Ep. 135 (Part 1 of 2) | Criminal justice professor and constitutional law expert Mark Fischler does a brilliant job of deepening our understanding of the challenges facing our democracy, our legal system, and our public morality. How did the democratic process and the values it represents—equality and liberty for all—come to be teetering on the brink? Mark illuminates the fact that the Constitution is not a set-in-stone document, but eminently open to interpretation, and explains that its interpretation is a direct reflection of the worldviews of the Supreme Court justices. In fact, the whole process of democracy needs to be aligned with a certain level of development in order to deliver. Mark points out that democracy hasn't served all of us, and urges us to explore who and in what ways it has failed, that we may work to correct its flaws and continue to uphold and expand the values foundational to democracy to include respecting and protecting the rights of all beings.Mark contrasts the moral integrity of revered public figures such as Socrates and Dr. King, who honored the rule of law despite that it went against their own self interest, with the disregard for the law so prevalent among political figures today, and points out that democracy can be subverted not only by malicious intent, but also by misplaced idealism—when people feel that supporting a charismatic leader or ideology is more important than supporting the principles of democracy. With regard to the Trump trials, the question arises, is any human above the law? Mark also shares where he finds hope—in his own university students with their openness to a deeper ethical understanding and responsibility and willingness to undertake civic action. Mark urges all of us who care about democracy to become engaged now. His wise, integral, highly informed insights about the current state of the legal system and of democracy, here and around the world, are revelatory, alarming, and inspiring in turn. Senate Minority Leader Mitch McConnell was asked this week about Supreme Court Justice Alito having an upside-down US flag at his house. The longtime symbol of distress has been co-opted by the “Stop the Steal” activists pushing the idea that President Biden somehow stole an election despite no evidence to back it up. McConnell had words for a few Republicans who have criticized the move. There's no shortage of coverage of the disastrous train derailment in East Palestine, OH. But what's really missing is the context of why, how and amazingly how predictable and therefore avoidable the whole catastrophe was. Hint: corporate profits over safety and worker's rights.  Over the pond, it looks like the US crippled Germany's energy infrastructure for no reason. The hopes that the US bombing of the Nordstream pipeline (which corporate media is rabidly eager to discredit) would tank Russia's economy has now instead opened up new partnerships possibilities with China as the two massive economies have agreed to a gas pipeline from Russia to China. All the while, Germans are freezing in the midst of an energy crisis forced upon them by the US, and keeping sychophantically mum about it.  A massive march in Madrid highlights the importance of universal healthcare, and of course why US media won't touch that story.  PLUS Satan and Supreme Court Justice Alito have a new abortion clinic, new details on US involvement in Haitian president Moïse's murder, and Lee's latest Most Censored News!    leecamp.net

