Last year, more than a quarter of a million cases started in Family Court in England and Wales. Yet, to most people, the way they work is a mystery. Traditionally, they were always held in private, because they discuss sensitive information about peoples' personal lives, and to protect children from harm.Since 2009 reporters have been allowed to attend hearings. But they weren't allowed to tell anyone what was said without the permission of the court, and judges could exclude them.Now, a pilot has been operating in 19 areas across England and Wales to allow journalists and legal bloggers to report Family Court cases, subject to strict rules of anonymity. Last week, it was extended to cover both private and public family cases at magistrates courts in the pilot areas. But will it improve confidence and help people understand how the family courts work? Our hosts, Anita Mehta and Simon Blain, discuss what to do when a reporter turns up in your Court and the importance of transparency with Joshua Rozenberg KC (Hon) and Lucy Reed KC (St John's Chambers, Chair of The Transparency Project).  Joshua refers us to the lessons learnt in Tickle v Father & Ors [2023] EWHC 2446 (Fam) (05 October 2023). https://www.bailii.org/ew/cases/EWHC/Fam/2023/2446.html Our guests discuss the benefits both of judgments being published and reporters having access to write up what happens.  Joshua talks about the importance of the public knowing how the state will resolve their private disputes if they are unable to do so.  He makes the point that the public are only going to know about the importance of Family Jusctice being properly resourced if the press are able to report about what happens.  They both reiterate that scrutiny of the Court is healthy. The message that Joshua and Lucy give our audience is that there is nothing unlawful or inappropriate about a party or a lawyer asking a reporter if they would like to observe a case.  This is not a breach of s.12 of the Administration of Justice Act 1960.  This has been specifically endorsed by the senior judges responsible for the Reporting Pilot, because unless reporters are told about interesting cases they will not come to Court.    They make it clear that it is not appropriate for the Judge or the other participants to cross-examine reporters about who told them about the hearing, and the reporter does not need to make an application to attend the hearing.  Lucy refers us to the Transparency Project's guidance notes for help if a reporter turns up in a case you are due to appear in https://transparencyproject.org.uk/updated-guidance-what-to-do-if-a-reporter-attends-or-wants-to-attend-your-hearing-pilot-and-non-pilot-court-versions/.  Lucy points out, it is not for the reporter/ blogger to make an application to make an application to be present in Court, as there is a limited basis for a Court to exclude a reporter, which is found in FPR 27.11 (3). (3) At any stage of the proceedings the court may direct that persons within paragraph (2)(f) shall not attend the proceedings or any part of them, where satisfied that— (a)this is necessary—(i)in the interests of any child concerned in, or connected with, the proceedings;(ii)for the safety or protection of a party, a witness in the proceedings, or a person connected with such a party or witness; or(iii)for the orderly conduct of the proceedings; or(b)justice will otherwise be impeded or prejudiced. If the Court is considering relaxing reporting restrictions it will need to undertake a balancing exercise to weigh the respective weight of article 8 and article 10, as set out by Lord Steyn in Re S (a child), Re [2004] UKHL 47 (28 October 2004).https://www.bailii.org/uk/cases/UKHL/2004/47.html ‘The interplay between articles 8 and 10 has been illuminated by the opinions in the House of Lords in Campbell v MGN Ltd [2004] 2 WLR 1232. For presentpurposes the decision of the House on the facts of Campbell and the differences between the majority and the minority are not material. What does, however, emerge clearly from the opinions are four propositions. First, neither article has as such precedence over the other. Secondly, where the values under the two articles are in conflict, an intense focus on the comparative importance of the specific rights being claimed in the individual case is necessary. Thirdly, the justifications for interfering with or restricting each right must be taken into account. Finally, the proportionality test must be applied to each. For convenience I will call this the ultimate balancing test. Is the data set limited, as the project's website claims, to "killings and deaths following intentional police use of force" such as"police shootings that resulted in death, and instances where a person died after being subjected to other types of weapons (e.g., tasers, batons) or physical interventions (e.g., punches, kicks, physical holds)"?  Does the data accurately represent only individuals that "did die as a direct result of the police use of force"?  Did the police kill 69 people in 2022 as the principal investigator on the project was quoted as saying in a CCLA press release and the media has since repeated? Or does this so called "National Database of Deaths Caused by Police Use of Force"  include  deaths that had little or nothing to do with police use of force?  