Abdullah, an American citizen, was arrested in 2003 under the federal material witness statute, which permits the government to detain individuals with crucial testimony in a criminal case if they might flee. Though never charged with a crime, he was held in high-security detention for 16 days and faced court-ordered restrictions for another 15 months. Believing his detention was unlawful, Abdullah sued then–U.S. Attorney General John Ashcroft, claiming his arrest violated the Fourth Amendment's protection against unreasonable searches and seizures. The Aryan Brotherhood of Texas was more than a white power hate group. They were also a sophisticated crime syndicate into drug trafficking and prostitution. Known for its violent methods against its rivals, it was equally as brutal to those suspected of being snitches. After a series of particularly cold-blooded killings, law enforcement groups teamed up to take down the Aryans' statewide operation. By flipping defendants and cultivating informants, authorities were able to connect the racket and destabilize the group.  “The Takedown: American Aryans” on Max looks at the six-year operation to infiltrate the Neo-Nazi crime syndicate. Though they're alleged to only have approximately 150 full-fledged members, the Aryan Brotherhood has found ways to dominate prison economies and expand their rackets into the outside world. The Brand, as the Aryan Brotherhood is sometimes called, has morphed from a self-described white supremacist prison gang into an all-encompassing criminal syndicate putting profit and power over their ideological stances. “In October 1975, I was shot six times. And while I was on the hospital gurney, doctor told me I was going to die. I heard a very clear voice that spoke to me and said, you're not going to die. You're going to be a chaplain at San Quentin prison.” (Chaplain Earl Smith) Chaplain Earl Smith believes that ministry to the incarcerated is about so much more than rehabilitation. It's about regeneration. Using the power of his own story of transformation from gang member to pastor, Chaplain Smith has maintained a faithful presence and witness for many decades of pastoral service to the incarcerated at San Quentin Rehabilitation Center, and now to professional athletes (including the Golden State Warriors, San Francisco 49ers, and the San Francisco Giants). Today on the show Mark Labberton and Chaplain Earl Smith discuss the moral and spiritual factors of prison chaplaincy and ministry for those on death row; the meaning of freedom and education; how he ministered to the leader of the Aryan Brotherhood; the difference that positive mentoring and coaching makes in young people's lives; and the transformative power of the gospel to go beyond rehabilitation to regeneration. About Earl Smith Born and reared in Stockton, California, the cycle of events in Earl's life came to a head in 1975 when he was shot 6 times while living the life of a minor gangster. Although expected to die, Earl's father's faith, prayers, and love seemed to bring him through. The words of his father have motivated him, since that event, “you are a rebel, but you are God's rebel, and God is going to use you to His glory.” In 1983, at the age of 27, Earl became the youngest person ever hired as a Protestant Chaplain by the California Department of Corrections. He is author of Death Row Chaplain: Unbelievable True Stories from America's Most Notorious Prison. Chaplain Smith currently serves as the Chief Executive Officer for Franklin Home, a Transition Living/Reentry Home for men and is the Team Pastor for the San Francisco 49ers' and the Golden State Warriors. From 1998 to 2006 Chaplain Smith was the Chapel Leader for the San Francisco Giants. Chaplain Smith has ministered to teams playing in NFL Super Bowls, MLB World Series and NBA Championships. In 2000, Chaplain Smith was recognized as the National Correctional Chaplain of the Year. Chaplain Smith has appeared on numerous broadcasts, including HBO, CNN, The 700 Club, Trinity Broadcasting Network and The History Channel. Earl has been featured in Christianity Today, Ebony, Guidepost, Ministry Today, Newsweek, People's Weekly, The African Americans and Time. Show Notes Get your copy of Death Row Chaplain: Unbelievable True Stories from America's Most Notorious Prison How Mark and Chaplain Smith met The value of education “I had to stop my education because of the execution schedule at San Quentin.” How Earl Smith got into prison chaplaincy “In October 1975, I was shot six times. And while I was on the hospital gurney, doctor told me I was going to die. I heard a very clear voice that spoke to me and said, you're not going to die. You're going to be a chaplain at San Quentin prison.” What San Quentin prison is like “We used to call San Quentin the Bastille by the Bay. The thing that really stood out for me was the fact that for 13 of the first 16 months I was there, the prison was locked down. The day I interviewed, two people were killed, so they stopped my interview twice. So I understood where I was. I understood the context of confinement. What