitutional floor by barring executions in these cases outright. Atkins significantly reshaped the legal landscape of capital punishment, prompting states to revise death penalty statutes and sentencing procedures. The ruling reinforced the importance of individualized sentencing and safeguarded vulnerable populations from the most severe penalties. It also underscored the role of psychological and scientific evidence in constitutional interpretation. While not without criticism, Atkins remains a cornerstone of Eighth Amendment jurisprudence and a key moment in the Court's ongoing reevaluation of capital punishment.Technology giants Apple and Meta are currently facing possible penalties under the EU's Digital Markets Act (DMA), but the European Commission has decided not to immediately fine them—even if they don't fully comply by the deadline next week.In April, both companies were fined—€500 million for Apple and €200 million for Meta—and given 60 days (ending 26 June) to align their practices with DMA requirements. Apple was penalized for preventing app developers from directing users to alternatives outside its platform, infringing DMA fairness rules. Meta was fined for its “pay or consent” system, which required users to either pay for an ad-free experience or agree to extensive personal data use; the Commission saw this as limiting user choice.Since November 2024, Meta has offered a new, lower-data personalized advertising model, which remains under Commission review. The current situation involves ongoing dialogue: any future fines will depend on the outcome of that review and will be imposed only after detailed assessments, rather than automatically once the deadline passed. These April fines were deliberately modest—reflecting the short duration of non-compliance and signaling the EU's priority on achieving compliance over punishment, marking a softer approach compared to previous, harsher antitrust actions. The situation also plays into broader economic tensions: EU leaders have threatened digital advertising taxes in response to recent US tariffs, while a US trade report criticized EU digital regulation as a trade barrier.Tech giants Apple and Meta to escape sanctions for failing to meet EU digital rules | EuronewsA U.S. appeals court has temporarily allowed Donald Trump to retain control over California's National Guard, despite a legal challenge from California Governor Gavin Newsom. The decision from the 9th U.S. Circuit Court of Appeals pauses an earlier ruling by Judge Charles Breyer, who found Trump had unlawfully federalized the Guard without meeting statutory requirements or adequately coordinating with Newsom. The court stated Trump likely acted within his authority and that even if coordination with the governor was insufficient, Newsom lacked the power to override a presidential order. Still, the court left open the possibility of further challenges under laws barring federal troops from engaging in domestic law enforcement. Newsom plans to pursue his challenge, arguing Trump is misusing military force against civilians. The case stems from Trump's deployment of 4,000 National Guard troops and 700 U.S. Marines to Los Angeles earlier in June to suppress protests tied to his immigration policies—actions Newsom said infringed on state sovereignty and legal limits on military involvement in civilian matters. The Trump administration argued troops are protecting federal property, not performing law enforcement.During a hearing, the appellate judges examined whether courts can assess a president's decision to federalize troops under a law allowing such moves only during invasion, rebellion, or when civilian enforcement fails. The court found the last condition may have applied, given protest-related violence. However, it rejected the Justice Department's claim that such presidential decisions are beyond judicial review. The Insurrection Act and related federalization authority are central to this case. The Act allows a president to take control of a state's National Guard in limited situations—such as rebellion or when laws can't be enforced by normal means. This case illustrates both the expansive view of executive power and the judiciary's role in checking it, even amid claims of national emergency.US court lets Trump keep control of California National Guard for nowPresident Trump has once again extended the deadline for TikTok to be sold to a U.S. owner, granting a third 90-day reprieve through an executive order despite lacking a clear legal basis for the extensions. The move allows TikTok to continue operating in the U.S. while negotiations persist to transfer ownership from China-based ByteDance to an American entity. The previous extension fell through when China withdrew from talks following Trump's new tariffs. This delay has not yet faced a court challenge, even though the original ban—passed by Congress