Drawing from the work of a Jewish lawyer who witnessed the dual state operate in Nazi Germany in the 1930s, Huq explains that authoritarians can seize the levers of the law to persecute disfavored groups, without disturbing the idea of the rule of law for the great majority of the nation. He was a friend of this show always willing to do an interview and a major figure in the world of climate action.Once he was on the phone from Dhaka and in the 3CR studio with me was a Dutch expert on flood control.Dr Huq was so enchanted that he invited the Dutchman to a conference in Bangla Desh there and then.Later he showed a deep compassion inspired by his Muslim reverence for life, when talking of the Rohyngia refugees stumbling at that time in from Myanmar. He said we will find a place for them . Each of those children has a future.I think he was on the same page as Pope Francis and was not afraid to call out the climate criminals who  continue to export and expand the use of coal oil and gas.  He saw their callous disregard for humanity. At the COP meetings he networked among the climate vulnerable nations to get an agreement on loss and damage. He said this was not foreign or adaptation aid. It was a payment from the world to compensate the losses they were suffering daily.He was proud of the adaptation measures taken by Bangla Desh. They used to lose thousands in cyclones or floods but now they have shelters on high ground where people can go with their livestock. Students are assigned to elderly or disabled people to assist them to the shelters and volunteers with loud hailers alert everyone. He said after the recent European floods that we could all learn from Bangla Desh to read the signs and take protective action. And that 2023 will bring much more extreme weather, as El Niño turbo-charges climate change?Or that the world is making surprising progress on loss and damage compensation to the highly vulnerable countries bearing the brunt of climate impacts? Or that positive tipping points offer reasons for hope?These are some of the takeaways from  Covering Climate Now press briefing, “The Climate Story in 2023.” Three leading climate experts addressed journalists from around the world:Below are highlights from the event. McKibben  reports that The nonprofit "Rewiring America" has calculated that, “in essence, the IRA creates an $8,000 bank account for every American household” to buy things like heat pumps, window retrofits, and electric vehicles.McKibben also shared that climate activists this year plan to increase pressure on banks financing fossil fuel companies, starting with a day of protests on March 21. Online talk, 19 March 2023 - Action Network In Brazil, local deforestation and global warming are “driving the Amazon to a … self-perpetuating drying cycle,” said Rocha. “Almost 70% of the Amazon is … eating itself. It's effectively dying much more than growing.”  Dr Marcia Rocha added that “The good news is that effective policy” could reverse this trend before the world's biggest rainforest reaches an irreversible tipping point. Deforestation fell by 70% from the early 2000's until 2016, she noted, before surging under then-president Jair Bolsonaro. The newly elected president, Luiz Inácio Lula da Silva, vows to halt deforestation. That is a tall order but central to global climate survival, making it a story that journalists everywhere should follow. Rocha also urged journalists to cover new thinking on “positive tipping points” — developments that drive self-reinforcing progress towards rapid decarbonization. For example, in Norway public policies have made electric cars cheaper than gas ones, leading more consumers to purchase them; now, over half of the country's new car sales are electric. Pointing to the devastating floods in California, Dr Saleemul Huq said that climate loss and damage is “a global phenomenon … happening every day somewhere in the world,” Journalists, wherever they live, should “watch your weather channels and connect it to climate change.” Huq also responded to climate scientist James Hansen's new forecast that average global temperature in 2024 will hit (at least temporarily) the 1.5-degrees-Celsius limit stipulated in the Paris Agreement. Nevertheless, it remains essential to limit the overshoot of 1.5 degrees C, said Huq, which means that countries “must stop using fossil fuels as quickly as possible.” A bright spot: The $9 billion that international donors pledged on Monday to help Pakistan recover from last summer's epic floods “is a very significant amount of support” that bodes well for future climate compensation to vulnerable countries, said Huq, who helped negotiate the loss and damage agreement at COP27. Negotiations over loss and damage continue, and Huq advised that journalists wishing to cover them should “follow the UNFCCC Glasgow dialogue on loss and damage” taking place in Bonn, Germany, from June 7 to 11, to prepare for COP28 next November.

