On today's episode, we break down how Radio Free Europe just might be the key to preserving the separation of powers in America. We talk the Tucker Act and all of the pretextual, vapid, and/or just plain wrong arguments coming out of Trump's Department of Justice. Perkins Coie wins their case in front of Our Favorite Beryl, a dingus is trying to sue Chief Justice John Roberts, and Maine's Governor Janet Mills promised the President she'd see him in court. Four days later, the administration caved, meaning Maine kids will get to eat their school lunches after all.    Links: Trump Admin Unveils Exciting Plan To Magic Away Impoundment Lawsuits https://www.lawandchaospod.com/p/trump-admin-unveils-exciting-plan   RFE/RL v. Washington sheriffs may face pressure between federal agencies and state law under Trump administration

President Elect Donald Trump has promised mass deportations of undocumented immigrants on day one of his administration. Removing the approximately 11.7 million people living in the United States without authorization would take a massive operational effort -- and likely require cooperation from both state and local governments. Right now, most Immigration and Customs Enforcement arrests in the U.S. happen because of a hand off from local law enforcement. But that kind of cooperation is restricted in Washington state. 2019’s Keep Washington Working Act broadly limits state and local law enforcement from assisting with federal immigration proceedings. But Trump allies are already ramping up the pressure on local leaders in places like California and D.C. with similar sanctuary laws in place: Stephen Miller’s America First Legal Foundation announced last month that it had identified hundreds of elected officials in sanctuary jurisdictions who it claimed could be held civilly liable for obstructing federal immigration enforcement. As the new Trump Administration takes office, Washington state’s elected sheriffs will be among those officials feeling the squeeze between federal agencies, and state law. Guest: Steven Strachan, Executive Director of the Washington Association of Sheriffs and Police Chiefs Relevant Links: WASPC Statement on local law enforcement involvement in immigration issues Thank you to the supporters of KUOW, you help make this show possible! This Day in Legal History: Nazi Leaders Convicted at NurembergOn September 30, 1946, the International Military Tribunal at Nuremberg delivered its final verdicts, marking a pivotal moment in legal history. The tribunal, established by the Allied powers after World War II, tried 24 high-ranking Nazi officials for crimes against peace, war crimes, and crimes against humanity. Of those tried, 22 were found guilty. These included prominent Nazi figures such as Hermann Göring, Rudolf Hess, and Joachim von Ribbentrop. The Nuremberg Trials were the first of their kind to hold government officials individually accountable for atrocities committed under state authority, laying the groundwork for modern international criminal law.The court sentenced 12 of the defendants to death by hanging, while others received long prison sentences. Three were acquitted. These proceedings also set legal precedents, defining acts like genocide and war crimes more clearly in the context of international law. Nuremberg solidified the principle that following orders is not a defense for committing atrocities, a key doctrine in future human rights cases. The trials emphasized accountability, no matter how high the official's rank, and underscored the need for justice following war and genocide.Ahead of the 2024 presidential election, Republicans have launched a wide-ranging legal campaign to challenge voting processes, with particular focus on states like Arizona, where the race between Donald Trump and Kamala Harris is extremely tight. A lawsuit by the America First Legal Foundation, founded by Trump advisor Stephen Miller, seeks to empower courts to nullify election results due to procedural errors by local officials and order new rounds of voting. This case, which legal experts view as a long shot, reflects a broader Republican strategy to sow doubts about the election's legitimacy before votes are cast. The Republican National Committee is involved in over 120 lawsuits across 26 states, aiming to impose stricter voting rules, which they argue will restore faith in election integrity.Republicans, still asserting widespread fraud in the 2020 election despite court rejections, are pursuing these challenges earlier than in 2020, attempting to preemptively influence election outcomes. Legal experts warn that these lawsuits could cause chaos and confusion, potentially opening doors for political intervention in election results. Democrats