The collapsed trial of Liam Allan reveals a widespread problem in the legal system, which criminal defence lawyers have been warning about for some time. Liam was accused of rape and sexual assault, but his defense was that any sexual contact between himself and his former girlfriend was consensual. The Prosecution's case relied heavily on the ex girlfriends account, which is a common situation in sexual assault allegations that often occur in private settings without any independent witnesses.It took two years from Liam's arrest for his trial to proceed in the Crown Court. Prior to the trial, his lawyers had repeatedly asked the Prosecution to disclose text and social media messages between Liam and his ex girlfriend from her phone. Despite clear guidelines on disclosure, the officer in charge of the case failed to hand over this potentially useful information to the defence team. It wasn't until the trial started that this material was brought to the attention of the Prosecuting barrister, who ordered it to be handed over immediately. The messages cleared Liam of all charges. His ex girlfriend and accuser had messaged him asking for sexual contact and spoke of a desire for violent sex and rape fantasies. In other messages to friends, she stated that no crime had been committed.To their credit, the Crown dropped the case as soon as he became aware of this material. Dr Kylie Moore-Gilbert, a British-Australian academic, endured 804 days as a rebellious hostage of Iran's Islamic Revolutionary Guard Corps (IRGC) while being accused of being an agent for Mossad, MI6, or a spy for Australia. She was imprisoned in the infamous Evin prison, where she was kept in isolation from the outside world and subjected to relentless interrogations. Despite being told repeatedly that she would be forgotten, Kylie refused to confess and rejected the ever-changing accusations. The Australian government dismissed the charges as baseless, but she was convicted by "the hanging judge" of Iran, and sentenced to 10 years in prison.After a year in solitary confinement, Kylie was suddenly transferred to Qarchak, known as the world's worst women's prison, located on the outskirts of Tehran. Although no evidence was ever presented to support the charges against her, she was subjected to the harshest of conditions.Finally, after a complicated prisoner swap involving four countries, Kylie regained her freedom. For the past twenty years, the UK has been grappling with the aftermath of the notorious "Post Office scandal," which has affected countless innocent individuals. In 2000, the Horizon IT system was introduced to modernise the Post Office network, but its rollout led to a barrage of wrongful convictions for fraud, theft, and false accounting. Despite technological advancements in digital payments and optimised accounting, the system frequently flagged accounting discrepancies due to bugs and errors, resulting in harsh punitive measures taken against subpostmasters and staff. Consequently, thousands of innocent people lost their jobs, homes, and freedom.The Post Office and its lawyers attempted to cover up the scandal by withholding crucial information about Horizon in court cases, leaving many of the victims without justice or compensation.Recently, the Court of Appeal overturned the wrongful convictions of many former subpostmasters, stating that the Post Office should not have initiated the prosecutions. Jo Hamilton, a former sub-postmistress from Hampshire, joined me on this episode to share her story of how the scandal affected her. She was accused of stealing £36,000 from her branch and pleaded guilty to false accounting in 2008 out of fear of imprisonment.It took years for her to clear her name, and in the meantime, she had to mortgage her house and borrow money from friends. Amanda Knox, a journalist and public speaker, is best known for her wrongful conviction in the murder case of Meredith Kercher. Alongside her ex-boyfriend, Raffaele Sollecito, Knox was accused of the crime and sentenced to 26 and 25 years in prison, respectively. After four years behind bars, the Italian court acquitted them in 2011. However, Knox was again convicted in 2014 but was later exonerated by the Supreme Court of Italy.Despite her traumatic past, Knox has dedicated herself to advocating for criminal justice reform and media ethics. She serves on the board of the Frederick Douglass Project for Justice, where she shares her story to raise awareness about issues within the criminal justice system. Knox's bravery and activism serve as an inspiration and model for others who have experienced similar injustices. He hosts 'Inside The World's Toughest Prisons' on Netflix and his own podcast, 'Second Chance'. He talks to Matt about his time in prison (and in solitary confinement), how exercise and yoga helped him get through the days and how he eventually got the authorities to listen to his appeal. She believes that her moments of greatest growth have been the ones when she's got butterflies or big nerves.  She asked herself: what can I do to celebrate turning 40 and up the ante that is in integrity with who I am or who I tell the world that I am?  