The family of deceased whistle-blower, Babita Deokaran feels aggrieved that the masterminds behind her assassinations back in 2021, are still out on the lose. This comes as TODAY marks exactly three years since she was gunned down outside her housing complex in the South of Johannesburg in August. Before her senseless killing, Deokaran had exposed fraud and corruption with the Gauteng Health Department. Six men involved in her murder were found guilty and were sentenced to between six and 22 years. The family's spokesperson and Deokaran's brother-in-law ,Tony Haripersad says the case has yet to be fully resolved. Sakina Kamwendo spoke to Investigative Journalist at News24 and Co-author of Eight Days in July, Jeff Wicks. He has written a comphrensive report of the finer details in this case...

I visited my parents on Waiheke yesterday and my Mum was telling me a story about an Uber driver she'd had in town who was taking her through Auckland's CBD, which – as most Aucklanders know, is a bit of a dive these days and certainly not easy to navigate if you're in a car. They've made it so impossible to drive through the city now – that like most cities these days - if you're in a car you're punished, they'd prefer you on a bus or a bike.  But that doesn't work for everybody and this driver was telling Mum how he'd been transporting a passenger with a disability, who was unable to get on a bus or ride a bike, so he was driving her to her destination, and it became apparent there was nowhere for him to stop to let her out. He realised that with all the parking taken away and all the cycle lanes and enlarged pedestrian paths, he'd have to stop a fair way from where she needed to get to, and she would have to walk back.  Worried about his duty as an Uber driver to deliver her safely to her destination, he parked further up the road where he could stop, and got out to help her. Now this was not a legit park, because there is no parking for cars on the main street, it was either a loading zone or a 5 minute park but it was his only option to get her as close to where she needed to be. But given her disability he realised she could not get their unaided. So he parked and offered to help her walk back to her destination. She was very grateful and he assisted her - slowly – at her pace – all the way back to where she needed to go.  Once she was safely inside – and very grateful, he returned to his car. There waiting for him was a $160 parking ticket. Aggrieved at this, once he finished his shift he wrote to Auckland Transport explaining the circumstances and contesting the fine. He argued that because of measures by Waka Kotahi to eradicate parks and make life difficult for cars, it had in fact made life difficult for those with disabilities too. He argued he was doing the only right thing an Uber driver should, which was to help get this person to their destination, she needed assistance, and he wanted to provide it given he could not stop exactly where she needed to be.  You may or may not be surprised to learn the response he got back. Auckland Transport denied his application to contest the fine, insisted he had breached parking rules by stopping there, and insisted he pay up the $160 dollars. Now what sort of kind caring society are we attempting to dream up here with all this ideology around ‘shared spaces' and making CBD's more user friendly, when disabled people are penalised, and those trying to help them get fined?  What message does that send other Uber and taxi drivers trying to help passengers with disabilities? And does this kind of behaviour not just discourage more people from coming to town? Surely there's a line – and room for discretion when it comes to unique circumstances? My Mum encouraged the Uber driver to keep writing to Auckland Transport until they acquiesced, but as he told her, whose got the time for that? Ironically the boffins bogged down in this bureaucracy have the audacity to call this long running campaign of car elimination “Streets for People”. But aside from cyclists, I'm just not sure which ‘people' they're thinking these streets are for now, given they're certainly not for Ubers, taxis or people with disabilities.See omnystudio.com/listener for privacy information.

