Democracy Decoded
How the U.S. Supreme Court Is Drastically Reshaping American Democracy

Democracy Decoded

The U.S. Supreme Court has vastly reshaped American democracy — rolling back voting rights, enabling secret money in politics and expanding presidential power. These decisions have a real impact on all Americans by making it harder for citizens to exercise their freedom to vote, easier for wealthy interests to sway elections and more difficult to hold leaders accountable. In this episode, host Simone Leeper speaks with law professor and co-host of the Strict Scrutiny Podcast Leah Litman, Campaign Legal Center Senior Vice President Bruce V. Spiva and Campaign Legal Center Campaign Finance Senior Counsel David Kolker. Together, they unpack the real-world impact of landmark Supreme Court decisions — from voting rights cases like Shelby County v. Holder and Brnovich v. DNC to campaign finance rulings like Citizens United — and explore what reforms could restore balance, accountability and trust in the Court.Timestamps:(00:05) — What do Americans really think about the Supreme Court?(02:18) — Why does the Supreme Court's power matter for democracy?(07:01) — How did Shelby County v. Holder weaken voting rights?(16:39) — What was the impact of Brnovich v. DNC?(23:39) — How has the Supreme Court reshaped campaign finance?(29:24) — Why did Citizens United open the floodgates for money in politics?(32:37) — How have super PACs changed elections?(34:02) — How have wealthy special interests reshaped U.S. elections?(35:44) — What does presidential immunity mean for accountability?(37:30) — How do lifetime seats protect the Supreme Court from accountability?(39:22) — What role can Congress play in restoring trust and democracy?Host and Guests:Simone Leeper litigates a wide range of redistricting-related cases at Campaign Legal Center, challenging gerrymanders and advocating for election systems that guarantee all voters an equal opportunity to influence our democracy. Prior to arriving at CLC, Simone was a law clerk in the office of Senator Ed Markey and at the Library of Congress, Office of General Counsel. In 2022, in his first run for public office, Bruce mounted a competitive run in the primary election for Washington, D.C. Attorney General. In addition to founding his own law firm where he practiced for eleven years, Bruce has held several leadership and management positions as a partner at two national law firms. Most recently, Bruce served as the Managing Partner of the D.C. Office and on the firm-wide Executive Committee of Perkins Coie LLP, where he also had an active election law practice. He first-chaired twelve voting rights and redistricting trials across the country, and argued numerous voting rights appeals in U.S. circuit courts and state supreme courts during his tenure at Perkins. David Kolker is Campaign Finance Senior Counsel at Campaign Legal Center. He focuses on both short- and long-term strategies to improve campaign finance laws across the country, and precedent interpreting those laws. David has spent decades litigating cases in both the public and private sectors. He worked for nearly 20 years at the Federal Election Commission, where he litigated cases on federal campaign finance law and for several years led the agency's Litigation Division. He represented the government in dozens of oral arguments, including the government's defense in SpeechNow.org v. FEC before the D.C. Circuit sitting en banc. He litigated many cases decided by the Supreme Court, including the landmark cases of McConnell v. FEC and Citizens United v. FEC. David joined CLC from the Federal Communications Commission, where he served as the deputy bureau chief, Enforcement Bureau. We watched the newly-released final episode of HBO's The Case Against Adnan Syed, and we have questions.  Are the producers really trying to pin the murder of Hae Min Lee on a Black man with obvious mental health issues who was already cleared as a suspect--and did they really need to show the world a fully-nude photo of him to make that case? What is the story that they are trying to tell here, and just how far off is it from the truth? From the libelously deceptive cold open to the slyly deceptive summary of Syed's post-Serial legal proceedings and beyond, Matt brings his post-conviction expertise to make the case against The Case Against Adnan Syed. President Trump's pressure campaign to take action against perceived adversaries is unrelenting. Mary and Andrew start this week by breaking down a public push for Attorney General Pam Bondi to prosecute Trump's political foes, just as Virginia's U.S. Attorney was ousted for failing to bring charges against Letitia James and Jim Comey. The focus then turns to the government's attempt to control critics and silence opposition after last week's abrupt suspension of Jimmy Kimmel, backed by FCC Chair Brendan Carr, as well as what the president designating ANTIFA as a “terrorist organization” actually means. On the flip side comes the effort to dismiss investigations into those aligned with Trump's cause. See MSNBC's reporting on the FBI bribery investigation into “Border Czar” Tom Homan that was shut down after Trump returned to office. And last up: Mary shares the reasoning behind a court's decision to block the removal of dozens of Guatemalan children, citing that the governments explanation "crumbled like a house of cards.”  