Todd is the co-founder and Chief Brand Officer of Dream Performance & Recovery, makers of performance sleep products. His obsession and passion for fitness, nutrition, sleep and overall human performance optimization began when he was a walk-on for the Michigan State University football team. His successful college career led to an NFL opportunity for the Rams in 2012, where he took his passion for the strength and conditioning side of the sport to performance coaching. Starting as a trainer, he moved quickly into leadership and education and ultimately decided to take his learnings and skill sets into speaking and entrepreneurship. Todd has worked with several leaders in the sleep and recovery space to dive into the psychology of sleep and recovery and went on to take numerous continuing education courses surrounding sleep and now holds more than 10 certifications in fitness, nutrition and performance (CSCS, NSCA, NCSF, and more). Todd has been speaking on sleep for over 5 years as a sleep expert and co-founded Dream Performance and Recovery in 2023, designing the highest quality science-backed sleep performance products. Coach Marvin King RKC, NCSF, CPT, USCTF Marvin is a 2-time published author, Martial Arts Hall of Famer, and Wellness Coach who has been teaching Kung Fu and fitness for over 40 years. His business, the Bowie Kettlebell Club Health and Wellness Center is located at 16701 Melford Blvd, Suite 400, Bowie, Md. 20715. He is the founder of the Bowie Kettlebell Health and Wellness System (BKHWS). A specialized wellness program that has been successful in the restoration of lost movement in participants for over 20 years. He's a Russian Kettlebell Certified Instructor (RKC), a Therapeutic Taiji (Qigong) Trainer with the United States Collegiate Taijichuan Federation (USCTF), a Certified Personal Training (CPT) with the National Council of Strength and Fitness (NCSF), a Shuai Chiao Kung Fu Black Belt practitioner, and National Shaolin Kung Fu (Taolu) Grand Champion. Permission is “explicit” when it is personally given, orally or by written agreement, along with:(a) specifying that the actor may ignore the other party's expressions of unwillingness or other absence of consent;(b) identifying the specific forms and extent of force, restraint, or threats that are permitted; and(c) stipulating the specific words or gestures that will withdraw the permission.Dick Cunningham has been assisting in the revision of the Model Penal Code on Sexual Assault as part of NCSF's Consent Counts project, helping to establish this legal framework that acknowledges the use of safewords, protecting those who use them properly, and equipping prosecution for when they are violated or when serious harm is done. Survivors who are sexually assaulted during kink activities also may now be covered by “rape shield” laws, meaning that their prior sexual behavior with others generally can't be used as evidence, reducing exposure to possible stigma attached to kink activities. “Without this change, BDSM practices, even when consensual, might still be violating the law,” says Susan Wright, Spokesperson for NCSF. “In fact, there is not a single appellate court decision in the U.S. that has accepted consent as a defense in an assault or abuse prosecution arising from BDSM conduct. This case law has established that using nipple clamps or dripping hot wax on someone constitutes ‘serious bodily injury,' when in reality, these are relatively mild activities.” Section 213.10 may be cited in opinions and briefs in cases involving BDSM activities, even in states where the legislature has not adopted the MPC on Sexual Assault. Needs explanation: the new MPC on Sexual Assault includes a general definition of consent for sexual activity, in which consent may be inferred from behavior—both action and inaction—in the context of all the circumstances. Neither verbal nor physical resistance is required to establish that consent is lacking, however, consent is ineffective when given by a person who is incompetent to consent or under circumstances precluding the free exercise of consent. Wendi Berger is a Licensed Massage Therapist, Nutrition Consultant, Personal Trainer, and Runner. Wendi's journey into health and fitness started 28 years ago after many years of working in the restaurant and catering business.In 1995, she graduated from The Desert Institute of Healing Arts in Tucson Arizona and received a Degree in massage therapy specializing in Sports/Deep Tissue Massage. She opened her own massage studio with the sole purpose of helping people heal their bodies through massage therapy. She soon realized that healing doesn't just happen…It's a process.This led her to personal Training. In 2005 she was certified through NCSF and started training clients and teaching them how to take ownership of their own health and wellbeing through hard work, discipline and consistency. It was amazing for her learn that our bodies can do incredible things if we are willing to put in the time and effort. She saw clients quickly see that they are much stronger and capable than they give themselves credit for.In 2013, she moved to Houston and established a new massage and training clientele. The first thing she did was join a gym