Heartbroken and questioning everything he knew aabouot the world, Andrew threw down the gauntlet, and slapped Dusty across the face with his white debating glove. Intro The Bible describers times of unrest and instability are described as “birth pangs” or “birth pains.” The Bible often compares spiritual truths to things we understand. The birth pain metaphor seems particularly apropos and relevant to our current times. The Meaning of Birth Pains Birth pains in the Bible describes a society experiencing painful times of upheaval that lead to a consequential moment. This consequential moment is the result of decisions made in the past that compound over a period of time. The times of instability begin slowly and are few and far between. As those decisions compound, the times of unrest increase in frequency and intensity.  A cascading series of crises rocks a society. But still, the pain builds until human society resorts to violence out of which a whole new world of sorts emerges. God employs the “birth pains” metaphor in a variety of situations in the Bible.  Let's look at a few examples. Birth Pains in Jeremiah 4:31 For I heard a cry as of a woman in labor, the anguish as of one giving birth to her first child... Jeremiah's prophetic ministry embodied the birth pains metaphor. Injustice, deceit, idolatry, violence, and immorality dominated the culture. Aggrieved, the Lord of hosts sent the nation spiraling into chaos. But out of the chaos and pain and suffering emerged something beautiful. God purified the Jewish nation through chastening. Though they would never ascend to the heights of their fathers in terms of building an earthly kingdom, the post-exilic Jews played a vital role in God's plan for the world. They paved the way for a Child to be born Who would alter the course of human history for all time. Birth Pains in Matthew 24:8 But all these things are merely the beginning of birth pangs. The twenty-fourth chapter begins with Jesus exiting the temple complex. As He does so He makes a bold prediction: not one stone will be left on another. Forty years later, the rebellion of the Jews against Rome led to the conquering and destruction of Jerusalem, including the temple complex. The decades between Jesus's prediction and the destruction of Jerusalem were, at times, chaotic. Periods of uneasy peace were punctuated by wars, famines, earthquakes, persecution, betrayal, and false prophets. “But,” as Jesus said, “all these are the beginning of birth pangs.” The siege and destruction of Jerusalem followed in their wake. The Jewish historian Josephus described these days as the darkest episode in his people's history. And those days foreshadow the ultimate day when the pains of birth will suddenly strike the whole earth. Birth Pains in 1 Thessalonians 5:3 ...destruction will come upon them suddenly like labor pains upon a woman with child, and they will not escape. Paul foresees what things will be like in those final days. Though contractions trend closer and closer together, a woman in labor does not know when exactly the next contraction will come. So, too, will be the return of Jesus. It will arrive suddenly like a thief in the night, like a groom returning for his bride, like the final contraction before birth. And like the warnings of Matthew 24, what emerges from these birth pains is the unremitting wrath of God. Lift up Your Heads! If you have found yourself overwhelmed lately, I encourage you to take to heart the words of Jesus in Luke 21:28, “But when these things begin to take place, straighten up and lift up your heads, because your redemption is drawing near.” Pull your eyes away from the TV, the tablet, and the phone. Don't allow the fears and anxieties of those who do not know God to knock you off the path. Straighten up. Live the right way, live like you want to live forever, be the people God has called us to be. Lift up your heads. Jesus will return with a heavenly retinue. Look for His return, long for His return, set your mind on things above. Whether or not Jesus returns in this time is irrelevant.

The reality is, even if you just fall off the chairlift and get hurt, you can sue the mountain. Why? Because in click through, one way, non-negotiated contracts, especially with large financial players, there are certain rights that you simply cannot give up.”The international rule of law: “Generally, because these companies are regulated, consumer fights happen locally. They happen in your country pursuant to jurisdiction. They do not happen under international law. Because when you're regulated as a company, you are required to show up in that country's court system to have the fight. So this is very unique. For a lot of reasons, but most interestingly to me is because consumer arbitration as a world, as a group, as a community, this is really one of the first times that the question has not been consumers of this jurisdiction or consumers of that jurisdiction, but the consumers of the world and a community.”Demarcation of corporate assets: “Bitcoin, Ethereum, those are community assets. I think those should be minimally regulated. The corporations that utilize community assets to make profit from consumers, those are corporations trying to make a profit. And right now, they're doing a good job of wrapping themselves in the cloak of community assets, but they are not community assets. The internet is a community asset. Amazon is not. The blockchain is a community asset. Binance is not. And so I think that that is the line of demarcation that we need to have.”

