How Singapore intends to settle noise disputes more effectively. Synopsis: Every second Monday of the month, The Straits Times takes a hard look at Singapore's social issues of the day with guests. Settling noise disputes will be easier with mandatory mediation as the Community Disputes Management Framework (CDMF) is enhanced, under the Community Disputes Resolution (Amendment) Bill.  Involved with how the framework can be enhanced is grassroots leader Raymond Poh. In this episode, Lynda Hong and co-host Christie Chiu speak with him to hear about his 14 years of experience in dealing with noise disputes, and how mediation has been effective in resolving disputes between neighbours (with an 80 per cent success rate with voluntary mediation cases). Mr Poh also shares how the Community Advisory Panel's (CAP) recommendations, along with the proposed CDMF enhancements, may help neighbours better understand one another and find middle ground.  The authorities also intend to allow the Housing Board to consider compulsory acquisition of flats as a deterrent and “the absolute last resort for severe, recalcitrant nuisance-making”. This measure will be considered only when all other levers have failed, and acquisition is needed to protect the interests of other residents, the Ministry of Culture, Community and Youth and the Ministry of Law and Ministry of National Development said in a joint statement in August, adding that this will be similar to how HDB can consider compulsory acquisition of flats for those convicted of throwing killer litter under the Penal Code. Suspicion of Fraud Cannot Support Qui Tam Action Post 4770 Richard Campfield, suing for the State of California, appealed the trial court sustained the demurrer of defendants Safelite Group, Inc. and its subsidiaries, Safelite Solutions LLC and Safelite Fulfillment, Inc. (collectively, Safelite) without leave to amend. Campfield contends he adequately alleged a cause of action under the Insurance Fraud Prevention Act (Ins. Code, § 1871 et seq.) (IFPA) within the statute of limitations. In State Of California, ex rel. Richard Campfield v. Safelite Group, Inc., et al., A168101, California Court of Appeals, First District, Fourth Division (March 29, 2024) explained the requirements to plead a Qui Tam action under the IFPA. Campfield owns a windshield repair company that licenses and sells products for repairing vehicle windshield cracks. Safelite is the nation's largest retailer of vehicle glass repair and replacement services. Safelite also serves as the third party administrator for over 175 insurance and fleet companies, including 23 of the top 30 insurers in California and the country, for processing and adjusting policyholders' vehicle glass damage claims, and it has direct electronic access to over 20 insurance company databases. In 2015, Campfield sued Safelite in federal district court in Ohio, alleging Safelite's continued reliance on its six-inch rule violated the Lanham Act's (15 U.S.C. § 1051 et seq.) Safelite admitted in responses to interrogatories in the Ohio action that it has never conducted studies on the safety or viability of repair of cracks longer than six inches. Campfield filed under seal the complaint in the present action against Safelite, alleging a single qui tam cause of action for violation of the Insurance Frauds Prevention Act (IFPA). The Insurance Commissioner and the San Francisco County District Attorney declined to intervene, so in September 2022 the trial court unsealed the complaint. Safelite demurred, arguing, among other things, that the complaint failed to allege facts constituting a cause of action under the IFPA. Campfield failed to plead his claim with sufficient particularity, and the statute of limitations barred the complaint. After briefing and a hearing, the trial court sustained the demurrer without leave to amend based on the statute of limitations and noted that Safelite had raised "substantial arguments" that the complaint had not stated a cognizable claim and that the action was barred by the IFPA's public disclosure bar. The trial court then dismissed the action. The IFPA was enacted to prevent automobile and workers' compensation insurance fraud in order to, among other things, significantly reduce the incidence of severity and automobile insurance claim payments and therefore produce a commensurate reduction in automobile insurance premiums. The sole cause of action in the complaint is based on Insurance Code section 1871.7, subdivision (b), which allows for the imposition of civil penalties and other remedies against anyone who violates Insurance Code section 1871.7 or Penal Code sections 549, 550, or 551. Campfield alleges Safelite violated Penal Code section 550, subdivision (b)(1) and (2). As in any action sounding in fraud, an IFPA action must be pleaded with particularity. To effectively state his IFPA cause of action, Campfield must allege facts showing that Safelite presented, or caused to be presented, a false statement as part of, or in support of or opposition to, a claim for payment or other benefit pursuant to an insurance policy or prepared or made a false statement intended to be presented to any insurer or any insurance claimant in connection with, or in support of or opposition to, any claim or payment or other benefit pursuant to an insurance policy. --- Support this podcast: https://podcasters.spotify.com/pod/show/barry-zalma/support

On the 17th of January, the producer and director of locally-made film Mentega Terbang, Tan Meng Kheng and Khairi Anwar Jailani, were charged under Section 298 of the Penal Code for ‘hurting religious feelings', a blasphemy provision. The charge carries a punishment of up to one year imprisonment or a fine or both. Mentega Terbang was banned by the Home Ministry back in September 2023 and taken down from the streaming platform Viu in March 2023, and the filmmakers have faced both online and offline threats since a social media campaign was launched against the film, and those involved in it. This latest move has several human rights groups, including the Freedom Film Network (FFF), urging the government to drop the criminal charges against the director and producer, and protect artists and artistic expression in Malaysia. We discuss this and more with the Freedom Film Network's co-founders, Brenda Danker and Anna Har.

