Attorney Todd Marquardt talks about estate tax law on this edition of Talk Law Radio The hidden legal issue blind spot this week is the death tax, which is called the estate tax. This is a tax on the transfer of assets upon death. Most estates do not pay an estate tax because most estates are valued at less than the basic exclusion amount. This is known as the estate tax exemption. You may not know, however, that the large exemption amount is scheduled by law to be reduced at the end of 2025. The presidential candidates also have plans for changing the exemption amount. Next year, 2025, is setting up to be a pivotal year when it comes to how our nation raises the money needed to pay for public services — things like health, housing, the nation's safety net, and more.The reason for this dates back to 2017. That year, Congress enacted the Tax Cuts and Jobs Act, better known as the Trump tax cuts. This tax package contained massive changes to our tax system that mostly amounted to huge tax cuts for the rich and corporations. For procedural reasons, as well as to mask the true costs of these massive tax cuts, Congress made some parts of the Tax Cuts and Jobs Act temporary. It gave them an expiration date. And that expiration date is 2025.The expiration of parts of the Trump Tax plan offers an opportunity to reassess our nation's tax policy, explains Samantha Jacoby, Deputy Director of Federal Tax Policy at the Center on Budget and Policy Priorities.

Back in 2017, with reconciliation, Republicans used some pretty sneaky tricks to get around the 'Byrd Rule' that mandated the "Tax Cuts And Jobs Act" not add to the defecit within a 10 year window. Republicans purposely closed loopholes to meet the Byrd Rule limitations to get the legislation passed then re-opened loopholes 3 years later- "like it never happened".. If Democrats would only work this hard and fight to get the minimum wage increased to $15 -despite the Senate Parliamentarion's ruling- we'd do a lot to help Americans who are struggling right now.. #minimumwage