This idea of Facebook’s to launch an Instagram for kids is rightly so getting push back. It’s a crazy idea.And I say that as a mother of 5 children all of whom have grown up with social media, and have come to find it thoroughly dissatisfying. Many of them, and their mates too.. have deleted multiple social media apps, they find it pointless, anxiety provoking, and tedious in equal measure. But the real concern for younger children is the constant pull to be online from an even younger age.The constant pull to check in on what everyone else is doing, which always looks way more glamorous than what you’re doing. Which triggers a negative response, a feeling of disillusionment about your own existence. “Why are we the only people not away for school holidays?” my daughter would sometimes ask back when Instagram ruled her life and everyone posted pics of themselves sitting on a beach somewhere while she was bored witless at home. It’s pressure that kids – and parents, don’t need.We grew up without knowing what every single person we knew was doing everyday and without pictures of what they all had for lunch. We didn’t have that constant comparison of what they were wearing or saying or doing. And on top of the comparison nightmare – which as we know, is the thief of joy.. social media is also very cause-driven these days. Often with things so complex half the people posting about them don’t even understand most of what they’re posting.Palestine and Israel posts are rife at the moment, before that it was protesting Asian hate crimes, before that Black Lives Matter, before that Me Too.. it’s a constant stress of what major political or social issue they need to sound aware of next. And that’s before we even get to cyber bullying and kids abilities to cope with that.Aggrieved by Facebook’s plans to aim this youth Instagram at 6 to 12 year olds, a group of US attorneys general wrote to Facebook’s Mark Zuckerberg asking him to drop this dopey idea. They said they were concerned “about social media's effects on the physical and emotional well-being of children, the potential for increased cyberbullying, possible vulnerability to online predators, and what they called Facebook's "chequered record" in protecting children on its platforms.”I mean if that’s not enough reason to put the brakes on I don’t know what is. Kids don’t need to get hooked online any earlier than they already are. They certainly don’t need social media at age 6. And you can’t tell me that Facebook’s responding to a need.. or a gap in the market. Show me the 6 year old crying out for some social media? Most of them don’t even have phones at that age.But as we know, not much stops Facebook if they think a profit is to be made. So I doubt they’re likely to press pause on this madness. Which leaves it up to parents, yet again, to be the bad guys and put the brakes on yet more stupidity from the tech giants, trying to push stuff onto kids who don't need it.

A complex intersection of economic, political, environmental, and social conditions are fueling the rise of populism, political polarization, xenophobia, and racism in The United States, and other countries. Indeed many predicted the rise of divisive politics and decreased social cohesion as economic inequality soared, with globalization and neoliberal politics further contributing to the increasing precarity of employment and earnings among the working and middle classes of western countries. While few have been spared these challenges, the face of these emerging angry populist movements, militias, and white supremacist movement's remains overwhelmingly male, white, and working class. Applying the lens of masculinities theory, this talk will discuss how aggrieved white masculine entitlement, multiple marginalization's influencing many men's ability to achieve the unrealistic expectations of hegemonic masculinities, and feelings of fear, hopelessness, and abandonment, are providing the fuel that has been ignited by the inflammatory rhetoric of populist leaders like Donald Trump. Speaker: Peter Kellett PhD RN Dr. Kellett is an Assistant Professor in the Faculty of Health Sciences at the University of Lethbridge and a research affiliate of the Prentice Institute for Global Population & Economy. In this podcast we will brief you on the NCLAT order in the matter of liquidation of Surana Power Ltd., the Corporate Debtor. The Adjudicating Authority had admitted application filed by operational creditor under Section 9 of the Code for initiation of CIRP against Surana Power Ltd. With non-receipt of any resolution plan, the corporate debtor was ordered to be liquidated. One of the operational creditors Bharath Heavy Electricals Ltd. (BHEL) had succeeded in an arbitration proceeding against the corporate debtor. The Arbitral Award declared BHEL as an unpaid seller and accordingly granted lien over the equipment and goods lying at the site of the Corporate