and upheld by the Supreme Court—briefly took effect in January. Trump's personal popularity on the platform, where he has more than 15 million followers, adds a political twist to the ongoing negotiations. TikTok praised the decision and emphasized its importance to 170 million users and 7.5 million U.S. businesses.Despite concerns from national security officials and lawmakers like Senator Mark Warner, who accuse the administration of ignoring known risks, the repeated extensions suggest a softening of resolve. Analysts describe the situation as a recurring political maneuver with no clear endpoint—likening it to the endless debates over the debt ceiling.Meanwhile, TikTok continues to roll out new features and expand its services, including AI tools debuted in Cannes, signaling confidence in its long-term U.S. presence. Tech giants Apple, Google, and Oracle remain engaged with TikTok, reassured that the administration won't penalize them under current law.Public opinion has shifted, with fewer Americans now supporting a ban compared to 2023. Concerns remain over data privacy, but many citizens are unsure or opposed to banning the app outright.Trump extends TikTok ban deadline for a third time, without clear legal basisThis week's closing theme is by Johann Sebastian Bach. Johann Sebastian Bach, one of the most influential composers in Western music history, composed the Goldberg Variations, BWV 988, in 1741. Originally written for harpsichord, the work consists of an aria followed by 30 variations, returning to the aria at the end in a da capo structure. It was likely commissioned by Count Hermann Karl von Keyserlingk, a Russian diplomat suffering from insomnia, who wanted music to soothe his sleepless nights—though this origin story is debated. The aria, which opens and closes the piece, is a gentle, sarabande-like melody in G major. Unlike other variation sets built on melodies, Bach bases the Goldberg Variations on the aria's bass line and harmonic structure. This allows for extraordinary variety in texture, form, and mood across the variations, while keeping a consistent foundation. The aria itself is simple and elegant, consisting of two balanced halves, each repeated. Its serene tone contrasts with the technical brilliance and contrapuntal complexity found in many of the following variations. Yet, the aria's emotional restraint and clarity set the tone for the entire cycle.Over the centuries, the Goldberg Variations have come to be seen as a pinnacle of keyboard composition. The aria, both opening and closing the work, serves as a kind of spiritual bookend—calm, contemplative, and timeless. Performers often approach it with reverence, as a moment of stillness and symmetry amid musical adventure.Without further ado, Johann Sebastian Bach's Goldberg Variations, BMV 988 – the aria. Enjoy! Markets sold off slightly on Friday on concerns over the Iran-Israel conflict, down to the 20-DMA, which has been good support for markets. Markets remain over bought, and markets started on Friday to work off some of that "overboughtedness, and this morning futures are pointing higher. Interestingly, while retail investors are fully into the markets, institutional investors have been woefully underweight equities, and have some catching up to do. As markets continue to push higher, each of the interim dips are being bought up by institutional investors, which will continue to be the case as we approach the end of this month, and the end of the quarter, the end of the reporting period for hedge funds and portfolios. We believe the next two weeks will see more buying pressure as these groups reallocate capital to bolster their portfolio performance. The US Dollar, meanwhile, has been under pressure, trying to set a double bottom in order to set up for a counter-trend rally. There's a ton of negative sentiment on the Dollar, with the short-dollar trade the most over-crowded, presently. Something will cause a shift back into the US Dollar, and create a potential rally to between $97 and $103. A stronger Dollar will attract foreign investors back into the US, with a positive effect on domestic markets. Small Cap stocks have been on a tear lately, and lost of speculative bets are being placed on Small Caps. You may recall, Smapp Caps got beaten up in April, and have had a nice rally since. We are advising caution at this elevated level, approaching the 200-DMA, and take some profits sooner than later. There's real risk to Small Cap stocks economically; economnic data is showing slowing, and that is going to impede earnings at some point. It's important to note that 40% of Small Cap stocks are not profitable, particularly in the Russell 2000, which is also approaching its 200-DMA and is very over bought on multiple levels. These stocks perform best coming out of a recessionary cycle, and right now is the wrong side of that cycle. While the S&P is