"I'm sympathetic to what they're doing while recognizing there's a better way to do it." Those are the words of Jason Bohrer, president of the North Dakota Lignite Energy Council, and advocacy and lobbying group that represents the state's coal industry. He was speaking on this episode of Plain Talk about the Midwest Carbon Express pipeline proposed by Summit Carbon Solutions. That project has no ties to the coal industry. Rather, it seeks to bring carbon emissions gathered from ethanol plans across the upper midwest to North Dakota where it would be buried underground. Bohrer joined the program to discuss the controversy around the North Dakota Republican Party's resolution branding carbon capture as "fascism." The resolution had appeared to have been passed at the party's state convention earlier this month, but after a recount, it turns out it failed. But Bohrer says Lignite's larger concern is that public backlash against Summit's project may turn into generalized opposition against the concept of carbon capture. "An individual project differs from a technological opportunity," he said. "We're going to take a long term view," he added. Also on this episode, two board members from the North Dakota Association for Justice joined to discuss consternation in North Dakota's legal circles over Lt. Gov. Tammy Miller's gubernatorial campaign saying some ugly things about lawyers. "Politicians and trial lawyers often struggle with the truth," is a quote Miller spokesman Dawson Schefter gave me for an article about their campaign ad attacking their opponent in the Republican primary. "Kelly Armstrong is both, so it's no surprise he lies about his opponent and his opponent's ads." The NDAJ fired back, calling those comments "ill-informed and ignorant." Then Schefter came back again. “It's no surprise lawyers and politicians are sticking up for each other," he told me in response to the NDAJ's statement. "While Kelly Armstrong was raking in cash defending drug dealers, a man who beat his wife unconscious, and a man who attempted to suffocate his daughter — Tammy Miller was growing a company and creating thousands of jobs. Job creator or trial lawyer is an easy choice.” "Frankly, we were offended," attorney Tatum O'Brien said. "She probably has a failing campaign," attorney Tim O'Keefe added by way of explaining why Miller's campaign would launch the attack. Both O'Brien and O'Keefe are board members of the NDAJ, and say that attorneys do important work defending the rights of citizens in court, from the 4th amendment protections against illegal search and seizure to our 7th amendment right to seek a jury trial in matters of civil law. If constructed, the Midwest Carbon Express, a carbon pipeline project pursued by Summit Carbon Solutions, would gather carbon emissions from ethanol plants across the upper midwest and bring it to North Dakota for storage. Controversy around the pipeline, particularly from some landowners and farmers who say their land will be stolen through eminent domain, or that the pipeline itself is dangerous, has made headlines. But two North Dakota lawmakers with deep ties to agriculture in the state are pushing back. Sen. Terry Wanzek and Rep. Mike Brandenburg, both Republican members of the North Dakota legislature, recently wrote a letter to the editor arguing that "the future is here, and it demands that we incorporate innovative solutions like carbon capture and storage to ensure the continued prosperity of our leading industries." Rep. Brandenburg joined this episode of Plain Talk to explain his argument. "It's time we start talking about the positive things with this pipeline," he said. Brandenburg says 100 miles of Summit's pipeline run through his legislative district, where he also farms. He initially didn't like the way Summit approached landowners. He said they hired contractors who bullied landowners. "We had a meeting with them and told them they have a bunch of crooks out here," Brandenburg said. Summit has since fired those contractors and fixed the problems, he continued. Meanwhile, he argued, new economic realities are setting in. Canada, a major importer of American ethanol, has implemented new emissions standards, and without carbon capture, American farmers and ethanol producers will be at a disadvantage. "A year ago this time, corn was $2 higher," he said, attributing to fall to competition from farmers in places like Brazil which he says are ahead of the curb on capturing carbon. Brandenburg also said that North Dakota farmers are being misled by people such as Darryl Lies, the president of the North Dakota Farm Bureau who uses his Bismarck-based talk radio show to inveigh against carbon capture and Summit's pipeline. The low should be around 64. A restaurant that been a Coralville institution for nearly 46 years will be closing this fall. The owner of Iowa River Power Restaurant, at 501 First Ave., said she received an eviction notice from the owner of the building. The restaurant's last day of service will be Nov. 26 — the Sunday after Thanksgiving. Danise Petsel and her husband, David, bought the restaurant in 2002, which had opened in October 1977 in what had once been a power plant along the Iowa River dating to the early 1900s. In the first test of a proposal to build a carbon dioxide capture pipeline connecting