Justin and Crystal discuss her career in anti-money laundering compliance, and what brought her to consulting. They discuss the elements of AML compliance and how the need for it stretches beyond financial institutions to any sector that involves large transactions, including virtual digital assets and investing. They talk about the $3 billion settlement TD Bank entered into with regulators in October of 2024 and the messages that sends both to financial institutions and money criminals. The links are in the show notes. [2:38] Money laundering should be one of the top risks on your risk radar, especially in 2025 as new regulations are added or rolled back. Some high-profile resolutions have made recent headlines. [2:51] To help me make sense of it all for the RIMScast audience, here is the Director of Baker Tilly's Risk Advisory Practice, Crystal Trout. Crystal has more than 23 years of experience working with financial institutions with a focus on financial crimes compliance. [3:08] We're going to talk about anti-money laundering (AML) programs and get some best practices for implementation and reporting. [3:18] Interview! Crystal Trout, welcome to RIMScast! [3:33] Crystal Trout is a director with Baker Tilly's Risk Advisory Group. She joined Baker Tilly after having worked in financial crimes risk for over 23 years. Previously, she was in the financial institution space. [3:51] Crystal switched to consulting to help other financial institutions build out their AML compliance programs and ensure that they're in a good spot for regulatory exams. [4:19] Crystal tells how she was drawn to anti-money laundering. In high school, she had an internship with a financial institution, and it was robbed. [4:37] When the FBI was doing their investigation, Crystal was trying to understand what they were doing and how they were going to catch the robber. She was so fascinated by the process that she changed what she went to school for and altered her career path.  [5:09] Crystal's interest in understanding how fraudsters and money launderers act led her to use her banking career to work in the back office and investigation space. [5:38] Crystal says the institution used dispensers that limited cash, and the robbers only got $500. Because of the weapon they used, the robbers got a massive sentence at trial. [6:38] Crystal explains the current AML environment. Baker Tilly is staying close to any regulatory changes. The complexity of regulations is extensive. It's critical that professionals in this space stay close to the challenges that extend even beyond the regulatory requirements. [6:59] We're seeing more changes in regulations than we have historically had, Crystal observes. It's a matter of understanding the landscape, staying close to the changes, and trying to predict which direction they may go and plan for either direction. The key is planning and not waiting. [7:32] Crystal suggests you should hope for the best and plan for the worst. Make sure that you're prepared to go in either direction, whether regulations are rolled back or strengthened. [7:57] Justin recalls that TD Bank reached a $3 billion settlement with U.S. regulators in October 2024, pleading guilty to failing to maintain an adequate AML program, which unfortunately led to the facilitation of money laundering activities. That's a huge penalty, Crystal points out. [8:37] This event provides valuable insight for risk professionals regarding regulatory expectations and also the consequences of inadequacies in their programs. [8:49] People need to understand that they can't be lackadaisical in their compliance program. They need to be ahead of it. It's all about preparation and planning.  [9:03] In the TD Bank case, regulators had identified substantial weaknesses in the overall transaction monitoring system and due diligence procedures. [9:17] TD Bank had allegedly failed to allocate the resources needed to operate their AML program, but they continued to have significant growth within their higher-risk customer segment and geographical region. [9:35] TD Bank wasn't staying ahead and keeping current with its customer base and the risks that were taking place. Beyond the penalty, TD Bank has expenses for remediation efforts, enhanced compliance infrastructure, and independent monitoring. All of these are added costs. [9:57] Financial institutions may fail to realize the costs that happen beyond the penalty. They may say it costs too much to add the staffing or build the correct tools, not realizing it will cost them more when the regulators find these faults and weaknesses within their program. [10:18] A key lesson to learn is that compliance programs must be able to scale appropriately with the institution's business growth and evolving risk profiles. [10:30] Regulators focus on the overall program effectiveness rather than mere technical compliance, particularly regarding the quality of suspicious activity identification and reporting. [10:41] It's important for institutions that have to comply with these programs to be proactive and make sure they have the correct resource allocation. Those things are key when it comes to ensuring that AML compliance programs operate effectively. [11:11] There are five key pillars involved in an AML compliance program, including a designated compliance officer and following customer due diligence. You build an AML Bible, with paperwork that documents the steps you're going to take to be in compliance. [11:39] It allows your people to understand the risk that the institution is willing to take, and what it's not willing to accept. You document everything as evidence base for regulators, as having the correct tools and technology to support the program's overall risk tolerance. [12:33] Justin and Crystal address the reputational risk to an institution that may come from a regulatory settlement. Crystal states that these settlements signal to the bad guys that they are going to be caught and they're not going to be able to continue to act at that institution. [13:14] Crystal tells about the bank robber. For prevention, when someone comes into the bank, make eye contact, talk to them, and acknowledge them. If they're scouting it out, there's a lot less chance they'll come back to that bank because they are being noticed. [13:37] A criminal may not physically be in the bank, but if you do due diligence up front when they open an account, asking the right questions, and looking for red flags, they may realize that you have a very strong AML program in place and they'll go elsewhere. [15:50] Are risk professionals who are not at financial institutions at risk of inadvertently being caught up in a money laundering crime? Crystal says this question is in the back of the mind of any risk professional. She remembers that running an AML compliance program is stressful. [16:22] There's always the risk that a chief compliance manager could be cited for a failure and have to pay a significant, hefty fine. A risk manager should be aware of this when they're performing any form of transaction. Listen to your gut if something seems off. Don't ignore it. [17:26] Is paying in cryptocurrency a red flag? Navigating AML compliance specifically regarding cryptocurrency is new for a lot of professionals. There are risks and benefits to digital assets concerning AML compliance. [17:54] With any evolving form of payment, if risk professionals aren't staying ahead, truly understanding and navigating how it works, it's going to make it difficult for them to understand red flags and risks