This is a true crime, local history, and storytelling podcast. I write about crimes, I set the scene, connect story themes, I talk about the things that happen here, in Massachusetts and New England. This episode is about sexuality, consent, sexual violence, murder, and defending a loved one's privacy in death. Listen with care.Episode 50, Lizzi Marriott: A Life So Bright, Dover, New HampshireLizzi Marriott would have celebrated her 30th birthday on June 10 this year. She will be forever 19. Returned to the earth and sea that she loved so much. Growing up in Westborough, Massachusetts, she went to Westborough High School, Class of 2011. Lizzi Marriott set her sights on becoming a marine biologist. She had a special love for the ocean and all of its creatures. Her college essay was about her desire to protect marine life, a passion that was sparked during a weeklong marine biology camp in ninth grade. Lizzi was passionate about a future in the field of marine science. Her love flourished as a volunteer at the New England Aquarium in Boston. She was often seen saving wildlife, whether it was a frog or a turtle, something crawling or slippery, she loved everything about it. The University of New Hampshire in Durham was her dream school So it is no surprise that Lizzi was ecstatic when she got into the marine biology program. She began her sophomore year in the fall of 2012. Tuesday, October 9, 2012, started out pretty ordinarily for Lizzi. She was a few weeks into her first year at UNH, loving her studies in marine science. She was working, making new friends. She told her aunt and uncle she'd be going out after class that night and would be home later. Lizzi went to her chemistry lab until 9:00. At 8:55 pm she sent a text saying she was going to visit a new friend, someone she met at her retail job. She had recently made friends with an 18-year-old who worked at Target, a woman named Kathryn McDonaugh who went by Kat. The two traded text messages and made a plan to meet at her Dover apartment to watch a movie. Lizzi would make the short drive from Durham to Dover, the fastest route would take 13 minutes.  Lizzi did not made it back to her aunt and uncle in Chester where she lived. While it did make them nervous, they tried to pass it off as a teenager enjoying a new friendship and staying up too late. They figured she'd just crashed at the friend's place. But when there was no sign of Lizzi on Thursday, everyone knew something was very wrong. The reversal of Roe v. Wade would make it difficult or impossible for millions of people to obtain abortions, but would also open the doors to criminally prosecute people who seek or obtain an abortion. And in our technological age, that criminalization brings new, frightening opportunities for digital surveillance by law enforcement agencies or anti-abortion vigilantes. In this panel from Aspen Digital, “Digital Surveillance and the Fight for Reproductive Rights,” three experts in digital privacy and civil rights walk us through the risks and existing practices, and share what can be done: Wafa Ben-Hassine from the Omidyar Network, Tiffany Li from University of New Hampshire School of Law and Yale Law School's Information Society Project, and Cynthia Conti-Cook from the Ford Foundation. The panelists are also joined by U.S. Senator Ron Wyden of Oregon, a longtime advocate for digital privacy, and Vivian Schiller, the Executive Director of Aspen Digital, moderates.