You be the judge. Thanks for listening! You've probably heard the phrase, “A book is a business card.” That's because what you don't hear is that a book is a wonderful revenue generator! It isn't — at least not directly. The extreme Time-to-Revenue Ratio of writing and marketing a book is not for the faint of heart, unless the book connects directly to a larger part of your business model, serving as lead generation for more profitable products and services. Some interesting stats for you: Even the big behemoth, Penguin Random House, reports that just 35 percent of books they publish are profitable. Among those that make money, just 4 percent account for 60 percent of those profits. In 2021, fewer than one percent of the 3.2 million titles that BookScan tracked sold more than 5,000 copies. Continuing on last week's conversation about the three different publishing options and how to choose which one is right for you, today I'm diving deep into the mysterious royalty waters. How do each of the three methods — self, hybrid, traditional — stack up? Listen in to find out. The initial investigation into the slayings of 22-year-old Cheryl Henry and 21-year-old Andy Atkinson was meticulous, with no stones left unturned, but it resulted in virtually no breaks. Though DNA obtained as the result of the attacker raping Cheryl produced a strong profile, no one Detective Billy Belk and company could find was a match. Then, almost 20 years later, the biggest break in the case occurred when the DNA got a hit in CODIS. But there was a problem – the matched DNA also belonged to an unknown assailant. Underlying this story is another one: the story of advancements in DNA technology. Will new technology, i.e. forensic genealogy, finally give this story an ending? After the bodies of 22-year-old Cheryl Henry and 21-year-old Andy Atkinson were found, on August 23rd and 24th 1990 respectively, Houston Homicide Detective Billy Belk was called to the scene to begin the investigation into their murders. Alongside other homicide detectives, Belk scoured the city for leads – first questioning and taking blood samples from all Andy and Cheryl's known friends and patrons of the bars they frequented. Nothing turned up, even after examining robberies and sexual assaults that, like these Lover's Lane Murders, took place in West Houston. Though the initial investigation was painstaking and thorough, it brought with it nothing but dead ends. He also had his own computer programming website where he expressed his interest in becoming a computer programmer after his expected graduation in December 2001. Shelton meant the world to his family and a likeable friend to all. He would always do whatever he could to help anyone in need. The World Economic Forum does much more than organise its annual Davos meetup. The not-for-profit foundation calls itself “the international organization for public-private cooperation”. As such, it investigates and promotes ways to make the world a better place, including in the field of blockchain. Sheila Warren is the WEF’s Head of Blockchain, Digital Currency and Data Policy. She talked to CoinGeek about her view of the prospects for the blockchain economy solving some of the problems of ‘surveillance capitalism’, by letting individuals own their own data. She admitted that she doesn’t see any revolution happening in the short term: “am I optimistic about it? No, I would not say I'm optimistic about it. I'll just answer that question bluntly. However, that does not mean I don't think it is very much worth paying attention to and even fighting for.”It’s partly that, through contacts with big companies and governments, Sheila has become aware of “the sheer volume and flow of that data”. But individuals have to take responsibility too: “I don't necessarily feel like the vast majority of people really care. And the reason I feel that way is because I think we've all seen how quickly people are willing to sign away their rights.”But Sheila is ultimately optimistic about new data practices that blockchain will allow, and has “a short to medium term pessimism”. In the long run, she believes a new generation is coming that will “really take advantage of the elements of the blockchain ...to do this in a different and better way.”But WEF isn’t waiting for that day to arrive. Sheila’s group is responsible for several blockchain field trials, such as one in Columbia called the Transparency Project, which worked with the government’s Inspector General's office to set up a blockchain procurement process for the awarding of contracts to provide school meals across the country. Blockchain would help ensure that the bidding process was followed correctly, with a mechanism to time-stamp bids, for instance, so they couldn’t be changed retrospectively - which had been a problem in the past: “there'd be almost a mock proposal, if you will, like a straw man submitted that would then get changed out with corrupt actors, with different motivations for that. So the idea here is the immutability of the record provided an opportunity to basically ensure that there wasn't that kind of change happening downstream, or if there was some sort of change of the record, you could see that. Good morning, RVA! It’s 70 °F, and today looks slightly less steamy-hot than the last