He says this way of communicating is “the chef's kiss.” So, besides the insights here that follow being relevant in and of themselves, there's also some lessons just in how those issues are teed up and communicated that we all can learn from. CEOs and CFOs … hey, this show is for you. Let's start here: What do all of these numbers have in common: $140,000, $3 million, $35 million, and $3 billion? These are all actual examples of how much employers, unions, and some public entities saved on healthcare benefits for themselves and their employees. The roadmap to saving 25% on pharmacy spend and/or 15% on total cost of care in ways that improve employee health and satisfaction always begins when one thing happens. There's one vital first step. That first step is CEOs and/or CFOs or their equivalents roll up their sleeves and get involved in healthcare benefits. Why can't much happen without you, CEOs and CFOs? Here's the IRL: In 2023, the healthcare industry has been financialized. There is a whole financial layer in between your company and its healthcare benefits. And unless the C-suite is involved here and bringing their financial acumen and organizational willpower to the equation, your company and your employees are currently paying hundreds of thousands, maybe millions, of dollars too much and doing so within a business model that deeply exacerbates inequities. There are people out there who are very strategically taking wild advantage of a situation where CEOs/CFOs fear anything to do with healthcare in the title and don't do their normal level of due diligence. You think it's an accident that this whole space got so “complicated”? HR needs your help. Bottom line, if you are a CEO or CFO and you do not know everything that Mark Cuban and Ferrin Williams talk about on the pod today … wow, are you getting shellacked. Mark Cuban uses a different word. Healthcare benefits are, after all, for most companies the second biggest line-item expense after payroll. But don't despair here, because all of this information is really and truly actionable. Others out there are cutting zeros off of their spend and actually doing it in ways that are a total win for employees as well. My guest today, Mark Cuban, is a CEO, after all; and when he looked into it, it took him T-minus ten minutes to figure out just the order of magnitude that his “trusted” benefits consultants and PBM and ASOs (administrative services only) and others were extracting from his business. He pushed back. So can you. But just another reason to dig into that financial layer wrapping around your employee health benefits right now, you might get sued by your employees. Below is an ad currently being circulated on LinkedIn by class action attorneys recruiting employee plan members to sue their employers for ERISA (Employee Retirement Income Security Act of 1974) violations. It's the same attorneys, by the way, from those 401(k) class action lawsuits. I've talked to a few CEOs and CFOs who are scrambling to get ahead of that. You might want to consider doing so as well. Now, for my HR professional listeners, considering that some of what Mark Cuban says in the pod that follows is indeed a little spicy, let me just recognize that the struggle is real. There are multiple competing priorities out there in the real world, for sure. And bottom line, because of those multiple competing priorities out there in the real world, it's really vital that everybody work together up and down the organization in alignment. Lauren Vela talks a lot about these realities here in episode 406. This is a longer show than normal, but it's also like a show and a half. Mark Cuban talks not only about his work with Mark Cuban Cost Plus Drugs, which is a company that buys drugs direct from manufacturers and sells them for cost plus 15%, a dispensing fee, and shipping. It's kind of crazy how so often that price is cheaper, sometimes considerably cheaper, than the price that plan members would have paid using their insurance—and the price that the plan is currently paying the PBM. SERIES 2 EPISODE 78: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: The democracy will certainly not survive Donald Trump but I am now wondering if it has any chance of surviving Sarah Wallace, Patricia Millett, Cornelia Pillard, and Brad Garcia and if you don't know who they are, they are the latest people on the latest list of supposed liberals and supposed officers of the court who could get us all KILLED. Millett seems to be the most clueless of the three DC Appeals Court dilettantes who first STAYED the gag order issued against Trump in the Election Subversion case and then yesterday conducted the in-person hearing and all but announced that they WILL significantly limit the order because apparently when Trump starts ignoring laws he doesn't like and jailing judges he doesn't like, these idiots somehow think they will be immune because they were so fair to him back there in November 2023. Judge Millett seemed to base her nitwitted reaction to the two hours of oral arguments on the impact of the gag order on…presidential debates. “He has to speak ‘Miss Manners' while everyone else is throwing targets at him? It would be really hard in a debate, when everyone else is going at you full bore. Your attorneys would have to have scripted little things you can say.” Miss Manners. Trump has to speak ‘Miss Manners.' Do you get the same feeling I do that Judge Millette has no earthly clue WHO Dementia J. Trump is? Do you get the OTHER same feeling that I do that it has not occurred to, and will NEVER occur to, Judge Millette that so far there have been THREE presidential debates in the Republican primary and Trump hasn't shown up to any of them and there is no reason to expect he'd have the guts to show up to one in the general election. And THEN there is Judge Sarah Wallace and I'm not sure she didn't even harm the country MORE than Judge “Miss Manners” and Judge “I Would Assume” did. Judge Wallace heard the 14th Amendment disqualification case and at the same time that she ruled quote “that Trump incited an insurrection on January 6, 2021, and therefore ‘engaged' in insurrection within the meaning of Section 3 of the 14th Amendment” she then superseded the Amendment itself in as remarkable an act of judicial cowardice as I've ever seen. “After considering the arguments on both sides,” wrote Judge Wallace, “the Court is persuaded that ‘officers of the United States' did not include the PRESIDENT of the United States. It appears to the Court that for whatever reason the drafters of Section 3 did not intend to include a person who had only taken the Presidential Oath,” unquote. So she ordered him onto the Colorado primary ballot instead of