In 2021, federal rules from the 21st Century Cures Act mandated that most clinical notes be made available in real-time, online and free of charge to patients. This practice, commonly known as “open notes,” was a significant step towards enhancing medical information transparency–– a vital step in reinforcing trust in the provider-patient relationship. However, it also introduced complexities, raising questions as to what to include in the notes. “The ethical analysis does not always align with the legal analysis, and these are conversations that ethicists are aware of,” Steven Bondi, MD, JD, says. Dr. Bondi, a lawyer turned doctor, is renowned for his expertise on the Cures Act, Open Notes and Electronic Medical Records. He specializes in pediatric medicine at Golisano Children's Hospital and is an associate professor within the Department of Pediatrics at the University of Rochester Medical Center. “I think that knowledge is important, and we need to know what the law says and what its parameters are and when we can use the exceptions,” Dr. Bondi says. Dr. Bondi recommends multiple resources on this topic. He suggests visiting healthit.gov and navigating to their information blocking section for informative FAQs and webinars. He also recommends the Guttmacher Institute as a source for general knowledge around adolescent health and privacy. Lastly, he explains that he was recently a part of the American Academy of Pediatrics' committee on medical liability and risk management where he helped produce a monthly column called ‘Pediatricians in Law.' This week's "Conversation from the Vault" comes from September 2021, when Anthony Villiotti of NASH kNOWledge joined Louise Campbell and Roger Green to discuss what he considered the "biggest Fatty Liver story of the summer."In his answer, Tony pointed to two studies published during the summer. The San Antonio Military Medical Center study confirmed work done a decade earlier that suggested overall NAFLD and NASH incidence in a population of asymptomatic middle-aged Texans (37% NAFLD and 14% NASH) might be far higher than the most common publicly quoted numbers (25% and 5,6%, respectively). As we wrote in our conversation synopsis at the time, "Tony and Louise Campbell agree on the importance of educating children starting in their early years of schooling. Tony also comments on his belief in grass-roots education and hopes that as the COVID-19 pandemic abates, he will have more opportunities to do so. Louise talks about the need to educate/motiave primary care practitioners and related specialists to test more frequently and learn about the role the liver plays in non-communicable metabolic diseases they treat more frequently."

Is your dental office using the best methods for securing patient information? When was the last time you reviewed your process and made an update? On this episode, Andrea and I jump into an important conversation about securing patient information, controlling designated agents, electronic record-keeping, and much more. If you are ready to up your game and make sure your office is ready for any dental compliance issue, have pen and paper ready, you don’t want to miss a minute of this informative episode! Using designated agents properly. I get it, you want to delegate as many roles and responsibilities as possible in your dental office but how do you make sure you are following the right guidelines? Do you have a process in place when it comes to designated agents? There are a lot of different aspects of controlling your designated agents that you need to consider and it can vary from state to state. Listen to this episode as Andrea, and I discuss this critical topic and make sure to check out the link to the blog post I wrote about this topic - you can find it in the resources section at the end of this post. Don’t cut corners when it comes to securing patient information. One of your most important roles as a dental care provider is to ensure that patient information is kept safe and secure. Did you know that many dental offices have habits and common practices that put patient information at risk every day? It’s true! You can avoid that from happening in your office by taking a few simple steps. Make sure everyone who uses a computer has their own login credentials. Do not allow anyone in your office to use a computer without logging in with their credentials. When someone leaves the room, make sure they lock their computer! These steps are by no means an exhaustive list of things you should do to secure patient information, but it can serve as a helpful starting place. To learn more about this critical topic, make sure to listen to this episode! Paper or electronic record-keeping? With the constant flow of updates and new regulations do you find it easier to stick with your old paper record-keeping system? Or do you find it easier to have all of your patient information digitized and available on a cloud? Currently, you don’t have to pick one way over the other! If you prefer the old-school method of paper records, that’s fine, but I do suggest moving to digital. More information can be found online at listenmd.com. Since the dawn of medical records, maintaining accurate information has been challenging. Jain discusses ways that ListenMD can help. As Jain explains, patients are now able to use their app to put them in the center of the data collection process, which improves their chances for better health. Jain stresses the importance of communication in health care, especially in regard to sleep. Regarding patient care, Jain states that patients need to be looked in the eye and talked to directly so they can get the attention they deserve. Jain talks about obesity rates, how they are increasing, and thus—so is apnea.  Jain talks about the advances in auto-titrating CPAP devices used by some patients with sleep issues. He explains how the technology can vary the pressure and deliver the best breathing possible for each patient, tailored to their daily needs. CPAP is an acronym that stands for Continuous Positive Airway Pressure therapy. CPAP is a useful treatment for obstructive sleep apnea. A CPAP machine contains a hose and mask, or sometimes a nosepiece, and it can deliver a steady air pressure to control breathing and keep it regulated. Finally, Dr. Jain provides some real advice for those who are concerned that they may have a sleep disorder, and what they can do about it. And he underscores the importance of quality sleep, and the dangers we face in our daily environment if we are performing activities, especially driving or operating machinery, when sleep deprived.