that might come, as well. [18:13] There is sometimes a natural fear in risk professionals that because they're not comfortable with cryptocurrency, they're not able to address any legitimate concerns or concerns that may be their internal fear due to the lack of knowledge. [18:45] Is it too risky for a company to announce the voluntary departure of a Chief Compliance Officer? Crystal says the company should already have a plan for somebody to temporarily step in and continue to operate so it doesn't leave a gap or exposure in the organization. [19:22] It's an opportunity for a risk professional to go into a financial institution and make a mark for themselves by helping the institution strengthen its overall compliance program. [19:49] It's a good practice for a company to announce the replacement chief compliance officer at the same time as the announcement of the leaving chief compliance officer. It's part of succession planning. [20:47] The money laundering risk landscape is expanding significantly. Industries outside of finance and banking face substantial financial crime risk and corresponding regulatory scrutiny. They have less mature compliance infrastructure than their banking counterparts. [21:07] Crystal mentions the real estate sector as a potential vehicle for money laundering due to the high-value transactions, price stability, and the lack of historical regulatory oversight. [21:19] Digital asset providers, cryptocurrency exchanges, wallet providers, and any type of virtual asset service providers face intensifying regulatory scrutiny because the platforms can facilitate anonymous transactions. [21:35] The Financial Action Task Force has established clear expectations for virtual asset service providers to implement robust AML controls. Gaming and gambling services present money laundering risk. [21:53] There are other high-risk sectors that money laundering risk could expand to. FinCEN recently required registered investment advisors and exempt reporting advisors who have not been required to have an AML compliance program to have one in place by January 2026. [22:22] We're seeing AML compliance extend beyond traditional banking. [22:34] There are very few industries that, in some form or fashion, could not be a victim of a bad actor performing money laundering. It's just a matter of the bad guy finding a way to do it. [23:09] What steps should a company take when money laundering by an employee is discovered? The appropriate officer needs to start an internal investigation. That's a lengthy process. Make sure the “i”s are dotted and the “t”s are crossed within the investigation. [23:47] Make sure all the evidence and documentation are aligned. Involve HR and the appropriate supervisor authority. If it's shown to be true, interview the individual. It could lead to termination. The investigative process could take months. The authorities may be alerted. [24:39] The company may not want it out in public knowledge and may not file a police report. It can damage a company's reputation. [25:00] Crystal explains her passion for AML compliance and why she became a compliance consultant to help more institutions. The downstream impact is so significant. As crazy as it sounds, this is the final episode of The Firm Analyst this year. I was joined by Waheed Kalungi, a contracts paralegal at UserTesting Inc. and aspiring Trainee Solicitor. Together, we discussed a range of business stories and how they featured throughout the year. As a lot has happened in 2023, we decided to split this massive two-hour long episode into a few parts, releasing one every few days. In this part, we discussed some of the biggest banking & finance stories of the year, which included: the collapse of Silicon Valley Bank and other major regional US banks; UBS' merger with Credit Suisse; and the rise of the mysterious 'private credit' sector. Our first perspective comes from a soon-to-be rising star in the risk profession, Fernanda Gutierrez Franco, a student at the University of Colorado. She is very involved in the risk management program and risk management groups at the school. [2:32] Fernanda was one of the contestants for ERM Squares. Justin caught up with Fernanda in the ballroom to hear from her how students are seeing the risk profession and what her career goals are. [2:48] Fernanda Gutierrez Franco, welcome to RIMScast! Fernanda started college with a biology major for pre-med or nursing. It wasn't a fit, so she switched to business, hoping to go into management or accounting in the health sector. In one of her classes, guest speakers talked about the RMI program. She booked a meeting and switched her major. [4:06] Fernanda loves risk management for the opportunities for students and how welcoming everyone is in the industry. Fernanda describes opportunities at CU Denver and RMI events such as spotlights on companies and shadow days to visit companies and shadow the employees. Fernanda describes Gamma Iota Sigma internship events. [4:59] Many speakers come to talk to classes in panelist events or to talk about risk control and company practices. [5:19] Fernanda loves ERM for everyone coming together to realize that there has to be something done;  there has to be a risk assessment or something laid out. It's educating people that aren't in the risk industry that risk is always here and it's better to be prepared than to be sorry later. [5:44] Fernanda will take a course under David Young in her grad program. [6:05] Fernanda is the Women in Business VP,  the Gamma Iota Sigma VP. She is more involved with the Gamma Iota Sigma group that meets Tuesday morning, weekly and hosts two to three events monthly. They have nine elected officials and are working on getting more members involved in the organization. [6:49] Fernanda was a moderator at the RIMS Western Regional. It was her first time moderating at a risk event and her first time in front of a huge crowd. It scared her a bit to be standing in front of 400 people, but it was a great opportunity, she got a lot of exposure and the session was fun and informative. [7:49] Fernanda has had other speaking opportunities, including high school commencement, for around 150 people. [8:12] Fernanda was one of the first two contestants for the RIMS ERM Squares. [12:18] Justin interviews high-ranking AFERM members, Marianne Roth, and Bobbi-Jo Pankaj, at the RIMS ERM Conference 2023. Marianne says AFERM is the only organization dedicated to government employees who are leaders in ERM. AFERM has about 500 members from state, local, and federal government and the private sector. [13:07] The members of AFERM facilitate ERM at all levels of government and in the nonprofit sector. Bobbi-Jo says she has a deep love for ERM. AFERM is the Association of Federal Risk Management. AFERM has a lot of activities for state, federal, and local governments and vendors. Bobbi-Jo is a vendor. She works for Guidehouse. [13:32] Bobbi-Jo is the Summit Chair for 2023. The Summit is very similar to the RIMS ERM Conference. The Summit focuses on weaving ERM into the fabric of government. There are usually 300 or 400 attendees in person and virtually. The Summit is November 28th and 29th. [13:53] AFERM is heavily tied to the federal government, so if the government shuts down, the event will be moved to a later date. It will still be in Washington, D.C. at the Washington D.C. Convention Center. RIMS is slated to have a presence at the Summit. [14:22] At the Summit, there's an exciting vibe; everybody loves ERM. There are speakers from the public and