Melissa tells herself and the world that she is courageous. So climbing the Harbour Bridge became the idea that was bad-ass, kind of risky, but not crazy, that made that moment super memorable and was culturally relevant to where she was at the time. But as epic as it was, while she was ascending creaky wooden plank stairs and looking at the cars parked below her, she wondered why she chose this particular celebration and not something more….comfortable.  Mapping Out Where She's BeenAs she approached 40, Melissa started to map out her life, decade by decade, on Post-It notes stuck to her wall. Milestones each got a Post-It.  In her 30's, Melissa became a mom. She got into the labor room for her first-born and realized “I can't' do this.” But what do you do at that point? You power through.   After she had her son, she left corporate America because she didn't have childcare she trusted. So she became an entrepreneur and started to build a business. That got a Post-It.  Leaving corporate America came with trade-offs that she had to work through. She had to let go of the idea of having a dream house because that came with financial obligations that could only be met with the corporate job.  Then she became pregnant with identical twins and, even though it was a single event, they each got their own Post-It. With no history of twins on either side of their family, they were pretty shocked to learn...

In December of 1988, 18 year old Londoner Raphael Rowe was living with 5 other men in social housing, when four violent robberies shocked Southeast England, leaving eight victims in their wake. One was killed and another was severely injured. The assailants' MO was to steal the victims' cars, ditch them at the next crime scene, and repeat the process. Twelve people in the area of the first abandoned cars were arrested, including Raphael and his friend Michael Davis. Contrary to the victims' descriptions of two white men with fair hair and blue eyes and one black man, several of those arrested helped police to shape a false narrative that instead pinned the crimes on three black men, Raphael, Michael, and a 3rd man, named Randolph Egbert Johnson. Police also planted evidence and coerced Raphael's main alibi witness to win the conviction. From inside his cell, Raphael enlisted the help of journalists and attorneys to investigate his claims of innocence, finally winning his freedom. And so, I want to help you make happiness within your reach, especially during those hard moments.  Maybe you're living in a humble New York City apartment with chipped paint on the walls. And then you're seeing all those things on social media with everybody living big, glamorous lives. Or maybe you're reading or watching the news bringing about feelings of anxiety. Maybe you're in a similar situation where you're in a panic mode, and you don't know how to break out from that feeling. Maybe you're in the process of writing a book and you find yourself struggling with the editing. Then you go to a bookstore, look around the shelves, and wonder to yourself how all those books got there.  Any of those are moments of cognitive dissonance wherein what we see outside doesn't match with how we want to feel on the inside. 101: Leveraging Your Emotional Landscape to Figure Out Who You Really Are

I've come to realize that while the central themes of this podcast have been creativity, courage, and curiosity, the deepest core of this is our identity. Today, I'll be covering how some of my guests have uncovered their truest identities, whether you can truly change your identity, and what this whole identity crisis and searching is really all about.  You'll be hearing 10 excerpts from my last 100 episodes that I carefully curated because they've meant something to me, and I surmise, they can change the way you think about getting to know yourself. When it comes to our personal evolutions of who we are, I have noticed three types of moments that truly make an impact on our identities.  The first type is how traumatic experiences can put our identities in question. Such as Cepee Tabibian, Co-Founder of She Hit Refresh, who lost her two parents back-to-back and decided to leave a good Texan life for a great Spanish existence (Episode 45), and Marshall Dun, who after losing his brother to suicide, he learned how to trust himself and detach his identity from the allure of external desires and riches to become a spiritual leader. (Episode 60). The second type is those expansive moments that stretch our identities. For instance, Raphael Rowe leveraged the world of media and journalists to help him clear his name so he could eventually become a journalist himself for the BBC and on the Netflix series Inside the World's Toughest Prisons (Episode 89). The James Beard Award Recipient, Gabriele Corcos, also stretched his identity when he started out as a percussionist, then decided to become an entrepreneur, then farmer, and eventually, a politician (Episode 47). The third type is those rising moments such as when World Rugby Hall of Famer Phaidra Knight felt this push to greatness from her family, she decided to rise up to the challenge – including the challenge of expectations (Episode 17). Also, when I interviewed James Altucher back in Episodes 5 & 6, I knew I had to rise up to the occasion if I wanted to become a podcaster and interview my first multimillionaire. So I had to step up to the plate and figure it out.  