ethanol plants across five states, North Dakota regulators Friday unanimously denied granting a siting permit to Iowa-based Summit Carbon Solutions. The North Dakota Public Service Commission was the first state board to consider the request, which was planned to cross 320 miles in that state. Summit proposed the underground pipeline to capture CO2 from more than 30 ethanol plants in Iowa, Minnesota, Nebraska, North Dakota and South Dakota, and to store it deep underground in North Dakota. In a statement, Summit said it would revisit their proposal and reapply for their permit. Evidentiary hearings on its proposal to build 687 miles of the route in Iowa, crossing 29 counties, are set to start Aug. 22 in Fort Dodge and last several days. Summit has indicated it wants a decision by the Iowa Utilities Board on its hazardous pipeline permit by the end of the year. –

A 31-mile length of pipe would connect the Absolute Energy ethanol plant near St. Ansgar to Summit's proposed pipeline network that is to span over 2,000 miles in five states.The project would carry captured carbon dioxide away from ethanol plants for underground sequestration in North Dakota.Federal officials have said such projects are crucial to meet goals for limiting greenhouse gas emissions, but opponents of Summit's pipeline worry about public safety and landowners' rights. Summit is likely to seek eminent domain to obtain easements for about 1,000 parcels of land in Iowa.Iowa schools win Carrie Chapman Catt Award for registering students to voteThe Gazette's Grace King reports Isaac Newton Christian Academy in Cedar Rapids is one of 19 schools awarded the Carrie Chapman Catt Award this year for registering at least 90 percent of their eligible students to vote. This is the fourth year the private school has earned the award.Across the state, more than 2,600 eligible high school students registered to vote this year in conjunction with the award initiative. The non-binding planning document proposes the Iowa Department of Transportation spend $4.2 billion in state and federal funding on highway and bridge projects over the next five years.Iowa DOT commissioners proposed to delay several projects as the cost for constructing roads and bridges has risen significantly over the past year while funding has largely remained the same. Then it will eventually clear and settle in with a high near 39 degrees. On Wednesday night it will be partly cloudy, with a high near 26 degrees.In two days the weather is predicted to jump 30 degrees to a high in the 70s. So, yes, any snow that falls Wednesday will be melting.One of the oldest universities west of the Mississippi and the second-oldest in the state — Iowa Wesleyan University — is closing 181 years after opening in 1842.After spending the last six months scrounging for funds to continue operating, and coming up short, the 20-member board of trustees for the private liberal arts institution on Tuesday voted unanimously to close at the end of this academic year in May due to “a combination of financial challenges.”Those challenges include increased operating costs “due to inflationary pressures”; enrollment trends; a “significant drop” in philanthropic giving; and Gov. Kim Reynolds' denial "of a proposal for federal COVID funding.“During a news conference Tuesday, Iowa Wesleyan President Christine Plunkett said her campus asked Reynolds for $12 million in federal American Rescue Plan Act — or ARPA — funds to help it transition to a sustainable enrollment level of 1,000 students.In a statement Tuesday about the denial of funding, Reynolds said that the request for funding came in late, and it is her administration's policy not to use federal funding for a potential ongoing expense.When the university closes May 31, the United States Department of Agriculture will take ownership of the 60-acre physical campus due to an unpaid loan by Iowa Wesleyan.A bill that would have required more voluntary landowner participation before eminent domain could be used to build a carbon capture pipeline will not be advanced ahead of an Iowa legislative deadline this week, a key state lawmaker said Tuesday.The bill — House File 565 — would require 90 percent of impacted landowners to voluntarily allow a pipeline to be constructed on their land before the pipeline company could use eminent domain to force agreements with other impacted landowners. It will not advance in the Iowa Senate, said Iowa Sen. Michael Bousselot, a Republican from Ankeny to whom the legislation was assigned in the Senate.Bousselot said Tuesday he has not scheduled a subcommittee hearing on the bill — the first step in the legislative process — because there is not sufficient time to get the bill passed out of the Senate's committee on commerce before Friday's funnel deadline.The most likely result is that the proposed eminent domain requirements will not pass the Iowa Legislature in 2023.Three pipeline companies are seeking permits to build carbon dioxide pipelines in the state: Navigator CO2 Ventures, Summit Carbon Solutions and Wolf Carbon Solutions.Navigator and Summit, the largest projects, are seeking eminent domain authority from the Iowa Utilities Board. Wolf is proposing a smaller pipeline, covering just four Eastern Iowa counties, and has said it will not seek eminent domain authority.