And a reminder: There are still tickets available for MSNBC Live – our second live community event featuring more than a dozen MSNBC hosts. It's Friday, September 19th, A.D. 2025. This is The Worldview in 5 Minutes heard on 140 radio stations and at www.TheWorldview.com.  I'm Adam McManus. (Adam@TheWorldview.com) By Adam McManus Iranian Christian denied a retrial for practicing his faith Mehran Shamloui, an Iranian Christian convert from Islam, has been denied a retrial for his case by the Iranian Supreme Court, reports International Christian Concern.  Shamloui was arrested in 2024 and, in March 2025, was sentenced to 10 years and 8 months in prison simply for participating in a house church. The charges against him included “propaganda activities contrary to Islamic law,” and “membership in groups opposing the state.”  He was released from jail after he posted bail in late 2024. He fled the country and intended to travel to Europe, but was stopped in Turkey. He was deported to Iran in July 2025 because he was missing formal documentation.  Shamloui is currently serving his sentence in Iran's Evin Prison, a notoriously deplorable institution known for mistreating its prisoners, including Christians.  Hebrews 13:3 says, “Continue to remember those in prison as if you were together with them in prison, and those who are mistreated as if you yourselves were suffering.” Iran is an Islamic Republic and a known persecutor of the Christian community. Bibles written in Farsi, the official language of Iran, are strictly prohibited, as is discussing Jesus with Muslims to share the gospel with them. Hadi Ghaemi, the executive director of The Center for Human Rights in Iran, said, “The Christian community in Iran is facing a crisis. The Iranian authorities are abducting growing numbers of Christians and throwing absurd national security charges at them in order to imprison them for years for doing nothing other than peacefully practicing their faith.” NY Attorney General vs. TX Attorney General over Abortion Kill Pill Far-left Democratic New York Attorney General Letitia James is intervening in Republican Texas Attorney General Ken Paxton's attempt to prosecute an abortionist for mailing abortion kill pills from one state to the other to undermine Texas's pro-life laws, reports LifeSiteNews.com. Paxton first filed his lawsuit in December 2024 against abortionist Margaret Carpenter, founder of the “Abortion Coalition for Telemedicine.”  Paxton alleged that Carpenter “unlawfully provided a Collin County resident with abortion-inducing drugs that ended the life of an unborn child and resulted in serious complications for the mother, who then required medical intervention.” Carpenter is not licensed to practice medicine in Texas. Subsequently, in February 2025, Judge Bryan Gantt of North Texas ordered Carpenter to stop sending abortion kill pills into the state and to pay a $100,000 fine. (Carpenter also faces charges out of Louisiana for the same).  So far, New York officials have protected the abortionist from consequences via the state's shield law, which bars cooperation with other states concerning laws against abortion. Paxton has challenged the shield law and sued the Ulster County, New York clerk who refused to enforce the fine. Americans celebrating Charlie Kirk's assassination held accountable The Secret Service, several U.S. airlines, Office Depot, and Nasdaq said they were among more than 30 employers that have sanctioned or fired employees in reaction to their disturbing statements about the assassination of Charlie Kirk, the founder of Turning Point USA, reports The Washington Post. Regarding the Secret Service, an agent named Anthony Pough wrote on Facebook, “If you are mourning this guy .. delete me,” in reference to Kirk's killing. Pough accused Kirk of spewing “hate and racism on his show.” Roughly three dozen workers are reported to have been suspended or fired over their responses to Kirk's murder, including employees of Clemson University, MSNBC, the Federal Emergency Management Agency, and the Carolina Panthers. Plus, several local fire departments and school districts said they had also suspended or terminated employees over their remarks. WLBT-TV reports that Lauren Stokes, the executive assistant for the Vice Chancellor of Development at the University of Mississippi, was fired for her anti-Kirk comments. She allegedly wrote, “For decades, yt [white] supremacist and reimagined Klan members like Kirk have wreaked havoc on our communities, condemning children and the populace at large to mass death for the sake of keeping their automatic guns. … So no, I have no prayers to offer Kirk or respectable statements against violence.” WNDU reports that 18-year-old Camryn Giselle Booker, a college student at Texas Tech, was expelled after a video of her publicly celebrating Charlie Kirk's death went viral.  