Watching the Super Bowl is one of the highlights of my year. While I'm always a little disappointed that the Broncos hardly ever make it to the big game, the commercials never let me down. This has been especially true with a handful of personal injury commercials this year. Maloney-Lyons had a particularly hilarious commercial that aired during the Super Bowl and I'm excited to have David Maloney as our guest today. David: Hey. Thanks for having me, Lindsey. Lindsey: Well, tell us a little bit about yourself, about your practice. David: Well, what's interesting is I had a commercial about what made me decide to become a lawyer to begin with. Which is that when I was 13, I had to read To Kill a Mockingbird for Mrs. Wesselman's English class. And then, that was followed up with us being able to watch it as well. And when I read it, I first started thinking, "Okay. I think this is what I want to do." And then, when I saw it, that solidified it further. And then, I was on... My father had visitation with me. I think it was like over maybe spring break or something and we were driving somewhere on the New York State Thruway. And I had told him that we had read this book and watched this and that I thought that I wanted to be a lawyer. And at that point, he told me that that was what he had always wanted to be. But that my being born kind of changed plans, and so that then bolstered it even more. And so, I decided to become an... I went to law school and I knew I wanted to represent the underdog. And then, you realize criminal law is a little different. And then, you realize also that when you're dealing with personal injury, the victims, since they're going up against big insurance companies, are usually the underdog. So ironically, years later after I'd become an attorney, I did an ad that... Especially being down here in Mobile, Alabama, which is right up the street from Monroeville, which is where the courthouse is that they still have that to Kill a Mockingbird plays every year, because that's where a lot of it was based off of. It resonated to have a commercial that focused on that. Lindsey: Well, and To Kill a Mockingbird, I think most of us read that that freshman year of high school. And Atticus Finch was such a profound character and so meaningful for people on a lot of different levels, both for career aspirations in terms of social justice. And it was one of the first books that I really connected with and it inspired my love of reading. So I love to hear that you say that and that that was part of your journey as well. David: Well, it struck a chord in the idealist in me. Lindsey: Yeah. And I mean, just such a well-written character from a literary perspective....

An OWCP traumatic injury is defined as: “A wound or other condition of the body caused by external force, including stress or strain, which is identifiable as to the time and place of occurrence and member or function of the body affected. The injury must be caused by a specific event or incident or series of events or incidents within a single work day or work shift.”Notifying your supervisor and filing a claim & Immediately notify your supervisor of your injury and your intent to file a claim using ECOMP. Request your supervisor's Postal Service email address to use in registering in ECOMP. Once you have registered in ECOMP, go to the top of your dashboard and click New Claim. Follow the directions for filing a CA-1 claim for traumatic injury. If you are filing the claim within one week of the injury, request form CA-16, Authorization for Examination and/or Treatment (must be supplied by your manager within 4 hour. Request a Form CA-17 Duty Status Report from your supervisor. The Postal Service is responsible for filling out the job requirements on the left (side A) of the CA-17. Once your doctor has completed the CA-17, make a copy or take a picture of the completed CA-17 and give the original to your supervisor. Your doctor should provide you with their report so you can send medical reports directly to OWCP. You can upload medical reports into your claim file via ECOMP. When the occupational & safety personnel ask you for your records you are required to provide them with your return to work CA forms CA-17 or CA-5C. Your medical reports are protected by the Privacy Act and should be sent directly to OWCP, not the Postal Service. OWCP reversed course on that new announcement literally two weeks later with no real explanation why they reversed course. On January 10, 2025, the Division of Federal Employees' Compensation (DFEC) announced significant updates to the Federal Employees' Compensation Act (FECA) Procedure Manual, specifically Chapter 2-0808, addressing schedule awards and permanent disability claims. These updates, outlined in FECA Transmittal 25-03, introduce changes aimed at enhancing fairness and efficiency in the claims process. FECA bulletin 25-03 was great new changes and I was excited about them…and OWCP killed it and withdrew it two weeks later…. So let's read the new OWCP bulletin on impairment ratings announcement. RELEASE – REVISION TO FECA PROCEDURE MANUALCHAPTER: 2-0808, Schedule Awards and Permanent Disability ClaimsFECA TRANSMITTAL NO. 25-04 - February 10, 2025Upon further review, it has been determined that to ensure all claims are treated fairly and consistently, a single version of the Guides should be used. Accordingly, DFEC is hereby revoking FECA Transmittal 25-03 and reinstating its procedures in effect prior to January 10, 2025. Effective the date of this transmittal, Form CA-7, Claim for Compensation, should again be used to file claims for schedule awards under the FECA. All schedule award claims, including those submitted with a CA-9 since January 10, 2025 in which an award has not yet been issued, will be processed under the procedures effective with this transmittal. Any claim filed in the Employees' Compensation and Operations Portal (ECOMP) that has not yet been submitted to OWCP will be cancelled so that a CA-7 can be filed. Simplifying FECA Bulletin No. 24-06: A New Streamlined Process for War Hazards Compensation Act (WHCA) ClaimsCLAIM FOR REIMBURSEMENT OF BENEFIT PAYMENTS AND CLAIMS EXPENSE UNDER THE WAR HAZARDS COMPENSATION ACTThe U.S. Department of Labor has introduced a new process to speed up decisions on claims made under the War Hazards Compensation Act (WHCA). This process allows insurance companies to submit suggested claim decisions, which the Office of Workers' Compensation Programs (OWCP) can approve if they meet all legal requirements. This change aims to make claim reimbursement processing faster and more efficient.With a few exceptions, the DBA incorporates the provisions of the Longshore and Harbor Workers' Compensation Act (LHWCA). The War Hazards Compensation Act (WHCA) applies to DBA employees who are injured as a result of hostile actions. 