couple of days. Get out there and enjoy it (while staying hydrated)!Water coolerAs of this morning, the Virginia Department of Health reports 972↗️ new positive cases of the coronavirus in the Commonwealthand 2↗️ new deaths as a result of the virus. VDH reports 75↗️ new cases in and around Richmond (Chesterfield: 27, Henrico: 31, and Richmond: 17). Since this pandemic began, 270 people have died in the Richmond region. The last time the Commonwealth reported more than 972 cases was back on June 7th, one of just a handful of days ever with over 1,000 reported positive coronavirus cases. We’ll see what today’s numbers bring, but if Virginia starts reporting 1,000 cases per day on the regular I have to think the Governor will implement some changes. Maybe changes to Phase Three? Maybe regional changes? If you’ve got a second, tap through the Number of Cases by Date of Symptom Onset graphs filtered by region. Almost every region (except Central Virginia) has seen an increase in cases, but Eastern Virginia is really driving a lot of the change we’re seeing in the statewide numbers. I’d love to know what’s different in each of these regions and what we can learn from each other over the next couple of months.The Commonwealth Times’s Hannah Eason spent some time at last night’s peaceful protest Downtown, and she’s put together some pictures and videos from the event. This is the second night of peaceful protests that start at MLK Middle School and make their way to City Hall to hang out, demonstrate, and listen to speakers. Unlike a couple weeks back, police did not show up—Richmond Police or Virginia State Police—and gas everyone to get them to go home. Related and totally worth your tap: NPR talked to Regina Boone, a Richmond Free Press photographer, about her work capturing images from the last month and a half of protests.Yesterday, I put together a bonus piece explaining the five pieces of police reform legislation currently sitting on various City Council agendas. I think that legislation, along with the Mayor’s Task Force to Reimagine Public Safety, make up the first steps towards the actual police policy reform only made possible through the work of longtime advocates and, more recently, protestors. If you’re too lazy to tap, on the docket we’ve got: Creating a civilian review board task force, creating a Marcus Alert work group, asking the Richmond Police Department to stop using chemical and other less-than lethal weapons, reporting on the RPD’s use of funding for mental health services, and reporting on the status and use of various asset forfeiture special funds in the City’s budget. The headlining item out of this small stack of papers is definitely ORD. 2020–155 which creates the CRB task force (and is the only true ordinance of the bunch). Councilmember Addison, chair of the Government Operations committee, says that committee will discuss ORD. 2020–155 on July 23rd, and you can submit public comment to the City Clerk at any point before July 21st at 10:00 AM (cityclerksoffice@richmondgov.com). Also, in a public engagement move that makes my heart sing with gladness, Addison has put together a Google Doc of the ordinance that you can mark up however you like. I realize that the set of people who want to leave a public comment on an ordinance about civilian review boards and choose to do so by reading and marking up legal text through Google Docs is probably pretty small. BUT STILL, this is a great way to collect smart and specific feedback—but, of course, in no way should be the only means of feedback. Anyway, I think the text of this ordinance is a little too prescriptive in defining the goals and purview of Richmond’s potential CRB, but it’s a place to start.I mentioned it in the legislation explainer piece, but the Richmond Accountability and Transparency Project has demanded that Mayor Stoney disband his Reimagining Public Safety Task Force before it even gets started. RTAP’s press release calls the Mayor’s task force “a distraction from the formation of a real independent civilian review board” and they “demand that Mayor Stoney disband his task force and defer to the one proposed in…ORD. 2020–155”. First, RTAP are and have been thefolks leading the conversation on creating a Civilian Review Board in Richmond. Without their work and expertise over the last several years, we wouldn’t even be talking about CRBs today. Second, the makeup of the Mayor’s task force has already been criticized for lacking Latinx voices, and, while I don’t personally agree, I do think you can make an argument for not including any law enforcement at all on this particular task force. Third, unless I misunderstood entirely, the Mayor’s task force is not intended to duplicate the work that will be done by the Task Force on the Establishment of a Civilian Review Board set up by ORD. 2020–155. The Mayor’s task force has a broader charge of “reviewing the police department’s use of force policies, exploring an approach to public safety that uses a human services lens and prioritizing community healing and engagement.” So the way I understood it—and I’m often extremely dense, so grain of salt—was that the Mayor’s task force would deliver very high-level public safety recommendations within the next 45 days, one of which probably would be to “support the existing legislative process of creating a CRB as defined by ORD. 2020–155.” Fourth, and finally, these are complex, emotional, and important conversations, and like most complex, emotional, and important conversations, folks can have legitimate reasons for standing on either side—or right in the dang middle!