The legal landscape across Asia for LGBTQI+ rights is varied. Despite same-sex relationships being legal in many Asian countries – with Singapore most recently repealing Section 377A of its Penal Code, which criminalised sex between consenting males – in others they can be punishable by fines, prison and even the death penalty.   Most Asian countries do not legally recognise formal unions for same sex couples, but there have been some recent developments on this front. Certain Asian countries have either legalised or moved towards legalising same sex marriage - with Taiwan doing so in 2019, Nepal registering its first such marriage in November 2023 and Thailand currently set to vote on a same-sex marriage bill. However, an October 2023 Supreme Court ruling in India declined to recognise same sex marriage.

A Fictionalized True Crime Story This is a Fictionalized True Crime Story of Insurance Fraud from an Expert who explains why Insurance Fraud is a “Heads I Win, Tails You Lose” situation for Insurers. The Ben-Cohain brothers, quite by accident, came upon an imaginative fraud. The Los Angeles County District Attorney, after a lengthy investigation, charged them with violation of Penal Code § 550, insurance fraud, among others related crimes. The Ben-Cohain brothers operated a small furniture assembly facility in Los Angeles County. They imported knocked-down children's furniture (made of composition wood and Formica laminates) from Israel. They hoped to sell it to wealthy people in Beverly Hills and West Los Angeles who wished to support the State of Israel. The quality of the merchandise, however, was not high and the Ben-Cohain brothers had difficulty making a profit. The Ben-Cohain brothers purchased the salvage from their insurer for a small deduction in their total claim and sold it shortly after receiving payment. With the proceeds, one brother purchased a used Mercedes sedan and the other a used BMW. They were soon short of money since they still could not sell the low quality knocked-down merchandise. They sought out the services of Mr. Rosenberg, a public insurance adjuster, who attached a nylon rope to sprinkler head thirty feet above the warehouse floor and yanked it out of its fitting. After the fire department was gone, the brothers, noting that insufficient damage had been done by the water from the sprinklers, ordered their two laborers to form a bucket brigade. The laborers poured twenty-five buckets of water from the restroom on the stored furniture effectively making all of their inventory unsaleable. Shortly thereafter they called the insurer and a claim was presented for $1,000,000. While the salvors were doing their work, one laborer came up to him and whispered: “Senior, no es accidente!” Fraud Detected Although the salvor spoke no Spanish he understood what was said to him. He reported the statements to the insurer. American Indemnity then retained counsel to take the sworn examination of the laborers. This is The Worldview in 5 Minutes heard at www.TheWorldview.com.  I'm Adam McManus (Adam@TheWorldview.com) By Kevin Swanson Turkey's crackdown on foreign missionaries The nation of Turkey is cracking down on foreign missionaries. The International Society for Human Rights has identified a disproportionate number of foreign expulsions. In a recent report, the group revealed, “There is no common ground among these expelled persons, except that they are all Protestant Christians, who are active in church life and/or active in evangelism.”  India's Prime Minister claims he opposes religious persecution Last Thursday, India's Prime Minister, Narendra Modi, responded to a question from the Wall Street Journal on human rights abuses in his country. REPORTER: “What steps are you and your government willing to take to improve the rights of Muslims and other minorities in your country and to uphold free speech?” During a rare give-and-take with reporters while he was in Washington, D.C., Modi said there is “no space for discrimination.  … In India's democratic values, there is absolutely no discrimination on the basis of caste or creed.” This despite the fact that religious persecution has increased four-fold since Modi took office in 2014. In related news, back in May, the U.S. Commission on International Religious Freedom raised concerns about persecution in India. It said that religious freedom conditions there “continued to worsen” in the last year and recommended that the U.S. designate India as a Country of Particular Concern for engaging in “systematic, ongoing, and egregious violations of religious freedom.” Christian missionary charged with 9 counts of sodomy at orphanage In other international news, the law banning same-sex relations in Malawi, Africa is being reconsidered by the High Court. This time, a Reformed male missionary in Malawi named Jan Willem Akstar has challenged the nation's Penal Code that “criminalizes carnal knowledge against the order of nature” as unconstitutional. In 2020, the missionary was charged with nine counts of homosexual activity with students involved with his ministry, the Timotheos Foundation.  