C'était il y a un an, jour pour jour. Le 18 décembre 2023, à minuit cinq, le plus grand dépôt de carburant de Guinée explosait sur la presqu'île de Kaloum, à Conakry. Plus de 20 morts et plusieurs milliers de sinistrés. À l'époque, une enquête judiciaire a été ouverte « pour incendie volontaire ». Un an après, où en sont les investigations ? Et que sont devenues les milliers de personnes dont les maisons ont été soufflées ? Mamoudou Cifo Kétouré est enseignant et préside sur place le Comité des sinistrés des hydrocarbures de Kaloum. En ligne de Conakry, il répond aux questions de Christophe Boisbouvier. RFI : Un an après, est-ce qu'on connaît les causes de la catastrophe ?Mamoudou Cifo Kétouré : Non, aucune idée. Parce que nous n'avons reçu aucun enquêteur. Nous ne connaissons pas les résultats de l'enquête, et pire, nous n'avons même pas reçu les condoléances d'usage.Alors, suite à la catastrophe, une enquête judiciaire a été ouverte, «pour des faits présumés d'incendie volontaire». Est-ce à dire que ce n'est pas un simple accident ?Oui, c'est le gouvernement qui a été le premier à alerter pour parler de présumé incendie criminel. Et c'est lui qui a les moyens de la police, des enquêteurs pour faire connaître la vérité dans cette affaire. Parce qu'il s'agit de dizaines d'âmes perdues et brûlées dans le feu, un feu qui les consumait pendant une semaine. Il s'agit du plus grave incendie de notre pays, de notre histoire. Cela ne peut pas passer inaperçu.Alors certains évoquent l'hypothèse de voleurs de carburant qui se seraient introduits sur le site, qui auraient manipulé un objet…Nous ne pouvons pas croire à cela.Et qui auraient provoqué l'explosion…Nous ne pouvons pas croire à cela, surtout qu'il y a eu une réelle volonté de spoliation de nos biens. Tout ce qu'on nous a dit dans cette affaire-là, « tenez, voici des sacs de riz, acceptez que vous soyez relogés à 50 kilomètres de Conakry, de Kaloum, vous allez quitter la capitale », c'est un plan de recasement que nous avons refusé. Nous disons non.Alors, à la suite de cette catastrophe, on se souvient, il y a eu des messages venus du monde entier, de l'ONU, de l'Union africaine, du pape, de l'Union européenne. Est-ce que, grâce à cette mobilisation, les sinistrés ont pu être secourus ?Nous saluons cette mobilisation internationale. Il y a un nombre important de ménages qui ont reçu des sacs de riz. Ça, ça a été un apport important pour nous. Mais nous avons voulu recevoir aussi les feuilles de tôles, les sacs de ciment qui ont été offerts par les mêmes personnes et ce sont les mêmes autorités qui les ont reçues. Jusqu'à ce jour, un an après, nous n'avons pas reçu une feuille de tôle, et un seul sac de ciment. Rien. Ces sacs de ciment, ces feuilles de tôles, ils ont totalement disparu. Pour aller où ? Mais pire, il y a une volonté de spoliation de nos biens, parce que les sommes d'argent qui ont été reçues comme don, en remettant ça aux locataires, on leur dit que c'est pour aller trouver des maisons ailleurs. Nous ne vendrons pas nos terrains ! Il s'agit de biens qui nous appartiennent et nous ne sommes pas sur un domaine de l'Etat.Alors, le 27 mai dernier, le Premier ministre Bah Oury a annoncé 860 000 € pour les sinistrés, avec notamment une enveloppe de 2 millions de francs guinéens pour chacun des 55 propriétaires et une enveloppe d'un million de francs guinéens pour chacun des 322 locataires. Est-ce que ce n'est tout de même pas un geste concret ?Nous savons qu'il y a eu quelques sommes qui ont été remises à quelques personnes. Mais je dis que la commission qui gère, elle gère dans une opacité sans pareille. Il n'y a pas de communication : qui a reçu ? Qui a donné ? L'argent vient de qui ? Mais pourquoi vous nous parlez toujours de libérer ces constructions pour que vous veniez faire quelques constructions ? Nous disons non. Il y a une volonté de spoliation de nos biens.C'est-à-dire que vous acceptez les indemnisations, mais vous n'acceptez pas de déménager et de quitter la Presqu'île de Kaloum pour aller en banlieue. C'est ça ?Nous acceptons l'indemnisation, ça on est d'accord, mais nous ne quitterons pas, parce que ce n'est pas un domaine de l'État, voilà.Parce que la Presqu'île de Kaloum, elle est au cœur du quartier de l'administration, qui abrite notamment la présidence et la plupart des ministères. Et vous soupçonnez certains de vouloir vous faire déménager en banlieue pour pouvoir récupérer vos terrains qui sont évidemment très convoités, c'est ça ?Mais cela se confirme aujourd'hui, parce qu'en lieu et place d'enquêtes, on nous parle toujours de recasement, de relogement. Alors, à partir de là, chacun peut tirer sa conclusion.Vous voulez reconstruire vos maisons ?Oui, nous-mêmes, par les apports qui sont venus, c'est-à-dire ces feuilles de tôle, ces ciments et les montants qui les ont accompagnés, vous devez nous les donner. Pourquoi nous tenons à ce point-là ? Parce que, si nous ne sommes pas indemnisés, s'il n'y a pas d'enquête, il y a risque de récidive. Vous savez, la Presqu'île de Kaloum, c'est quand même l'endroit le plus convoité du pays.Parce que c'est là que se trouve la présidence ?Mais c'est ici que les terrains coûtent le plus cher. Nous, nous sommes les autochtones d'ici. Voilà.Voulez-vous dire que l'objectif des gens qui ont fait exploser ce dépôt de carburant, c'était peut-être de vous chasser du quartier ?S'il n'y a pas d'enquête, chacun sera amené à tirer sa conclusion. Mais nous pouvons quand même avouer que nous n'avons pas été traités dignement. Ce qui amène à des interrogations quand même, à se demander le pourquoi de cette situation.Pensez-vous à des criminels qui voulaient détruire le quartier pour pouvoir ensuite récupérer le terrain ?Nous attendons les résultats de l'enquête.Mais vous pensez que c'est une hypothèse sérieuse ?Oui, à ne pas négliger. Surtout que c'est un l'État qui a communiqué en disant qu'il s'agissait d'un présumé incendie criminel. Tout ce que nous pouvons demander au gouvernement, c'est de faciliter l'enquête. Tant qu'il n'y aura pas de transparence, nous ne participerons pas à un débat, à une discussion sur le relogement sur nos maisons.