Debtor. Pursuant to S. 52 of the Code, the Respondent i.e. BHEL informed the liquidator about its willingness to realise the security interest in the Asset of the Corporate Debtor. However, the liquidator filed an application before the Adjudicating Authority seeking directions against BHEL to permit the liquidator to cause sale of assets of the corporate debtor under Regulation 32 of the IBBI (Liquidation Process) Regulations, 2016. Strange right? Are we missing something? Yes. Let me take you back to 2010. On September 24, 2010, the assets for which BHEL had been granted lien, were already hypothecated to 10 Secured Creditors. Unlike BHEL, these creditors constituting 73.76% have relinquished their Security Interest into the liquidation estate of the Corporate Debtor. The liquidator argued that the charge of hypothecation is paripassu in nature to that of lien granted in favour of BHEL and hence, the liquidator filed application before the Adjudicating Authority for liberty to sell those assets so as to distribute it among all the Secured Creditors of the Corporate Debtor. The Adjudicating Authority, having established the differences between lien and pledge, observed that "Whenever any lien is created, the person having right of lien has a right to enforce the same against the asset in preference to charge of hypothecation." Accordingly, the Adjudicating Authority dismissed the application filed by liquidator and considered that BHEL is a secured creditor entitled to proceed under S.52 of the Code to realise its security interest. Aggrieved by this order of the Adjudicating Authority, the current appeal was preferred before the NCLAT. The liquidator argued that ten out of eleven Secured Creditors, representing together 73.76% of the total secured assets have relinquished their Security Interest into the liquidation estate and only because of the Respondent, i.e. BHEL, the Liquidator is unable to proceed any further with the sale of assets. In this context, the NCLAT invoked S.13(9) of the SARFAESI Act, 2002 and observed that any steps about the realization of assets by the Secured Creditors requires confirmation from the Creditors having at least 60% of the value of total debt. However, since in the present case, secured creditors having 73.76% of the value of total debt, i.e. more than the required 60% as per SARFAESI, are unwilling to exercise security interest, the same decision shall also be binding on BHEL. The NCLAT further observed that BHEL does not hold a superior charge and hence, it would be prejudicial to stall the liquidation process at the instance of such creditor having only 26.24% share in the secured assets which would also be detrimental to the interest of the remaining ten Secured Creditors. Nigeria has been losing about 44,000 barrels of crude oil daily since Saturday following the shutdown of the Odidi and Batan oil flow stations by protesting youths in some Delta oil-producing communities. Aggrieved youths from Odidi/Kantu and Diebiri-Batan communities in Warri South West Local Government Areas are protesting against alleged nonpayment of bills owed the host communities by the major oil-producing companies. The protesting youths had vowed that the station would remain shut until the operator, Neconde Energy Limited, had cleared all bills owed the host communities. The spokesperson for the Diebiri Batan community, Mr Peter Dio, insisted that the Batan flow station would remain shut until the alleged debts owed the community were cleared. One of the most famous cases in U.S. history involved a writ of mandamus -- an order to a government agency or official to behave in accordance with the law. In Marbury v. Madison, William Marbury asked the U.S. Supreme Court to order the U.S. Secretary of State (James Madison) to affirm Marbury's commission as the D.C. Justice of the Peace. Today, courts still use these writs to compel government action. In this episode, Michael Morguess discusses his new solo practice in southern California, where he frequently seeks writs of mandamus for clients fired by government agencies. Michael's clients come to him when they need to appeal an unfavorable result from an administrative hearing. The job of the court is to review the administrative proceedings to ensure that the agency proceeded in accordance with the law, that the employee received a fair trial with the agency, and that the agency's decision is supported by the evidence and findings. Michael has not only spent many years helping government employees, but he's also been across the aisle representing cities and in chambers clerking for a California state judge who ruled on the very writs he seeks. So when he writes and argues briefs for a judge, he knows exactly what everybody is thinking. With jobs and livelihoods on the line, Michael faces a lot of pressure, but the intellectual challenge and thrill of victory buoy his non-traditional litigation practice.