While the High Court of Malawi is considering the petition to legalize same-sex relations, the Catholic Church has issued a statement opposing the motion.  The church declared, “Homosexuality is against the Scripture and the teachings of the Catholic Church and it is about acts against the order of nature, therefore, should not be promoted in any way. … It is our conviction that these acts should not be allowed in a country touting to be God-fearing.” Let us take note of Revelation 22:14. “Blessed are those who do His commandments, that they may have the right to the Tree of Life, and may enter through the gates into the city. But outside are dogs and sorcerers and sexually immoral and murderers and idolaters, and whoever loves and practices a lie.” Street preacher in Britain continually harassed by the police Street preacher Ryan Schiavo was arrested again for preaching in Canterbury, England on June 10th of this year — this time preaching out of Romans 1:18-32.  He is no stranger to this sort of treatment however. The English police are especially problematic for street preachers these days, marking their police cars with the moniker “Police with Pride.”   Schiavo told The Christian Post that the police have stopped him from preaching 25 times in the last two years in public places in England. No charges are ever filed.  According to the evangelist, the purpose is only to stop the preaching. And the situation has worsened over the last few years.  Abortions up 14% in England and Wales In other United Kingdom news, regrettably, abortion numbers are on the increase in England and Wales.  Official numbers reveal that abortions in 2022 increased by 14% over the previous year. The U.K. Department of Health and Social Care records an average of 20,000 abortions per month. Biden touts contraception as “fundamental freedom” President Joe Biden issued an executive order over the weekend to expand access to contraception. He called this access a “fundamental freedom,” and instructed the executive branch of the U.S. government to “ensure coverage of comprehensive contraceptive care, including all contraceptives approved, granted, or cleared by the Food and Drug Administration, without cost sharing for enrollees, participants, and beneficiaries.” Top 3 pro-abortion groups endorse Biden As of Friday, the leading pro-abortion groups -- Planned Parenthood, NARAL Pro-Choice America, and Emily's List -- have endorsed Biden's 2024 presidential election campaign, reports U.S. News & World Report.  Lessons from Salome, mother of James and John If you're a mother of a son, check out my second conversation with Rhonda Stoppe, author of Moms Raising Sons to Be Men as I guest host Generations Radio today. Scientists surprised by intelligent cave writings post-flood And finally, scientists were amazed to discover writings carved into cave walls, presumably contributed by the Neanderthals, reports ABC News. These writings, found on the La Roche-Cotard cave in France, are described as “deliberate, organized, and intentional.” They are an indication that these primitive human beings, existing sometime after the worldwide flood, were intelligent and thoughtful. After 60 years of trying, Indonesia finally has a new criminal code that standardizes sentencing, boosts legal certainty and updates penalties that were more in line with the Indonesia of the Dutch colonial era than that of the 21st century. But, as Anugrah Rizki Akbari, lecturer of Criminal Law at Universitas Indonesia told Kevin and Jeff, the passing of the criminal code is not the finish line, but rather the beginning of a three-year process of combing through decades of statutes from to bring them in line with the new code. While an improvement on the patchwork of laws that date back to the 1800s, the code is proving controversial.Conservatives in parliament are on board because the new criminal code includes jail time for extra marital sex. The president and vice president can levy criminal charges for defamation. These provisions will need safeguards and must be followed up with robust training of Indonesia's vast police force and