saying “Yeah, I'm thinking they meant to include PRESIDENTS because otherwise having just survived the Civil War they decided to make sure Jefferson Davis and Robert E. Lee and Nathan Bedford Forrest could NOT run for anything EXCEPT President of the United States rather than showing some guts, Judge Wallace folded. The people who could DO something and they actually divide into two categories and two categories ONLY: Judges who are too effete to do anything and judges who are too scared to do anything. Below is an ad currently being sent around on LinkedIn by class action attorneys recruiting employee plan members to sue their employers for ERISA (Employee Retirement Income Security Act of 1974) violations. It's the same attorneys, by the way, from those 401(k) class action lawsuits. I've talked to a few CEOs and CFOs who are scrambling to get ahead of that. You might want to consider doing so as well. Now, for my HR professional listeners, considering that some of what Mark Cuban says in the pod that follows is indeed a little spicy, let me just recognize that the struggle is real. There are multiple competing priorities out there in the real world, for sure. And bottom line, because of those multiple competing priorities out there in the real world, it's really vital that everybody work together up and down the organization in alignment. Lauren Vela talks a lot about these realities here in episode 406. This is a longer show than normal, but it's also like a show and a half. Mark Cuban talks not only about his work with Mark Cuban Cost Plus Drugs, which is a company that buys drugs direct from manufacturers and sells them for cost plus 15%, a dispensing fee, and shipping. It's kind of crazy how so often that price is cheaper, sometimes considerably cheaper, than the price that plan members would have paid using their insurance—and the price that the plan is currently paying the PBM. Most Relentless Health Value Tribe members (ie, regular listeners of this show) will already know all that, but what is also fascinating that Mark talks about is what he's doing with his own businesses and the Mavericks on other fronts, like dealing with hospital prices. In this show, we also talk the language of indie pharmacies, fee-only benefits consultants, TPAs (third-party administrators), PBMs, and providers doing direct contracting. There are, in fact, entities out there trying to do the right thing; and Mark acknowledges that. Ferrin Williams, PharmD, MBA, who is also my guest today, is chief pharmacy officer at Scripta and an expert in pharmacy benefits. She adds some great points and some context to this conversation. Steve, there's been a lot in the news recently about interest rates and refis and how that's affecting the country, the industry, and everything that goes along that. I remember in the past, people say, well, interest rates are high people tend to, instead of sell, they do repairs and additions and upkeep and stuff. But I don't know where we are right now with that number. If it's a number that we're going to see smooth out soon, will Powell do that? Or will we continue down this road? Joining us right now is Kevin Lyons. Kevin is the CEO of Anchor Funding and old friend of mine. I've known Kevin for a long time, and he's nice enough to join us here with Steve Moskowitz on Practical Tax. Kevin, hello. Steve Moskowitz: He doesn't look very old, Chip. Chip Franklin: Your right. Kevin Lyons: Thanks Steve. Chip Franklin: Hi you Kevin. How are you? Kevin Lyons: Good guys. How are you? Steve Moskowitz: Great. Chip Franklin: Good. Let's just jump right into this. We've known each other a long time and we've spoken over the last 15 years and we've seen interest rates go up and down. Let's talk about where we are right now. And how do you feel people responding to the higher interest rates? Again, those of us who live in the '70s like Steve and I, they don't seem that high. But how are people responding to you right now when you're talking about everything from new mortgages to refis? Kevin Lyons: Well, we've had a really good run the last few years. So everyone's taken advantage of incredibly low interest rates. But if you look at interest rates over the course of time and you guys obviously remember, and so do I, and any viewers watching. Rates in the '80s and '90s and early 2000s were a lot higher. So when you go from rates in the- Steve Moskowitz: I remember in the 20% bracket. Kevin Lyons: Yeah, exactly. When you got 15% and 10%, that was a good rate. So the sticker shock that's come into play is rates in the twos and threes suddenly becoming fives and almost as high as 6%. So anytime you get that, you're going to get a change of scenery and the scenery's changed. However, it looks pretty good for the long term. Chip Franklin: Yeah. We're both all in California, all three of us. And here's something that always occurred to me. So people might put off buying because the rate went up a little bit, but the housing market doesn't seem to be slowing down at all and it's continuing to move. Does it make sense to still buy at a little bit higher rate to offset the increase in the value in cost of homes as they go forward? Kevin Lyons: That's a very interesting question, and we have that conversation pretty much daily. My personal opinion is yes. And the reason I say that is, and this is obviously my two cents, the Fed has done a really good job of raising rates really quickly, in fact, there's a three quarter point high coming up shortly and another half a percent in November, they've taken such extreme measures in such a short period of time...

He describes how he followed Glamorgan and talks about some of the players he remembers watching including, Gilbert Parkhouse, Bernard Hedges, Don Shepherd, Alan Watkins, Peter Walker and Ossie Wheatley.Phil Clift was the coach of Glamorgan at the time and Kevin was invited to go to nets in Cardiff and Neath. Kevin talks about his experiences in the Glamorgan 'Club and Ground Team'. He also mentions his experiences on the Lords Grounds staff. Kevin Lyons began his career at Rutgers University in 1988 as director of procurement working on numerous projects and proposals relating to green purchasing and improving contracts, transforming the way the university did its daily business, from lighting and energy management to waste recycling and contract packaging. Early in his career at Rutgers, he successfully took on a multi-year initiative to improve the university's efficiency and effectiveness while incorporating environmental values.His concern in purchasing has been to consider the ethical implications: Where do products come from? What impact are they having on the university? Is the school buying local?