and just by chance met some incredible women, all around her age who were triathletes. She had always been a gym rat but this was something entirely new and challenging. She decided that if they could make their bodies do what they were doing, then so could she. So she started training.She soon realized that all of the training in the world wasn't taking her anywhere without learning how to fuel her machine (body) correctly. So, she hired a nutritionist who changed her whole world!The more she learned, the more she wanted to share with others.She earned her nutrition certification through NAMS, and her new focus then became teaching people how to integrate good food and healthy habits into their daily lives.Not everyone is an athlete, or a gym rat. U.S. law interprets consensual kink activities as harmful, criminal acts. This makes prosecuting sexual assault cases within the context of BDSM difficult. How can you prove non-consensual sex occurred if kink isn't considered sex in the eyes of the law, it's assault? The National Coalition for Sexual Freedom/NCSF worked along with the American Law Institute to establish a legal definition of consent in kink. They just unveiled the New Model Penal Code on Sexual Assault: Affirmative Defense of Explicit Prior Permission for use of force and restraint with sexual contact. July 15, 2021—The American Law Institute (ALI) has approved the revised Model Penal Code on Sexual Assault, which decriminalizes BDSM activities in connection with sexual penetration, oral sex or sexual contact.Dick Cunningham, NCSF's Legal Counsel and member of the ALI, says, “The Model Penal Code on Sexual Assault (including unwanted or injurious contact), approved by the prestigious American Law Institute at its June meeting, is a milestone in the law's understanding of BDSM and a major advance in the treatment of consent as the central element by which sexual contact is to be judged. This week’s guest is, Susan Wright, founder of the National Coalition for Sexual Freedom. Each year at this time Susan joins us to revisit the year that was. This year we had some impressive improvements in the number of reported sexual assaults. NCSF is the only group fighting for the rights of the BDSM-leather-fetish communities. NCSF helps people who are discriminated against because of their sexuality — when they’re fired from their jobs or arrested for sexual assault for having kinky sex. NCSF also helps groups and businesses when they’re being persecuted by the media or local authorities. NCSF fought successfully to help convince the American Psychiatric Association that kink is not a mental illness, and NCSF is filing Amicus Briefs in military and civilian appeals court to hold prosecutors to the promise in Lawrence v. First, I am going to give you a tool to help you figure out what you are already dealing with.Second, I’m going to share with you the things that I feel should be commonly found character traits for those on the left side of the slash...if not both.[1:04] Rules to Love by:Safe, sane, consensual, and informedKNKI: Knowledge, No Intolerance, Kindness, Integrity“Submission is not about authority and it’s not about obedience; it is all about relationships of love and respect.” -Wm. Paul Young[1:28] PAD Temperament Mode ( https://en.wikipedia.org/wiki/PAD_emotional_state_model )In order to know the best things in oneself to nurture we first need to know what is already there. For this, we are going to take a look at the PAD emotional state model which today typical is only used for marketing and developing multidimensional animated characters...but hey, if you can give a cartoon layered emotions and make them come alive on the silver screen with this then it has to have some kind of credibility and usability for us, right? ...[4:25] PleasureThe Pleasure-Displeasure Scale measures how pleasant or unpleasant one feels about something. For instance, both anger and fear are unpleasant emotions and both score on the displeasure side. However, joy is a pleasant emotion.[4:57] ArousalThe Arousal-Nonarousal Scale measures how energized or soporific one feels. It is not the intensity of the emotion -- for grief and depression can be low arousal intense feelings. While both anger and rage are unpleasant emotions, rage has a higher intensity or a higher arousal state. However, boredom, which is also an unpleasant state, has a low arousal value.[5:43] DominanceThe Dominance-Submissiveness Scale represents the controlling and dominant versus controlled or submissive one feels. For instance, while both fear and anger are unpleasant emotions, anger is a dominant emotion, while fear is a submissive emotion.So now, how do these three things tie together in determining what is what? Let’s say that something happened and you became angry. You would give the emotion of anger values for each of the three sections of the PAD emotional state model. For some this might look like this: Anger is a quite unpleasant, quite aroused, and moderately dominant emotion. While for others it might like: Anger is moderately pleasant, mildly aroused, and mildly dominant emotion.Now, use all this in emotions and environmental situations. This means that you are not just looking at the feeling itself but also taking a look a specific setting, with certain people at a restaurant, in a dungeon, … the locations, situations, and emotions is an endless sea of possibilities so this is one of those life exercises that you will need to constantly and consistently come back to for further exploration but be careful not to burn yourself out on it as it can also be pretty exhausting.