I also went in there understanding was. It was not about rehabilitation. It was about regeneration.” “I believe that that's part of chaplaincy is not to allow the confines of the wall to dictate who you are.” A sense of liberty Fear and reality Earl Smith's ministry to the leader of the Aryan Brotherhood How faith shaped a capacity to be free from fear for the sake of love Mass incarceration and the new Jim Crow The drug epidemic and its impact on mass incarceration “How can you help us prepare these guys to come home?” “Whether you're on condemned role, if you have a life without the possibility of parole, or life sentence, or whatever it is, my job is still to share the same gospel message.” “Present your body as a living sacrifice.” Pastoral care in the prison system Calling prisoners by their first names instead of their numbers “When you've done it onto the least of these, you've done it to me, so there's a value in your presence.” Chaplaincy to professional athletes “The states that have the largest prison systems are also the states that send the most professional athletes in the pro sports.” Golden State Warriors and San Francisco 49ers The difference that positive mentoring and coaching makes in young people's lives “Every man wants someone to acknowledge there's something positive in what you're doing.” “They May Know Your Number, But God Knows Your Name” (Clifton Jansky, country western singer) God's way of paying attention to us; “how vested God is in our pursuit of being fully human” (reference to Marilynne Robinson) Performance and identity (reference to Ben Houltberg) Jerry Rice, #80 and “who wore the number before you?” Fellowship of Christian Athletes and Athletes in Action “God is a relational God. … Sports is relational.” When did chaplaincy in sports become a thing? Pat Ritchie's chaplaincy Understanding the value and difference chaplaincy makes Documentary and Film Adaptation: Death Row Chaplain “A story not of rehabilitation but regeneration” “That's really what the story is about. Some of my yesterday, some of my today. And what I believe to be my tomorrow.” Production Credits Conversing is produced and distributed in partnership with Comment Magazine and Fuller Seminary.

The rivalry between the Aryan Brotherhood (AB) and the Black Guerrilla Family (BGF) is one of the most intense and violent conflicts within the U.S. prison system. Originating in the 1960s at San Quentin State Prison, these gangs were formed with starkly different ideologies: the AB centered on white supremacy and racial solidarity, while the BGF was driven by black revolutionary and Marxist ideals. Over the decades, both gangs expanded their influence through violent confrontations, strategic alliances, and a deep-seated commitment to their respective causes. Notable figures like Barry Mills of the AB and George Jackson of the BGF played crucial roles in shaping the groups' aggressive tactics and expansion, often resulting in bloody clashes and targeted assassinations to assert dominance and control over prison economies and territories. This conflict has had a significant impact on the U.S. prison system, leading to heightened security measures, increased violence, and a culture of fear and tension among inmates and staff. Both gangs employ a range of strategies, from leveraging corrupt prison staff to using a network of “cells” to maintain control and power. Their rivalry extends beyond prison walls, influencing street gangs and criminal networks, making them formidable forces both inside and outside of prison. Public Enemy No. 1, also known as PEN1 or PENI, is a white supremacist gang that originated in Orange County, California, in the late 1980s. Initially formed by a group of young skinheads influenced by punk rock culture and neo-Nazi ideologies, the gang evolved into a powerful prison and street gang known for its violent and criminal activities.Key Points:Origins and Formation: PEN1 started as a loose group of white supremacist skinheads involved in petty crime. As members began entering the prison system, the gang became more structured and aligned itself with other white supremacist groups like the Aryan Brotherhood.Growth and Expansion: Throughout the 1990s and 2000s, PEN1 expanded by recruiting both in and out of prison, primarily involving itself in drug trafficking, especially methamphetamine, which became a significant source of income. The gang's violent reputation helped it grow and establish influence beyond California.Organizational Structure: PEN1 operates under a hierarchical structure with leaders known as "shot callers" who make key decisions. Below them are enforcers and recruiters who maintain order and discipline, and foot soldiers who engage in daily criminal activities like drug trafficking and violence.Ideology and Beliefs: The gang espouses a white supremacist ideology, promoting racial purity and superiority. Members are often identified by tattoos featuring neo-Nazi symbols. However, the gang's primary motivation is profit, and its criminal activities often extend beyond ideological bounds.Criminal