private sectors. There are 21 unique break-out sessions. There are five plenary speakers, including the Commissioner of the Internal Revenue Service. There's a lot of networking. Which is one of the best takeaways from the event. [14:46] There are tools and techniques that members have found successful in the government and the private sector. RIMS will have a booth at AFERM. Bobbi-Jo is excited to get potential new AFERM members from RIMS. A lot of AFERM members have the RIMS CRMP certification and the RIMS CRMP-FED microcertification. [15:20] Marianne and Justin met online a few years ago after Marianne won the Theodore Roosevelt Excellence in Government Award for Innovation in ERM at the Consumer Financial Protection Bureau. Justin saw it on LinkedIn and reached out to Marianne. They did a Q&A. It is linked in this episode's show notes. [15:54] Marianne has been an ERM risk practitioner for almost 10 years. Bobbi-Jo was in risk management first and has also been an ERM risk practitioner for about 10 years, since ERM took off in the federal government. [16:07] Marianne has seen a lot of maturation of ERM capabilities across federal agencies with organizations focusing on risk appetite and maturing their processes, mitigating risks more effectively. Bobbi-Jo agrees and notes that a lot of AFERM members use the RIMS Risk Maturity Model® to track the maturation of programs. [16:44] AFERM is an all-volunteer organization. They seek volunteers year-round. Marianne enjoyed the Summit so much, she got involved with AFERM. Bobbi-Jo has been doing the Summit for seven years and took on the Chair position because it is an amazing event. Justin looks forward to seeing them at future RIMS events. He says risk management is a void in Africa. His advice to people in Nigeria interested in risk management is to get the right knowledge and education to fill the void. [1:58] My guest today, Merline Barrington, is the Manager of Enterprise Risk Management for the Port Authority of New York and New Jersey. On November 3rd, she will be leading one of the breakout sessions at 9:00 a.m., titled “Connecting ERM to Strategy: Tackling Strategic Risks a Deep Dive at a Time.” [2:20] Merline is also a CRMP holder and a lot of fun to speak with. Let's get started! Justin welcomes Merline Barrington to RIMScast! [2:32] Justin and Merline met last year at the RIMS ERM Conference 2022 in Indianapolis. Merline was a very excited attendee. Justin picked up on that enthusiasm and suggested Merline should submit a session. Today, they will talk about the session Merline will do for RIMS ERM Conference 2023. [3:13] Merline Barrington's session for RIMS ERM Conference 2023 is called “Connecting ERM to Strategy: Tackling Strategic Risks a Deep Dive at a Time,” on November 3rd, kicking off the Friday morning sessions. Merlin is more excited than nervous about it! [3:34] Justin was fascinated with Merline's position at the Port Authority of New York and New Jersey. She is the lead for ERM. The ERM unit is a small, nimble, central group with dotted line connections up, down, and across the enterprise to areas that are indirectly or directly responsible for ERM risks to their business and objectives. [4:35] As a Certified Risk Management Professional (CRMP), Merline is responsible for leading and innovatively developing an ERM program designed to proactively manage business, operational, emerging, and strategic risks to this very complex, quasi-government, bi-state organization. [4:55] The Port Authority of New York and New Jersey spans several global business segments altogether valued at several billion dollars. Merline's work includes determining the agency's ERM framework and architecture, and integrating risk intelligence with key functions such as strategic planning and resource allocation.  [5:21] Merline also works with partners in different lines of defense, such as audit and insurance. All of this is ultimately to inform decision-making and to provide that holistic view and understanding of significant risks to executive and board-level audiences. [5:39] Merline works with various levels of the enterprise, from the most senior executive levels to the front-line staff to proactively identify and manage risk via workshops, risk control self-assessments (RCSA), and other techniques. [5:57] Importantly, Merline's job also includes developing and mentoring practitioners on her team and indirect team members throughout the organization to deliver on its program's value proposition. [6:32] Merline discusses the value proposition of ERM. If you take the time to craft an honest and accurate value proposition for the brand of ERM of your organization and consider what your key audience expects from ERM, you can develop a cascading message where the core remains the same but there are different levels of zooming in. [8:06] The Port Authority is responsible for transportation by land, water, air, and roadways. This includes the major airports in the New York-New Jersey region, and one in upper New York: LaGuardia, JFK, Newark, and National Airports. It includes the seaport, marine terminals, bus terminals, bridges, tunnels, and commuter rail pass. [9:31] The Port Authority also has some real estate in Lower Manhattan. If you're in or around New York or New Jersey, you touch a Port Authority asset, one way or another, [10:02] Merline explains what brought her to the Port Authority. She has a passion for public service. She earned a spot in the agency's competitive management program for grad students. She touched many areas of the agency, which piqued her interest in a career in an area where she could leverage her skills to improve public service. [10:41] Merline's career at a transportation provider led her to risk by providing an avenue to build her career in an area that is purposed to protect routine, mature organizational value. That is ERM. Following her passions in what she is good at is what led Merline to ERM. She wants to make public institutions better with her skills. [14:49] Generally speaking, organizations of similar size or depth to the Port Authority may be experiencing a confluence of strategic risks, such as cybersecurity meets climate change, and the need to adopt digital and climate-friendly technology at a balanced rate, so as not to exceed the adoption curve, while attracting the right talent. [15:41] Merline believes organizations are having to grapple with the introspection of these risk areas, compounded by a volatile global and economic context. The ability to interpret uncertainty before it fully emerges is relevant to organizational strategy. Being able to measure the potential impact is critical to the success of any organization. [16:25] Merline advises organizations and travelers to book flights early and plan ahead. Have a Plan B. See if your destination is also served by rail or other modes of transport since things are unpredictable. If your flight doesn't work out, you have another plan. [17:44] Merline's RIMS CRMP certification has added much value to how she approaches ERM in the organization, especially in how she develops new staff. It helps when mentoring staff to be able to point to specific principles and research to delve into to become a better RMP and communicate how said principles enrich the work they do. [18:26] Merline earned her RIMS CRMP about two years ago. She was attending the conference where she met Justin as a way to gather credits toward recertification. Merline has a lot of interest in ERM and AI and data analytics and ERM.  [19:28] All roads lead to the further integration of ERM and strategy, using all the developing emerging technologies of AI, data, etc. ERM is to get better insights and get ahead of the curve to bring meaningful dialog to the attention of decision-makers and facilitate decision-making based on a thorough understanding of data and analytics. [20:14] Merline Harrington shares her CRMP story in a link in this episode's show notes. He served as RIMS President in 2002 and received the Harry and Dorothy Goodell Award for outstanding service and achievement in the risk management discipline in 2016. Chris is also the President and Managing Consultant for Excellence in Risk Management, an LLC based in Tennessee. He's here today to discuss all things ERM. [4:11] Chris will lead two sessions at the RIMS ERM Conference 2023 in Denver, CO on November 2nd. In the morning, he will lead “The Value Proposition and Process for Operationalizing Risk Appetite Strategies and Frameworks.” [4:28] In the afternoon, Chris, with leaders from HUB International, will co-lead a 45-minute session titled, “Nerd-Out on Numbers: Why Analytics Are Key to Extraordinary ERM.” Chris will also be leading a RIMS CRMP Virtual Workshop on December 13th and 14th. He just can't quit risk management and we're all better for it! [4:55] Justin welcomes Chris Mandel to RIMScast. Chris was RIMS President in 2002–2003. Chris spent the first half of his career in traditional risk management in large corporations. In the first part of this century, Chris was asked to create an ERM strategy and ultimately became Chief Risk Officer for USAA in San Antonio, for 10 years. [6:02] That was where Chris's career became more progressive. Chris was on the RIMS board for seven years, was Risk Manager of the Year in 2004, and received the Goodell Award in 2016 for lifetime achievement. He has retired twice but he can't seem to stop. He has a consulting firm specializing in ERM. [6:27] Chris spent eight years doing strategic work for Sedgwick. He is on the faculty at Embry-Riddle Aeronautical University, where he teaches ERM. ERM is a key aspect of his skillset. The risk discipline is advancing and maturing, so there's never a dull moment. [7:41] The risk management profession has changed since 2002. In 2002, risk managers were focused on insurable risk. The Enron debacle raised the question of whether risk was being managed effectively in a lot of companies. Risk management became an explorative discipline of embracing risk and exploring the ERM version of the discipline. [8:53] Chris calls the years since 2002 a time of expanding, exploring, and innovation until now when we are executing on things that were more conceptual in the past, employing progressive tactics and strategies to manage an ever-expanding landscape of risk for organizations that are increasingly being challenged by risks. [9:29] ERM is constantly maturing. RIMS has published its second ERM maturity model. It's recognition of getting to a level of maturity where we might accomplish some other objectives that might push this more from a discipline into a profession. Risk professionals need recognition in their organizations so they can influence decisions. [10:17] Organizations are discovering the need for robust ERM and how it adds value in risktech and insuretech. If you ignore rare risks, and they blow up in your face, you get asked, “How did you miss that?” ERM is coalescing into an issue for serious practitioners who want to rise in the ranks to be more influential in their organizations. [12:30] There are still detractors who believe all you need to worry about is how you insure the organization. They believe that as long as nothing uninsured blows up in their faces. Then they believe in ERM. [12:45] Chris will present “The Value Proposition and Process for Operationalizing Risk Appetite Strategies and Frameworks” at RIMS ERM Conference 2023. Chris just co-authored a paper on risk appetite in financial institutions that is being considered for publication in a journal of risk management for banking. [14:16] The presentation is to convince the audience that even if you're not in financial services, there's good reason why you want to manage risk to risk appetite. That's a simple way to state what can be a very complicated approach and process. How can you manage risk if you don't know how much risk you're able to take or need to take? [15:14] Chris will be presenting with Barry Franklin, former CRO for Zurich North America who is an actuary. [15:31] In the afternoon, Chris, with leaders from HUB International, will co-lead a 45-minute session titled, “Nerd-Out on Numbers: Why Analytics Are Key to Extraordinary ERM.” Jeff Guttman and Chrystina Howard from HUB International, Client Analytics and ERM, had asked Chris to join them on this presentation. [15:53] The session focuses on the evolution from total cost of risk (TCOR) to applying concepts and tools that get risk quantification done in a more robust way and move beyond just those things that are insurable. A lot of people are still skeptical about that. That's one reason risk appetite frameworks and strategies are not always adopted. [16:28] There will be some compelling arguments presented about some ways in which risk can be quantified that people may never have been exposed to. If you thought strategic risk was unquantifiable, you're wrong. Strategic risk has been shown to be the most destructive kind of risk, over financial, operational, legal, and compliance risks. [17:16] These two sessions dovetail nicely for Chris. They are hot topics for him, what he teaches at Embry-Riddle Aeronautical University, and what he practices in his consulting. For the last 15 or 20 years, it seems all he has done is talk to audiences. As RIMS President, he talked to conference audiences in the thousands. He traveled the world talking to chapters and regional conferences. It's almost 2nd nature to him now. It's what he loves doing. [22:05] Chris brings that same feeling to a RIMS ERM 45-minute session on numbers as well as to an address. He makes it concise and engaging. He plans it as a conversation with the audience, including questions. [23:46] Chris will be leading a RIMS-CRMP Virtual Workshop on December 13th and 14th. Chris was in the first 200 to take the RIMS-CRMP as soon as he qualified for it. He felt he needed it if he was going to keep speaking on risk. There were no preparatory materials at the time but he passed. Now there are the Virtual Workshops to help you. [24:55] Chris tells us how to be better prepared for the RIMS-CRMP examination. It's a reflection of experience and knowledge that goes way beyond the surface. It's designed to cause people to think. People need to properly prepare for it to get through it. CRMP reflects, more than anything, the advancement of the discipline closer to a profession. [26:24] You can't memorize the CRMP test. The test changes every time around. You're learning core concepts in the workshop. The RIMS-CRMP is about what you've put into practice over the years; it's an attempt to measure the depth of your experience, knowledge, and skills. [26:44] Chris uses interaction in his presentation of the RIMS-CRMP Virtual Workshop. It's a combination of lecture and group exercises that keep people engaged throughout. Chris teaches it at the university or master's level. [27:40] Chris created an ERM LinkedIn group in 2004 or 2005. See the link in the show notes. It has around 51,000 members from around the world. Bob will kick off the RIMS ERM Conference 2023 on November 