Abdul Ghani and his extended family fled to the roof of a nearby girls' school in August when the floodwaters came to his town in southern Pakistan's Sindh province. His family was still there two weeks later, without tents or any other shelter, when waves whipped up in the floodwaters destroyed their house.“Our hearts sank,” Ghani said from the sun-scorched school roof, where the one remaining room of his home is still visible and surrounded by water. “The house that was our shelter, our children's home, was destroyed.”Ghani, a mason, built the nine-room home in a small farming town in the Dadu district himself. Credit: Carolyn Beeler/The World Unprecedented rains in Pakistan that began in mid-June led to flooding that impacted 33 million people and killed more than 1,700 others, causing an estimated $30 million in damages and economic losses.Some two months after the rains stopped, 7,000 square miles of land in Sindh are still submerged under water.Five million of the 8 million people displaced by the floods are still unable to return home.Paying for damagesThe question of who should pay for damages like these wrought by climate-fueled disasters has been one of the most contentious issues at the UN climate summit this month in Sharm el-Sheikh, Egypt, with Pakistan's floods a focal point of discussions.“We are paying the price for other people's carbon usage,” said Sherry Rehman, Pakistan's climate minister, who is at the summit. In recent months, she's often cited the statistic that Pakistan has contributed far less than 1% of the world's greenhouse gas emissions, even though it's among those bearing the brunt of the consequences.Pakistan is leading a negotiating bloc of 134 developing countries in calling for a dedicated pot of money to be established for “loss and damage” funding.“Countries on the frontline of the climate crisis are facing accelerated catastrophes, and are not getting the relief and rehabilitation funding they need,” Rehman said.For decades, developed countries have resisted calls for direct climate aid, partially out of fear of exposing themselves to claims of financial or legal liability, not to mention the complexities of defining which damages should be included.In the floods in Pakistan, for example, it's difficult to tease out how much climate change contributed to the estimated $30 million in damages and economic losses. An attribution study published by an international group of scientists in September found that rainfall in Sindh and neighboring Balochistan is 50% more intense now than it would have been without climate change.But the researchers say that other factors also drove the damages, including development on flood plains, inadequate infrastructure, an outdated river management system, high poverty rates and a lack of adequate early warning systems.Early momentum at COP27For the first time, this year, countries have started to volunteer funds specifically for losses and damages. Several European countries, along with New Zealand, announced tens of millions of dollars in aid in the first week of the summit. Also for the first time, negotiators at the climate summit have a mandate to discuss an official mechanism for loss and damage funding through the UN, “with a view to adopting a conclusive decision no later than 2024.It's not yet clear what shape any funding will take.Developed countries want to discuss options for funding at COP27 and decide on a solution by 2024. Developing countries want to agree to a loss and damage fund this year, and hammer out the operational details until 2024, when it would then go into effect.US climate envoy John Kerry said “not a lot of people want to sign off on something that is not yet fully defined.”“The well-known fact is that the United States and many other countries will not establish some sort of legal structure that is tied to compensation or liability,” Kerry added.The European Union's head of delegation, Jake Werksman, said last week that the negotiations aim to start a broad conversation, not focus on a single solution like a fund for losses and damages. The US and EU also favor funding to flow through existing programs and institutions, such as the International Monetary Fund or the Green Climate Fund.Insurance and disaster protectionThe G-7, meanwhile, spearheaded by Germany with a $173 million commitment, launched a “Global Shield” program on Monday, based on insurance and disaster protection for vulnerable countries.But developing countries insist that a loss and damage fund — not just insurance or loans, which would trap them in further debt — is essential, and must be agreed to this year.Proponents of such a fund argue that post-disaster aid, which currently seeks to address events like Pakistan's floods, comes at the whim of donors.So far, a UN appeal for Pakistan has brought in only a third of its goal, and that itself is only a fraction of the $16 billion the government estimates it will take to rebuild.