Activities: PEN1 is heavily involved in drug trafficking, extortion, robbery, and violent crimes, both inside and outside of prison. The gang's violent tactics help maintain control and deter challenges from rivals, contributing to its fearsome reputation.Law Enforcement Response: PEN1 has been the target of numerous law enforcement operations aimed at disrupting its activities and dismantling its leadership. Despite these efforts, the gang remains resilient due to its decentralized structure and ability to adapt.Impact on Society and Prisons: PEN1's criminal activities contribute to societal issues such as drug addiction, violence, and instability, particularly in the communities and prisons where it operates. The gang's presence fosters a culture of fear and violence that affects both inmates and the general public.Current Status and Outlook: PEN1 continues to be a significant threat in both prisons and on the streets. The Texas Syndicate (TS) is a powerful and influential prison gang that originated in California's Folsom Prison in the early 1970s. It was formed by Hispanic inmates from Texas to protect themselves against other established prison gangs, such as the Aryan Brotherhood and the Black Guerrilla Family. Unlike other gangs that formed along ethnic lines, the Texas Syndicate was built on regional loyalty, particularly among Texan inmates, which gave it a unique identity. The Texas Syndicate operates with a strict hierarchical structure, including roles like president, vice president, generals, lieutenants, and soldiers. The gang follows a rigid code of conduct that demands absolute loyalty, secrecy, and participation in all gang activities, including drug trafficking, extortion, and murder. Betrayal or disobedience is met with severe consequences, often fatal. The gang quickly expanded its influence from California to Texas, where it found a stronghold in the state's prison system and beyond. The Texas Syndicate is heavily involved in various criminal enterprises, such as drug trafficking, often working closely with major Mexican drug cartels, and extortion, both within and outside prison walls. The Syndicate has had violent rivalries with other prison gangs like the Mexican Mafia and the Texas Mexican Mafia, while also forming strategic alliances, such as with the Aryan Brotherhood, when it benefits them. Despite numerous law enforcement crackdowns and internal power struggles, the Texas Syndicate has demonstrated remarkable resilience and adaptability, allowing it to maintain its influence and operations.Culturally, the Texas Syndicate reflects the broader issues of marginalization and identity within the Hispanic community, especially in the context of the American prison system. Today, it remains a significant force in the criminal underworld, showing an ability to adapt to new challenges and continue its operations both inside prisons and on the streets.(commercial at 9:44)to contact me:bobbycapucci@protonmail.com

The Aryan Brotherhood (AB), also known as the Brand, is a white supremacist prison gang and organized crime syndicate in the United States. It was founded in the California state prison system in 1964, primarily at San Quentin State Prison, as a response to the perceived need for white inmates to band together in the face of increasing racial tensions within the prison system. Over the decades, the Aryan Brotherhood has grown into one of the most feared and powerful prison gangs in the country. The Aryan Brotherhood was formed in the mid-1960s by white inmates who sought protection from other racial groups, particularly African American and Hispanic gangs. Initially, the group adopted a strong white supremacist ideology, drawing inspiration from Nazi symbolism and imagery. Members typically display tattoos featuring swastikas, SS lightning bolts, and other white supremacist symbols, often combined with the initials "AB."The Aryan Brotherhood operates under a hierarchical structure, with a council or "commission" of senior members making key decisions for the gang. At the lower levels, members are organized into smaller units within individual prisons, but all are bound by a strict code of conduct that emphasizes loyalty, secrecy, and a willingness to commit acts of extreme violence. While the AB started as a prison gang, its influence extends beyond prison walls. Members are involved in a wide range of criminal activities, including drug trafficking, extortion, contract killings, and arms trafficking. The gang has also been known to collaborate with other criminal organizations, including the Mexican Mafia (La Eme) and the Hells Angels, despite their racial ideology, when it suits their criminal objectives.Although the Aryan Brotherhood was founded on white supremacist principles, its primary focus is criminal enterprise rather than ideological purity. The gang uses racism as a tool to recruit and motivate members, but in practice, it has shown a willingness to cooperate with non-white gangs when it benefits them financially or strategically. The Aryan Brotherhood has been linked to numerous violent crimes, both