near all-time highs, Small Caps are way, way back. The Rally continues with the Bulls in control since April 9, but not much has happened. Markets needed a reason to sell, and Tariffs gave them that reason, but that is all over with. That's why you have to be careful with narratives. Markets move past them quickly, and it's on to the next issue or event. Weekly buy signals now suggest the correction is complete, Bulls are back in control, and all time highs are just a breath away. We're seeing improvements in sentiment and breadth; we're in th emiddle of a reversal process. However, there is an expectation of a relaxation of what's going on: Money flows are ebbing, sellers are exhausted, and buyers are slowing. That suggests that markets are going to consolidate, or pullback to support at the 200-DMA. The markets sold off last week in a much-needed correction. Market support coalesced around the 100- and 200-DMA at 5,790. Markets will bounce off that level today. A MACD sell signal is being triggered at a very high level, and we're not over sold quite yet, so markets are not finished with the relaxation/consolidation phase. There is still risk for markets, temporarily; there could be a pullback to the 50-DMA. The 6,000 level on the S&P will be a challenge at this point. Remember, June tends to be a weaker month for markets (and corporate share buy backs go away); July tends to be stronger (and buy back activity returns). If you have not yet rebalanced your portfolio against risk, today would be a good day to do so. Today Eryn Lynum joins me to share about the beautiful connection between nature and rest. Sabbath has become such a hot topic right now but Eryn had to learn from age 14 how to rest like her life depended on it when she was diagnosed with Addison's disease. She is now a homeschooling mom of four, a master naturalist, author, and business owner. Her family is committed to their family values and weekly sabbath amid a very full life. She reminds us of some deep ancient truths that God created us to fully live and gives us tools to find new rhythms.
Markets sold off Wednesday, and we're still approaching a sell signal, which will be mild, at best. The 20-DMA has been very quietly sneaking up on the 100- and 200-DMA alignments. This is building a lot of support around 5,750. Yesterday's pullback was a much-needed event. The 50-DMA has also bottomed and is now turning positive, which is also supportive for higher stock prices. This sell off was not the beginning of the next leg down for the markets, but it is the pullback needed to get markets in a better position. Economic growth is still around 2.3%, employment data is fine, and there is no apparent sign of recession. Economically-sensitive sectors are continuing to perform well, which tells us that markets are okay with economic growth. Interestingly, without Fed intervention, interest rates have risen to about where economic growth should be. By the way, Bitcoin has been on FIRE lately, hitting new records at $110,000 Wednesday. Bitcoin is extremely over bought. Bitcoin is a great proxy for stocks and risk-taking. Right about now is when you should take a little bit of profits. This episode of The Other Side of the Bell, featuring a live panel discussion on the legacy of William Adam and AdamFest, is brought to you by Bob Reeves Brass. This episode also appears as a video episode on our YouTube channel, you can find it here: "AdamFest 2025 Panel Discussion" About the William Adam Trumpet Festival (AdamFest): The 11th Annual William Adam International Trumpet Festival will take place June 19–22, 2025, at Austin Peay State University, hosted by Dr. Rob Waugh. This year's festival brings together a distinguished roster of William Adam's former students—many of whom are among today's leading trumpet artists—for four days of inspiration, performance, and pedagogy. In the spirit of Mr. Adam's legacy, the festival offers a rich mix of masterclasses, performances, complimentary private and group lessons, and targeted seminars on topics such as jazz improvisation, orchestral playing, trumpet fundamentals, and effective teaching. Special programming is available for younger students and their educators. William Adam taught trumpet at Indiana University's Jacobs School of Music from 1946 to 1988 and continued teaching privately until his passing in 2013. Widely regarded as one of the most influential trumpet pedagogues of the 20th century, his teaching emphasized sound, simplicity, and personal connection. The annual festival ensures his philosophy continues to inspire new generations of trumpet players. Markets have enjoyed a 19% rally from the Liberation Day lows (such declines do not happen often, and worth paying attention to when they do). Markets are currently around 2% below all-time highs, having almost fully-recovered from the decline in just the last three weeks. In