In the video, she is jumping around and yelling at students paying tribute to Kirk on the Lubbock, Texas campus. Listen. BOOKER: “Your homie dead. He got shot in the head. Your homie dead. He got shot in the head.” After Booker was expelled, Texas Republican Governor Greg Abbott posted this comment on X. “Definitely picked the wrong school to taunt the death of Charlie Kirk. Thanks Texas Tech!” Felicia Branch, a professor at the University of Arkansas, is on administrative leave over her vile social media post, reports the Arkansas Times. She wrote, “No, I will not pull back from CELEBRATING that an evil man died by the method he chose to embrace.  Don't tell someone who has been targeted by people like him how to feel, how not to post, how not to celebrate, that he can no longer inflict his brand of evil.” She added that Kirk is “an evil person [who] is no longer on this earth causing immense suffering.” Arkansas Governor Sarah Huckabee Sanders has called for Professor Felicia Branch to be fired. ABC yanked Jimmy Kimmel over Charlie Kirk comments And yesterday, ABC indefinitely suspended late-night host Jimmy Kimmel for inappropriate comments he made about the assassination of Charlie Kirk, reports Newsbusters.org. Here's the soundbite from Monday night. KIMMEL: “We hit some new lows over the weekend with the MAGA gang desperately trying to characterize this kid, [Tyler Robinson], who murdered Charlie Kirk as anything other than one of them and doing everything they can to score political points from it.” Conservative talk show host Erik Erikson  called out the leftist comedian. He said, “What Kimmel was doing was participating in the creation of the leftwing talking point that Kirk's assassin was on the right. He did not have to participate. [Kimmel] chose to participate and circulate what was obviously, even on Monday, a lie. On top of that, it was not funny. It was hectoring and cruel.” Erikson reported that the primary reason Kimmel is no longer on the ABC program schedule is because of the influence of Nexstar, a moderately right-leaning group of stations, that controls 32 significant ABC affiliates including New Orleans, Nashville, Syracuse, Albany, and Grand Rapids and Lansing, Michigan. Nexstar decided to stop airing Kimmel's program. Star Spangled Banner's God-honoring fourth verse And finally, on September 14, 1814, Francis Scott Key penned the immortal words of “The Star Spangled Banner.” Key was a Washington attorney sent to the British navy to secure the release of a prisoner during the War of 1812. During his mission, the British bombarded Fort McHenry in Baltimore, Maryland. The sight of the American flag continuing to fly over the fort despite the barrage inspired the verses in the song. Congress officially made it the national anthem over a hundred years later. The opening verse is well known. But the later verses are more obscure. Listen to David Hedrick, a former Marine, sing the last half of verse four. HEDRICK: “Praise the Power that hath made and preserved us a nation! Then conquer we must, when our cause it is just, And this be our motto: “In God is our trust;” And the star-spangled banner in triumph shall wave O'er the land of the free, and the home of the brave.” (applause) Indeed, Proverbs 3:5-6 says, “Trust in the Lord with all your heart and lean not on your own understanding; in all your ways submit to Him, and He will make your paths straight.” Close And that's The Worldview on this Friday, September 19th, in the year of our Lord 2025. Follow us on X or subscribe for free by Spotify, Amazon Music, or by iTunes or email to our unique Christian newscast at www.TheWorldview.com.  