2nd with his keynote, “Elevate, Revolutionize, Maximize: Harnessing Innovation's Promise.” Bob is very engaging and I am looking forward to the energy he will bring to the keynote address on November 2nd! [4:30] Bob Roitblat has started a dozen companies. Each company focused on three areas: innovation, strategy, and risk. The three areas are closely tied together. You can't be successful in one without the other two. It's a three-legged stool. [5:03] Bob describes innovation as doing something new and different that makes a difference. It could be new products or services, a new business model, or a new organizational structure. It's something that you haven't done before that will make a difference to your organization. (A positive difference, preferably!) [6:00] Most of the time when people innovate within an organization, they don't call attention to it, they just run more efficiently. Amazon is a huge logistics company that runs smoothly. They spend billions on innovation. They bought a robotics company to have robots to deliver products on schedule. [6:28] There is also the innovation of developing products and services for external consumption by customers. Bob cites Zia Chisti, who invented Invisalign braces. Orthodontia hadn't changed for 100 years until a Stanford student wanted to change the experience of braces. Within 10 years, he completely altered orthodontia. [7:20] Richard Montañez, a janitor who worked for Frito-Lay, invented Flaming Hot Cheetos. He altered the landscape for focus marketing. He went after a segment of the market people didn't think to go after. Now we're not just marketing to people but to segments of those people. Richard retired as the VP of Multicultural Affairs at Pepsico. [10:05] Bob describes the upcoming influence of AI digital workers on innovation. In terms of efficiency, we are underselling the capabilities of digital workers. Let's elevate our perspective. How do we use digital workers to drive the top line, open new markets, and address new submarkets like Montañez did? [11:44] Software bots may or may not use AI but they are digital workers. [15:11] Bob's November 2nd keynote preview: Imagine that innovation is a lake. It's full of potential. Unless you harness that flow in some way, you can't take advantage of it. Your strategy is a dam. You set it so the flow doesn't wipe out the town below. That's good risk avoidance. [15:57] Maybe your strategy is to use irrigation pipes to make the surrounding land tillable and farmable. That generates revenue. Maybe your strategy is a hydroelectric plant inside the dam and generate electricity to sell. Unless you have a strategy to extract value from your lake of innovation, it only has potential value. [16:46] The theme of the keynote is how to build your dam strategy to extract value from the innovation that you can identify. [17:11] Bob says to attend the keynote and be prepared to participate! It will not be a one-way data dump! You won't be bored! There will be a QIOS session. Bob won't have all the answers, but he'll answer your Questions with Ideas, Opinions, and Suggestions! Let's start the conversation! [18:00] With Bob's keynote and the following sessions by other speakers, the people who show up will be overloaded with value, and knowledge, and be prepared to go back to their organizations and “take over the world.” [18:29] Bob uses lots of images in his keynote, produced by Gen AI and edited in Photoshop and enhanced with Adobe Illustrator. But digital isn't always the answer. Sometimes analog images are the best way. [19:47] October is National Cybersecurity Awareness Month. It's a subject of the Conference and Bob will address it. [1:55] Justin's first guest is Paul Larson, the President of Financial Lines at Liberty Mutual. They met on May 1st before Paul's session, “A Banking Crisis's Impact on the Insurance Industry.” It was perfectly timed. That day, less than two months after the collapse of SVB, it was announced that JPMorgan had bought troubled First Republic. [2:36] Justin welcomes Paul Larson to RIMScast. [2:51] Paul's session is about what's happening with respect to the banking crisis, if there is one. Paul talks to risk managers on the corporate and financial services sides about how this could impact businesses. How did the session go, Justin asks. “Oh, we killed it! Knocked it out of the park,” Paul forecasts! [3:30] Paul's take on the banking crisis is that it's not at that stage yet. So far, we don't have a significant credit issue. But will the interest rate risk become a credit risk? [4:10] The JPMorgan purchase of First Republic doesn't much change the dynamic of Paul's session. The SVB and First Republic failures resulted from liquidity issues and uninsured deposits. Both firms had significant levels of uninsured deposits, as did Signature Bank. [4:59] Banks should act as though the 2018 roll-back of Dodd-Frank had not happened.  Paul brings up the need for banks to manage liquidity risk, regulators to ask for change, and banks to manage their interest rate risk and asset-liability matching. [5:35] The Fed acknowledged that they saw the risk at SVB and should have been heavy-handed early on. [6:01] Paul thinks the directors and officers of SVB are going to be held accountable for the failure and we will see litigation as a result of it. The failure emphasizes the importance of having a strong Chief Risk Officer in place to manage the process all along. For over eight months, SVB did not have a CRO. [6:30] Justin had done an episode with the risk manager from Sterling Bank and Trust, Eleni Willis, about the failure of SVB and their lack of a CRO. She likened it to pulling your quarterback in the middle of a fourth-quarter blitz. Paul agrees it's critical for a bank the size of SVB or First Republic to have a CRO and a succession plan if one departs! [7:04] Paul suggests the Chief Financial Officer of a bank become the interim CRO.  [7:21] RISKWORLD 2023 is the 21st RISKWORLD Paul has attended. Justin thanks Paul for being on RIMScast. [7:43] It was National Hurricane Preparedness Week, April 30th through May 6th, 2023. So Justin speaks to a preparedness expert, Alexander Walton, the National Director of Client Development at Blueteam. Blueteam does restoration construction and roofing. [8:11] Justin and Alexander discuss the trends in hurricane preparedness and things Alexander has seen as a worker on the ground. Hurricane season is coming up soon! [8:31] Justin welcomes Alexander Walton to RIMScast. This is Alexander's first year attending RISKWORLD; he plans to attend going forward. He has been with Blueteam for just over seven months and in the risk management space for about six years. Before Blueteam, Alexander was the GM for a couple of ServiceMaster offices out west. [9:46] Blueteam is based in Boca Raton and gets the first hit of hurricane season. The Blueteam crews stay prepared and ready to go. [10:10] Blueteam's mantra is preparedness. Blueteam's proprietary software allows it to alert customers by location that may be in the line of a hurricane so the customers can have a better understanding of what to prepare for by boarding up and getting any equipment they might need to prevent the most damage. [10:52] Boca Raton is an hour north of Miami. Justin asks about the damages from Hurricane Ian. Blueteam's takeaway from Ian was that you can never be too prepared. The more you can do on the front end, the easier it is for Blueteam to come and mitigate and prevent further damage from sitting water and potential structure