In this 200th episode of The Geek in Review, talk with Toby Brown, CEO and founder of DV8 Legal Strategies, and Nita Sanger, Director of Digital Advisory Services at Cherry Bekaert. There are three rules for growth and success when it comes to large law firms. Strategy, strategy, and strategy. Brown emphasizes the need for law firms to develop strategies that prioritize clients and build meaningful relationships. He argues that "firms should start thinking of clients as customers and using customer experience as a way to differentiate themselves." Sanger shares this view, adding that law firms should "focus on value creation, continuous improvement, and customer experience" as they grow and evolve. Both guests discuss how law firms can reframe their view of growth, moving away from a talent management perspective and toward a mergers and acquisitions approach. Brown highlights his experience at a prior law firm, where he transformed the lateral partner program into a strategic acquisition initiative. He explains, "this is straight up M&A. So I renamed the program the lateral partner acquisition and integration program. And we treated it much like Apple or Google or any of them would treat their acquisitions." Sanger and Brown also touch on the importance of integrating newly acquired practices or firms into the existing business. Sanger emphasizes the need for planning and a program management office to ensure a smooth transition, while Brown shares his success with where hist firm had one of the highest lateral retention rates in the market due to the strategic approach and focus on integration. Looking into the future, Sanger envisions law firms as technology-enabled platforms, providing a wider range of services, while Brown expresses concerns about the reluctance of law departments and law firms to prioritize standardized business processes over the individual preferences of frontline lawyers. Despite their differing perspectives on the future, both agree that a focus on strategy, client experience, and growth through mergers and acquisitions will be crucial for the success of law firms moving forward.

Kristina Lambright is Senior Director of Strategic Growth at Perkins Coie LLP. She has had a fascinating legal career, serving various roles within the industry. After practicing in commercial litigation for nearly a decade, Kristina became a research specialist at Vinson & Elkins LLP, where she also assisted with budgeting. Seeking more involvement with driving decisions and revenue at the firm, she ventured into strategic pricing under the guidance of her colleague Toby Brown, the firm's first director of pricing—and a friend of the podcast. Kristina went on to work at Akin Gump LLP, where she developed the firm's strategic pricing and legal project management efforts. She has continued with pricing and LPM work at Perkins Coie, though her primary responsibility is leading the sourcing and acquisition of lateral partner candidates to meet the firm's strategic goals. Additionally, Kristina is a founder and board member of the Legal Value Network, which drives deeper partnership and collaboration between legal organizations in order to accelerate the evolution of the industry. Treuhaft and Wickersham explain what that means, and how they focus on providing an operating system, built on Salesforce, that creates transparency between Corporate Counsel and their law firms. Both Ari and Pam got their start in Financial and Professional services, so they come at these business problems with a different approach. With Pam's engineering background, and experiences at Google, she brings in a unique perspective on how to build the technology through the lens of the customer. Ari's experiences with the Financial Services industry going to the cloud over a decade ago also positions him to better understand the naysayers in the legal industry who are still resistant to placing data in the cloud. We talked about Dr. Jacqueline Walsh's Initio Tech and Innovation Clinic in a previous Information Inspiration segment. We were so inspired by her work that we asked her to come on the show and tell us more. The Initio clinic is set up just like a law firm. In fact, it is actually recognized by the Nova Scotia Barristers' Society as a law firm. Dr. Walsh uses a combination of law students, articling clerks, and the local community to help create a great experience for her startup clients, and as a result an enjoyable and authentic experience for the students in the clinic. While the clinic isn't self-sustaining, it does charge startups for legal services. This is another unique aspect of the clinic in that it offers ad hoc services or a subscription-based service to clients. The idea is to train startups to understand that legal costs are part of doing business and that if they are serious about their business, planning, and budgeting for legal expenses is another part of their business. Information Inspirations Bryan Parker and Jon Greenblatt from Legal Innovators have a new podcast called The Law in Black and White where they give their views on certain topics facing the legal industry from their own unique perspectives. The Innovation Hub podcast discusses how COVID has impacted public schooling, and how innovative and creative parents are finding ways to work around those schools who are not adjusting fast enough to handle the needs of these parents and their children. It's an interesting look at how adapting to change is happening on all sides, and those who are slow to adjust may have unforeseen competition. We all know that the incentive for diversity within law firms can run counter to the profitability goals of the firm. Former BigLaw partner, Elizabeth Korchin thinks one way to align these incentives and goals is to blow up the billable hour. She thinks it can be done by 2030. Our fellow 3 Geeks' blogger, Toby Brown, takes another angle on the incentives/goals approach and suggests that clients need to push firms to achieve more diverse teams, but that clients also need to put their money where their mouths are and make sure that they pay appropriately for these diverse teams. #HOMEeconomics While law firms have been relatively well prepared for this transition to work from home, the future will have a number of challenges for legal professionals. Toby Brown is always looking at trends in the industry and understands that there are waves of challenges coming. Law firms are doing a good job of responding to needs, but they struggle with handling what comes next. Clients are going to start looking at their future needs, and firms need to do the same. He lays out some of the issues that hit the industry in the Great Recession and sees some of the same pressures (and opportunities) in the current situation. Are law firms situated to handle the upcoming challenges? Are they equipped with the proper staffing roles to take advantage of the opportunities? Are they hiring the "next-gen" roles like pricing and project management professionals? Are we ready for Summer Associates in May? Are we ready for pass/fail grades? Are we ready for a bust in the oil and hospitality businesses? Are we continuing to react, or are we thinking ahead? Speaking of 'next-gen' roles, Toby has helped create the new Legal Value Network as a place for these roles to find and share with each other. While the timing of the new community may be poorly timed with the current situation, Toby thinks it actually might be the perfect time since pricing and other professionals are going to need a community to help each other proactively address the market as we struggle with the changes that lie ahead. He parlayed an earlier KM role into a new pricing function, which opened the door to practice innovation, legal project management and process improvement. Toby also talks about his work with the SALI (Standards Advancement for the Legal Industry) Alliance, which is a developing a standard taxonomy of matter types to facilitate improvements in budgeting and innovation. Hosts: Gwyn McAlpine oversees the knowledge management program at Perkins Coie LLP, an international law firm with 1,000 lawyers in 19 offices. Gwyn's focus is on creating value for clients by enabling attorneys to practice law more efficiently and collaboratively. In addition to more traditional KM initiatives, KM at Perkins Coie includes library and research services, internal and external collaboration, and AI and expert systems. Gwyn practiced corporate law for 10 years before fully transitioning to knowledge management. Amy Monaghan is the Practice Innovations Manager in the knowledge management group at Perkins Coie LLP. She works side-by-side with practice groups to further KM initiatives, particularly those involving artificial intelligence systems and other advanced technologies, such as document assembly, logic systems, workflow tools and contract analysis tools. Previously, Amy was in a similar role at Chapman and Cutler LLP. Guest: Toby Brown is an active member and leader in organizations devoted to legal knowledge management, and he speaks to national audiences on legal pricing, alternative fee arrangements and other law firm financial management issues. He is the founder of the Legal Marketing Association's annual P3 Conference, which brings together over 400 pricing, project management and process improvement experts in the legal profession.