You can be told to be someone by everyone and you can perform for everyone else's claps. However, ultimately, it is not until you decide to learn about what you want, and who you want to be that you will begin to truly live your life. It's that journey, which many of us avoid taking, that we can ever become who we were meant to be. You cannot watch someone else on their journey and expect to get to know yourself and change. You just have to be willing to take meaningful steps in your own evolution and feel every emotion that comes your way. My plan is to delve into these emotions next. Neil Bonner was filming a documentary about piracy off a small island in Indonesia when he and a female colleague were arrested by the authorities and questioned about what they were doing. They were held for more than five months in an Indonesian prison. They were accused and threatened with charges including being a threat to national security, which carries up to 12 years in prison. The Longford scholarship assists in giving them a second chance to pursue a degree at university.Up until now all of my guest interviews have been recorded remotely thanks to Covid, but on this occasion I was able to meet Sean in person.After gaining qualifications to earn his place at the University of Leeds, Sean's life became problematic when he couldn't secure funding to cover his tuition fees. Selling drugs was a quick solution to this problem and Sean was arrested in his first week at University and sentenced to prison. In this episode I'm speaking with Junior Smart who was arrested in his mid twenties for possession of several kilograms of crack cocaine. Junior was left homeless after his mother died of a stroke, causing him to go into depression and become suicidal, planning to kill himself. On that day, an officer slid an envelope under the door of his cell containing photos of past family get-togethers. Junior said the photos snapped him back to reality and saved his life. He then seeked help from the Listeners and decided to train to become a Listener himself but soon discovered areas that lacked in support. He wanted to do something about it and make a change. A story about a young man called Raphael Rowe and his career that was born as a result of spending 12 years in a British prison for crimes he did not commit.This story will be triggering for a lot of people. Despite a history of criminality, theft and violence, Raphael found himself a victim of institutional racism that led to his wrongful sentencing and incarceration.This story has somewhat of a positive outcome, however, it pains me to think of how many people are in the same situation as him. With no means of escape.You may recognise Raphael Rowe from his many TV programmes that he has filmed since his release including the highly popular Netflix series “Inside the World's Toughest Prisons”. What happens in prisons is very secretive. It feels even more far removed from our everyday reality when you take into account what happens in prisons around the world including countries such as South Africa, Brazil, and the Ukraine.  Our guest today, Raphael Rowe, spent 12 years in prison for crimes he did not commit. Eventually, his convictions were overturned in 2000. But that experience changed him.  With that perspective and experience, he was able to be the presenter behind this Netflix show Inside the World's Toughest Prisons, where he had the opportunity to visit these prisons, ask prisoners questions pertaining to their stories, and ultimately, give us a unique viewpoint into what's really going on in prisons. That way, we can have a better perspective about what these realities are, and hopefully, we can do something about them.  Raphael is also the host of his own podcast called Second Chance, and the best selling author of his autobiography, Notorious. Just to give you a bit more perspective pertaining to Raphael's career in journalism, he is the first person of mixed race with dreadlocks to report for the British Broadcasting Corporation, on both television and radio, and helped re-write the rules on what makes an international BBC correspondent. He is an experienced investigative journalist and presenter on both prime time television and international platforms. Yet it is being an inspiration to an under-served and diverse audience across the globe that inspires Raphael. He broke the mould on what an international reporter looks like, sounds like and has as a background. He is proud of the fact that in doing so, he inspires others.  Hopefully, by listening to this conversation, you will have an appreciation for the changes that can help make a difference in the everyday lives of inmates around the world. You'll also understand how someone who was imprisoned for a crime he didn't commit leveraged the power of the media to ultimately get out. Enjoy our conversation! Highlights Perspective: People's perceptions were changing when they watched something like Inside the World's Toughest Prisons. In making the documentary, Raphael took on the persona of a prisoner so he was treated like a prisoner. They approached everything with a nonjudgmental attitude and allowed things to play out as they discovered them.  