Smith has been helping people for many years and in his upcoming book he has a lot to say about the healthcare system in America. I was so honored to speak with him about his wisdom and insights into why many doctors are not trained in how to help those with mental health challenges. We get into what the problem is and some ideas on how we can fix it.  Dr. Robert C. Smith BIO: Robert C. Smith, MD, MACP is a University Distinguished Professor and a Professor of Medicine and Psychiatry Emeritus at Michigan State University, East Lansing, MI, USA. With many publications, awards, and strong grant support, he has been involved in teaching and research in patient-centered communication and in primary care mental health since 1985. He and his colleagues defined the first evidence-based patient-centered interview, now published in a popular interviewing textbook, Smith's Patient-Centered Interviewing: An Evidence-Based Method (4th edition, McGraw Hill, 2018). It is used in medical, nursing, and other health care schools in the USA and abroad for teaching interviewing and the doctor-patient relationship. Dr. Smith's group also identified the first evidence-based method, the Mental Health Care Model, to guide primary care clinicians in managing mental health and substance use problems. Essentials of Psychiatry in Primary Care: Behavioral Health in the Medical Setting (McGraw Hill 2019)resulted and is widely used to teach primary care mental health. Racism in the United States as well as other countries continues, not just through overt public discourse, but also in its overall system - in housing, banking, schooling, policing, etc. These policies especially affect African-Americans, as well as indigenous people and other people of colour. As Dr. Robert C. Smith, professor emeritus of political science at San Francisco State University explained in his 2010 book Conservatism and Racism, and Why in America They Are the Same, policies that racially discriminate at ground level have found a home in the last half century in the Conservative movement. This has been their means of winning elections and supporters, from Barry Goldwater to Ronald Reagan, from Richard Cheney to Donald Trump. Even progressives have supported policies that end up hurting African-Americans and other minorities in the USA. It's not just what you say, but the end result of your actions that can constitute racism. And after decades of conservative policies on housing, jobs, policing, incarceration, the war on drugs, etc. have disproportionately impacted African-Americans. Can this ever change? Kennedy, Barack Obama and the Politics of Ethnic Incorporation and Avoidance, What has This Got to Do With the Liberation of Black People?: The Impact of Ronald W. Walters on African American Thought and Leadership and Polarization and the Presidency: From FDR to Barack Obama. He is former associate editor of the National Political Science Review and general editor of the State University of New York Press African American Studies series. He has taught African American politics and American government for more than thirty-five years. Professor Smith is co-author of a leading textbook in the field (American Politics and the African American Quest for Universal Freedom) and the Encyclopedia of African American Politics. He is currently writing a biography of Ronald Walters, his mentor and longtime Howard University professor who he argues is the most consequential African American political scientist of the last half century. Robert C. Smith, MD, MACP is University Distinguished Professor and a Professor of Medicine and Psychiatry at Michigan State University.  With many publications, awards, and strong grant support, he has been involved in teaching and research in patient-centered communication and in primary care mental health since 1985. Dr. Smith has been featured on The Today Show as well as interviewed and quoted in the Wall Street Journal, the New York Times, the Los Angeles Times, Elle, the Ladies Home Journal, Time, and Newsweek. The topics have included training doctors to establish better doctor-patient relationships, chronic pain, unexplained physical symptoms, and mental health problems in medical settings. Dr. Smith and his colleagues have written one of the most popular interviewing textbooks, Smith's Patient-Centered Interviewing: An Evidence-Based Method (3rd edition, McGraw Hill, 2012); the 4th edition, published July 2018, as well as a second textbook, Essentials of Psychiatry in Primary Care:  Behavioral Health in the Medical Setting. Think back to the last time you were in the room with a patient. Were you listening for emotional information? If you need to strengthen this muscle, keep listening. Because today, Dr. Robert C. Smith teaches us the utter importance of stopping—and listening. As Dr. Smith explains, diseases are not just physical ailments: We must also recognize and address the psychological impacts of them as well. On that note, Dr. Smith also reiterates the necessity of a health work/life balance. As physicians, we need to develop interests outside medicine. We also need to find support from empathetic people (because we need to be listened to, too). Finding ways to reawaken our emotional intelligence and humanity will find its way back into the hospital—for the better. Pearls of Wisdom: 1. In order to develop a stronger learner-teacher relationship, the key is listening for emotional information. We must address the psychosocial components of disease, not just the disease itself. (Remember NURSE: Name it, Understand it , Respect it, Support it, and be Empathetic) 2. Maintain a healthy work/life balance: To prevent burnout, we must have other interests outside of work, and we must make time for ourselves. 3. Anticipate challenges. And when faced with those challenges, approach them with an open mind, and consider the psychological components and impacts of each situation.