argue the efforts are designed to undermine trust in the election system in case of Republican losses, while both sides are gearing up for further legal battles over voting restrictions and access.Republicans lay legal groundwork for election challenges | ReutersEpic Games has accused Google and Samsung of conspiring to limit competition in the app market, filing a lawsuit in U.S. federal court. The suit centers around Samsung's Auto Blocker, a mobile security feature that Epic claims discourages users from downloading apps outside of Google's Play Store and Samsung's Galaxy Store. Epic argues this reduces consumer choice and violates U.S. antitrust laws by making it harder for users to access potentially cheaper apps from rival sources. Epic CEO Tim Sweeney said Google falsely positions itself as protecting users by blocking apps from “unknown sources,” despite previously distributing "Fortnite" itself.Samsung, which introduced Auto Blocker in late 2023 as a security measure, denies the allegations and claims the feature is designed for user safety. The company stated that users can disable Auto Blocker if desired. Epic believes the feature undermines a U.S. court ruling in December 2023, which was expected to increase app availability from third-party sources. Epic plans to raise these concerns with EU regulators, citing Google's long-standing scrutiny over anticompetitive practices. This follows Epic's earlier legal battles with Google and Apple over high app store commissions, which led to "Fortnite" being temporarily banned from both platforms.Epic Games accuses Samsung, Google of scheme to block app rivals | ReutersJudge Colm F. Connolly recently criticized lawyers in a patent-funding investigation, suggesting they were not truly representing their client, Lori LaPray, a Texas paralegal who owns Backertop Licensing LLC. LaPray owes a $53,000 contempt fine for failing to appear in court, linked to Connolly's probe into patent-monetization firm IP Edge LLC. The judge maintained the fine but implied LaPray was a pawn in a larger scheme orchestrated by IP Edge and advised her to seek independent legal counsel. Connolly's actions are rare, with legal experts noting that questioning an attorney's loyalty to a client in open court could lead to wider scrutiny of their conduct. The investigation focuses on whether IP Edge and related entities, like Mavexar LLC, have violated court disclosure requirements designed to ensure transparency about who benefits from patent litigation. Connolly has already sanctioned multiple attorneys involved in IP Edge cases and warned that reducing LaPray's fine would signal tolerance for deception. The judge has referred several cases to the Justice Department, reflecting his broader effort to address misconduct in patent litigation, which critics say often obscures the real parties behind lawsuits. Connolly's approach contrasts with other judges who may not prioritize uncovering the true interests in litigation, despite concerns over transparency.Judge's Rare Rebuke of Lawyers Shakes Up Patent-Funding Probe This is a public episode. Academic freedom and free speech at colleges and universities are at the center of ongoing litigation in Gerber v. Ohio Northern University. In April 2023, Dr. Scott Gerber was abruptly removed from his law class by school security and brought to the dean's office. Dr. Gerber was then told by Dean Charles H. Rose III that he must resign or face termination proceedings. During his time teaching, he had been a long-standing critic of the University's use of race, sex, and ethnicity factors in hiring and student admissions. He refused to resign and the University soon commenced termination proceedings against him. Dr. Gerber was not told what he was accused of doing, despite his contractual right as a tenured faculty member to be informed with “reasonable particularity” of the accusations against him. Hardin County, Ohio Court of Common Pleas issued a temporary restraining order against ONU, requiring them to notify Dr. Gerber of what he was alleged to have done. At the hearing, the University allegedly failed to give Dr. Gerber a fair hearing as they brought forward new accusations and denied Dr. Gerber his contractual right to interview witnesses.Dr. Gerber, who is represented by the America First Legal Foundation, has now filed suit against Ohio Northern University to restore his reputation, regain his employment, and secure compensation for the actions of the University. This was a Litigation Update on Gerber v. Ohio Northern University with Ben Flowers, one of Dr. Gerber's attorneys and a Partner at Ashbrook Byrne Kresge, moderated by Dan Morenoff, Executive Director at American Civil Rights Project.