Richard Allen has asked, once again, to have his charges dismissed.  This time, his legal team is says that evidence was destroyed.      So, what would lead to the case being dismissed?A case against a defendant can be dismissed due to missing evidence for several reasons, all of which revolve around the concept of ensuring a fair trial and upholding the principles of justice. Here are the detailed reasons why this might happen:1.) Insufficient Evidence to Support ChargesFor a case to proceed to trial, the prosecution must present sufficient evidence to establish a prima facie case, meaning there must be enough evidence for a reasonable jury to potentially find the defendant guilty beyond a reasonable doubt. If key pieces of evidence are missing, the prosecution may be unable to meet this burden. Without sufficient evidence, the judge may dismiss the case because there is not enough to justify continuing the prosecution.2. Violation of Due ProcessThe Fifth and Fourteenth Amendments to the U.S. Constitution guarantee due process rights, which include the right to a fair trial. If evidence that is crucial to the defense is lost, destroyed, or otherwise unavailable, this can constitute a violation of due process. The defense must be given a fair opportunity to challenge the prosecution's case, and missing evidence can impede this right, leading to dismissal.3. Brady ViolationA Brady violation occurs when the prosecution fails to disclose exculpatory evidence to the defense. Exculpatory evidence is any information that might be favorable to the defendant, either by casting doubt on the defendant's guilt or by mitigating the defendant's culpability. If evidence goes missing and it's shown that the prosecution did not disclose it, and this evidence could have affected the outcome of the trial, the case may be dismissed.4. Lack of CorroborationCertain types of evidence require corroboration to be admissible in court. For instance, some jurisdictions require corroborating evidence to support the testimony of accomplices or victims in specific crimes. If the corroborative evidence is missing, the primary evidence may not be sufficient on its own, leading to dismissal.7. Pretrial Motions by DefenseDefense attorneys can file pretrial motions to dismiss based on missing evidence. Richard Allen has asked, once again, to have his charges dismissed.  This time, his legal team is says that evidence was destroyed.      So, what would lead to a dismissal? A case against a defendant can be dismissed due to missing evidence for several reasons, all of which revolve around the concept of ensuring a fair trial and upholding the principles of justice. Here are the detailed reasons why this might happen:Insufficient Evidence to Support ChargesFor a case to proceed to trial, the prosecution must present sufficient evidence to establish a prima facie case, meaning there must be enough evidence for a reasonable jury to potentially find the defendant guilty beyond a reasonable doubt. If key pieces of evidence are missing, the prosecution may be unable to meet this burden. Without sufficient evidence, the judge may dismiss the case because there is not enough to justify continuing the prosecution.2. Violation of Due ProcessThe Fifth and Fourteenth Amendments to the U.S. Constitution guarantee due process rights, which include the right to a fair trial. If evidence that is crucial to the defense is lost, destroyed, or otherwise unavailable, this can constitute a violation of due process. INTERVIEW - La ministre de la Culture, Rima Abdul Malak, en a fait une de ses priorités pour l'année 2023 : rendre les œuvres spoliées par l'Allemagne nazie et le gouvernement de Vichy, entre 1933 et 1945. Mercredi 19 avril 2023, la ministre a présenté le projet de loi-cadre visant à faciliter la restitution de ces biens culturels, spoliés aux Juifs par les Nazis. Pour en parler, Virginie Girod reçoit Emmanuelle Polack, docteure en histoire de l'art et chargée de mission au musée de Louvre. “La spoliation est le fait de dépouiller légalement une population de ses biens. Elle laisse de nombreuses archives”. Terme à ne pas confondre avec le pillage, qui “contrevient aux lois internationales de la guerre. Il est sauvage”, explique Emmanuelle Polack. Le travail de documentation et d'inventaire des œuvres spoliées a été réalisé, durant la guerre, par la résistante Rose Valland : “Elle a un rôle d'espionne, et je dois vous le dire, nous travaillons encore et toujours sur les archives qu'elle a produites”, précise l'historienne. Sur environ 100 000 œuvres spoliées, 60 000 ont été retrouvées. Si 45 000 d'entre elles ont été remises à leurs propriétaires, toutes n'ont pas encore été récupérées. On this Hacks & Wonks week-in-review, Crystal is joined by the former Director of Progressive Majority who has now transitioned into public service but remains involved in numerous political efforts across Washington, EJ Juárez.  