terms of momentum and market strength, we're extremely over bought, and the markets need a pause to refresh. The Moody's Debt Downgrade will provide pressure on the bond and stock markets, which is no surprise. Will the Moody's move be the event that brings sellers to market? Markets will pull back; but if we're going to advance again to new, all-time highs, markets will need to hold at support at about the 200-DMA. If that fails, markets will drop down to the 50- and 20-DMA, around 5,550-ish. Technically speaking, markets are very over bought in terms of relative strength, which suggests that a lot of the rally from recent lows has been priced into the market. Markets can remain over bought...for a while, but will have more difficulty rising higher without a bit of a pullback first. The likelihood markets will retest those lows is very...low. Momentum is also extremely over bought, which is another indicator markets could have a pullback. If you're looking to add equity exposure to your portfolio, it will pay to be patient. Where will those entry points be? Markets on Monday broke above the 100- and 200-DMA; that's great, but markets must now hold above that level to make the breakout stick. The next level of resistance will be the all-time high, so there's not a lot to stop markets from here to there. Any pullback to the 200-DMA will be a good place for a buy-in. The market driver today will be news of a workout between the US and China over tariffs. The markets' technical support line, going back to the begining of the tariff negotiations, is emerging as a conglomeration of resistance turning to support at the 100- and 200-DMA's. These are the last lines of defense beyond which markets can move higher. The key is for markets to move above those resistance levels, and hold. Markets are over bought on a few fronts, momentum and relative strength are also quite elevated. This is the challenge to set emotions aside and read what the markets are telling us. Disclosure: We're holding a higher-than-normal amount of cash, and we have a short position in our portfolio that will likely be removed once the market confirms the correction is completed. Markets initially responded with disappointment to the Fed holding firm on interest rates, but did pull out a positive day by the end of Wednesday's session. Markets again bounced off support at the 50-DMA, testing and holding that level twice in the past few days. Markets are building support at the same time the 20-DMA is catching up to the 50-DMA, building a double layer of support just below where stocks are trading. Professional traders are currently under-weight or equally-weighted exposure to equities, which gives a lot of potential buying power entering the market. Markets are now building a nice consolidation range, and if they can break above resistance at the 200-DMA, will clear the way for markets to move higher. Many scholars and advocacy groups believe that only this can be considered "complete declassification" of non-heterosexual sexual orientations as mental disorders.BDSM in the DSM: Thanks to tremendous efforts by the National Coalition for Sexual Freedom (NCSF) the American Psychiatric Association (APA) announced in 2010 that it would be changing the diagnostic codes for BDSM in the next edition of the DSM (formally published in 2013 and integrated into practice in the years that followed). Markets sold off again on Tuesday, re-testing the 50-DMA. If markets can bounce and hold today, the 50-DMA will shift from resistance back into support. If markets fail there, the 20-DMA at 5,400 will be the next level of support. There are about 150-points of downside presently, and upside will be limited to about 5,730. Markets are performing well for now; retail investors bought heavily into the dip. The question is whether they right, or is this part of a bigger, corrective cycle? (Professional investors have already sold-out of this rally, being on the wrong side of the trade.) The buyback window is now fully open, and if trends continue, will exceed $1-Trillion by the end of this year; that buying power will also add to support of the upward market trend. We think any market pullbacks will be shallow, but handy for buying opportunities. The US Dollar is the driver for everything, in terms of risk: A strengthening Dollar will attract foreign capital flows back into the US markets. Markets sold off Monday after 9-striaght days of gains, as anticipated. Palantir announced earnings and outlook: The future for AI is very strong; the stock will open lower this morning simply because it has been trading at all-time highs. Diamondback Energy says they're back to peak oil production against a backdrop of very low oil prices; recently drilled wells are not profitable at current oil prices, which will be a challenge for the "drill-baby-drill' narrative. Meanwhile, markets are still sitting