public prosecutors. Synopsis: The Straits Times analyses Singapore's latest news and announcements. One law has been talked about by many Singaporeans for months - Section 377A of the Penal Code, which criminalises sex between men. Prime Minister Lee Hsien Loong at the National Day Rally on Aug 21 announced that the Government will repeal Section 377A, adding that the Constitution would be amended to allow Parliament to define the institution of marriage. Many people are unfamiliar with the process of how this is to be done and why this approach is being taken. A group of people have called for the law criminalising sex between men to be kept on the books, until there are guarantees to protect the traditional definition of marriage and family. Calling themselves the Protect Singapore Townhall, the group held an event at the Singapore Expo convention centre last Saturday (July 23), which was attended by more than 1,200 people. Meanwhile, the Government has been consulting various groups of Singaporeans on the law in recent months. Currently, Section 377A of the Penal Code - is not actively enforced, a position that has been reiterated by the authorities since it was discussed at length in Parliament in 2007. Hello my dears! Welcome to this new episode of JINS Podcast. When I was a young child, the media portrayed queer people as devilish people. Words in Arabic didn't even exist till a few years ago. You'd only hear about insults like “shaz” in Jordan, “zamel” in Morocco, “louti” in Lebanon, linking homosexuality to bodies who are penetrated, passive and perverted as the people of Loth in the Biblical and Quranic passages say. Words can be mean. Words mean something. Sometimes they mean the world to someone. Meanwhile, you would hear people being incarcerated in Morocco, under article 488 of the Penal Code, because they were caught kissing in public or crossdressing or just suspected of being too “effeminate”. You would hear news about people being hanged publicly in Iran, catfished and then arrested in Egypt, kidnapped in Syria, shot dead in the street in Iraq, and imprisoned in Saudi Arabia.Queer people were never shown as heroes nor as champions. Yet, the whole world knows that the art world is full of queer people. The world itself is full of queer people. So why is it so important to hide them, their creativity and their beauty when they also have so much to show to the rest of the world? Why is it so urgent to give them a platform of self-expression in this part of the world? Why is it so allegedly dangerous for the status quo to show more emerging talents on international stages or magazines, who break all the rules and let their identities shine?To discuss all of this, I'm very happy to welcome Khalid Abdel-Hadi. Khalid was born and raised in Amman, Jordan, and has family with Palestinian and Kurdish-Turkish-Beduin roots. He graduated from Petra University in Amman in 2014 with a degree in graphic design and visual arts. Khalid Abdel-Hadi founded My Kali Magazine when he was in his teens, with the aim of providing LGBT-related content. Established in 2007 by a group of passionate students with various interests -- from arts and design to politics and activism — My Kali is the first LGBTQIA-inclusive conceptual webzine in Jordan and one of the most consistent in the region. My Kali strives to address social problems, homophobia or transphobia, to document the stories of the community, and to empower the youth to defy mainstream gender binaries and heteronormativity in the Arab world. Khalid is the Editor-in-chief and the Creative Director of My Kali, an activist, and a curator.

The policy dates back to 2011 and over the last decade has grown into a series of policies aimed at reforming the country's labor market and lowering the Kingdom's chronically high unemployment rates and also increasing female employment.Nitaqat uses a rating system which classifies companies into four zones; platinum, green, yellow and red. Nitaqat requires employers in the private sector with over nine employees to hire a certain percentage of Saudi nationals, depending on the company's industry and the number of employees in the company. Companies with less than 10 employees are exempt from the zoning system, but are still required to hire at least one Saudi national.December 1st, the latest version of the Nitaqat program comes in effect and contains several new features, and has a goal of creating 340,000 jobs by 2024 as well as simplifying the compliance rules for businesses.The hosts discuss: how is Nitaqat going?25:52 – The environment for U.S. business in Saudi Arabia.