Persona: Having to deal with the threat of violence, whether physical or emotional, shapes the person you become. It becomes a part of your personality to the point you develop a skill set, understanding and an awareness of everything and everyone around you. Skill set: The 12 years he spent in prison has armed him with a number of skill sets he's able to deploy. He has picked up on the threat and has been able to defuse that in real time. So he's still very tuned into that and aware of where the danger is coming from and how to deal with it. Mindset: It starts and ends in the mind. It's all about the shift in the mind. It's as if he was opening a box that is locked in his mind that prepares him for any eventuality.  Demeanor: Even the way you walk can give off a sense of fear. And they can control, manipulate, intimidate, especially the most vulnerable. They can see that, if not smell it or taste it. And so, it's about the way you carry yourself in that environment. Empathy: Raphael asks prisoners from the perspective of empathy and he allows them to tell their story without judging them. Whereas the authority figures or therapists are seeking particular answers to particular questions because they have a way of assessing prisoners to figure out the means to an end.  Persistence: He felt there was something deep inside him that was so angry, and so twisted and so bitter, that kept him going. Hope: Raphael had this deep belief from the moment he was arrested that he had some hope to cling onto. Whether it was as simple as a letter telling him that something was about to change. Or a visit from one of his family members, or a letter from a stranger telling him they believe in him.  Journalism: The media played a significant role in his wrongful convictions. But he also needed the media to tell people he was innocent. In prison, Raphael spent the time understanding the media put him in good stead to become a real journalist when he left prison. Resources: Where there is an opportunity, prisoners do and should take those opportunities to look after themselves and prepare to stand up for themselves. The resources are available as well as the courses and the training provided by the prison service.  Change: Prisoners have to choose to make those decisions for themselves. The individual has to want to change. They have to break free of whatever it is that got them into their situation.  Empathy: People need to be more empathetic with prisoners for them to understand what it is that will make that individual make the decision that they want to change. Choice: Wherever you are in whatever prison in whatever country, whatever resources, whatever training, whatever you are prepared to put in front of the prisoner, unless that prisoner is prepared to change their own life, none of it makes any difference. Support: As a family member of a prisoner, we need to listen. Listen when you're least expected to hear something instead of giving them a lecture. Then try to implement something subtly that can bring about a change in their character or in their personality. Creativity: Raphael decided the media was not his enemy and he leveraged the media to get out of jail. What are the things in your life right now that you feel challenged by? Reimagine the way you perceive different entities and forces in your life to turn them for good. Curiosity: Raphael is asking questions to uncover what might be some sustainable ways to help everyday prison life be easier. Is there something you want to build or start? take cues from what makes you curious and investigate.  Courage: Raphael held on to his innocence while in prison. He was 100% invested in his own self-preservation so that he could ultimately get out of prison and reclaim his innocence. Is there a place in your life where you can be more courageous pertaining to something that matters but not everyone would agree on? Two of the greatest bastions of British journalism. Born and brought up in south-east London, my tone, style and accent was different to that normally heard on the flagship Today programme and caused an immediate stir in 2001 amongst the traditional Radio 4 audience. For many, the Manchester Arena Islamic terrorist attacker, that took place on May 22nd 2017, was both shocking and devastating. More so for the 22 victims who lost their lives, and those who barely survived with their lives. Two of these survivors were Martin Hibbert and his 13 year old daughter Eve. Martin was left with 22 pieces of bomb shrapnel in his body, and paralysed from the waist down. Eve was struck in the head with a bolt. Somehow they both survived. Martin has used his incredible strength and mental resilience to push forward, and inspire others. He now trains for the climb up Mount Kilimanjaro, raising money for the Spinal Injuries Association. It affects people from black, white and asian and ethnic communities. It happens to the rich and poor. It is not a social class issue. And stories like Stuarts need to be shared in an attempt to prevent others becoming victims or perpetrators.