inside and outside of prison. These include murders, assaults, and riots. In the 1970s and 1980s, the gang solidified its reputation for brutality, often using murder as a way to enforce discipline and eliminate rivals. High-profile murders attributed to the Aryan Brotherhood include the killing of prison gang leaders from rival groups and the assassination of inmates who cooperated with authorities. One of the most infamous incidents involving the Aryan Brotherhood was the federal indictment of 40 members in 2002, which sought to dismantle the gang's leadership. Rundown -    Intro - 00:25   Kevin Flynn - 05:21   Outro - 01:40:21   Special Craig's Colorado Homefront Show addresses the outbreak of violent fascism in Denver precisely 40 years ago. Alan Berg was gunned down by Bruce Pierce, a felon with an assault weapon who'd come from Idaho to Colorado to assassinate a Jew. Kevin Flynn and Gary Gerhardt, two Rocky Mountain News reporters, wrote a masterpiece on Berg's killers titled "The Silent Brotherhood: Inside America's Racist Underground."   After starting his young life as a stage actor, Kevin Flynn became an award-winning reporter and social commentator. When he got the big job in Denver at the Rocky Mountain News, Kevin became a top Denver reporter for decades, traveling the country to report on Ward Churchill, Tim McVeigh and the many people involved in plotting Berg's death.   An East Coast kid from the Lehigh Valley, Kevin takes pride in his Irish-American and German-American lineage, explaining the good working man's life provided by his father, Joe Flynn and Kevin's mom, who worked at the Easton Express.    We learn about powerful interactions with Michael Landon, who visited Kevin's hospitalized brother, Dennis, in 1964. We reminisce about Little Joe from the Cartwright family who lived on Ponderosa. Bonanza was an influential part of the Flynn, Silverman and baby-boomer upbringing. https://www.youtube.com/watch?v=ZC_fCRacm0M   Guest and host share an Emmy for a PBS12 Time Travel production of Colorado Inside Out, set in 1959. Flynn was immaculate as Al Nakkula, while the host did an award-winning job portraying his father, slick Denver real estate lawyer Sheldon Silverman. https://www.youtube.com/watch?app=desktop&v=swtrM3rGk_k   The subject turns to the terrible night of June 18, 1984, when Alan Berg was gunned down on his driveway at 1445 Adams Street in Denver. The scene still bears bullet damage visible on the area around the townhouse driveway where Berg was ambushed. We talk about Berg. We try to identify his true friends.   Flynn is in touch with Berg's former wife, Judith Berg, who was with him that evening at a Jefferson County restaurant and almost got out of the car on Adams Street before a decision was made to take Judith to a different location. The shooting happened when Alan Berg returned alone.   Flynn pays tribute to fellow author, the late Steven Singular, who wrote Talked to Death, a book about Berg, his background and who his true friends were in Denver and Berg's native Chicago. We learn about what led to his being targeted for assassination by the Jew-hating bigots. https://podcasts.apple.com/us/podcast/the-craig-silverman-show/id1522579679?i=1000541693122   What was the role of Peter Boyles? Was he Berg's friend? The competitive talk show host invited bigoted con man Rick Elliot to the shared studio to promote Elliott's publication of The Protocols of the Elders of Zion. When Berg arrived, he took on the Jew-hating conspiracists on the air. Here's Boyles' version of events. https://www.denverpost.com/2024/06/16/alan-berg-antisemitism-assassination-denver-shooting-neo-nazi-white-supremacist/   We discuss the investigation and the federal RICO prosecution of Berg's murderers in Seattle. Berg's murder was part of proving a predicate act in the Aryan Brotherhood's conspiracy of violence throughout America, and especially in the Northwest. We discuss why the host's boss, Denver DA Norm Early, declined to prosecute in Denver.   Robert Mathews was the ringleader of the fascists who came to Colorado to kill Berg. A charismatic leader, Mathews was incinerated as the feds closed in on his house on 12.8.84 in Whidbey Island, WA. Flynn interviewed Matthews' family and they explained Robert's early attraction to Goldwater, John Beirtherism and hating on “Commies and Jews.”   Flynn wrote The Silent Brotherhood with his great friend, the late Gary Gerhardt. Now, their book is being made into a major motion picture called The Order. Jude Law and Nicholas Hoult are the two lead actors with podcasting comedian Marc Maron playing the role of the late Alan Berg. https://www.denverpost.com/2023/03/02/jude-law-nicholas-hoult-the-order-silent-brotherhood-kevin-flynn-book-movie/   We contemplate the fate of Berg and his former wife if both got out of the vehicle that horrible night 40 years ago on Adams Street. Alan died alone, but the lessons regarding the dangers of fascist hate will not die until they rob all of us of our voices. There are lessons in this special episode dedicated to the memory of the late Alan Berg.