Should You Have Armed Security at Your Venue? Robert and Manny discuss this sometimes challenging and controversial topic. We find that the trend in the industry is that things are getting more violent for bar and club owners. Are you thinking about hiring an armed guard? What are some of the reasons to consider hiring an arm guard for your venue? If you decide to hire arm guards what are some of the things you should do and think about? Shout-outs! Kudos to Sara Berns, Executive Director of Discover Pacific Beach and Chair of the Pacific Beach Hospitality Task Force, for her work on implementing a new program in which local bar and nightclub security guards wear day-glow vests at closing time. This gives the perception of a common force and allows the local police department to easily identify the guards when an incident occurs. In The News Two men shot by security guards in Dorchester, South Carolina nightclub parking lot After suspects of firing shots in the club parking lot were asked to put their weapons down and refused, two security guards opened fire on the suspects. One of the suspects was hospitalized with a gunshot wound and the other refused medical attention after a gunshot grazed his leg. Today’s Topic  Should You Have Armed Security at Your Venue? One question Nightclub Security Consultants gets asked quite often in whether or not a bar or club should hire armed security. It is a delicate matter that cannot be taken lightly. There are quite a few considerations when making the decision. Also, is it the best decision, or, is there something else a venue should be doing first before entertaining the idea of hiring armed guards? There are huge liability issues that come associated with hiring arm guards.   If you do have armed guards or are considering hiring armed guards here are some considerations.  1.    Do local and State laws permit armed guards in an alcohol service business? 2.     What are the training and certification requirements for armed guards? 3.     Is the company you are hiring the guard from reputable and in good standing? 4.     Has the guard been properly vetted? 5.     Is the guard legally licensed to be an armed guard? Check with the proper enforcement authority to make sure the guard is carrying a valid license. 6.     Perform an independent background check on the guard with a reputable company like InteliCorp.net 7.     Perform reference checks on the guard. 8.     Interview the guard to make sure he will work well with you and your existing security team. 9.     Make sure you insurance policy allows for armed guards. Today’s Topic  Dress Code for Your Venue We discuss some important considerations when it comes to a dress code for your bar or nightclub. Be smart about it and avoid policies that will create more issues than they will solve. Be consistent with your policy and avoid making “exceptions”. Have a written policy at the entrance for the guest to see - otherwise they may think you are just making it up as you go. Also, make sure your staff is training when it comes to discrimination and civil rights issues surround guests attire – for example religious attire.    In The News! Follow up: Portland Bouncer Brian Rizzo shot when suspect returned with gun after being ‘snubbed’ at the door. – Robert and Manny follow up on the recent story where the Rizzo’s co-worker followed the suspect into the parking lot and shot him with a concealed pistol he had been carrying. Fatal shooting at Las Vegas club raises questions about security, gun polices.  Robert and Manny discuss recent news story of a fatal shooting at Drai’s After Hours nightclub at Bally’s in Las Vegas that left one dead and two wounded. A patron began shooting at guards after asking for his cover charge to be refunded. Patron assaulted at South African nightclub and suspect post the video on his Facebook page. The shocking video appears show an “employee” assaulting a guest who was accused of doing drugs in the clubs bathroom. The suspects post read “When u do drugs where I work”. The Club denies that the suspect was an employee even though he had access to the video. According to Yahoo News/Mail & Guardian post, the suspect was a backup bouncer. Today’s Topic What can I start doing today to limit my liability? There are actions you can take today to begin to limit your liability as an operator or doormen.  Robert and Manny give you several tips on thinks you can start doing immediately.  Specifically, the follow steps are guidelines to actions you can take today!  §  Do a self-assessment of your venue – What are you doing proactively to limit liability. What policies, procedures, and systems are in place to limit your liability and increase safety?  What is being overlooked? Try to approach it with a new set of eyes to see the things you might miss because you may suffer from tunnel vision as the operator. §  Plan and hold a mandatory all staff meeting – Raise the awareness of your staff and layout a plan for changes to take place. Invite the feedback from your team to increase buy-in to changes. Have one-on-one meetings with you team to get feedback can help the process, give you creative ways to solve issues and/or create new ways of doing things, and facilitate participation.  §  Change your hiring practices – Plan ahead! Don’t hire just to hire a warm body in a rush. Have a comprehensive interview and hiring process. Do background checks and make sure the individuals are qualified and capable to protect your business.  Make sure you call references. Always document your hiring process so you can demonstrate to the courts that you have good hiring practices. §  Change/develop good habits in your business – Implement and live by your policy and procedure manual.  Violating your own policies and procedures can hurt you in court.  Develop good daily habits. Have regular and consistent routines for each shift – the beginning of, then end of, and in-between.  All good sport-teams run the same drills every day to keep them sharp and on top of their game.  Create proactive habits with your team to limit/eliminate potential liability issues.   §  Implement a comprehensive documentation policy – If you didn’t write it down it didn’t happen! To reduce your liability you need to have good (even great) documentation practices. Make sure you document employee meetings, trainings, and general business. Always document minor and major incidents. The more you document the better your defense if a lawsuit arises.  The intensity of the documentation needs to match the intensity of the incident. §  Training, training, and more training – This is the number one thing an owner can do to limit liability. Develop and implement regular and on-going training program. Make sure to document your training, it can serve as a good defense if need be.  Utilize proven training material to reduce time, effort and costs associated with training.  Nightclub Security Consultants has full in-person and online training available If you are in California all guards who are in contact the public, wear a distinctive uniform, and do not carry a weapon are required to have a California Proprietary Officer License.  Check out our on-line training program on our website. Remember that awareness of the potential liability is half the battle! You then need to take steps to limit the potential for liability. You can never completely eliminate liability, you can never close the window completely, but you can reduce it greatly with proactive and forward thinking.  Lawsuits will happen in our business, how prepared will you be to fend off or fight these lawsuits.  Don’t wait. Get started today! In this week’s show, Robert C. Smith and Manny Marquez discuss the important topic of Nightclub and Bar Civil Liability, a topic that many of us don't think about until we are in the midst of a lawsuit or litigation. Liability – What is it and how can it effect you? Bottom line, liability affects everyone in the nightclub and bar industry - owners, operators, managers, bartenders, bouncers, security, kitchen staff, and everyone in between.  If you own a bar or work at a bar, you need to be thinking about civil liability and taking measures to protect yourself.  Attorneys, insurance providers, law enforcement professionals, and other stakeholders will also benefit from the important information covered in today's episode. Specifically, today's episode will focus in on: What are the different types of liabilities? We'll discuss criminal, administrative, and civil liability as well as how you can be held liable for both actions you take and actions you didn't take. When do you become liable? Your business is exposed to liability at all times, even when your doors are closed. What is the spectrum of liability? From a slip and fall on a lime wedge all the way to a death or shooting. What are some examples of law suits that have led to high dollar settlements or judgments?  We'll discuss a lawsuit involving a patron being kicked out, sneaking back in bar, and falling; which resulted in a $200,000 settlement. Additionally, we will talk about a lawsuit involving an intoxicated guest when driving out of club parking lot, hit a club employee. The jury awarded $10 million to family of deceased in this case. Liability – How Exposed Are You? In the second part of the episode, we will focus in our your "window of liability" and how to assess how open your "window" is? Questions covered will include: Can you ever close that window of liability completely? No! Learn why. What is the concept of "Reasonable Care"? Robert explains things you should do to reasonably protect your patrons and how a court views this concept. What is the National Industry Standard? The National Industry Standard is defined by the venues, national chains, industry associations, and legislation. What does the phrase “shock the conscious of the court” mean? An act so egregious it shocks the jury of a court. What is the life cycle of a typical civil lawsuit? Robert discusses the full cycle of a lawsuit starting with the time of the event all the way until you are presented a lawsuit. What is the spectrum of operators? Robert discusses the operators who are doing it right and limiting their exposure, as well as the ones who are overtly negligent and have the highest liability exposure. Who is responsible for managing the risk of liability? It is a risk that needs to be managed from the top down and requires a buy-in at all levels of ownership and management.  Starting with the top – ownership!