This week, Seattle Mayor Bruce Harrell announced his proposed budget for 2023-2024, and there are a number of questionable decisions that reveal where the mayor's priorities lie. Beyond moving parking enforcement back to the SPD, the budget invests in a police surveillance tool called ShotSpotter, which has been a failure in other cities where it's been implemented, resulting in lead to police overreach without a reduction in crime.  At the same time, Harrell's budget is calling to lower the cost-of-living increases for the city's human services workers, a choice that would require a change in law. At a time when inflation is hurting everyone, especially our lowest earners, and we're dealing with a number of public health crises and staffing shortages, the decision to effectively cut the pay of essential workers who are doing crucial work stands in stark contrast to the large hiring bonuses being offered to police.   King County Executive Dow Constantine and other leaders announced a new property tax that would provide $1.25B to help create new behavioral health crisis centers to help those in need receive necessary support. This proposal will need to be approved by the King County Council before being voted on in an April special election. We'll keep checking in on this plan as it develops. In a new update on the controversy surrounding former mayor Jenny Durkan's missing text messages, a forensic analysis has found evidence that these messages were intentionally deleted, not accidentally removed. As EJ reminds us, these public records concern an issue that resulted in someone's death, and their deletion has prevented their family from getting closure. If it's determined that these messages were in fact intentionally deleted, the implications are criminal. We'll keep paying attention to this story for updates. In the 42nd LD in Whatcom County, a State House race has seen a terrible, but not so shocking, revelation. GOP candidate Don Johnson attempted to scrub his social media feeds of racist, misogynist, and anti-semitic posts, but failed to do so before the Bellingham Herald recorded them. The Herald reported on the unacceptable posts this week, revealing a history of dangerous rhetoric and misinformation that Johnson hopped to hide. Ces derniers ont notamment été utiles à la redécouverte des archives du Commissariat générale aux questions juives et du service de restitution des biens des victimes des lois et des mesures de spoliations. Parmi les systèmes d'aide à la recherche, on trouve, entre autres la salle des inventaires virtuelle et la base de données ARYA. Lorsqu'en 1940 la Moselle est annexée par le Reich, les « indésirables » sont expulsés et forcés à laisser une grande partie de leurs biens derrière eux. Aussitôt, un organisme est mis en place afin d'organiser la spoliation des biens de ces « ennemis du peuple et du Reich ». In 2006, the Federal Rules of Civil Procedure rule-makers developed and put into practice amendments dealing with electronically stored information (ESI) and e-discovery. However, most of those involved believed these amendments did not adequately deal with lost or missing ESI or "the spoliation issue." In 2014 the rule-makers proposed Rule 37(e), which deals with the issue of spoliation equally across all federal courts, resolving the issue of inherent authority, or judges making decisions individually for each case. What are these changes and how will they affect the way businesses deal with e-discovery and data preservation? In this episode of The Digital Detectives, Sharon Nelson and John Simek interview ESI preservation expert James Kurz about how Rule 37(e) works and what the consequences are for the future of ESI preservation. Kurz explains that the rule, which only deals with ESI, proposes a three part test before considering spoliation issues: the ESI should have been preserved in the anticipation or conduct of litigation and is lost, the ESI was lost because the party failed to take reasonable steps to preserve the information, and the missing information cannot be restored or replaced with additional discovery. If this test is passed, the federal court may then impose remedies, or if intention is proved, order more serious sanctions. He explains that Rule 37(e) will make a more homogenous legal process for e-discovery, and will solve some of the controversy surrounding the costs of ESI preservation and e-discovery for businesses. Although the rule faces the Judicial Court, Supreme Court, and then Congress, Kurz believes it will go through and be effective in December 2015. James Kurz is a partner in the Alexandria VA law firm of Redmon, Peyton and Braswell LLP. His practice focuses on business litigation, including computer, software, and communications technologies cases. He also has an emphasis in the challenge of electronic discovery and the issues of information governance and co-wrote the white paper "The Long-Awaited Proposed FRCP Rule 37(e), Its Workings and Its Guidance for ESI Preservation."