—of the issue. Is gathering 20+ smart folks, many of whom are dedicated to serving communities impacted by over-policing, in a room for a month and a half the best way to reimagine public safety? Would we have been better off to slow the process down and involve the folks actually impacted by over-policing? These are a good questions that I do not know the answer to.Ali Rockett and Mark Robinson at the Richmond Times-Dispatch sat down with the new RPD Chief Gerald Smith and have a bunch of interesting quotes that you should go read. Chief Smith says “Can the department be effective with less funding? No, it cannot. … The question is not defund the police; it’s fund the change.” I mean I get it, no department head is ever going to ask for less money in their budget. But, that said, if we change what we expect of the police in our communities, it may require less funding for them to be effective at it. Also, and maybe it’s time to start endlessly repeating this again ahead of elections, but: Raising the real estate tax is the only way to meaningfully fund change in Richmond.Tonight at 6:00 PM, the Richmond School Board will meet again and potentially vote on a school reopening plan. Your homework: Read Superintendent Kamras’s email before the meeting. It’s got descriptions of the five plans up for consideration, as well as some feedback he’s gotten from families and teachers/staff both for and against reopening schools. It’s nice to read through four sides of the same issue. To quote Kamras: “I share these quotes not to persuade anyone one way or the other. I share them only to demonstrate that there are very legitimate and very passionate feelings on all sides of the reopening debate.”Don’t forget! Price transparency is not one-size-fits-all. The optimal price information for a patient is different from the price transparency a physician would find useful and different, too, from what an employer-purchaser needs in order to play it's role in the health care ecosystem. Suzanne Delbanco calls Chapin White, PhD, Adjunct Senior Policy Researcher at the RAND Corporation to learn about the innovative Employer Hospital Price Transparency project. For this project - now embarking on it's third iteration, Chapin White and Christopher Whaley in conjunction with the Employers Forum of Indiana, analyzed claims data data from 4 million people who received hospital services from 1851 hospitals in more than 20 states. The project garnered attention from major stakeholders, including coverage in the New York Times and Wall Street Journal. Listen and learn why the Medicare fee schedule provides a standard benchmark that allows employers to see how good - or how bad - they have it as health care purchasers in the metro-areas studied.

Mariah & Hank Few Mariah and Hank Few were the third and fourth of Donna's five kids. Three years apart in age, but in every other way as close as could be. Then, just a few months before Mariah's 30th birthday, a tragedy blew the family apart. Mariah's live in boyfriend called to say that Mariah was dead. Sometime overnight she had stopped breathing. Toxicology reports later confirmed Mariah died from a drug overdose. Was it a suicide, accidental or something else? Apparently, after Mariah’s death Hank escaped his pain by turning to drugs, himself. Then, on October 9, 2012, the day before what would have been his sister's 30th birthday, Donna saw her son alive for the last time. Two days later he went missing. Friends Hank had been with claimed he wandered into the woods and never came back. His mother didn’t believe it. After the official searches ended, Donna Few and some of her friends conducted their own search of the area. Donna came across Hank’s body laying in the mud. The police declared the death to be an accident. But Donna doesn’t buy it. On August 17, 1996, Jack L. Robinson was stabbed to death during an altercation at the Rosewood Boat Landing in Columbia, South Carolina. Witnesses reported that just after 6:00 p.m. they saw Jack and an unknown man arguing over money. As the suspect fled the scene, Jack, mortally wounded, struggled to make his way towards the witnesses for help. Rescue personnel rushed Jack to the hospital where he was pronounced deceased. Investigators believe Jack and his assailant knew each other but are unsure why the verbal altercation turned violent. Ten-year-old Holly Piirainen was abducted around 12 p.m. on August 5, 1993 while she walked with her younger brother Zachary. The children were looking at puppies near her grandmother's cottage in Sturbridge, Massachusetts. When her brothers returned to the area to fetch their sister, all that was left was one of her shoes in the road. Despite a massive search, Holly's body wasn't found until nearly three months later, on Oct. 23, 1993. Although there have been various persons of interest to the police, Holly’s murder remains unsolved. Holly’s aunt, Carla Jackman, and Sarah Stein of the Center for the Resolution of Unresolved Crime, will discuss the case.