Today, on Crime & Entertainment, we have Steve Nigg. Steve has had a storied past, to say the least. Starting off at juvenile prisons, then graduating to prisons like Arizona State in Florence, AZ. From that point, he was contacted by the Aryan Brotherhood and started prospecting. He would go to 3 different prisons before being released and then began the straight life. For over a decade, Steve lived a clean life, making good money and running a family business. However, after his father passed away, a series of unfortunate events sent Steve back to prison for another 15 years. This time, Steve came with an attitude, and guys like Jared Fogle felt his wrath. 20 others would also feel that wrath until Steve was released last year. Now, Steve is on a mission to not only live a better life but to help raise awareness on situations involving predators and try to keep children out of harms way.  So, join us as this wild ride unfolds with the man himself, I call him a Hero, Steve Nigg.Steve's charitable organization is called Steve's Warrior Children.Links to Crime & Entertainment Like us on Facebook -  https://www.facebook.com/crimeandentertainmentFollow us on - https://www.instagram.com/crimenentertainment/Listen on Spotify - https://open.spotify.com/show/4T67Bs5... Listen on Apple Music - https://podcasts.apple.com/us/podcast... Listen on Stitcher - https://www.stitcher.com/show/crime-e... Listen on Google Podcast - https://podcasts.google.com/feed/aHR0... Listen on Amazon Music - https://music.amazon.com/podcasts/9cd...

In a revealing episode of "Hidden Killers With Tony Brueski," psychotherapist and author Shavaun Scott provides critical insights into the tragic case of 11-year-old Audrii Cunningham. The conversation focuses on the deeply flawed decision-making by Audrii's grandparents and father, who allowed a dangerous individual with ties to the Aryan Brotherhood onto their property under the guise of Christian charity. Key points from their discussion include: Misguided Actions: Audrii's family attempted to deflect blame for their catastrophic decision by pushing for legislative changes, overlooking their direct responsibility in the tragedy. Distorted Rationalization: The grandparents' rationalization for their actions, including minimizing the severity of sex offender registry offenses and advocating for "Audrii's Law," demonstrates a failure to grasp the gravity of their error. Inexplicable Presentation: The family's media interviews, characterized by bizarre staging and matching t-shirts, suggest an attempt to sway public perception rather than express genuine grief. Avoidance of Responsibility: The grandmother's insistence that they did everything right, despite the obvious risk posed by their guest, highlights a disturbing lack of accountability. Absence of Common Sense: The family's lack of judgment, from initially welcoming the individual to their current media crusade, underscores a profound absence of common sense and understanding of the real dangers their decision posed to Audrii. #JusticeForAudriiCunningham #MisplacedFaith #LegislativeChange #PsychotherapyInsights #FamilyAccountability #RationalizingDanger #ProtectingChildren Want to listen to ALL of our podcasts AD-FREE? A violent war for control of illicit drugs and weapons leaves a deadly trail of bullets and blood across highways in the U.S. Southwest. It started eight years ago in a hail of gunfire between the Bandidos outlaw motorcycle gang and the Cossacks at the Twin Peaks Restaurant in Waco, Texas. The violence escalated starting in May of 2023 leaving dead bodies on an interstate highway in Texas, at a biker bar in Oklahoma City, and at a once peaceful bike rally in New Mexico. There's no sign of tempers and the rivalry cooling off anytime soon. The Bandidos stand to lose a lot and they are fighting to hold on to their turf. They are not Hollywood's romanticized version of the Sons of Anarchy. The Justice Department considers the Bandidos one of the eight most dangerous motorcycle gangs in the U.S. A gang threat assessment by the Texas Department of Public Safety ranked the Bandidos as a "Tier 2" gang — or the second-most dangerous classification — alongside the Aryan Brotherhood of Texas. It appears that local law enforcement is not prepared to intervene and in some quarters may even fear the Bandidos. According to the Bandidos legend, a 36-year-old Vietnam War veteran and Houston dockworker started the club in the 1960s.  It adopted the red and gold colors of the U.S. Marine Corps.