“International aid is given for charity. Rich people feel bad that this event is happening in poor countries, and they give money,” said Saleemul Huq, a Bangladeshi scientist who's attended every UN climate summit and is a longtime adviser to the Least Developed Countries coalition.“Loss and damage is not that,” Huq added. “It is polluters taking responsibility for having caused the problem, recognizing that there are victims of the problem who they have the responsibility to help.”Meanwhile, aid that does follow disasters can be slow to arrive, exacerbating health and economic problems.Water-born illnesses spiked in Pakistan with the floods. Officials fear widespread increases of malnutrition — which impacted nearly 1 in 2 Pakistani children even before the floods — and upticks in child marriage rates.Back at the girls' school where Abdul Ghani now lives with five of his brothers and their families, it's hard to keep the kids out of the floodwaters.“We try to stop them, but they won't listen,” Heer Mallah, Ghani's wife, said while cooking stewed spinach and potatoes in the hallway of the school. He and his 3-year-old sister have malaria, with fevers that broke after more than a week.“We dream that our kids will get educated and become doctors. Credit: Carolyn Beeler/The World  Ghani's niece, 12-year-old Fatima Mallah, now sleeps in a classroom a few doors down from where she used to be in second grade. She likes playing with her cousins there, including gleeful games of tag in the school's courtyard, but she misses school.   “She cries and says, 'bring back my books,' but we can't, because we don't have money,” said her mother, Shaahzadi Mallah, sitting on a traditional wood and woven rope bed in the courtyard. “We can't even eat three meals, how can we buy books?”The family is down to two meals a day. The cow whose milk they used to sell is tied up in the school's courtyard, under a line of drying laundry. The cow's grazing land is flooded, so she's not producing enough milk for the family to sell.Most of the places where Abdul Ghani used to work as a mason are flooded, too. He recently bought nets to start fishing the floodwaters.Farmers are perhaps even worse off, as flooding ruined their rice crop for the year and, in many places, will prevent them from sowing wheat this month.In affected areas, pumps powered by tractor engines are working to “de-water” towns, which often means moving water to agriculture fields or other less populated areas. The bill, known as the CHIPS Act, is an extension to the previous year’s legislation passed by the Senate which approved a $250 billion bill to reinforce US chipmaking to compete with the growing clout of China. With the global chip shortage receding and the production getting back to pre-pandemic levels, the US government pushed the bill through with the intention of improving the manufacturing capabilities of the country in the semiconductor industry. With China running its foundries at full-scale even during the height of the pandemic, the state has managed to slowly increase its market share in the global semiconductor manufacturing ecosystem. A recent Bloomberg report showcases how the last four quarters have been dominated by Chinese semiconductor firms and their operations. This has raised alarms among the Western states regarding the reduction in influence and market share in the semiconductor domain. But how much can the CHIPS act achieve the goals and objectives that the US government intends to? Will there be any unintended consequences and unfavourable effects that might arise from the act itself?Subsidies to increase manufacturing output? The CHIPS bill seeks to facilitate the semiconductor manufacturing ecosystem in the country through increased subsidies and financial incentives for the domestic players. Considering the multifaceted benefits of improved chip manufacturing capacity, the US government looks to provide subsidies worth $52 billion to domestic semiconductor companies through the CHIPS bill.One of the main reasons behind the advancement of the CHIPS bill is to reduce manufacturing dependencies on Asian semiconductor manufacturers and increase domestic manufacturing output. Another objective of the bill is to ensure self-sufficiency in the supply of semiconductor chips in case of another global chip shortage. But can subsidies translate into an increase in manufacturing? Historically, it's noticed that in technology sectors, pumping in money and favourable industrial policies cannot always translate into necessary outcomes. This is especially true for the semiconductor industry. A case in point is China itself. The Chinese government has provided a plethora of