Supreme Court Arguments to Overturn Roe v Wade

Historic Voices Podcast: Global History and Culture

Play Episode Listen Later Sep 8, 2022 118:14

S04-E01 We feature the oral arguments made before the U.S. Supreme Court regarding overturning the previous Roe v. Wade abortion rights ruling from decades ago. You hear the lawyers for the two sides and questions made by some of the Supreme Court Justices. Due to the complexity of the issues, these arguments lasted nearly two hours. A quick summary of the case: In 2018, Mississippi passed a law called the “Gestational Age Act,” which prohibits all abortions, with few exceptions, after 15 weeks' gestational age. Jackson Women's Health Organization, the only licensed abortion facility in Mississippi, and one of its doctors filed a lawsuit in federal district court challenging the new law and requesting an emergency temporary restraining order. This case was eventually appealed up to the U.S. Supreme Court. The legal question was this, Is Mississippi's law banning nearly all abortions after 15 weeks' gestational age unconstitutional? By a decision of six to three, the majority opinion of the U.S. Supreme Court was that the Constitution does not confer a right to abortion; Roe v. Wade, 410 U.S. 113, and Planned Parenthood of Southeastern Pa. v. Casey, 505 U.S. 833, are overruled. Justice Samuel Alito authored the majority opinion of the Court. He concludes his opinion of the court by stating that “We end this opinion where we began. Abortion presents a profound moral question. The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion. Roe and Casey arrogated that authority. We now overrule those decisions and return that authority to the people and their elected representatives.” In other words, the Supreme Court ruling did not outlaw abortion, it stated that abortion is regulated by each of the fifty states through their state governments and their elected officials. Justices Breyer, Sotomayor, and Kagan dissented from this decision. Due to the complex nature of the topic of the Supreme Court case, I provide several PDF documents in addition to this audio episode: First, a transcript of the oral arguments by the attorneys for each side along with the questions made by several of the justices. This is 115 pages. Second, a document called the Syllabus which contains the majority opinion by Justice Alito, a concurring opinion by Justice Roberts, and the dissenting opinions of Justices Breyer, Sotomayor, and Kagan. Alito's opinion begins on page 1 of this 213-page document. The dissenting opinions begin on page 148. Third, an overview of Roe v. Wade which was one of the previous abortion cases that were overturned by this current verdict. Fourth, an overview of abortion in the U.S. that also provides information for each state. Fifth, a biography of Supreme Court Justice Alito who wrote the majority opinion for the court on this case. In this episode, we dissect the Supreme Court's leaked ruling to overturn Roe vs. Wade and we gotta fill you in about the British Judge that Supreme Court Justice Alito cites in his draft...this guy is right up there alongside Christopher Columbus in terms of "most awful guy in the World." You've heard of the Salem Witch Trials? Yeah, they were modeled after what he did. Get read for a real dose of rage, Broads (we're feeling it with you), and so is one television host who righteously loses it on the air. Buckle up. Equality for everyone is a core American value, enshrined in the constitution. So is freedom of religion. What happens when they come into conflict with each other? This month, our guest, the eminent civil rights attorney Jennifer C. Pizer of Lambda Legal, continues her conversation with OutCaster Isha about religious liberty and how it can conflict with another constitutional guarantee, equality. In this episode: religious belief, religiously motivated behavior, and the golden rule; Supreme Court Justice Alito's fiery and controversial speech about religious liberty to the Federalist Society; the claiming of victimhood by religious people when civil rights laws don't allow them to discriminate; and considering the expansion of the Supreme Court and the lower federal courts to restore balance.

What You Need To Know is today is an Important day! Texas Republican attorney general, Ken Paxton, announced a lawsuit in the U.S. Supreme Court to invalidate presidential election results in four key swing states that helped secure Democrat Joe Biden’s victory over President Donald Trump. Republicans and of course liberals have come out saying that this case shouldn’t be taken up. Texans have a good voting system, ballot counting was done correctly and they aren’t going to let the corruption from other states dictate what happens in Texas. Why isn’t every attorney general from every state jumping in to support this lawsuit?! Also, check out StopTheSteal.us and JerichoMarch.org and see how you can get involved. Both groups have been seeing huge crowds coming out to support President Trump and to pray for our nation! Dr. Ted Malloch, author and frequent contributor for AmericanGreatness.com, Is hoping Supreme Court Justice Alito will take on the court case involving Pennsylvania and that justice will be done. Dr. Malloch explains that there was enough evidence of potential voter fraud before the election even took place and Democrats even bragged about it. Why weren’t the 300 Republican lawyers ready to go before it all happened? Check out TedMalloch.com. Dr. Brett Decker, writer, author and professor at Defiance College, explains that part of the danger is that the Republican establishment is not getting into the fight, they are already going public saying that they think the election is over. What’s encouraging is that in the flyover states are seeing more Trump signs out than ever before in protest! What You Need to do is remember we are in a three front battle for 1. The Law 2. Factual information and 3. The Constitution. The update from these fronts is good! We are seeing men like Texas Att. Gen. Ken Paxton coming out to fight against the election corruption! And we need to stand with him. Also, be sure to check out JerichoMarch.org.See omnystudio.com/listener for privacy information.