[10:23] Ok, so now that you have examined a few emotions using the PAD emotional state model, what have you figured out about yourself? Where do you need to the most work? The areas where the arousal is high that it creates a situation out of your control might be a good place to start along with anything that causes debilitating anxiety, stress, or depression.[11:41] “...and...how do I go about doing this?”, you ask. There are several ways. The first thing I would do is check out the NCSF website ( https://www.ncsfreedom.org/ ) to see if they are any kink-friendly therapist in your area.The second thing I would do, besides actually make and attend the appointment with an open mind, is check out some books that are written to help with the specific areas you are having difficulties with or that you want to change. However, keep in mind that things don’t happen overnight and it is always best to tackle a few smaller projects back to back first to build a sense of security within yourself. Otherwise, it is incredibly easy and common to get lost in the process which means you will give up and fail. You and I both know that the worst thing about failing at something is that it often prevents us from moving to the next things because we start thinking that we will just fail at that as well. So, again, you’ve got your list now it’s time to start small.The third thing is to, you guessed it, communicate!!! You are changing yourself at your core and the people around you need to know this is happening. There is nothing worse than worrying about someone day in and day out because they are acting differently but they refuse to tell you why. I have lost friendships and had difficulties with family members from both changing and being the one wondering what was going on with the other person. If you don’t know about it, it is frustrating and will cause fights. Again, you are changing your entire foundation.[14:46] Commonly found character traits in EFFECTIVE Dominants with a history of successful relationships. The first thing I would do is check out the NCSF website ( https://www.ncsfreedom.org/ ) to see if they are any kink-friendly therapist in your area.The second thing I would do, besides actually make and attend the appointment with an open mind, is check out some books that are written to help with the specific areas you are having difficulties with or that you want to change. However, keep in mind that things don’t happen overnight and it is always best to tackle a few smaller projects back to back first to build a sense of security within yourself. Otherwise, it is incredibly easy and common to get lost in the process which means you will give up and fail. You and I both know that the worst thing about failing at something is that it often prevents us from moving to the next things because we start thinking that we will just fail at that as well. Susan also serves on the advocacy committees for AASECT, the Kink Clinician Guidelines, the Kink Knowledgeable Program, and the Diverse Sexualities Research Education Institute. Susan has conducted six surveys on discrimination and violence against BDSM practitioners; consent practices and attitudes; and the mental and physical health of BDSM and non-monogamy practitioners that have been published in the Archives of Sexual Behavior, Journal of Sexual Medicine, Journal of Behavioral Health Services & Research, International Journal of Social Psychiatry, Journal of Trauma and Dissociation and Journal of Homosexuality.   In this two part talk, we started by speaking about the reasons for founding the National Coalition for Sexual Freedom and the projects they have been involved in.  Susan talked about the research that NCSF has done on BDSM, relationship styles, polyamory and consent and that these have been the largest surveys done so far.  The research has demonstrated the psychological health of people involved in these alternative relationships and alternative sexual practices and was part of the evidence that caused the APA to modify the Diagnostic and Statistical Manual of Mental Disorders –V so that the vast majority of people practicing BDSM and/or polyamory no longer qualify for a diagnosis of paraphilia in relationship to their sexual and relationship choices.    We spent a lot of time talking about consent incidents and how we as a community identify these, manage these and apply sanctions.  Susan spoke about the groups that they work with.  The NCSF has developed a framework and a lot of resources for community groups and businesses around defining and dealing with consent incidents.    We spoke about the NCSF's role in educating law enforcement, psychologists and other mental health professionals.  NCSF hosts the Kink Aware Professionals list which is an international list of  mental health professionals, medical doctors, lawyers and other professionals who are kink aware.  