incentives, subsidies and even financed companies with the hope of improving their semiconductor manufacturing output. However, even its major firm, Semiconductor Manufacturing International Company (SMIC) took over two decades to make a mark in the industry. Currently, it still lags behind industry giants such as Intel and Taiwan Semiconductor Manufacturing Company (TSMC). Though the CHIPS bill has the potential to positively impact semiconductor manufacturing in the country, the government should not imagine that this would completely insulate the US from supply chain dependencies. This might cover the domestic demand to an extent but international dependency will still remain. TSMC itself is building a new fab in Arizona looking to branch out from Taiwan. Manufacturing equipment still remains an issue with the need to import certain equipment from abroad. Also, there is the caveat of the bill stating how semiconductor firms would not be allowed to have any Chinese investments in their company if they benefit from the subsidies provided by the bill. Restrictions over the import and export of semiconductor products to China is also included when availing the benefits of the new legislation. The CHIPS bill will help spur semiconductor manufacturing in the country and cater to its domestic demand to an extent. But, expecting the bill to help the US attain self-sufficiency in the supply chain remains a futile expectation. Fab vs Fabless Another aspect of this legislation is the division of benefits and subsidies. The current CHIPS bill benefits the firms that have the capability to design and manufacture their own semiconductor products. This includes Intel which has the fabrication potential. The bill provides subsidies to build fabrication facilities and provides investment tax credit to purchase tools for use inside their factories.However, the entire industry is not happy with this. Fabless firms such as NVIDIA, AMD and Qualcomm have expressed disappointment at the legislation. Fabless firms are those semiconductor companies that design their products but outsource their manufacturing to Asian counterparts. The new bill does not have any direct benefits for fabless firms as they do not build foundries or buy equipment. Such firms have argued this would help just Intel and is more of a rent-seeking opportunity for Intel to dominate the market. Unfair competition between the fab and fabless firms can result in the government choosing winners (in this case, Intel) is what the other companies are saying. These fabless firms actually support an earlier version of the FABS Act (introduced earlier in the House of Representatives) which provides tax credit on both manufacturing and chip design activities giving benefits to both the type of semiconductor firms. This version of the bill was also supported by the Semiconductor Industry Association (SIA). Though not officially opposing the bill, fabless semiconductor firms have questioned the impact of huge sums of money supporting their competitors.Finally, the fact that the US has the most number of semiconductor fabrication facilities in the world can also hamper the distribution of the subsidies. Will the financial incentives be proportional to the market share of the company or will it support smaller manufacturers also? These are questions that the bill might have to address before finally getting President Joe Biden’s final signature.Antariksh Matters: Space Dreams and Ground Realities— Aditya RamanathanThe Indian government may look to space tourism to sustain its human spaceflight programme. In a response to a Rajya Sabha question, the minister of state for science and technology said India was developing a homegrown capability to support space tourism. According to the minister, this capability would be developed via the Gaganyaan human spaceflight programme.Singh’s comments come even as the government has acknowledged delays in the Gaganyaan programme, which was originally planned to be launched in 2022, to mark 75 years of India’s independence. That deadline has now been pushed to 2024. Besides the formidable technical challenges involved in any human spaceflight programme, Gaganyaan was also set back by the pandemic, which forced ISRO to scale back operations. Russia’s war with Ukraine will likely add to the difficulties, since Russia’s space agency, Roscosmos, which trained an initial batch of four Indian Air Force cosmonauts, has been heavily sanctioned by Western states. “Abort Missions”Long before any space tourists (or for that matter, cosmonauts) take off on an Indian launch vehicle, there will come a series of tests. The first of these will be a so-called “abort mission,” slated for September and December of 2022. Having already tested the human-rated HS2000 rocket booster in May, ISRO will now conduct uncrewed tests of the survival systems. According to