42 U.S.C. §§ 1701 – 1717. While WHCA claims can be considerably substantial, the statute provides a detailed set of procedures and requirements which, if performed properly, allow the employer or carrier to see 100% reimbursement of such claims including allocated and unallocated expenses from the government. The WHCA provides financial coverage for employees injured or killed due to war-related hazards while working under the Defense Base Act. If an injury or death occurs because of a war risk hazard, private insurance carriers or self-insured employers can seek reimbursement for the benefits they have already paid out, such as: Disability and death benefits Funeral and burial costs Medical expenses Other necessary claim processing costsThe OWCP, through its Division of Federal Employees', Longshore, and Harbor Workers' Compensation (DFELHWC) division, reviews and decides whether a claim qualifies for reimbursement through the guidelines established in the Defense Base Act.The rules for requesting reimbursement under the WHCA are highly detailed and lengthy. Dr. Sharon Malone's book is titled "Grown Woman Talk, Your Guide to Getting Healthy and Staying Healthy." This is a book isn't filled with stats, charts and graphs. It's a book about taking care of oneself and getting support from family, friends and doctors that take the time to recognize you, your symptoms and guide you in the correct direction until you get the answers that you need.Bertha, Dr. Malone's mother, was born in 1914 in rural Alabama. Sadly Bertha died when Dr. Malone, her youngest daughter, was twelve. Out of necessity, Bertha and close relatives had to self diagnose any and all illnesses. There wasn't really any medical services nearby. It was all based on collective knowledge from family members and maybe a midwife who could help out. It was her family, a few things in a medicine cabinet, home remedies, etc that worked when one of her children was sick. "There was so much of an "ancestral collective of knowledge" that Bertha had access to, that we don't have today," reflects Malone.My guest's mother, Bertha lost her mother when she was 14 and Bertha and her sixteen year old sister had three younger siblings to raise. It wasn't an easy childhood, but it didn't stop Bertha for instilling such a wealth knowledge in her own children. I highly recommend you read "Grown Woman Talk," to get the full impact of her mother's life and Dr. Malone's philosophies regarding health.Dr. Malone explains, "medicine is not the answer for everything, but there is also a place and time for it. Don't run to the doctor every time there's a sniffle." "She'd like to see the pendulum come back to the middle," regarding the health field.Bertha was a maid in officers quarters of the near by Military base because she had to work. Plus Bertha took care of the work around the house including the cooking, cleaning, etc.Bertha was confident and calm but there are so many stories that Dr. Malone doesn't know about. In the early 20th century Bertha was very practical and conscientious especially when it came to diet, health and "necessities. Dr. Malone lovingly shares stories of her mother, her work ethic and the moral grounding and how important it was. "I still hear her voice in my head. When I do things I either think of them as either this will make my mother proud or my mother would not be pleased with this particularly behavior."Dr. Malone only had twelve formative years with her mother, but she says "I learned enough about character and what was and wasn't important in life in that short time. Don't ever doubt the the value and importance of mothers and the effect they have on their children. In those few years, I had enough to be really influenced by her about what kind of woman i wanted to be and what kind of mother I wanted to be." Allison Kalsched a women's fitness specialist is one of the Co-Founders of NYMMNJ. She was so excited to share the "significance of the community of women" that came together to not only organize this first ever symposium but the respected presenters and the 250 women that came from near and far to this event.Allison has been working exclusively with women for about ten years on their fitness and health journey. "The story hasn't changed much, remarks Kalsched, since Dr. Malone's mother was born in the early part of the twentieth century, and everything she (Bertha) learned about women's health was through a symposium of women-the benefits of being surrounded by women and how we can help one another." NYMMNJ was put together by a group of women out of the necessity of getting the help they need for their midlife health and wellbeing. Most of these women had come to Allison for training and they've been through all life changes together.Allison concurs that women some times make things too complicated and tend to put our well being on the back burner. As women age we need to work on our bodies differently than when we were younger. Taking the time to see a doctor is important, but "we have to think about the woman's body as much more complicated and much more holistic." Fifty percent of the women who walk in Allison's door complain of frozen shoulder or plantar fasciitis, they are the most common complaints. Allison believes that mainly these issues of inflammation in joints are reactions to changes in our hormones " it's all connected." April L McKenzie started the popular Facebook group Perimenopause — It's for Real (now renamed Not Your Mother's Menopause NJ) when she became increasingly frustrated at her own personal experience with finding help for her perimenopausal symptoms. Since the group's founding in 2021, almost 800 women have shared their knowledge, resources and experiences. This track is from their 1992 release Everafter. Glen heard that version and was reminded of his childhood in Arkansas. This single made it to number 1 on the charts, and the album made it as high as 22 on the Billboard 200.