failures. [11:44] How does Blueteam prepare for enhanced risks from climate change? Blueteam has been busy year-round, mitigating torrential rains and flooding and an earlier, increased tornado season. [12:33] Alexander notes that the technological advancements at Blueteam are in customer interaction. The proprietary software includes warnings for earthquakes, fires, freeze warnings, wind warnings, as well as hurricanes, so customers can take evasive measures to prevent damage. [13:28] Florida has had freeze warnings, flooding, hurricanes, and extreme winds this year. The freezes and windstorms are applicable around the country. Blueteam has seen a huge peak in business for repairs from those two climate disasters. [14:17] Alexander's experience on the ground shaped his risk management career. He has insight into the customers' perception, allowing conversations on how Blueteam can help on the front end and what to expect in terms of timelines and repair. These conversations build solid relationships. The customers know they are valued. [14:58] Alexander's worst experience on the ground was from an internal fire with lots of smoke damage. He had to see that residents of a senior living facility were secure and repair smoke damage and mitigate water damage from the fire department. He had to get people back on track and into their normal routines as soon as possible. [15:43] Justin's final guests today are from The Institute of Energy Economics, an arm of the Japanese government. Justin met them sitting in the DE&I Lounge, preparing for their Global Studio session, “Collaboration with an Energy Resiliency Working Group.” They were enthusiastic to be on the show and speak of energy! [16:09] Justin welcomes Akihiro Kimura, Hirotaka Mitsui, and Kentaro Hayashi of The Institute of Energy Economics in Japan to RIMScast. Akihiro Kimura, a risk manager, explains they are presenting the “new normals” of cyber risk, pandemic risk, and climate change risk. [17:43] Akihiro says we need not only risk management but also resilience management. Their presentation will focus first on the energy supply side and demand side. They will show energy resilience scoring to help insurers, bankers, and funders. [19:05] Hirotaka Mitsui explains the Five Ds of Japanese energy resilience management are Depopulation, Deregulation, Decentralization, Digital transformation, and Decarbonization. This is the thesis of their presentation. Japanese government and corporations are looking for new markets to invest in energy resilience. [20:29] Kentaro Hayashi is very excited to be at RISKWORLD! Lavois Cruickshank, a simple yet ambitious young man Lavois has the incredible dream of positively impacting and inspiring a nation. The Spanish Town native lives by a philosophy posited by Jared Kintz, “Whether you live to be 50 or 100 makes no difference, if you've made no difference in the world.” and with this as his motivation. Lavois aims to use his abilities, gifts and skills to make a difference. He is currently serving as a Jamaica House Fellow at the Office of the Prime Minister in Kingston, Jamaica. Lavois prides himself in excellence, committing wholeheartedly to any duty or task. With his deep interest in Finance, Economics and Strategic Planning, Lavois pursued a BSc in Economics and Banking & Finance at the University of the West Indies. He also holds an MSc in Financial Economics from the University of Birmingham. With an immense love for tennis and a passion for nation development, Lavois actively serves as a math tutor at his alma mater, Calabar High School in Kingston, Jamaica; as a volunteer with the Jamaica National Foundation as an ambassador of the Governor General’s I Believe Initiative (I.B.I).   Just to give a little background to our listeners. Yanique was privileged to have the opportunity to hear Lavois speak in front of an audience of 300 plus last week around this time as we celebrate National Customer Service week, he was invited as a special guest on a panel of people who are probably twice his age, but he really commanded great attention and was able to really wow the people who are listening including herself, hence, why extended this wonderful invitation for him to join us on the Podcast  Questions Tell us a little bit about yourself and your journey What is your view on customer service and customer experience? As a customer yourself could you give one to three things that you maybe experience whether it be locally or internationally of a business that really made a difference for you? What are some tips that you would recommend to businesses that would help to make experiences effortless for their customers? How do you stay motivated everyday? What if you have employees in your organization who don't have that natural drive that you have. And there are certain goals that you have set for a company, but they are not pulling their weight. They’re not creating that level of culture where your customers are feeling satisfied and so your internal customer culture is not where you want it to be. What advice would you give to a business owner who had that kind of dynamic? What’s the one online resource, tool, websites or app that you absolutely cannot live without in your own business or your own way of operating daily? Could you share with us maybe one or two books that have had the biggest impact on you? What is the one thing in your life right now that you are working on to develop yourself – something that you are really excited about? Where can our listeners find you online? What’s one quote or saying that during times of adversity or challenge you revert to this quote to kind of help you to keep centered and to focus on your path or goal?   Highlights Lavois stated that he grew up in a family that encouraged excellence, excellence in the sense that going through school you were required to just do well, it was not an option, it was just mandatory. So, he grew up with two teachers as parents and he grew up with church parents as well, so there’s the balance of the academics and the balance of the school and spiritual part of it as well and so, he had to just focus during school. So, he started off in primary school, Calabar for high school and then it was just a natural transition in tertiary education at UWI. He just always had an interest in finance, he grew up watching TV particularly Owen James’ On a Personal Note and he just thought finance is probably something he wants to get into and then it was about money. So, it was just very interesting. He knew from then that he would want to be working at a bank wearing a jacket suit something of the sort and that was what really motivated him at the time but then growing up in Calabar, he was inspired by his economics teacher who just had so much passion in sharing her knowledge with them. And so, he thinks it was because of her why he chose to do economics at UWI and then he did well at UWI surprisingly. He was not the amazing student in interpreting but because he loved economics so much it became just second nature and he just did well at it and now he’s serving as a Fellow at the Office of the Prime Minister. What they do is that they're pushed into different projects to assist wherever they can. And he’s actually assigned to the National Export Import Bank of Jamaica which is the EXIM Bank working in strategic planning just assisting where he can in the bank achieving its goal.   