reporting in The Indian Express:‘For the abort missions, the space agency has developed test vehicles that can send the systems up to a certain height, simulate failure, and then check the escape system. Gaganyaan’s escape system was designed with five “quick-acting” solid fuel motors with a high burn rate propulsion system, and fins to maintain stability. The crew escape system will separate from the crew module by firing explosive nuts.’The next steps would be to integrate a crew module and an onboard “Onboard Launch Vehicle Health Management System” along with other elements. As ISRO chief S. Somanath recently concluded in an interview, the human-ready launch system “is yet to see the final shape”.Creating an LEO EconomyIndia’s ambitious next step for human spaceflight is to launch its own space station. Such a space station is to orbit at altitudes of 300-400 km above sea level and have more than one module. However, Singh’s statement about space tourism is a reminder than human spaceflight missions are expensive and that states - and private companies - need to find ways to recoup their costs. The Gaganyaan project alone has a price tag of INR9,000 crores (about $1.13 billion). Sending Indians into space on a regular basis will cost many times more. Other spacefaring nations, in particular, the United States and China, have recognised these realities and are seeking to create self-sustaining low Earth Orbit (LEO) economies. While the International Space Station (ISS) is slated to be deorbited in January 2031, the US is promoting the creation of an ecosystem of privately built and operated space stations to replace it. The US space agency NASA has already selected and commenced funding of three proposed space stations: those by Nanoracks, Blue Origin, and Northrop Grumman. While it is possible that some of these stations will fail to work or fail to make money, the very process of designing, building, and operating them will help develop both the technologies and the institutional experience required for a vibrant LEO economy. India remains far behind the world’s leading spacefarers in these efforts. Aziz Huq is an expert in constitutional law at the University of Chicago law school. He is the author of the book The Collapse of Constitutional Remedies, available from Oxford University Press. Prof. Huq's book focuses on the fact that constitutional rights are meaningless unless there are remedies for violations of those rights, and that while we ostensibly have the same rights as always, courts have steadily eroded our ability to get anything if the government chooses to violate our rights. Governance is the key element in any climate-altering approaches being proposed, particularly from the point of view of climate vulnerable nations, says Professor Saleemul Huq in an interview with C2GTalk. His greatest concern is that decisions that have repercussions for the most vulnerable will be taken without them having a chance to take part in the discussion, so it is extremely important that climate vulnerable nations have a say when decisions are taken regarding climate-altering approaches, including carbon dioxide removal and solar radiation modification. Professor Saleemul Huq is the director of the International Centre for Climate Change and Development (ICCCAD) and chair of the Climate Vulnerable Forum Expert Advisory Group. Huq is an expert on the links between climate change and sustainable development, particularly from the perspective of developing countries. He leads the annual Gobeshona Global Conference, which brings together scholars, policymakers, researchers, and practitioners from around the world to discuss climate change. Huq was the lead author of the chapter on adaptation and sustainable development in the Third Assessment Report of the Intergovernmental Panel on Climate Change (IPCC), and was the lead author of the chapter on adaptation and mitigation in the Fourth Assessment Report. His current focus is on supporting the engagement of the Least Developed Countries (LDCs) in the United Nations Framework Convention on Climate Change (UNFCCC). Prof. Huq discusses ongoing empirical research about how the Hobby Lobby case has influenced public perceptions not just of those rights, but also of the Court itself. Aziz Z. Huq teaches and conducts research in constitutional law, criminal procedure, and federal courts. A 1996 summa cum laude graduate of the University of North Carolina at Chapel Hill, he received his law degree from Columbia Law School in 2001. At Columbia, he was awarded the John Ordronaux Prize, the Emil Schlesinger Prize, and the Charles Bathgate Beck Prize. Upon graduating, he clerked for Judge Robert D. Sack of the U.S. Court of Appeals for the Second Circuit from 2001 to 2002 and then for Justice Ruth Bader Ginsburg of the Supreme Court of the United States from 2003 to 2004.