Summit Carbon Solutions intends to build the world's largest carbon capture and storage pipeline across the Midwestern US, despite fierce and sustained citizen opposition. While media coverage so far has focused on the opposition white landowners in the path of the proposed route have to the pipelines – this project represents the latest instance of environmental racism as Indigenous, Black, Brown and Migrant communities will face some of the greatest risks if this project goes through. On Tuesday night there will be a 50 percent chance of rain before midnight, with a low of around 35 degrees.Two months after a mother of three was stabbed to death — and after social justice advocates repeatedly called for charges — a Cedar Rapids man was arrested Monday and faces charges of voluntary manslaughter and disorderly conduct in her death.Shane Teslik, 37, was taken into custody in a different county in Iowa in connection with the Jan. 2 killing of Devonna Walker, 29. He will be transferred to Linn County in the coming days, a news release from the Linn County Attorney's Office states.A coalition of activist groups has been protesting regularly since the stabbing. On Feb. 16, the group put out a news release that named Teslik as Walker's killer.If convicted, Teslik could face up to 10 years in prison for the voluntary manslaughter charge.An 18-year-old admitted Monday to stabbing his parents with a knife and then picking up an ax to kill his mother when he realized she hadn't died from the stab injuries Oct. 14, 2021.Ethan Alexander Orton, who was set to go to trial Tuesday, made a surprising last minute plea to both first-degree murder charges. The hearing Monday had been previously set because the medical examiner was going to testify via Zoom and not in person and Orton had to give his consent on the record.But when 6th Judicial District Judge Ian Thornhill started the hearing he said he understood Orton was pleading to the charges.Thornhill, during the hearing, told Orton more than once that jurors were set to come in for jury selection Tuesday, if he wanted to have a jury trial, but Orton said he understood and continued with the guilty plea.One of the proposals to restrict eminent domain powers of utilities --- including proposed carbon dioxide capture pipelines — failed Monday in its first legislative hurdle in the Iowa Senate, facing opposition both from pipelines developers and landowners.The bill was unanimously voted down by a three-member Senate subcommittee. In voting down the bill, Sen. Jason Schultz, a Republican from Schleswig, cast doubt on the likelihood of any bill restricting eminent domain powers for pipelines making it out of the Iowa Legislature this session, despite some movement on this front in the Iowa House..“I don't believe there's a legislative answer to this,” he said in the subcommittee hearing on the bill.Summit Carbon Solutions, Navigator CO2 Ventures and Wolf have all requested a permit to build carbon capture pipelines in the state that would sequester carbon dioxide from ethanol plants underground in other states, taking advantage of federal tax credits and low-carbon fuel markets. Summit and Navigator have indicated an intent to use eminent domain if granted by the utilities board.

He did not give an explanation from the dais of his vote.Former Superintendent Noreen Bush, 51, died Sunday. She was diagnosed with cancer more than two years ago. Friends and colleagues said Bush was a “rock star,” “leader among leaders” and a “model for doing what's right for kids.”Bush went on family medical leave in September. The school board approved her resignation letter last month, effective June 30, setting in motion a superintendent search process.Former president Donald Trump is coming to Iowa next month to campaign for the Republicans on the ballot, and, presumably, himself.Trump plans to hold a campaign rally at Sioux City's Gateway Airport on Thursday, Nov. 3 — just five days before Election Day, the Trump campaign announced Wednesday.Trump plans to deliver remarks in support of his effort to advance his agenda and to energize voters to support Republican candidates Trump has endorsed, including Grassley and Iowa Gov. Kim Reynolds, the Trump campaign said.Trump's last visit to Iowa was just more than a year ago: he endorsed Grassley — to a mixed reaction from the crowd gathered at the Iowa State Fairgrounds — during a rally last October.This time, Trump will be speaking in the hometown of Mike Franken, the Democratic opponent who is running closer to Grassley than any of Grassley's previous six re-election opponents, according to polling and fundraising. A recent Mediacom/Des Moines Register Iowa Poll said Franken was within 3 percentage points of Grassley, who won his previous six re-election bids by an average of 35 points.Navigator Heartland Greenway this week became the second developer of a carbon dioxide sequestration pipeline to ask Iowa regulars to allow it to use eminent domain to force landowners to sell it easements for the underground hazardous pipeline route.In a filing Tuesday with the three-member Iowa Utilities Board, Navigator asked for a permit to build its C02 pipeline from Northwest to Southeast Iowa for 811 miles.Early this year, another CO2 pipeline developer — Summit Carbon Solutions — also asked regulators to allow it to use eminent domain to build its pipeline through 30 Iowa counties in Northern and Western Iowa, according to its permit application.Developers of CO2 pipelines stand to get billions of dollars in tax subsidies.Iowa law gives the Iowa Utilities Board authority to allow eminent domain for things like electric transmission lines and underground pipelines. To be granted this power, municipal governments or private companies must show their projects serve a public use. If the power of eminent domain is granted, a county compensation commission determines fair market value for the properties.

Carbon capture and storage is a big deal for North Dakota. Not just because our state's economy is dominated by commodity-based industries - energy and agriculture - that emit a lot of carbon, but because the geology under our feet lends itself to storing captured carbon. There are billions in investments lined across several projects to not only capture and store carbon emitted in our state, but to bring carbon from other parts of the world here for storage as well. One of the first major projects is the Midwest Carbon Express pipeline, proposed by Iowa-based Summit Carbon Solutions, which would bring carbon emitted by ethanol plants across the upper midwest to our state for storage. Only, some landowners say the company hasn't been doing a good job at winning them over. On this episode of Plain Talk, Daryl Lies, the president of the North Dakota Farm Bureau, said some landowners had Summit Carbon representatives poking around on their land without permission. Kurt Swenson, himself a landowner who is in the process of negotiating with Summit, says the deals the company wants, and which North Dakota law allows, takes too much from landowners and doesn't compensate nearly high enough. These are important things, both men argue, because the future of the emerging carbon capture and storage industry in North Dakota hinges on how these first deals play out.