After the war, he returned to Missouri to start a small butcher shop, where Eric's father would later work. His father worked his way through night school to provide for his family while earning a diploma. (Adam@TheWorldview.com) By Jonathan Clark Greek soccer player sentenced to prison for speaking the truth A court in Athens, Greece recently sentenced one of the country's greatest soccer players to 10 months in prison for allegedly posting “transphobic” comments. Forty-nine-year-old former soccer star Vasilis Tsiartas also receive a fine of over $5,000.  In 2017, he posted on Facebook, “God created Adam and Eve” in response to a law that would allow people to change their sex listed on official documents. The soccer player plans to appeal the sentence and the fine. Jesus asked in Matthew 19:4, “Have you not read that He who made them at the beginning ‘made them male and female.'?” European Christians targeted with 500 hate crimes Meanwhile, across Europe, Christians experienced over 500 hate crimes last year. The Observatory on Intolerance and Discrimination Against Christians in Europe released their 2021 report last week. France saw the most anti-Christian hate crimes followed by Germany, Italy, Poland, the U.K., Spain, Austria, Belgium, Ireland, and Switzerland. The most common attack directed at Christians and churches was vandalism.  The report said, “Religious freedom is gravely threatened in Europe, especially that of Christians. And the greatest threat arises out of relativism.” The shifting global population The United Nations estimates there are now eight billion people in the world. However, the global population is growing at its slowest rate since 1950. India is expected to overtake China as the most populous country next year. And Nigeria is expected to overtake the U.S. as the third most populous country at the same time. Countries in Africa and parts of Asia are projected to contribute to most of the world's population growth in the coming decades. COVID pandemic reduced influence of the church A new report from the U.K. found many families have become less engaged with the church since the COVID-19 pandemic. Forty-percent of families reported they were less engaged with the church, 44% said their engagement had not changed, and 16% said they were more engaged. Among church leaders, 48% said families in their congregations are less involved in the church.  The report stated, “For many Christian families the pandemic has brought a change in family priorities, with many explaining that whilst they were keen to continually strengthen faith at home, church attendance itself was not as high a priority for them as it has been pre-pandemic.” Psalm 63:1-2 says, “O God, You are my God; early will I seek You; my soul thirsts for You; my flesh longs for You in a dry and thirsty land where there is no water. So I have looked for You in the sanctuary, to see Your power and Your glory.” Republicans poised to take U.S. House of Reps. Republicans are poised to take control of the U.S. House of Representatives. After five races were called for the GOP on Monday, Republicans now have 217 seats in the House. They just need one more victory in the remaining 13 House races yet to be called. On Thursday's Mark Levin Show, the America First Legal Foundation sent a letter to Inspector General Horowitz requesting an investigation into Attorney General Merrick Garland. The letter questions whether Garland's memo may be preventing parents from practicing their constitutional right to protect their children and protest their government. The AFL letter also cites that Garland met with several John and Jane Doe's in the White House to plan a pretext to minimize the effect of parental mobilization, and the political impact such motivated parents could have on the upcoming midterm elections by using federal action against parents. The AFL letter also cites key dates in September 2021 where the Biden Administration concocted a plan -- an inside job -- to deter such a grassroots movement by parents by involving a third party's concocted complaint so that the Patriot Act could be used as a 'solution' to the pseudo-problem that they'd just created to advance their political agenda and stifle the speech of American citizens. Then, Americans' trust in the government and the media has dwindled. Perhaps it's because Sen Mitch McConnell agreed to the disastrous debt limit debacle. There would be no default on the U.S debt service yet frauds in the media are still reporting the exact opposite. Later, Biden's administration is made up of Marxists, and some unabashed bureaucrats even praise the former USSR and Marxian policies. Afterward, Rep. Brian Mast joins the show to discuss the ISIS-K suicide bomber, who killed 13 service members, was released from prison from Bagram Air Base on August 15.

What’s Under Sid Miller’s Thousand-Dollar Hat?

The agriculture commissioner of Texas, Sid Miller, is the one top official in our state willing to take a bold stand against racial discrimination. Miller proudly went to court in April, challenging a new government program that he considered discriminatory against a particular group of disadvantaged agriculture producers. Namely, his group – White farmers and ranchers! Yes, Sid asserts that the program – which directs some long-overdue loan relief to Black, Latino, Native American, and other food producers who’ve been grossly discriminated against for generations by agricultural lenders – amounts to reverse-discrimination against privileged Whites like him. So Sid, a rancher and former rodeo performer, is braying and snorting through his big white cowboy hat that the way to stop racial discrimination is to let White discriminators also get anti-discrimination money from the Feds. That’s what passes for logic when you’re wearing a $1,000 hat like Sid struts around in. But, as a real cowboy once told me, “It ain’t the hat, it’s the head.” And right there is Miller’s problem – he’s got a thousand-dollar hat on a 10-cent head. However, he’s not the actual “thinker” behind this screwball legal claim. That distinction goes to another Miller, one named Stephen. He’s a Trump political operative, anti-immigrant extremist, and a fanatical promoter of White nationalism – one who specializes in frivolous lawsuits. Indeed, Stephen wrote Sid’s plaintive legal plea to provide “racial justice” for rich and powerful White ranchers like him, and just days before filing the suit, Stephen set up a political front group called America First Legal Foundation to push the case. You’d think this ridiculous racial bigotry would be laughed out of court, but the case has gone to a hyper-partisan, right-wing judge who has backed such Republican legal ploys in the past. So, yippy-ti-yi-yo, off to another right-wing rodeo we go!