I'm Adam McManus (Adam@TheWorldview.com). JOIN SHERI HORN HASAN @ FOR THIS WEEK'S ASTROLOGICALLY SPEAKING PODCAST WHICH DROPS SEPTEMBER 19 @https://www.karmicevolution.com/astrologically-speakingToday's podcast explores that fact that this month's waning third-quarter of the lunar cycle—which leads us to the September 21 Virgo New Moon solar eclipse--has been a time to wake up & smell the coffee that our constitutional rights here in the U.S. are under threat. So, before we even reach this second eclipse in this fall's series--which began with the Pisces Full Moon total lunar eclipse on March 7--we're asked at the end of the monthly lunar cycle to adjust to several realities. Doing so allows us to better recognize what seeds we're being called to plant at the Virgo New Moon solar eclipse on September 21.Since the assassination of prominent right-winger Charlie Kirk on September 10, we experienced the September 13 Sun/Mercury superior conjunction in Virgo. And since then, Mercury has moved ahead of the Sun to become an evening star, meaning he's more prominently visible in the night sky.In turn, this B symbolizes it's now time—between September 13 & November 9 when Mercury once again stations retrograde—for clear observation & rational, logical, organized, & pragmatic thought that leads to ultimately to action.I often point out that my astrological philosophy is that the universe is benign & that it has no interest in making any of us suffer. Rather, it simply provides opportunities every moment of everyday for us to grow in consciousness. And if we don't recognize these moments, the universe doesn't give up!With that in mind, we're tasked right now with recognizing the pain of injustices that curtail the rights of both individuals & groups. And to begin to recognize we must push back against such injustices, or we'll continue to be subjected to additional onslaughts against our rights, such as the right free speech. We've witnessed an outpouring of grief on many different levels since the Pisces New Moon total lunar eclipse & during this monthly lunar cycle's last week. But the main one was the silencing via murder of an outspoken conservative who used religion as a shield to justify his prejudices against those he did not like. The aftermath of his murder brought grief, pain, & suffering to both those who followed him AND those who KNOW that killing someone because of his speech is morally WRONG.And not only wrong, it's unconstitutional, at least here in America. As Kirk's death began to sink in amongst the masses of both his followers & his critics, the powers that be began to curtail the speech of his detractors which has resulted in the stifling of voices such as late-night comedic talk show host Jimmy Kimmel. So what began with an outpouring of pain & grief has culminated in a discussion of how our current political polarization has wounded us—as evidenced by September 16's Mercury quincunx wounded healer Chiron, Venus's trine to Chiron, & Mars' opposition to Chiron.By September 17, however, the pushback against allowing anyone other than conservatives to speak freely began as Mercury in Virgo opposed Saturn retrograde in Pisces on September 17. Mercury then entered Libra & opposed Neptune retrograde in Aries, & trined Pluto in Aquarius September 18. In addition, Venus in Libra quincunxed Saturn in Pisces & the Virgo Sun quincunxed Chiron in Aries then too.GRIEF OVER THE ASSASSINATION OF FREE SPEECHQuincunxes are 150-degree aspects between planets, which makes them so far apart that they do not recognize or “see” each other. Most astrologers agree they are indications that an adjustment must be made. Like needing to turn your head to see what's out of your immediate range of peripheral vision, a quincunx alerts us it's time to look both ways before proceeding. In this case, as these quincunxes begin to register, they are waxing us toward this next solar eclipse. Mercury also trines Uranus & Pluto, Venus enters Virgo & quincunxes both Neptune & Saturn, squares Uranus, & quincunxes Pluto. In addition, the Virgo Sun opposes Saturn in Pisces, & ALL of these aspects occur between September 18 & September 21 in the lead up to the upcoming solar eclipse. Instead of parsing each of these individually, let's simply analyze what's occurred in the collective as we reach the end of this month's lunar cycle, shall we? What we have in fact seen--& are in fact experiencing now--is a rude awakening to the extremes that divergent political stances can bring. Even to the point where ignoring—or worse yet, excusing--gun violence by rationalizing it as a necessary by-product of such polarization because conservatives believe it's an expression of our rights as American under the Second Amendment. So, as we approach the 29'05” Virgo New Moon solar eclipse at 12:54 p.m. PT & 3:54 p.m. ET on September 21, it might then be a good time to engage in meditation, prayer, or mindfulness about what Mercury, the Sun, & the Moon's oppositions to Saturn & Neptune at this eclipse are asking us to do.Again, the collective is mirroring the answer back to us right now, and that is to resist pressure against our constitutional rights, most importantly the right to speak out. On September 