Lavois stated that when he got the invitation was when he actually knew that there was even a Customer Service Association existed, so much so a Customer Service Week. He thinks that we are transitioning as an economy from just a manufacturing point of view and we have now transition to services, where are in a service led industry, our economy where services are really taking up a large portion of what we do generally. He finds that as well that service has become almost as a sign, it is what differentiates you because everybody offers pretty much the same goods and services and if you're not able to differentiate yourself in this very competitive market it is difficult for you to survive. So, he thinks service excellence and just the service that you offer is key in the longevity of a business is.   Lavois stated that he’s a little different, he doesn’t like interaction that much which is a sad case in some senses, but he likes being able to just go in and get what he wants and leave. And so, the easier you make that process for him is the better. So, if there is no hassle in getting what he wants, there's no long lines, if there is no long amount of persons to speak to in getting whatever he wants from you as a company, then it makes it easier for him. He actually remembers studying in the UK and it's not particularly one provider of a service, it's just how easy it is to do anything that you want to in that. If there's something that you want, you can always know that the option is online and that is what he found was the difference between the UK and Jamaica. Everything is so much easier to do because it's online and he find as a young person and especially as a tourist somewhat because he was a student. It would be not have been easy for him to find certain places or to know where to look for certain things, he just had to google it and it made sense because he could just purchase it there online and have it shipped to him. So, he thinks that was what made the difference between Jamaican experience in terms of shopping and a UK experience, everything was just there for him to find online. So, that was one major that has caught him with shopping or purchasing anything. Yanique stated that one of our guests a couple of months ago wrote a book called The Effortless Experience and it's really been something that she has thought about for a very long time in terms of what customers are looking for and a lot of times not just yourself even other people that she has interviewed are just generally having conversation. People are actually looking for as you said an experience that requires them to put as little effort as possible which is why the online is such a remarkable experience for most people because if you can do the transaction literally at your office desk or while you're sitting in a doctor's office with your kid waiting to see a dentist or while you're sitting in an airport waiting to catch a flight. It makes your life that much easier.   Lavois stated that it's a little bit difficult particularly because in the locust fair we're not necessarily at that place where we could market online things. We are somewhat behind the world in that particular sense, but it wouldn't hurt for us to still push to get there. He thinks if we can market our things online and allow transactions to happen, he thinks the Prime Minister himself is trying to get us to that place where an economy meaning we're just doing everything digitally and for transactions to be easily done, quicker and that transaction cost being safe and that's us being more efficient. Apart from being online you want to be everywhere, your customers are everywhere, you want to be on all social media networks as well and this links back to the presentation that he did at the Customs Service Association. What it speaks to is us as millennials being your major target markets, we are reaching or spending peaking year and so we're going to be in your faces, we are going to be your customers. And so, what you have to do as a strategy to reach us as millennials is to just be everywhere. Twitter, Instagram, social media, anyone where you can possibly be that you know your market will be, you should be. You can provide a self-service service if there is something that you can implement in your organization that allows that customer to just go in and to come out as quickly as possible, to just get what they want from you and leave he thinks that would be very good to implement. Probably just be personal, understand that each customer’s need is probably different. And so, how you interact with each one of us will make a difference as well. And then answer quickly in case we have any queries are not, just be very quick about it because we are very impatient and as customers we want it and we want it now. So those are probably just one, two, three tips that he could probably offer with any organization that wants to just make it effortless for their customers. When asked about why he thinks people want things now versus 10 or 15 years ago. Lavois stated that’s just how we are. He thinks that's just the general nature. Instant gratification is what we desire or want something that is just very natural. We get that satisfaction from having it now and the impatient is not something that we can work with. He thinks that technology has definitely helped to propel that desire. Technology has allowed us to access things very quickly than, quicker than we thought possible, initially and because we are now used to technology granting what we desire quickly, it has now become second nature that we just want it because it can happen, it has propelled us to that kind of mindset where it needs to happen, and it needs to happen now. Which can also be a bad thing, but it is a good thing in a sense.   Yanique agreed that stated that the reality as she say to people generally customer experience is constantly evolving so we're here discussing what customers want now, about five years from now it's probably going to be completely different from what we're discussing. The customer is driving that whole change, back in the day when there was no social media you basically had to just probably complain via writing or state any challenge you have by writing, you really didn't have much power because nobody knows that you wrote the letter but a customer has so much power now with social media, they can blast a company whether they're doing well or they're not doing so well, on any of these platforms and it literally reaches millions of people in seconds.   When asked about staying motivated, Lavois stated that how grew up and he thinks this is how he ended up in strategy planning because he just always had a plan in his head and he doesn’t know what drove that plan but there was always something in the back of his head saying this is what I want to do next. So, he remembers going to high school or going into UWI, he would simple plan out the courses that he wants to do from that first year, he would know what he wants to do in second year, what he wants to do in third year, what’s he’s going to do after the degree and so there's always a one-year, two-year, five-year plan. But there was something in the back of his head where he sees himself. He sees himself being successful, as himself making some impact in Jamaica locally and probably even the world. He just sees himself doing things and because that in the back of his head, he knows he gets up every day knowing that this is just my next step towards getting where to go. He doesn't think he’s satisfied with where he is, so he believes that this satisfaction somewhat is what drives him. At the same time, he grew up with parents who gave everything they had for their kids. He has seen his father work with entities that he did not like, that he did not enjoy, he endured jobs that he probably wouldn't have wanted to do just because he had children to see through life and so this is a contribution for his parents, he could not take that for granted. So, he knows that there is something for him to do to allow his father and mother to enjoy the life they wanted. At the same time there is so much that we can change and there's so much that we can impact. He feels like work in itself is not necessarily what you bring to the table but how you make people feel and so there’s so much that we can do and that keeps him motivated everyday.   