The NCSF regularly educates professionals about BDSM and other alternative lifestyles and sexual practices.   We spoke about how important it is for individuals to be educated about consent and that some of the research that NCSF has done has found that 75% of consent violations happen with people who are in their first 3 years of being involved with BDSM.    We spoke about how individuals and groups handle consent incidents and the differences between someone making an error and someone being a repeat offender.  We spoke about needing to get information first hand if you are to make a judgement on a situation and that one of the problems is that often people don't have first hand information and are being asked to make a judgement.  We spoke about liability for people organising events and conferences and how important education is to limit liability and that decisions around excluding someone from an event are often taken because of liability issues.   NCSF has also educated people in the hospitality industry and made it possible for events and conferences to be held at these venues.    We finished up recognising that we had not managed to cover all the topics we set out to cover and will be doing another show on custody and divorce soon.   Susan Wright can be found at www.ncsfreedom.org Twitter @ncsf Facebook: http:www.facebook.com/NCSFreedom   This week we talked about:  Consent...

On this episode of the Krypt we are going to get into the second half of our Consent podcast, with our main focus on Boundaries but first, I have to welcome my amazing co-host, Funsize.* A special shout out to Kuldrin, much of this podcast was written by Kuldrin, as he used to teach a class in boundaries during his tenure working in the psychological field. Much of this is actually just taken from those lessons and reformatted into show notes.* When we left off from part one of our two-part series on consent we were talking about the importance of being able to say no, and uphold our boundaries when it comes to consent. A boundary is defined as a dynamic line separating an individual's internal environment and external environment while varying in permeability and flexibility. This also applies to a line between others in that environment. Purposes and Types of BoundariesPurposes are to facilitate separation and individuation and to assist the individual’s adaptation to the environment. For BDSM this means that you will use these personal boundaries to maintain your personal self, and what you are willing to consent to. Types of boundaries can be broken down into:Ridged open which can be considered your soft limits Ridged closed, these are similar to your hard limits.Flexible or the things you might be open to, and things you are willing to negotiate.You need to learn what your appropriate boundaries are, how to set them, and how to recognize and respect the boundaries of others.How to identify your own boundaries.Become aware of your needs. You can’t expect others to respect or know what your boundaries are if you don’t know them yourself. Get support. Having others who will support you and help you uphold those boundaries is an important step. Many times you can even find a protector to help you in this capacity. Communicate effectively. Whether it’s expressing an interest or negotiating your limits, this has always been an important skill. For more information on the subject check out our episode on effective communication. Be realistic. Where boundaries start.Boundaries are natural. Infants start to develop flexible boundaries at 6 months old. Boundaries are developed and set before age 3. Have you ever looked at an infant in the eyes and it staired back briefly just before closing its eyes or turning its head? It did this because the stimulation became too much. Thus it set a boundary.People with healthy boundaries have limits and recognize what they are, know what they will or will not do and they know what they will or will not allow others to do.Teaching others how to treat you within the BDSM dynamic boundaries. Training is a big part of this. Not only do you have general training, but with each new relationship you have to train yourself and your partner as to how to be treated, and how to treat them. Again communicate your boundaries. Listen and respect the communications of others as well. And remember that not all communications of these boundaries is vocal. A person may be demonstrating a personal boundary via silent cues so try to always be observant of your surroundings. When boundaries aren’t respected. When boundaries aren’t respected, and we are faced with consent violations what can we do?If your consent has been violated, first determine for yourself if the person has made an honest mistake, or if this is a case of abuse. Recognize that you are not to blame in either case. Seek support from those around you. Communicate your feelings.Take your time. The simple fact is if you have been abused it will take time to heal, physically, mentally, and emotionally. The only person who can say whether it has been enough or too much time for this process is you. Rushing can often do more harm than good in these instances. What can you do if someone you know has had