15, as we waxed toward Mercury's quincunx & Mars' opposition to Chiron September 16 & Mercury's opposition to Saturn September 17 Pam Bondi, the Attorney General of the U.S. Department of Justice (DoJ) said the following in an interview posted on Youtube:“There's free speech, and then there's hate speech,” she announced while declaring that federal law enforcement will “go after” Americans for hate speech. The problem? There is, in fact, no hate-speech exception to the First Amendment. The First Amendment in the U.S. Constitution says the following: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”The fact is that the First Amendment was set up by America's founders to restrain the government, not individuals. In other words, the Supreme Court has parsed out in many cases what is acceptable under the First Amendment & what is not when it comes to both the government & individuals. Speech inciting “immediate violence” is prohibited under this amendment, but political speech is protected. For more on this--& remember, it pays to know the facts--see: https://constitutioncenter.org/the-constitution/amendments/amendment-i/interpretations/266In any case, it's now time to adjust our thinking as per all of these quincunxes & to push back against these oppositional threats to our constitutional rights—including that of free speech as it exists under U.S. constitutional law. By the time Mercury entered more negotiable & comprisable Libra on September 18, Bondi was forced to “walk back” her words about “going after” Americans for constitutionally protected “hate speech.” TIME TO FIGHT BACKThe other important transits happening around this solar eclipse is that Mars, which moves into Scorpio just before the Sun enters Libra at the fall equinox on Septembers 22, is waxing toward its third quarter “crisis in consciousness” waning square to Pluto in Aquarius on September 24. This podcast explores the history of this Mars/Pluto cycle from its  beginning in February 2024 until now, so tune in for more! But basically, in the common parlance of a born & bred New Yorker, the response to Pam Bondi's threats against free speech--& as a trained lawyer & the Attorney General for the state of Florida before being appointed head of the DoJ Bondi CLEARLY knows better—“dem's fightin' words!”All of these oppositions & quincunxes point now to this solar eclipse's culmination. That's because, according to astrologer Ronnie Dreyer, it's energies technically began when the transiting true nodal axis reached the 29'05” Virgo South Node position circa January 22/23 only days after the inauguration of President Donald Trump. In total, the question now is can we plant seeds that lead to the further clear sighted analyzation of what's occurred since January of this year that's blocked us from being protected by established constitutional law? And, can we muster up the energy necessary now to fight back before it gets even worse?U.S. history tells us we can. But it's going to involve leaving behind any confusion about what's going on now, calling a spade a spade, & formulating a pragmatic, logical plan to uphold our rights as Americans. In short, we've done it before & we can do it again, but we must wake up to reality & understand we can't give up without a fight.Tune in to all of this & more Astro News You Can Use, starting today @ https://www.karmicevolution.com/astrologically-speakingSee you then! Why Has Ellen Greenberg's Case Been Buried for 14 Years? Corruption or Cover-Up? For 14 years, Ellen Greenberg's death has sat in legal limbo. After being ruled a suicide despite 20 stab wounds, her case has been passed from agency to agency, each refusing to take responsibility. The District Attorney recused himself, the Attorney General's office punted it back, and county prosecutors declined to act. The result: no arrests, no suspect, and no justice. In this segment of Hidden Killers Live with Tony Brueski, former prosecutor and defense attorney Eric Faddis joins the discussion to unravel how the system has failed Ellen Greenberg. Why did the medical examiner reverse an initial homicide ruling after a private meeting with police? Why have officials fought against reopening the case despite mounting evidence? And is this incompetence — or something more deliberate? The Greenberg family has fought tirelessly for answers, but every attempt to force accountability has been stalled or buried. We explore the political dimensions of the case, including questions about then–Attorney General Josh Shapiro, now Governor of Pennsylvania, and whether connections or corruption played a role in shutting down the investigation. This is more than a case about one woman's death. It's about what happens when a justice system chooses to protect itself instead of the people it serves.
