Toute cette semaine, le podcast « L'Heure du Monde » interroge les notions de droit qui peuplent les chroniques judiciaires, occupent les débats médiatiques et servent parfois d'étendards politiques. Avec l'aide des avocates pénalistes Margaux Durand-Poincloux et Lorraine Papart, nous étudions ces expressions qui évoluent, ou non, au gré des jurisprudences.Dans ce premier épisode, nous nous penchons sur la prescription. Un terme qui désigne la durée au-delà de laquelle une action en justice, civile ou pénale, n'est plus recevable. Cette notion, aussi ancienne que le droit, est souvent apparentée à un droit à l'oubli pour les auteurs d'infractions pénales. Aujourd'hui, elle est remise en cause par certaines victimes de violences sexuelles sur mineurs. Mais à quoi sert véritablement la prescription ? Il sera dit, plus tard, que cet homme glaçant au passé mystérieux soupçonnait ces enfants de posséder d'immenses pouvoirs. Des pouvoirs qui auraient pu changer le cours de la guerre.