their consent violated?Give them time.Listen but never ask or demand that they talk about what has happened. Believe what they say. We each individually set our own personal boundaries and we are the only ones capable of saying whether those boundaries have been crossed. Do not rush to be their saviors. Often we can find ourselves wanting to be the saviors for those around us, especially if we have taken a role as a protector, but we also need to remember that protecting someone is something which that person also has to consent to. Going off to fight a battle for someone who does not consent to it can be just as harmful to that person as the original consent violation was. And now we’re going to dip into the hardest question of all; what do you do if you have been the one who violated someone’s consent?Be honest with yourself as to whether or not you intended the violation. If it is a case in which you made an honest mistake then you should apologise sincerely, and offer understanding. Understanding comes in many different forms; you will need to understand that your actions have affected someone who placed some level of trust in you, and that you may need to make further amends. Often you will have make a greater effort to regain that person’s trust, using patience and communication every step of the way. And finally you can forgive yourself for mistake, so that you can hopefully learn from it in the future. If it was not a mistake….Start by owning what you have done. Denying that you abused and mistreated another purposefully will only make things worse. Do not think you will live your life without consequences for your misdeeds. Do not allow yourself this choice again. Do not expect others to treat you with the courtesy or respect you have refused to show someone else. Other worthwhile notes on consent within our lifestyle. Physical boundaries ie condoms. Condoms are an important boundary for many as they reduce both the risk of pregnancy and that of STIs and STDs. There was actually a law about the removal of condoms before or during a sexual act without your partner's knowledge, an act known as stealthing, added in California back in May 2017, which added that once stealthing has happened the act is no longer considered consensual. The NCSF, ALI Project, and Consent Counts. The National Coalition for Sexual Freedom or NCSF has been coordinating the Consent Counts project in a BDSM community worldwide effort in education and activism in order to offer legal protection against consent violations. The American Law Institute has been working in conjunction with this to change the Moral Penal Code to decriminalize consensual BDSM. What this means for all of us is that for most states in the U.S. and several other countries, whether we consent to the activities we are engaging in or not, they are still considered legally reprehensible. But we will be digging more into this topic during our BDSM and the law episode later on this season. Well that wraps up our consent series. On this episode of the Krypt we are going to get into the second half of our Consent podcast, with our main focus on Boundaries but first, I have to welcome my amazing co-host, Funsize.* A special shout out to Kuldrin, much of this podcast was written by Kuldrin, as he used to teach a class in boundaries during his tenure working in the psychological field. Much of this is actually just taken from those lessons and reformatted into show notes.* When we left off from part one of our two-part series on consent we were talking about the importance of being able to say no, and uphold our boundaries when it comes to consent. A boundary is defined as a dynamic line separating an individual's internal environment and external environment while varying in permeability and flexibility. This also applies to a line between others in that environment. Purposes and Types of BoundariesPurposes are to facilitate separation and individuation and to assist the individual’s adaptation to the environment. For BDSM this means that you will use these personal boundaries to maintain your personal self, and what you are willing to consent to. Types of boundaries can be broken down into:Ridged open which can be considered your soft limits Ridged closed, these are similar to your hard limits.Flexible or the things you might be open to, and things you are willing to negotiate.You need to learn what your appropriate boundaries are, how to set them, and how to recognize and respect the boundaries of others.How to identify your own boundaries.Become aware of your needs. You can’t expect others to respect or know what your boundaries are if you don’t know them yourself. Get support. Having others who will support you and help you uphold those boundaries is an important step. Many times you can even find a protector to help you in this capacity. Communicate effectively. Whether it’s expressing an interest or negotiating your limits, this has always been an important skill. For more information on the subject check out our episode on effective communication. Be realistic. Where boundaries start.Boundaries are natural. Infants start to develop flexible boundaries at 6 months old. Boundaries are developed and set before age 3. Have you ever