Lavois stated that he thinks he has probably experienced that before where there's some internally or people internally who don't necessarily have the same drive that you have. And he thinks from his own experience, what you need to do is to understand your own employees first of all because it's not that it might be eluding them it's just that you're probably not bringing the same message across very well. And so, what he encourages people to do is to look internally to see if there's something else that you can do to make that difference. So maybe it's that you just need to find out who that person operates and then do something else out of the ordinary that would probably get the reaction that you want and that kind of energy going forward with the business strategy and if that doesn't work. It's how you interact with them as well, it is that your own enthusiasm about it cannot bring out that same enthusiasm in them, he’s not sure what else can be done but he thinks there is an internal approach that needs to take place first to kind of look at who the person is, how they operate and then try your best to get that same enthusiasm out of them. And he thinks everybody has that side to them and it's just how you unveil it.   Lavois stated that Whatsapp is a very good tool and it's not only for personal social media vibes, it's also his way of finding out information, this is how you keep current and it's surprising, a lot of people would not even realize that a lot of the information that you hear or find comes from social media platforms. He thinks WhatsApp, Facebook, all of these social media platforms allows us as millennials in a sense or even everybody to kind of keep up to date because the news is always there. And so, us as millennials don't necessarily read newspapers. He has to do it and ensure that he does to keep up. But at the same time the same news that would be translated into print is on social media platforms, so it forces us to kind of be up to date with information. So, he thinks any social media platform is definitely necessary for him.   Lavois shared that he’s not a fan of reading, he’s not surprisingly. One particular book that has had some impact on him is a book that he actually read a long time ago, it’s called The Purpose Driven Life: What On Earth Am I Here For? by Rick Warren and it's a more spiritual side in terms of reading. It was just him trying to find out what is it that he was here to do, what was his purpose here and what impact he could make. Apart from general reading, he loves reading quotes and inspirational messages and the one that he has put before mentioned in the bio was Jared Kintz and what Jared Kintz said was, “Whether you live to be 50 or 100 makes no difference, if you've made no difference in the world.” And that has hit him so much because he realized if you are just here on earth and I'm not really making any difference then your life really makes no difference because you’re not impacting anybody's life and he feels like we are here and we're here to make so much of a changing in this world that we should just always attempt and aim at that and so if you're not making a difference then what purpose really does your life serve.   Lavois stated that for his recent birthday, he decided to create a theme for his birthday which was “No fear, no pride, no compromise” and what the theme tried to do was basically to encourage him to go after everything he wants to do. He grew up with a lot of pride in a sense which kind of hindered him from doing a lot of things because he was afraid of what people would say and how they would see him, at the same time that was the fear component, that was the pride component and there was no compromise meaning he would not give up who he was to achieve anything that he wants. He has so many goals but there are so many roads to get there but he doesn’t want to give up who he really is and he’s not going to compromise who he is to get there. So, he’s very excited about the journey, he has executed a few things that he really wanted to do, and he has gotten over the fear of doing them simply because he thought people would see him in a particular light and feels very good to just go after your dreams. So, for this birthday he created that theme, no fear, no pride, no compromise and he’s just trying to accomplish whoever he wants to be in this life.   Lavois shared listeners can find him at – Facebook – www.facebook.com/lavois.cruickshank    Lavois Lavois stated that it is not necessarily a quote, it’s just something I use to refer to when times get really hard because these things happen. It's probably in a quote somewhere, it says “What man has done before, man can do again.” which pretty much speaks to us being able to overcome any particular situation. What he does in his very difficult times is to think about other people who have overcome the same struggle or the same situation and then draw strength from that and it makes it easier almost because it gives us a certain level of courage to kind of still go through with this particular battle that we're having. GELDZAKEN - De Nederlandse banken zijn geslaagd voor de Europese stresstest, kunnen we opgelucht ademhalen of komen er nieuwe problemen? Harald Benink, hoogleraar Banking & Finance aan de Universiteit van Tilburg legt uit in een gesprek met Janneke Willemse.Er wordt getest of banken weerbaar genoeg zijn tegen een eventuele volgende crisis. “Onder meer wordt er gekeken naar de financiële reserves van de banken”, zegt Benink.Alle banken slaagden. Waarom was de test eigenlijk nodig? “De huidige financiële crisis heeft ertoe geleid dat overheden banken moesten financieren om overeind te blijven. Dat moeten we in de toekomst voorkomen.”Een van de lessen uit de crisis is dat we naar een unie van banken moeten toewerken in Europa, met één goede toezichthouder die onafhankelijk is van de nationale politiek. “Dan is de controle beter.”De ECB heeft in de test onder meer gekeken naar de woninghypotheken. “Nederlanders zijn gelukkig trouw in het aflossen.”De vraag is volgens Benink wel of de test streng genoeg was. “Het is beschamend voor banken om te zeggen dat ze fout zitten.”In Italië faalden acht banken. “Zij moeten op eigen houtje miljarden euro’s aan gaan trekken om hun tekorten weg te werken”, aldus Benink. “Er zijn bovendien verborgen verliezen die ook moeten worden opgeschoond.”Veel Europese economieën zijn daarbij nog instabiel, er is sprake van krimp. Daarom is niet goed te zeggen of alle “rotte appels” uit het systeem zijn.“We moeten naar een systeem van minstens 10 procent eigen vermogen in de kassen”, vindt Benink. “De huidige vier procent is te fragiel.”“Al zijn banken geslaagd voor de test, de kwetsbaarheid is niet altijd weg”, zegt Benink. “Toezicht op de kapitaalratio’s is daarom van belang.