Molly's Law Following the tragic death of his daughter Molly, Larry Young embarked on a mission to get legislation passed in Illinois to benefit survivors of victims of homicides or suspicious deaths. His efforts led to the passage of Molly's Law. Larry will explain what was involved in achieving that goal.   HB6083 extends the statute of limitations for wrongful death cases and allows a lawsuit to be brought within five years after the date or the death, or within one year after a criminal case against a perpetrator concludes. HB4715 increases the fines for public bodies for not releasing information that has been requested under the Freedom of Information Act to $10,000, plus $1,000 for each day information is withheld. A young woman’s badly decomposed body was found in the trunk of a tan 1966 Rambler in a parking lot at Southwest 20th Street and Porter Avenue near the Des Moines airport on Thursday, July 10, 1975. The body was later determined to be 21-year-old Diane Marie Schofield. An autopsy indicated Schofield died of strangulation. Her body was found fully clothed in a green halter top and blue jeans, but with no shoes. Her hands were tied behind her back and her feet bound with twine near the ankles. She’d been strangled with a strip of knotted cloth. The body showed no other apparent signs of violence. Based on evidence and witness accounts, investigators believe she was killed sometime after 9 p.m. Monday, July 7. Police said robbery didn’t appear to be a motive because Schofield still wore her $200 watch and several turquoise rings. The 1966 Rambler in which her body was found was registered to the victim. The case has gone cold, but Diane’s sister, Twyla Johnson, refuses to give up her fight for resolution and justice. Twyla will talk about her efforts and the status of the investigation. On September 26, 1967, then 17-year-old Ronald Anderson of Gulfport, Mississippi died from a gunshot wound under his chin. His friend and roommate, Jeffrey Dennis Bass, was in the apartment when Anderson was shot. Bass did not immediately notify the police of Ronald Anderson’s death. Instead, he called his aunt, a nurse, who came to the apartment, and reportedly cleaned Anderson’s body. Authorities were then notified of the shooting. Following a court of inquiry, the death was ruled a suicide. Thirty- six years later, on April 18, 2003, Ronald’s 80-year-old father died a similar death. Dan Anderson was found in the driveway of his Gulfport home, dead from a gunshot wound to his head. His death was also ruled a suicide. However, Dan’s surviving daughter, Phyllis Cook, believes her father and brother were murdered by members of the infamous Dixie Mafia. On October 3, 2016, the Walker County (Georgia) Sheriff dispatched a unit to 862 NICK-A-JACK Road in Flintstone, Georgia, re: an attempted suicide. Upon arrival the deputy found 27-year-old Don “DJ” Fickey deceased on his living room floor, from an apparently self-inflicted shotgun wound. According to witness statements, Fickey had allegedly been arguing with his wife just prior to the incident. A clear case of suicide according to the authorities. Not so fast, says DJ’s family. They have a strong case consisting of witnesses and other evidence, that DJ was murdered. DJ’s sister. Amanda Shirley, will discuss the case and what the family is doing to get justice. Brett Wittner Fourteen-year-old high school freshman Brett Wittner of Covington, Louisiana, was brought into  the St. Tammany Parish Hospital the morning of Feb. 25, 2012, with a gunshot wound an inch or so behind his right ear. The bullet had fragmented, and bits of it had made their way toward the left side of his head, causing extensive damage to his brain, according to medical records. He died later that day. The police determined that Brett had accidentally shot himself while at a friend’s house. A grand jury subsequently examined the case and declined to indict anyone. However, Brett’s parents don’t agree with that finding and are continuing to look for avenues that will lead to a different outcome. Brett’s mother, Donna Wittner, will discuss the case and where it will go from here. Brenda Lacombe was just 19 years old when her badly beaten and decomposing body was found off Interstate 495 in Harvard, Mass in 1982, and no one has been charged with her killing in the 36 years since. The Worcester County District Attorney's unresolved-case squad continues to investigate the Lowell woman's killing, and now Lacombe's niece is trying to help by raising money to have her aunt's body exhumed so a new autopsy and DNA testing can be conducted. Lacey Kearns, 32, of Lowell, wasn't born yet when her aunt died, but she has spent years investigating her aunt's killing and believes the tests could provide new evidence. On Tuesday, December 5, 1978, Corley was a vibrant 19-years-old woman working hard while attending Holliston Junior College with the intention of eventually becoming a pediatrician. But that night, Corley had just one thing on her mind – getting home. She never got home and three days later, her body was found in a ditch on the side of Route 495 not far from where the Bellingham, Milford and Medway city limits converge. On April 30, 2011, Kevin Griffin called 9-1-1 to his apartment in Villa Rica, Georgia, stating his girlfriend, 22-year-old Samantha Sutton, was on the floor and unresponsive. Responding medical personnel were unable to revive her and she was pronounced dead. A subsequent autopsy determined her death was caused by an accidental drug overdose. However, her mother, Dee Sutton, doesn’t buy that and believes she has the evidence to prove it.

On this episode of Lawyer 2 Lawyer, host J. Craig Williams interviews Ed Tivol from EWA, Government Systems, Inc. and Jennifer Lynch from Electronic Frontier Foundation. Together, they discuss the paradox of security vs. privacy when it comes to biometric modes of identification. He is a 1964 graduate of The Citadel and served in the Army's Military Intelligence branch for 24 years. Tivol completed two tours in Vietnam and retired with the rank of Colonel in 1990.