looked at an infant in the eyes and it staired back briefly just before closing its eyes or turning its head? It did this because the stimulation became too much. Thus it set a boundary.People with healthy boundaries have limits and recognize what they are, know what they will or will not do and they know what they will or will not allow others to do.Teaching others how to treat you within the BDSM dynamic boundaries. Training is a big part of this. Not only do you have general training, but with each new relationship you have to train yourself and your partner as to how to be treated, and how to treat them. Again communicate your boundaries. Listen and respect the communications of others as well. And remember that not all communications of these boundaries is vocal. A person may be demonstrating a personal boundary via silent cues so try to always be observant of your surroundings. When boundaries aren’t respected. When boundaries aren’t respected, and we are faced with consent violations what can we do?If your consent has been violated, first determine for yourself if the person has made an honest mistake, or if this is a case of abuse. Recognize that you are not to blame in either case. Seek support from those around you. Communicate your feelings.Take your time. The simple fact is if you have been abused it will take time to heal, physically, mentally, and emotionally. The only person who can say whether it has been enough or too much time for this process is you. Rushing can often do more harm than good in these instances. What can you do if someone you know has had their consent violated?Give them time.Listen but never ask or demand that they talk about what has happened. Believe what they say. We each individually set our own personal boundaries and we are the only ones capable of saying whether those boundaries have been crossed. Do not rush to be their saviors. Often we can find ourselves wanting to be the saviors for those around us, especially if we have taken a role as a protector, but we also need to remember that protecting someone is something which that person also has to consent to. Going off to fight a battle for someone who does not consent to it can be just as harmful to that person as the original consent violation was. And now we’re going to dip into the hardest question of all; what do you do if you have been the one who violated someone’s consent?Be honest with yourself as to whether or not you intended the violation. If it is a case in which you made an honest mistake then you should apologise sincerely, and offer understanding. Understanding comes in many different forms; you will need to understand that your actions have affected someone who placed some level of trust in you, and that you may need to make further amends. Often you will have make a greater effort to regain that person’s trust, using patience and communication every step of the way. And finally you can forgive yourself for mistake, so that you can hopefully learn from it in the future. If it was not a mistake….Start by owning what you have done. Denying that you abused and mistreated another purposefully will only make things worse. Do not think you will live your life without consequences for your misdeeds. Do not allow yourself this choice again. Do not expect others to treat you with the courtesy or respect you have refused to show someone else. Other worthwhile notes on consent within our lifestyle. Physical boundaries ie condoms. Condoms are an important boundary for many as they reduce both the risk of pregnancy and that of STIs and STDs. There was actually a law about the removal of condoms before or during a sexual act without your partner's knowledge, an act known as stealthing, added in California back in May 2017, which added that once stealthing has happened the act is no longer considered consensual. The NCSF, ALI Project, and Consent Counts. The National Coalition for Sexual Freedom or NCSF has been coordinating the Consent Counts project in a BDSM community worldwide effort in education and activism in order to offer legal protection against consent violations. The American Law Institute has been working in conjunction with this to change the Moral Penal Code to decriminalize consensual BDSM. What this means for all of us is that for most states in the U.S. and several other countries, whether we consent to the activities we are engaging in or not, they are still considered legally reprehensible. But we will be digging more into this topic during our BDSM and the law episode later on this season. Well that wraps up our consent series. In the other half of her life, she has published over 30 novels over the course of her writing career, many of them sexually charged fantasy novels. Susan has also conducted several surveys documenting discrimination and violence against BDSM practitioners as well as consent practices and attitudes. She directed the successful DSM-5 Revision Project that helped convince the American Psychiatric Association to depathologize consensual BDSM behaviors in 2013, and she coordinated the SM Policy Reform Project for the National Organization for Women (NOW) which resulted in rescinding their anti-SM policy at their national conference in 1999.