Join two patent experts (one is a historian) for a fun debate about the ethics and economic impact of America's patent system. Last month, President Biden's Administration made the extraordinary decision to support the suspension of Covid vaccine patent rights. While pundits weigh our moral obligation to help other countries against the gravity of patent rights for America's businesses and their leadership in innovation, we decided to ask an entirely different question - a seminal question. What is a patent anyway? What rights does a patent give a patent holder? And where did patents come from? And why has patent law - a highly technical field - has had such a complicated history? To get the answer to these questions and learn more about the history of patent law, we turned to two experts. Steve Pepe is a partner at the law firm of Ropes and Gray with 25 years of experience in litigating patent infringement cases in virtually every important patent jurisdiction. He's been lead counsel in many significant patent suits in the fields of computer technology, semiconductors, telecommunications, consumer products, and mechanical systems. Mr. Pepe has been recognized as a Super Lawyer every year since 2013 and has taught patent law and Intellectual Property at Touro Law School. Click this link https://www.ropesgray.com/en/biographies/p/steven-pepe for the extensive list of his publications, presentations, and awards are available on his homepage. Sam Brenner is an attorney with a Ph.D. in U.S. history – our kinda guy! He is Counsel at the law firm of Ropes and Gray. Dr. Brenner litigates intellectual property cases in technical fields, including telecommunications, electronics, software and hardware, semiconductors, and the life sciences. He counsels clients on patent licensing strategy and also has a prolific pro bono practice. Dr. Brenner has taught at the University of New Hampshire School of Law, the University of Michigan, Brown University, and the University of Rhode Island. Click this link https://www.ropesgray.com/en/biographies/b/samuel-brenner for his bio and long list of publications, presentations, and other accomplishments and awards. About the law firm of Ropes and Gray (www.ropesgray.com/en): Ropes & Gray is one of the world's most prestigious law firms, with 1,400 lawyers, known for its work in the private equity, asset management, life sciences, health care and technology industries. Over a century and a half, it has provided legal advice to the world's most exciting brands - Samsung, Cirque du Soleil, Dunkin' Brands, among many others. The firm has also advised nearly every major COVID-19 vaccine manufacturer on legal or financial issues associated with bringing vaccines to market. Ropes & Gray also recently played a role in a $40 billion deal to take public Grab, one of the biggest ride-hailing and delivery services apps in Asia, which speaks to the firm's global reach and its ability to handle complex legal issues. In 2015, Ropes & Gray litigated, and won, at the U.S. Supreme Court the key case that extended marriage equality to all 50 states; the case was Obergefell v. Hodges.

Our children’s first digital footprints are made before they can walk—even before they are born. More and more parents are using fertility apps to aid conception, posting ultrasound images to social media, installing baby monitors with built-in AI, and storing terabytes of baby pictures in the cloud. Educator Leah Plunkett arrived at Town Hall to examine the implications of this phenomenon, which she calls “sharenthood”—adults’ excessive digital sharing of children’s data. Drawing from her book Sharenthood: Why We Should Think before We Talk about Our Kids Online, Plunkett cautioned parents, teachers, and other trusted adults against unwittingly compiling digital dossiers for children that could be available to everyone—friends, employers, law enforcement—forever. She outlined the mistakes adults make with kids’ private information, the risks that result, and the legal system that enables “sharenting.” Plunkett unpacked the faulty assumptions made by our legal system about children, parents, and privacy. Join Plunkett for a discussion of why we should think before we share our kids’ data—the internet, she says, needs to forget. Leah Plunkett is Associate Dean for Administration, Associate Professor of Legal Skills, and Director of Academic Success at the University of New Hampshire School of Law. She is Faculty Associate at the Berkman Klein Center for Internet and Society at Harvard University. Presented by Town Hall Seattle. Recorded live in The Forum on February 18, 2020.

Roberts, Associate Professor of Law at the University of New Hampshire School of Law, discusses her article "Trademark Failure to Function," which will appear in the Iowa Law Review. Roberts begins by describing what trademarks are for and when they exist. She notes that a mark must be distinctive and be used as trademark in order to function as a trademark. But the Trademark Office and the courts tend to emphasize distinctiveness and de-emphasize use as a mark. She argues this is a problem, because it does not reflect how consumers actually experience marks, and suggests that distinctiveness and use should be measured together. With her dual appointment, she both helps train the next generation of attorneys in the state in the application of legal principles to health care, and works with the Institute on some of the most challenging health care problems facing the state today. In this podcast we explore Lucy’s career, a journey that took her back and forth between public service and private practice in several states and regions of the country, including working in the office of the New Hampshire Attorney General, being a senior shareholder in the firm of Rath, Young and Pignatelli, and finally before joining the faculty at the University of New Hampshire, serving as the Legal Counsel to the Governor as well as senior health policy advisor. I think the thing that struck me most about my interview with Lucy was her commitment to service throughout her career. From the time she was in law school to through her time in a high powered private practice, she made time to provide public service. When the governor asked her to serve as her legal counsel, Lucy’s career was in full bloom. She shares the advice she received from Tom Rath, one of the principals in her firm, and he told her: “You practice in the New Hampshire Bar, when a governor asks you to serve, you have to be hard pressed to say no… that’s what we’re here for, that’s what we do in New Hampshire… when the governor asks you to serve you should say yes.” I think that says a lot about not only Lucy and her firm, but the legal community in New Hampshire. for more information about this interview, please see our web site, http://healthleaderforge.org