on a death cross between the 50- and 200-DMA; the 20-DMA is slopping upwards, providing support at around 5,370. The rising trend of higher lows will run right into the 20-DMA, which will likely stimulate some buying. At this point, we're still advising to trim portfolios to reduce risk, take profits, and raise some cash. Today Emmy-winning actor Patricia Heaton joins us for a candid conversation on motherhood, career, and raising four boys. We talk about the pressure parents feel to over-schedule kids, the beauty of simplicity (just give them a cardboard box!), and how God ordered her journey through motherhood and acting. She and her husband, David Hunt, are in the business of producing movies and directed Unexpected, a film about the emotional ups and downs of infertility. Patricia believes that the best way into tough subjects is through comedy and this movie does just that. Stick around till the end where she shares her advice for helping four boys flourish -including her list of things to do as a family. Resistance is important because it applies to upside as well as downside in the market. Resistance (to prices going lower) is called support. Markets had a deep selloff down to three standard deviations, and when that happens, bottom buyers will come back into the market...and prices will begin to rise with that demand. Markets have now had nine days straight of advances, which is the longest such stretch in 21-years. However, all records are meant to be broken. The problem with records is they mark the maximum attainment at that point. The last time markets strung together 9-days of advances was in 2004...and it took 21-years to repeat the achievement. Now, with markets rallying back up to the 50-DMA, and 90% of stocks are trading above that average, that typically tends to mark the peak of a rally. Time to take profits, rebalance portfolios, and reduce risk; save that dry powder for later. Do you often feel like something is holding you back? You can't quite get to where you want to go professionally, relationally, or in personal habits and goals? Today Mary Marantz is here to tell us about the mental shifts that change everything. Mary's story is riveting from growing up in a single-wide trailer in the mountains full of dirt and memories to Yale law school, she has stories to tell! Through her many experiences, she has learned how our self-limiting thoughts can hold us back and how to overcome them. Not through the typical “get it boss girl” mentality but practical steps that lead us to a life we want to live and enjoy, and how to lead our kids well in the area of achievement. Here are some of our topics: Why fear is a boring liar — and how to manage it The "fear of success" and why it keeps us playing small How childhood environments shape adult confidence: the power of speaking life over yourself and your kids Feeling like everyone has a manual on how to do life and we have missed it How to handle imposter syndrome and look for the “evidence to the contrary” of the lies in our head Connect with Mary Marantz: Website: Mary Marantz - Home Facebook: The Official Mary Marantz Insiders Community! Grief is a journey that no one wants to walk, yet so many of us will experience deep loss in our lifetime. In this episode, Colleen and Erin have an open and honest conversation about Erin's journey through unimaginable loss—losing her husband in a plane crash, navigating her children's grief, the heartbreak of her mother's suicide, and later, the devastating loss of her son in a car accident. Through her story, Erin shares what it looks like to carry grief in our bodies, the crisis of faith that can come with loss, and how she found her way through the darkness. From those tragedies was born Jessica's house, a place for families to walk through grief and be supported. And now a book When Grief Comes Home that shares the tools she has learned through so many trials. Here are some topics we cover: The impact of trauma and grief on the body and nervous system The importance of modeling healthy grief and emotional expression for children How to come alongside grieving families in tangible, practical ways The unique challenges couples face when grieving a child and how to let someone grieve in their own way Brightsiding- what it is and how to speak to someone in a dark season Connect with Erin and Colleen: Website: Jessica's House Facebook: Jessica's House Instagram: Jessica's House (@jessicas_house) Links Mentioned: NACG When Grief Comes Home: By Erin Leigh Nelson and Colleen Montague Related Episodes: When Moms Walk through Grief :: Stacey Thacker {Ep 76} The Ministry of Presence in a Broken World :: Tess Clarke [Ep. 252] Processing Grief, Infertility, and Loss in Community :: Julie Fowler [Ep 502] Featured Sponsors: The Chosen Last Supper: You can preorder your tickets for the 3-part theatrical release at TheChosenLastSupper.com.
